MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 689-02 CITY OF MOUNDS VIEW COlJNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A VARIANCE FROM THE MINIMUM PARKING REQUIREMENT FOR A PROPOSED HOUSING FACILITY LOCATED AT THE SOUTHEAST CORNER OF MOUNDS VIEW DRIVE AND COUNTY ROAD I; PLANNING CASE NO. VR02-001 WHEREAS, The applicant, Mike Bjerkesett of the National Handicap Housing Institute, has applied for a variance from the minimum parking requirement for multi-family; and, WHEREAS, The applicant is proposing to construct a 20-unit residential housing facility for mobility-impaired adults; and, WHEREAS, The City Code requires 1.5 parking spaces per unit plus 1 garage space per unit; and, WHEREAS, The applicant is proposing 30 parking spaces, none of which are garage spaces; and, WHEREAS, the property is zoned R-4, High Density Residential, and is legally described as follows: ii.act A, RegisleredLwuJ Survey No -11-1, Files ojRegislrar (!f /'illes, Ramse:v ('Ollllfy Slale (?lkfilll7esola \VHEREAS, the Mounds View Planning Commission has reviewed the following documents regarding this proposal: Resolution 689-02 April 17,2002 Page 2 . Planning Application ') Zoning Map J Letter from Applicant 4 Site Plan Packet 5 Staff Report WHEREAS, the purpose of the variance provision in the Zoning Code is to give relief to property owners when the strict enforcement of the zoning code requirements imposes a hardship thereby restricting the improvement of property due to practical difficulties brought about by unique or cxtraordinary features of the physical property that are beyond the property owner's control; and, WHEREAS, a public hearing was held Wednesday, April 3, 2002, with regard to this variance requcst; and, \VHEREAS, according to Section 1125.02, Subdivision 2 of the Mounds Vicw Municipal Codc, the Planning Commission is to review a standard set of criteria, of which all must be . satisfied, in order to grant a variance to the Zoning Code. NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission hereby makes the following findings of fact related to this request: 1. The property is irregularly shaped and is fronted on all but one property line by public right -of- ways. 2. The facility would house physically handicapped, mobility-impaired adults who require different amenities than one would find in a typical multi-family housing facility. 3. The applicant is proposing more handicap parking stalls than is required in the Minnesota State Building Code. 4. The literal interpretation of the provisions ofthc Zoning Codc would deprive the applicant of rights commonly cnjoycd by othcr property owners in the R.-4, High Density Residcntial zoning district in that varianccs to the requiremcnts are often justified when practical ditl-iculties present a hardship as they do in this situation. 5. The applicant is not responsible for the conditions or circumstances that necessitate the approval of the variance. . 6. Granting the variance would not confer upon the property owner a special privilege denied to others in the same district due to the unique nature of the existing conditions present on the site as well as the type of facility proposcd. r . . . Resolution 690-02 April 17, 2002 Page 3 7. The variance would not be materially detrimental to the purpose of this Title or to other property in the same zone. 8. The variance would not impair a supply oflight or increase congestion, nor would it increase the danger of fire or endanger the public safety or diminish property values. NOW, THEREFORE, BE IT FURTHER RESOLVED, the Mounds View Planning Commission, based upon its review of the documentation, testimony presented at the public hearing, and the identified findings of fact, does hereby approve the variance request from the minimum parking requirement to allow 30 parking spaces and no garages for the property located at the southeast corner of County Road I and Mounds View Drive, contingent upon the following: I. The applicant shall arrange to have recorded with Ramsey County this resolution of approval and provide proof of such recordation to the City within 60 days of the date of approval, or this variance shall be rendered null and void. 2. The variance shall expire at such time as the facility is no longer used as handicap housing. 3. The site plan shall be revised to show an additional ten (10) parking spaces marked "proof of parking", which could be constructed in the future if so needed. 4. The parking situation shall be reviewed by the Planning Commission after one year of operation to determine whether the additional ten (10) parking spaces are needed.
