RESOLUTION APPROVING A VARIANCE FOR A TOTAL OF 112.5 SQUARE FEET
OF EXTERIOR WALL SIGNAGE AT MOUNDS VIEW SQUARE, 2537 COUNTY
HIGHWAY 10; PLANNING CASE NO. VR2008-001
WHEREAS, the applicant, Aldi, Inc., has applied for a variance from the
maximum wall-mounted signage allotment for their retail space located at Mounds View
Square, 2537 County Highway 10; and,
WHEREAS, Section 1008.09 of the Sign Code indicates that the maximum wall-
mounted signage for an industrial building is 100 square feet per business occupant;
and,
WHEREAS, Aldi, Inc. requests a total of 112.5 square feet of wall signage; and,
WHEREAS, Section 1008.16 of the Sign Code indicates that variance requests
be treated as any other variance request as articulated in Section 1125.02, Subdivision
2 of the Mounds View Zoning Code; and,
WHEREAS, according to Section 1125.02, the Planning Commission is to review
a standard set of criteria, of which all must be satisfied, in order to grant a variance to
the Zoning Code.
NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning
Commission makes the following finding of facts related to this request:
1. The retail end space at 2537 County Highway 10 is in need of additional
exterior wall-mounted signage on the west and south building faces in order
to state what type of store Aldi is.
2. The literal interpretation of the provisions of this Title would deprive the
applicant of rights commonly enjoyed by other properties in that the City has
approved similar variances in the past for reasonable sign variance requests.
3. The special conditions or circumstances necessitating the variance request
do not result from the actions of the applicant.
4. Granting the variance would not confer upon the property owner a special
privilege in that every property owner has the right to apply for a variance to
improve the function and viability of their business. Neither would such
approval confer a special treatment as similar reasonable variances have
been granted in the past.

5. Allowing for an additional 12.5 square feet above the allowed amount on the
west and south sides of the building would be the minimum variance necessary
to provide suitable visibility of the additional "Food Market" wording and
alleviate the hardship.
6. The variance would not be materially detrimental to the purpose of the
Municipal Code or to other property in the commercial zoning districts.
7. The proposed variance will not impair an adequate supply of light and air to
adjacent property or substantially increase the congestion of the public streets
or increase the danger of fire or endanger the public safety or substantially
diminish or impair property values within the neighborhood.
NOW, THEREFORE, BE IT FINALLY RESOLVED that the Mounds View
Planning Commission, based upon the above identified finding of facts, does hereby
approve the variance requested for a total of 112.5 square feet of wall signage on the
west and south sides of the retail space occupied by Aldi Food Market, located at 2537
County Highway 10.

RESOLUTION RECOMMENDING APPROVAL OF AN INTERIM USE PERMIT FOR A
TEMPORARY TENT AT MOE'S RESTAURANT LOCATED AT 2400 COUNTY
HIGHWAY 10; PLANNING CASE NO. IU2008-001
WHEREAS, Jeff Moritko, owner of Moe's, has applied for an interim use permit
for a temporary tent at Moe's restaurant, located at 2400 County Highway 10; and,
WHEREAS, the subject property is zoned B-3, Highway Business, and has a
Comprehensive Plan future Land Use Map designation of Community Commercial; and,
WHEREAS, the Mounds View Zoning Code allows temporary outdoor tents in
commercial districts by interim use permit; and,
WHEREAS, the Mounds View Staff and the Planning Commission have reviewed
the zoning requirements associated with temporary tents in commercial districts, and
finds that all conditions are satisfied by this request.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission makes the following findings of fact related to the conditional use permit
request:
1. The request is consistent with the Mounds View Comprehensive Plan.
2. The request is consistent with the Mounds View Zoning Code.
3. The size of the structure is within permitted allowances and complies with
setback provisions.
4. There have been no complaints filed regarding the use of the tent in the
previous year.
5. The applicant has sufficiently demonstrated that a need exists for the
temporary outdoor tent.
6. The site has adequate parking area available to satisfy the demands of the
temporary tent.

