MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 710-02 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT TO ALLOW AN AUTO REPAIR FACILITY TO LOCATE IN A B-3, HIGHWAY BUSINESS DISTRICT, AT 2135 PROGRAM A VENUE; MOUNDS VIEW PLANNING CASE NO. CU02-001 WHEREAS, The applicant, Jason Studer, has applied for a conditional use permit to locate an auto repair facility in a B-3, Highway Business Zoning District, specifically on the property located at 2135 Program Avenue, which is legally described as follows: Programmed Land First Addi lion nLock 2. !,ol 2 Ramsey County. Minnesota WHEREAS, The Mounds View Zoning Code conditionally allows auto repair in B-3 zoning districts; and, WHEREAS, the Planning Commission has reviewed the following documents regarding this proposal: a. Planning Application b. Location Map c. Proposed Site Plan d. Letter from Surrounding Property Owner e. Applicant's Resume f. Staff Report WHEREAS, the Mounds View Planning Commission finds that the proposal satisfies the conditions outlined in Chapter 1125 of the Zoning Code; and, WHEREAS, the Mounds View Planning Commission finds that the request is consistent with the Mounds View Comprehensive Plan in that the Comprehensive Plan designates the subject property as Community Commercial on the Future Land Use Map; and, . . . Resolution 710-02 October 2, 2002 Page 2 WHEREAS, the Mounds View Planning Commission finds that the proposed auto repair facility would not be out of place given the character and geography of the surrounding area; and, WHEREAS, the Mounds View Planning Commission finds that the proposed auto repair facility would not depreciate the neighborhood; and, WHEREAS, the Mounds View Planning Commission granted a variance from the minimum lot area requirement on September 18, 2002; and, NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the conditional use permit with the following stipulations: 1. The applicant shall arrange to record the City Council resolution approving the conditional use permit with Ramsey County and provide proof of such recordation to the City within sixty days of Council approval or this pertuit shall be considered null and void. 2. The entire site, other than that taken up by a building, structure or plantings, shall be surfaced with a material to control dust, drainage and erosion, which is subject to the approval of the Director of Public Works/City Engineer. .., .), The lighting shall be accomplished in such a way as to have no direct source of light visible from adjacent land in residential use or from the public right of way and shall be in compliance with Section 1103.09 of this Title. 4. All signing and informational or visual communication devices shall be minimized and shall be in compliance with the Mounds View Sign Code. 5. Provisions are made to control and reduce noise. 6. No outside storage except as allowed in compliance with subdivision 4 of Section 1114,04 shall exist. 7. No outside sale or service except as allowed in compliance with subdivision 5 of Section 1114.04 shall exist. 8. The auto repair facility shall only operate between the hours of7:00 am and 7:00 pm. The car wash may operate 24 hours per day. 9. All conditions pertaining to a specific site are subject to change when the City Council, upon investigation in relation to a formal request, finds that the general welfare and public betterment can be served as well or better by modifYing the conditions. 10. The parking requirement provided in Section 1121. 13 shall be met. . . .
