MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 660-01 CITY OF MOUNDS VIEW COUNTY OF RAMSEY ST ATE OF MINNESOTA RESOLUTION DENYING A VARIANCE FROM THE MINIMUM SETBACK REQUIREMENT FOR ACCESSORY STRUCTURES TO ALLOW A ZERO-FOOT SETBACK FOR A STORAGE SHED ON THE PROPERTY LOCATED AT 5532 ST. STEPHEN STREET; MOUNDS VIEW PLANNING CASE VROI-005 \VHEREAS, The applicant, Arlen Baumhoefner, has applied for a Variance to allow a zero-foot setback to construct a storage shed on the property located at 5532 St. Stephen Street; and, \VHEREAS, 5532 St. Stephen Street, a through lot, is zoned R-l, Single Family Residential, and is legally described as follows: Lot 10, Block 4. Daile)' 's HillvieH' Additioll Ramsey COllllt)', J..-fil/I/esota WHEREAS, the Mounds View Planning Commission has reviewed the following documents regarding this proposal: 1. Planning Application 2. Zoning Map 3. Location Map 4. Site pJan 5. Staff Rcport WHEREAS, the purpose of the Variance provision in the Zoning Code is to give relief to property owners when the strict enforcement of the zoning code requirements imposes a hardship thereby restricting the improvement of property due to practical difficulties brought about by unique or extraordinary features of the physical property that are beyond the property owner's control; and, \VHEREAS, a public hearing was held Wednesday, June 20, 2001, with regard to this Variance request; and, \VHEREAS, according to Section 1125.02, Subdivision 2 of the Mounds View Municipal Code, the Planning Commission is to review a standard set of criteria, of which all must be satisfied, in order to grant a Variance to the Zoning Code. .. . . . .,.... Resolution 660-01 June 20, 2001 Page 2 NO\V, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission hereby makes the following findings of fact related to this requcst: 1. 5532 St. Stephcn Strect is a through lot in the R-I Single-Family Residential Zoning District. 2. The Variance requested would allow a zero-foot setback [or a storage shed. 3. The I itcral i ntcrpretation ofthe code would not prcvcnt the property owner from constructing the storagc shed in the rear yard. 4. Therc arc no special conditions that cxist on the propcrty that would prevent the propcrty owncr from complying with thc provisions establishcd in the Zoning Code. 5. This request is not unique in the sense that thc setback requirement for accessory structures applics to all residentially zoned property within the City of Mounds View. 6. Granting a Variancc in this case would confer a special privilege not enjoyed by other property owners. 8. Granting a Variance in this situation would be detrimental to the purpose of the Title by allowing an accessory structure to locate within a requircd setback whi Ic there is ample space to construct the accessory structure in a location that meets thc setback rcquirements cstablished in the Municipal Code. NO\V, THEREFORE, BE IT FURTHER RESOLVED, thc Mounds View Planning Commission, bascd upon its rcview of the documcntation, tcstimony presented at the public hearing, and the identified findings of fact, does hercby deny thc Variancc request for a zero-foot setback to construct a storage shed in the rear yard of thc property located at 5532 St. Stcphen Street.
