The Applicant withdrew his request in response. MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 697-02 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION RECOMMENDING APPROVAL OF A DEVELOPMENT REVIEW, MINOR SUBDIVISION AND REZONING FOR A SIX UNIT TOWNHOUSE DEVELOPMENT LOCATED ON SILVER LAKE ROAD (PLANNING CASE NO. DE02-004, MJ02-003 AND ZC02-002) WHEREAS, the Applicant, Mike Juaire ofPMJ Group, Inc. has applied for (1) a development review, (2) minor subdivision and (3) rezoning to construct a six (6) unit housing facility fronting Silver Lake Road on property legally describcd as follows: Subject to Silver Lake Road, the South 115 feet of the North 233feet of Lot 56, Auditor's Subdivision No, 89. Ramsey County, Minnesota, lying East of the West 216.6 feet thereof WHEREAS, the south 100 feet of the above described property is zoned R-2, Single and Two-Family Residential, and the north 15 feet of the above described property is zoned R-3, Medium Density Residential, and; WHEREAS, the Applicant has requested that the part of the subject property currently zoned R-2, Single and Two Family Residential, be rezoned to R-3, Mcdium Density Residential; and, WHEREAS, the Applicant wishes to move the existing lot line 15 feet to the north to create a larger lot upon which to construct a six-unit, multi-family, townhome styled development; and, WHEREAS, according to Section 1006.06 of the Mounds View Municipal Code, any new construction or expansion of existing facilities requires the approval of a development review; and, WHEREAS, according to the Zoning Code, medium density housing is an allowed use in R-3 zoning districts; and, WHEREAS, the memo provided by the Applicant indicates that the proposed dwelling units would be approximately 1,750 each; and, WHEREAS, the number of parking stalls provided, four (4) per unit, is more than the minimum allowed, three (3) per unit, in the Zoning Code for this typc of facility. WHEREAS, the proposed development satisfies all applicable dimensional requirements of the Zoning Code; and, . . . Resolution 697-02 May I, 2002 Page 2 WHEREAS, the Planning Commission has reviewed the following documents regarding this proposal: 1. Application 2. Zoning Map 3. Location Map 4. Memo from Applicant 5. Site Plan 6. Certificate of Survey 7. Ploor Plan 8. Elevation Drawings 9. Resolution 697-02 10. Staff Report NOW THEREFORE BE IT RESOLVED that the Mounds View Planning Commission does hereby recommend that the City Council approve the development review request for the construction of a six-unit housing facility located on the above-described property fronting Silver Lake Road, subject to the following stipulations: 1. The applicant shall obtain a Right of Way permit from Ramsey County for any and all work to be performed within the Silver Lake Road right of way, including but not limited to the two proposed driveway access points. 2. All utilities to the building and individual units shall be installed underground. 3. The landscape plan shall be revised and resubmitted according to staffs suggestions. 4. The Applicant shall submit a grading plan with contours and elevations noted for review by the Public Works Department. The plan shall show the top of the driveway and parking lot curbing flush with the grade of the surrounding area. 5. The Applicant shall revise and resubmit the site plan and floor plans to reflect the two middle units being offset to eliminate the long, unbroken south wall of the building. In addition, the building elevations shall be revised to show brick facing on the north and west elevations similar to the east elevation. 6. The Applicant shall revise and resubmit the site plan to include additional fencing or landscape screening as may be required by the Planning Commission. 7. This development review approval shall be considered null and void if either of the associated minor subdivision or rezoning requests is not approved. BE IT FURTHER RESOLVED that the Mounds View Planning Commission does hereby recommend that the City Council approve the minor subdivision request ofthe Applicant as shown on the Certificate of Survey dated March 27, 2002, subject to the following stipulations: . . . The applicant shall revise and resubmit the Certificate of Survey to include five-foot perimeter drainage and utility easements along the north and south property line and ten- foot perimeter drainage and utility easements along the east and west property lines and add the following text to the Certificate of Survey: "Separate drainage and utility easement documents dedicating the easement areas as shown on this survey have been filed with Ramsey County. 2. The applicant shall submit the park dedication fee of $4,839 prior to the City stamping the deeds for recordation. 3. The applicant shall arrange to record the City Council resolution of approval with Ramsey County and provide proof of such recordation to the City. 4. The applicant shall record the deeds effectuating the subdivision with Ramsey County no later than two months after the City Council approval. The Applicant may seek a one- time two-month extension of this deadline if requested in writing prior to the original two-month expiration. BE IT FURTHER RESOLVED that the Mounds View Planning Commission does hereby (1) recommend that the City Council approve by ordinance the requested rezoning of the portion of the subject property currently zoned R-2, Single and Two-Family Residential, to R-3, Medium Density residential and (2) direct staff to revise the City's Comprehensive Plan Future Land Use Map to reflect the higher density residential use. BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs Staff to forward this Resolution to the City Council prior to approval of the minutes. Adopted this 1st day of May, 2002.