NOW, THEREFORE, BE IT FURTHER RESOLVED that the Mounds View
Planning Commission recommends approval of the interim use permit for an outdoor
temporary tent with conditions as follows:
1. The tent or membrane structure shall comply with all provisions of the Fire
Code and the applicant shall apply for and receive fire permits issued by the Fire
Marshal and receive a satisfactory inspection each time the tent is erected.
2. The temporary tent may be erected on the deck only for a maximum of 180
days in a calendar year.
3. The tent framework and membrane covering shall be maintained in a good
condition. Deficiencies shall be corrected as soon as practicable.
4. The interim use permit can be reviewed at any time by the City if problems
arise which would necessitate revision or termination of the permit.
5. The interim use permit will become null and void if the property owner fails to
comply with the provisions of the permit or if the structure is removed for more
than a one-year period, or if the property undergoes a change of ownership.
BE IT FURTHER RESOLVED, that the Mounds View Planning Commission
recommends that the permit approval shall remain in force indefinitely so long as the
conditions above and those of the Zoning Code remain satisfied.
BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs
staff to forward this resolution to the City Council prior to approval of the minutes.

129 SQUARE FEET, OF EXTERIOR WALL SIGNAGE FOR TOTINO'S AT MOUNDS
VIEW SQUARE,

WHEREAS, the applicant, Totino's Italian Kitchen, represented by Steve Elwell,
has applied for a variance from the maximum wall-mounted signage allotment for their
restaurant space located at Mounds View Square, 2535 County Highway 10; and,
WHEREAS, Section 1008.09 of the Sign Code indicates that the maximum wall-
mounted signage for a commercial building is 100 square feet per business occupant;
and,
WHEREAS, Totino's is requesting an additional 29 square feet of signage above
the allowed amount; and,
WHEREAS, Section 1008.16 of the Sign Code indicates that variance requests
be treated as any other variance request as articulated in Section 1125.02, Subdivision
2 of the Mounds View Zoning Code; and,
WHEREAS, according to Section 1125.02, the Planning Commission is to review
a standard set of criteria, of which all must be satisfied, in order to grant a variance to
the Zoning Code.
NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning
Commission makes the following finding of facts related to this request:
1. The free-standing restaurant space at 2535 County Highway 10 is in need of
additional exterior wall-mounted signage on the south building wall in order to
have signage directly facing County Highway 10.
2. The literal interpretation of the provisions of this Title would deprive the
applicant of rights commonly enjoyed by other properties in that the City has
approved similar variances in the past for reasonable sign variance requests.
3. The special conditions or circumstances necessitating the variance request
do not result from the actions of the applicant.
4. Granting the variance would not confer upon the property owner a special
privilege in that every property owner has the right to apply for a variance to
improve the function and viability of their business. Neither would such
approval confer a special treatment as similar reasonable variances have
been granted in the past.

5. Allowing for a second sign of 40 square feet, on the south wall of the building
would be the minimum variance necessary to provide suitable visibility and
alleviate the hardship.

adjacent property or substantially increase the congestion of the public streets

WHEREAS, the applicant, Matt Eenigenburg, has applied for a variance to allow
a one foot setback to continue for a driveway located at 5414 Jackson Drive; and,

WHEREAS, according to Section 1125.02, Subdivision 6 of the Mounds View
Municipal Code, the Community Development Director is to review a standard set of
criteria, of which all must be satisfied, in order to grant an administrative variance to the

WHEREAS, the property owners adjacent to the subject property were notified of

AT 5352 & 5354 RAYMOND AVENUE;
MOUNDS VIEW PLANNING CASE VR2008-003
WHEREAS, the applicant, Robert Yentsch, representing Kinyon Properties, has
applied for a variance to allow for driveways with a one-foot setback from the property
line of a duplex located at 5352 & 5354 Raymond Avenue; and,
WHEREAS, 5352 & 5354 are zoned R-2, Single and Two Family Residential,
and is legally described as follows:
Norseman 1St Addition, Lot 5, Block 1, Ramsey County, Minnesota
WHEREAS, the Mounds View Planning Commission has reviewed the following
documents regarding this proposal:
1. Planning Application

3. Zoning Map

WHEREAS, the purpose of the variance provision in the Zoning Code is to give
relief to property owriers when the strict enforcement of the zoning code requirements
imposes a hardship thereby restricting the improvement of property due to practical
difficulties brought about by unique or extraordinary features of the physical property
that are beyond the property owner's control; and,
WHEREAS, the Planning Commission held a duly-noticed public hearing
regarding this request on June 18, 2008; and,
WHEREAS, according to Section 1125.02, Subdivision 2 of the Mounds View
Municipal Code, the Planning Commission is to review a standard set of criteria, of
which all must be satisfied, in order to grant a variance to the Zoning Code.
NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission
finds that the criteria as identified in Section 1125.02, Subdivision 2 of the Mounds View
Municipal Code are satisfied and finds there to be sufficient hardship with regard to the
property located at 5352 & 5354 Raymond Avenue, and makes the following findings of
fact related to its decision:

