MOUNDS VIE'" PLANNING COMMISSION RESOLUTION NO. 706-02 CITY OF MOUNDS VIE\V COUNTY OF RAMSEY STATE OF lVIINNESOTA RESOLUTION RECOMMENDING TO THE CITY COUNCIL DENIAL OF A REZONING OF THE PROPERTY LOCATED AT 2925 COUNTY HIGHWAY 10 FROM R-l, SINGLE FAMILY RESIDENTIAL. TO R-3, MEDIUM DENSITY RESIDE:\'"TIAL AND THE PROPRTY LOCATED AT 2901 COUNTY HIGH\VAY 10 FROM B-3. HIGH\V A Y BUSINESS DISTRICT, TO R-3. MEDIUM DENSITY RESIDENTIAL; PLANNI:\'"G CASE NO. ZC02-004. \VHEREAS, the applicant. John Matthews, has applied to rezone the properties located at 2925 County Highway 10 and 290 I County Highway 10, with property identi fication numbers as follows: 06-30-23-31-0031 06-30-23-31-0173 \VHEREAS, the Planning Commission has revicwcd thc following documents regarding this proposal: 1 . Zoning Map .., future Land Use Map 3. StafT Report \VHEREAS, the Planning Commission held a public meeting rcgarding this rcquest on Wednesday, August 21, 2002; and, WHEREAS, according to Section 1125.01 of the Mounds View Zoning Codc, the Planning Commission is to considcr the possible adverse effects of the proposed rezoning and shall make a finding of fact related to its review of the request; and, NO\V, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission makes the following findings regarding the possible adverse effects of this rezoning as required by the Mounds View Zoning Code: 1, The Current zoning of the lots is R-l, Single Family Residential and B-3, Highway Business. The rcqucsted zoning of the lots is R-3, Medium Density Residential. 2. According to the Comprehcnsive Plan, thc parcels proposcd to bc rezoned arc designated Mixed-Use PUD on the Future Land Use map. 3. The minimum land area required for a PUD is three (3) acres. The subject properties total approximately 2.3 acres. .". .." . . . Resolution 706-02 Page :2 4. The surrounding arca located along Highway 10 bctwecn Groveland Road and Fairchild A venue are also designated as PUD on the Future Land Use Map. Without thc subject properties, the remaining area to the west and the area to the east would not consist of the minimum area required of thrce (3) acres for the PUD designation, thus preventing these areas from bcing rezoned to PUD in the future. NOW, THEREFORE, BE IT FURTHER RESOLVED, based upon the above findings of fact, the information and documents regarding the rezoning proposal, the report drafted by staff and the testimony of the applicant, and in consideration of the public testimony given at the public hearing, the Planning Commission does hereby recommend to the City Council denial of the rezoning request made by John Matthews. BE IT FINALLY RESOLVED that thc Planning Commission directs staff to forward this resolution to thc City Council prior to approval of the minutes.
