RESOLUTIO:\ DENYING A VARIANCE FROl\I THE MAXIl\I(;'/1 SIG:\ HEIGHT
REQ(;IREl\IENT TO INCREASE A PYLO:\ SIGi\ TO SIXTY-FIVE FEET AT DAYS

\VIIEREAS, The applicant, \Villiam B~IL has applied for a Variance to increase the
height or an existing pylon sign for the Days Inn located at 2149 Program Avenue; and,
\VHEREAS, 2149 Program Avenue, is zoned B-3, Highway Business District, and is
legally described as follows:

\VHEREAS, thc Mounds View Planning Commission has reviewed the following
doeumcnts regarding this proposal:

\VHEREAS, the purpose of the Variance provision in the Zoning Code is to give relief to
property o\vners when the strict enforcement of the zoning code requirements imposes a hardship
thereby restricting the improvement of property due to practical difficulties brought about by
unique or extraordinary reatures of the physical property that are beyond the property owner's
control; und,
\VHEREAS, a public hearing was held Wednesday. January 2,2002, with regard to this
Variance request; and,
\VHEREAS, according to Section 1125.02, Subdivision 2 orthe Mounds View
Municipal Code, the Planning Commission is to review a standard set or criteria, of which all
must be satistied. in order to grant a Variance to the Zoning Code.

NO\\'. THEREFORE. BE IT RESOLVED, the Mounds View Planning Commission
hereby makcs the following findings offact related to this rcquest:
1. 2149 Program ^ vcnuc is zoncd B-3, Highway Business District.

The Variance requested would allow thc height of an cxisting pylon sign to be increascd
from 50 fect to 65 feet.
3. The property was granted a variance on August 7, 1991 to increase the height of the sign
from 35 f~:et to 50 fcet.
4. The literal intcrpretation of the codc would not prcvent the property owner from constructing
the storage shcd in the rcar yard.
5. Therc arc no spccial conditions that exist on the propcrty that would prevent the property
owncr from complying \vith the provisions cstablished in the Zoning Code or with the
previously approved variance.
6. This request is not uniquc in the sense that the maximum height requiremcnt for signs
applies to all properties within a B-3 zoning district.
NO\\'. THEREFORE. BE IT FURTHER RESOLVED. the Mounds View Planning
Commission. based upon its revicw of the documentation, testimony presented at the public
hearing, and the idcntificd lindings of fact, does hcreby deny the rcquest for a sign height
\ariance to increase the height of an cxisting pylon sign [rom 50 feet to 65 feet for the Days Inn
located at 2149 Program A venuc.