1. Circumstances apply to this property in that the duplex is located on only a 100
foot wide lot with a steep grade drop to the backyard, making it difficult to place a
garage in the rear yard and be able to access it with a driveway.
2. The literal interpretation of the provisions of the Zoning Code would limit the
applicanYs ability to have a two car wide driveway in order to provide enough
parking spaces for the tenants.
3. The applicant did not build this duplex, and intends only to substantially improve
the property.
4. Granting this variance would not confer upon the applicant a special privilege in
that the lot size is a pre-existing condition.
5. The one (1) foot variance is the minimum variance required to alleviate the
applicanYs hardship.
6. Granting a variance to allow for a driveway with a one foot setback would not be
detrimental to the purpose of the Zoning Code in that due to lack of parking
space, some of the tenants are parking closer to the property lines now and
causing no adverse impacts.
7. Granting the variance would not impair an adequate supply of light or air to the
adjoining property.
NOW, THEREFORE, BE IT FINALLY RESOLVED, the Mounds View Planning
Commission, based upon the above findings, approves the variance request of Robert
Yentsch representing Kinyon Properties, to allow for two driveways with a one-foot
setback from the north and south property lines subject to the following condition:
1. The driveways are constructed in such a way as to not cause water run-off onto
neighboring properties.

WHEREAS, the applicants, Tom and Laurie Malaske, have applied for a variance
to allow a six-foot tall fence in the front yard at their property at 2551 Ridge Lane; and,
WHEREAS, 2551 Ridge Lane is zoned R-1, Single Family Residential, and is
legally described as follows:

WHEREAS, Section 1103.08 of the Mounds View Zoning Code indicates that the
maximum height of a fence in a front yard four feet (4'); and,
WHEREAS, the applicants have applied for a variance to allow an existing six
foot (6') fence in the front yard abutting Long Lake Road; and,
WHEREAS, the Mounds View Planning Commission has reviewed the following

WHEREAS, the purpose of the variance provision in the Zoning Code is to give
relief to property owners when the strict enforcement of the zoning code requirements
imposes a hardship thereby restricting the improvement of property due to practical
difficulties brought about by unique or extraordinary features of the physical property
that are beyond the property owner's control; and,
WHEREAS, a public hearing was held on Wednesday, September 7, 2005, with
regard to this variance request; and,
WHEREAS, according to Section 1125.02, Subdivision 2 of the Mounds View
Municipal Code, the Planning Commission is to review a standard set of criteria which
must be satisfied in order to grant a variance to the Zoning Code.

NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning
Commission hereby makes the following findings related to this request:
1. The exceptional or extraordinary conditions relating to the variance
request is that the property is a corner lot on a busy street with a sidewalk
which is elevated about two feet above the subjecYs backyard.
2. The literal interpretation of the provisions of the Zoning Code would
deprive the applicants of rights enjoyed by other properties in the same
zone because the height limitations would preclude having a fence tall
enough to provide security, screening and buffering from Long Lake Road.
3. The applicant cannot control the configuration of the lot intends only to
provide some security and privacy for their backyard with the fence.
4. Granting the variance would not confer upon the property owners a
special privilege denied to others in the same district due to the unique
nature of the existing conditions present on the site.
5. The two-foot variance (six foot tall fence) is the minimum variance that
would alleviate the applicants' hardship.
6. The replacement of the fence would not be materially detrimental to
the purpose of the Zoning Code or to other property in the R-1, Single-
Family Residential zoning district.
7. Allowing the six-foot tall fence in the front yard of 2551 Ridge Lane would
not impair the supply of light or increase congestion, nor would it increase
the danger of fire, endanger the public safety or diminish property values.
NOW, THEREFORE, BE IT FURTHER RESOLVED, the Mounds View Planning
Commission, based upon the above findings, does hereby approve the variance request
for a six-foot tall fence in the front yard of 2551 Ridge Lane, contingent upon the
following:
1. The applicants shall obtain a zoning permit for the fence.

