MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 657-01 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A REZONING OF 2625 COUNTY HIGHWAY 10, FROM R-3, MEDIDM DENSITY RESIDENTIAL, TO B-2, LIMITED BUSINESS; PLANNING CASE NO. ZC01-002 WHEREAS, Dr. Kevin Barcus and Dr. Bruce Schnabel (the "Applicants") representing the Mounds View Animal Hospital, have applied to rezone City-owned property located at 2625 County Highway 10 (the "Property") from R-3, Medium Density Residential, to B-2, Limited Business; and, WHEREAS, the Applicants have secured permission from the Property owner-the City of Mounds View-to submit a rezoning application on the Property, which is legally described as follows: Lot 78, Spring Lake Park Hillview, Subject to Highway COllnty of Ramsey, State qlMinnesota WHEREAS, the Planning Commission has reviewed the following documents regarding this proposal: 1. Planning Application 2. Zoning Map 3. Location Map 4. Old Comprehensive Plan Map (1979) 5. Future Land Use Map (Proposed, 2001) 6, Staff Report WHEREAS, the Planning Commission held a public hearing regarding this request on Wednesday, June 6, 2001; and, WHEREAS, according to Section 1125,0 of the Mounds View Zoning Code, the Planning Commission is to consider the possible adverse effects of the proposed rezoning and shall make a finding of fact related to its review of the request; and, WHEREAS, according to Minnesota Statutes, Section 462.356, the Planning Commission is to review any proposed sale ofland for compliance with the Comprehensive Plan, NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission makes the following findings regarding the possible adverse effects of this rezoning as required by the Mounds View Zoning Code and whether the proposed sale complies with the Comprehensive Plan, as required by Minnesota Statutes: I , According to the Comprehensive Plan, the Property proposed to be rezoned is designated High DensIty Residential. The Comprehensive Plan, however, is out of date and is undergoing a . . . Resolution 657-01 Page 2 substantial revision, which will result in a new Comprehensive Plan being adopted by the City Council. The proposal would be consistent with the Comprehensive Plan if the Plan were revised to designate this property Community Commercial. 2. The Property is Jocated at the corner of County Highway 10, Eastwood Road and County Road I, a busy intersection with restricted vehicle movements to and from Eastwood Road. High-density residential borders the Property to the northwest, single-family dwellings to the north and commercial to the west and south. A rezoning to Limited Business would not be inappropriate given the higher volunles of traffic and the existing uses_ ., -'- The proposed rezoning wouJd have little impact on the neighborhood, as the area is dominated by higher density residential and higher density commercial uses in an area that experiences higher volumes of vehicular traffic. The primary access to the property would be from Highway 10_ Thus, a depreciation of the neighborhood would not be expected. 4. The Mounds View Anima] Hospital has been serving this community for the Jast 13 years. In order to meet the growing needs of their clients, they need to expand into their own freestanding building. This rezoning would allow the animal hospital to relocate and expand, thus satisfying the needs of the business as well as the greater community. 5_ The proposed sale of the land would not be inconsistent with the Comprehensive PJan in that the property was purchased with the sole intent of redevelopment. There are no identified public purposes for this property in the Comprehensive Plan which wouJd warrant its retention. NOW, THEREFORE, BE IT FURTHER RESOLVED, based upon the above findings of fact, the information and documents regarding the rezoning proposal, the report drafted by staff and the testimony of the applicant, and in consideration of the public testimony given at the public hearing, the Planning Commission does hereby recommend to the City Council: (a) approval of the rezoning request as shown on the attached Exhibit A, (b) approval of the sale of the Property to the Mounds View Animal Hospital, and (c) revision of the proposed Future Land Use Map to reflect a Community Commercial land use designation. BE IT FINALLY RESOLVED that the Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. " Adopted this 6th day of June, 200 I. a~.
