COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF A MINOR SUBDIVISION
OF 7841 SPRING LAKE ROAD, REQUESTED BY BRIAN DIEHL, MOUNDS VIEW
PLANNING CASE NO. M101-002
WHEREAS, Brian Dichl has requested approval ora minor subdivision of784l Spring
Lake Road, zoned R-l, Single Family Residential, and legally-described as follows:

C oun(l'. Minnesota Zl'ing easl o.f the 1-vest 8 feel thereof and sOlltherzv of the follOl.ving
described line: Commencing at the nortlnvest comer of said Lot 25; thence south 00
degrees./9 minutes 41 seconds East, assumed bearing. along the west line of said Lot
25 a distance of 16.41 feet to the point o.f beginning o.f the line to described: Ihence
North 87 degrees 04 minutes 20 seconds East a distance (~f 460.64 feet to the east line
of said Lot 25 and there terminating.
WHEREAS, the applicant has submitted a Certificate of Survey for the above described
property; and,
WHEREAS, the applicant proposes to split o[fthe rcar 260 feet of the property to create a
30,474 square foot buildable lot fronting unimproved Knollwood Drive and legally described as
shown on attached exhibit "A"; and,
WHEREAS, the applicant proposes to dedicate right-of-way to the City [or thc future
construction of a cul-de-sac as shown on attached exhibit "8"; and,
WHEREAS, the Planning Commission has reviewed thc applicant's request for a minor
subdivision and has determincd that it is in conformance with Chapters 1104, 1201, and 1202 of
the Municipal Code; and

vVHEREAS, the Planning Commission finds that the applicant's request for a minor
subdivision is in conformance with the Comprehensive Plan; and,
V/HEREAS, the Engineering Technician and Public Works Forcman for the City of
Mounds View have reviewed thc proposed minor subdivision and have found it acceptable; and,
WHEREAS, thc proposcd Certificatc ofSurvcy has been forwarded to the City Attomcy
for review; and,
\NHEREAS, the proposcd Certificatc of Survcy has been forwarded to Ramsey County
for revi ew; and,
WHEREAS, in accordance with Section 1204.04, Subd. 4, a park dedication fee in the
amount of 52,346 is applicable with this proposed minor subdivision; and,
t\OW, THEREFORE, BE IT RESOLVED, having found that the proposed subdivision
satisfies City subdivision and zoning requircments and is in conformance with the
Comprehensive Plan, the Mounds Vicw Planning Commission rccommends approval of the
minor subdivision of 7841 Spring Lake Road requested by Brian Diehl, subject to the following:
I, Prior to the City affixing its signaturcs to the Resolution of approval, the applicant
shall submit the required park dedication fee in thc amount of S2,346.
2, The applicant shall be rcsponsible for relocating the restricted access gates on
unimprovcd Knollwood Drive north an appropriate distance to allow sufficient
setback from the proposed drivcway.
3, If the cuI-de-sac is required to be improved as a result of any future subdivision, the
applicant shall be responsible for a proportionate sharc of the construction costs.
4, Thc applicant shall record the City Council resolution of approval, the Certificate of
Survey and the eascmcnt documcnts with Ramsey County within sixty (60) days of
final adoption, and present proof of such recording to thc City of Mounds View.
Failurc to record these documcnts or providc proof of such recordation shall causc
this approval to be null and void.
BE IT FURTHER RESOLVED that the Mounds Vicw Planning Commission directs staff
to forward this rcsolution to thc City Council prior to approval of the minutes.