ADJUSTMENTS) BETWEEN 5056 GREENWOOD DRIVE AND THE TWO ADJOINING
LOTS TO THE SOUTH, REQUESTED BY THE ORDAHL FAMILY TRUST;

WHEREAS, property owners Ordahl Family Trust, represented by Steve Ordahl,
has requested approval of a minor subdivision of contiguous lots located at 5056
Greenwood Drive and the two adjoining lots to the south, properties zoned R-1, Single
Family Residential, legally-described as follows:

WHEREAS, the Planning Commission has reviewed the ApplicanYs request for a
minor subdivision and has determined that it is in conformance with Chapters 1104, 1201,
and 1202 of the Municipal Code; and
WHEREAS, the Planning Commission finds that the ApplicanYs request for a minor
subdivision is in conformance with the Comprehensive Plan; and,

WHEREAS, in accordance with Section 1204.04, Subd. 4 of the Municipal Code, a
park dedication fee would be required, based on City Council action.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission recommends approval of the minor subdivision (lot line adjustments) of 5056
Greenwood Drive and the two adjoining lots to the south (PIN #07-30-23-44-0106 and
#07-30-23-44-0116) subject to the following stipulations:
1. The Applicants shall arrange to have current Title Commitments prepared and
submitted for all three parcels prior to the approval of the subdivision by the City
Council.
2. The Applicants shall remove the existing shed from the east vacant lot (PIN 07-
30-23-44-0116) within 60 days from the date of City Council approval.
BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs
staff to forward this resolution to the City Council prior to approval of the minutes.

COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF AN AMENDMENT TO
CHAPTER 1120 OF THE MOUNDS VIEW ZONING CODE TO ADD A SECTION
FOR SENIOR HOUSING
WHEREAS, the City Council has directed that a section be added to the Zoning
Code to address Planned Unit Developments and senior housing; and,
WHEREAS, City staff has prepared a section to be added to Chapter 1120 of the
Mounds View Zoning Code, to read as follows:
g. Senior Housing:
(1) The building must have at least 60 percent of its units designated for
assisted living or memory or Alzheimer's care for the city to consider the project or
building as a planned unit development.
(2) The tract of land for which a planned unit development, senior housing
project is proposed and permit requested shall contain not less than two (2) acres
of land.
(3) The senior housing building shall not have more than three (3) stories
above grade.
(4) The front, side and rear yard building setbacks at the periphery of the
planned unit development site, at a minimum, shall be:
(a) Front = 30 feet
(b) Side = 20 feet
(c) Rear = 30 feet, or 50 feet if abutting residential
(5) The parking recommendations are as follows, unless the City Council
determines more or less parking stalls would serve a better purpose: Parking
spaces required are:
(a) Independent living = 1 space per unit with half of the spaces
enclosed
(b) Assisted living = 0.5 spaces per unit
(c) Nursing homes and memory care = 1 space for every 4 beds
(d) Facility staff = 1 space for every employee on the largest shift

(6) The permanent residents residing in independent living units shall be
limited to persons who are 55 years of age or over except that one other person
may reside in any senior or elderly housing unit including his or her spouse, parent,
foster parent, or legal guardian.
WHEREAS, amending the Zoning Code to incorporate senior housing in Planned
Unit Developments will serve to clarify the zoning requirements; and,
WHEREAS, the Mounds View Planning Commission concurs that an amendment
to the City Code is warranted and justified.
NOW, THEREFORE, BE IT RESOLVED that
Commission recommends approval of an amendment
Mounds View Zoning Code by incorporating paragraph
Residential Planned Unit Development section as defined
the Mounds View Planning
to Chapter 1120.03 of the

associated with this request.
NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning
Commission makes the following findings about the possible adverse effects of this
proposed rezoning request as required by the Mounds View Zoning Code:
1. The current zoning of the lots is R-1, Single Family Residential and R-O,
Residential/Office. The requested zoning of the lots is R-4, High Density
Residential.
2. According to the Comprehensive Plan, the parcels proposed to be included in
the rezoning are designated Mixed-Use PUD on the Future Land Use map.
The proposed rezoning would be consistent with the anticipated future land
use for this area.
3. The rezoning and the proposed development plan for senior housing should
not adversely affect adjacent property owners and would not be out of place
on the County Highway 10 corridor, the City's most intensely developed
thoroughfare.
4. The proposed rezoning to allow for an independent living, assisted living and
memory care senior housing development would help satisfy an under-
represented housing choice in the City.
NOW, THEREFORE, BE IT FURTHER RESOLVED, based upon the above
findings, the information and documents about the proposed rezoning, the report drafted
by staff and the testimony of the applicant, and in consideration of any public testimony,
the Planning Commission does hereby recommend APPROVAL of the rezoning request
made by Select Senior Living.
BE IT FINALLY RESOLVED that the Planning Commission directs staff to
forward this resolution to the City Council prior to approval of the minutes.

