STATE OF MINNESOTA
A RESOLUTION RECOMMENDING APPROVAL OF A DEVELOPMENT
REVIEW FOR A PARKING LOT EXPANSION AND A REZONING FROM
PLANNED UNIT DEVELOPMENT (PUD) TO HIGHWAY BUSINESS (B-.3)
FOR THE LOT ADDRESSED 2404 HIGHWAY 10; MOUNDS VIE\V
PLANNING CASES DE02-00S & ZC02-00S
WHEREAS, the applicants, Tony Jacob and Rob Jacob (the "Jacobs"), owners of Jake's
Sports Cafe, have applied for a development review to expand their parking lot onto the adjacent
undeveloped lot addressed 2404 County Highway 10 and have additionally requested a rezoning
of this same lot from PUD to B-3 to match the zoning of the Jakc's property at 2400 County
Highway 10; and
WHEREAS, The undeveloped parcel, formerly associated with the Theater PUD, is
legally described as follows:

WHEREAS, the Mounds View Planning Commission has reviewed the following
documents regarding this proposal:
1. Planning Application
2. Zoning Map
3. Location Map
4. Site Plan (date stamped 8/14/02)
5. Staff Report
\VHEREAS, on July 22,2002 the City Council adopted Resolution 5802 which
approved the removal of the subject parcel [rom the Theater Planned Unit Development
re-establishing the thirty-foot setback to County Road H2; and,
\VHEREAS, as a condition of approving Resolution 5802, the Counci I requircd that the
Jacobs make application for a devclopment rcvicw for the parking expansion in accordance with
Section 1006.06, Subdivision 2 ofthc Mounds Vicw Municipal Code and make application for a
rezoning from PUD to B-3; and,

WHEREAS, before development may procecd, the Planning Commission and City
Council is rcquired to rcview and approve all applications for development; and,
WHEREAS, the City Code indicates that rezoning requests shall bc consistcnt with the
Future Land Use Map of the Comprehensive Plan and that the Planning Commission shall find
that the rezoning would not be detrimental to the neighborhood or adversely affect any adjoining
properties.
NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission
hcreby makes the following findings of fact related to this request:
1. The Future Land Use Map of the Comprehensive Plan designatcs this area as a Mixed
Use Planned Unit Development. The proposed Highway Business zoning district would
not be inconsistent with the vision for this area.
2. The rezoning of the property would not adversely affect any adjacent or nearby properties.
The PUD designation would have allowed an I 1,000 square foot office building in
addition to parking. The current proposal contemplates only parking.
NOW, THEREFORE, BE IT FURTHER RESOLVED, the Mounds View Planning
Commission, based upon its review of the documentation and findings of fact, recommends
approval of the rezoning request from PUD to B-3.
NOW, THEREFORE, BE IT FIN ALL Y RESOLVED, the Mounds Vicw PlaIming
Commission, finding that the submitted site plan satisfies City Code, recommends approval of a
development review subject to the following conditions:
1. The Site Plan shall be revised as follows:
a. One additional handicap accessible space shall be identified with one being
marked "Van Accessible" unless the accessible spaces satisfy Universal Parking
Space Design guidelines.
b. The garbage dumpster constmction details shall be added to the site plan,
c. The crushed landscape rock shall be replaced with wood mulch or chips.
d. The dimension for the curb cut width shall bc indicated and shall not exceed 30
feet.
e. A notation that indicates continuous B-612 perimeter curb around the parking lot
shall be added.
f. A notation shall be added that indicates the existing fence to be relocated or
replaced with a fence to match the existing privacy fenccs in the development.
g. A notation shall be added that the decorative wrought iron fence shall not exceed
4 feet in height.
2. The lighting plan shall be rcvised to show fixture details and pole height from grade.

3. A drainage and utility plan shall be submitted to the Director of Public Works for his
review and approval.
4. If necessary, the Jacobs shall execute an easement document which would allow the City
to install and maintain a public trailway along the southern boundary of the Jacobs'
property.
5. The Jacobs shall enter into a development agreement with the City that sets forth all of
the terms, conditions, requirements, agreements, guarantees and plans for the orderly
development of the property.