WHEREAS, the applicant, Select Senior Living, has applied for the following

family developments to have a minimum lot area per dwelling unit of 2,500 square feet;

WHEREAS, the applicant has submitted a senior housing development proposal
with a lot area per dwelling unit of 1,148 square feet, due to the smaller unit sizes; and,

WHEREAS, Section 1104.02 of the Mounds View Zoning Code requires one
bedroom multiple family units have a minimum floor area of 630 square feet and two
bedroom units to have a minimum of 750 square feet; and,
WHEREAS, the applicant is requesting approval for studio and one bedroom
units that have floor areas of 432 to 716 square feet; and,
WHEREAS, Section 1121.13 of the Mounds View Zoning Code requires multiple
family properties (independent living units) to provide 2'/2 parking spaces per unit and
the assisted living and memory care provide 1 space for every 3 beds plus 1 space for
every staff member on the largest shift; and,
WHEREAS, the Mounds View Zoning Code would require this development to
provide 112 total parking stalls and the applicant is requesting a variance to provide 27
fewer stalls than required by the zoning code - 76 constructed parking stalls and 9 proof
of parking stalls, which the City of Mounds View may require the applicant to construct
at any time the City determines they are necessary; and,
WHEREAS, Section 1104.01 of the Mounds View Zoning Code allows for up to a
two foot encroachment for roof overhangs, and Section 1109.04 states that the side
yard building setback for R-4 zoned senior congregate living is 40 feet, which is double
the normal R-4 minimum side setback requirement; and,
WHEREAS, the applicant has designed a three story residential style senior
housing building with hipped roofs that have a four foot overhang that would encroach
two feet into the building setback on the west and east sides of the north wing, and a
small section of the building footprint that would extend four and six feet into the large
building setback; and,
WHEREAS, the Mounds View Planning Commission has reviewed the following
documents about this proposal:
1. Zoning Map
2. Proposed Site Plans
3. Staff Report
WHEREAS, the purpose of the variance provision in the Zoning Code is to give
relief to property owners when the strict enforcement of the zoning code requirements
imposes a hardship thereby restricting the improvement of property due to practical
difficulties brought about by unique or extraordinary features of the physical property
that are beyond the property owner's control; and,
WHEREAS, a public hearing was held Wednesday, August 20, 2008, about this
variance request; and,
WHEREAS, according to Section 1125.02, Subdivision 2 of the Mounds View
Municipal Code, the Planning Commission is to review a standard set of criteria, all of
which must be satisfied, in order for the city to grant a variance to the Zoning Code.

NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning
Commission hereby makes the following findings of fact related to this request:
1. The property is proposed to be zoned R-4, High Density Residential.
2. The extraordinary circumstances surrounding this property are the unique
lot size and shape and the type of housing. The city code does not clearly
accommodate the proposed housing. The side yard building setback for
senior housing is double what is required of any other multiple family
housing developments.
3. Granting the variances would not confer upon the applicant a special
privilege in that all property owners are able to apply for a variance to
improve the function or appearance of their property. Denying the
requests would limit the applicanYs ability to redevelop the property.
4. The special conditions or circumstances necessitating the variance
request do not result from the actions of the applicant. The city has not
yet addressed in the city code some of the unique characteristics of
assisted living and memory care housing, that made it difficult for the
applicant to avoid needing variances.
5. The applicant believes that permitting the property to have the requested
increased density, reduced unit sizes, reduced parking and encroach into
the building setbacks is the minimum variance, as it allows for a well
designed project with new housing options for Mounds View residents and
fits the architectural characteristics of a residential neighborhood.
6. Granting these variances would not be materially detrimental to the
purpose of the Code since the city is in the process of amending the code
to address most of these issues.
7. The proposed variance would not impair an adequate supply of light and
air to adjacent property or substantially increase the congestion of the
public streets or increase the danger of fire or endanger the public safety
or substantially diminish or impair property values within the
neighborhood.
NOW, THEREFORE, BE IT FINALLY RESOLVED that the Mounds View
Planning Commission, based upon the above identified finding of facts, does hereby
approve the variances requested to increase the site density, reduce the minimum unit
sizes, reduce the total number of parking spaces to 76 constructed and 9 proof of
parking stalls from the required 112 spaces, and allow a two foot roof overhang to
encroach and a four to six foot structure encroachment into the building setbacks for the
proposed 96-unit Select Senior Living development located at 2865 County Highway 10
and 7980 & 8020 Groveland Road.

Condominium, described as follows: That part of Lot 1, Block 1, MERMAID ADDITION,
lying southerly and easterly of a line described as follows: Commencing at the most
easterly corner of said Lot 1, thence North 34 degrees 38 minutes 17 seconds West,
along the northeasterly line of said Lot 1, at a distance of 280.00 feet to the point of
beginning; thence South 55 degrees 24 minutes 00 seconds West a distance of 123.00
feet; thence South 2 degrees 13 minutes 00 seconds East a distance of 345.80 feet to
the southeasterly line of said Lot 1 and there terminating.
WHEREAS, The above-described land is zoned PUD, Planned Unit
Development and is designated as Regional Commercial on the Comprehensive Plan;
and,
WHEREAS, Charlie and Dan Hall have submitted a Preliminary Plat for a major
subdivision which combines the 2 existing lots and creates a new 1.4 acre lot; and,
WHEREAS, the community development staff have reviewed the preliminary plat
and finds that it satisfies the minimum subdivision requirements as articulated in Titles
1100 and 1200 of the Mounds View Municipal Code and complies with county platting
requirements; and,
WHEREAS, in accordance with Section 1204.04, Subd. 4, the subdivision is
subject to a park dedication fee which the amount will be determined by the City
Council; and,
WHEREAS, the proposed subdivision is not within a designated wetland area;
and,
WHEREAS, the Mounds View City Council approved the Mermaid Planned Unit
Development (PUD) Agreement on October 10, 2000; and,

WHEREAS, the Mermaid PUD currently does not allow retail uses; and,
WHEREAS, the property located at 2200 County Highway 10, legally described
as Lot 1, Block 1, Mermaid Addition and Outlot A, Mermaid Addition; was approved by
the City Council for bowling lanes, hotel, banquet center, night club and lounge and
restaurant uses; and,
WHEREAS, the property owners wish to amend the PUD Agreement by adding
"retail" as an allowed use for the site in order to redevelop the proposed 1.4 acre lot into
a retail center; and,
WHEREAS, the Planning Commission has reviewed this request and has
examined the potential adverse effects that could result from such an amendment.
WHEREAS, the Mounds View Planning Commission has reviewed the following
documents regarding these requests
1. Staff Report
2. Preliminary Plat
3. Zoning Map
4. Aerial View
5. Site Plan
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission recommends approval of the Preliminary Plat date stamped August 13,
2008 submitted by Charlie and Dan Hall subject to the following conditions:
1. The applicant shall arrange to have an acceptable Title Commitment provided to
the City Attorney for review prior to the final approval of the subdivision by the City
Council.
2. The applicant shall satisfy any additional requirements made by the City Attorney
in a plat opinion.
3. The applicant shall pay a park dedication fee in an amount to be determined by
the City Council.
4. The applicant shall apply for Final Plat approval no later than 6 months after the
date of approval of the preliminary plat, or the Preliminary Plat approval will
become null and void.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission makes the following finding of fact related to this PUD Amendment
request:
1. The property in question, 2200 County Highway 10, described by the PUD
Agreement as the "Mermaid" is zoned Planned Unit Development (PUD).

2. The Mermaid appears to have excess parking, and as such the owners have
requested an amendment to the PUD to allow for retail to be allowed on the site
in order to redevelop 1.4 acres of the property into a retail center.
3. The Mounds View Comprehensive Plan Future Land Use Map designates this
area as a Regional Commercial Planned Unit Development.
4. The property at 2200 County Highway 10 is within the City's primary commercial
corridor and as such, redevelopment and new businesses are desirable.
5. The property is at the corner of County Highway 10 and County Road H, one of
the main commercial corners in the city. The construction of a new retail center
would have no depreciatory affects upon the surrounding area.
6. Any new development must apply for a development review.
7. There do not appear to be any adverse effects associated with this proposed
amendment.
BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs
staff to forward this resolution to the City Council prior to approval of the minutes.

RESOLUTION RECOMMENDING CITY COUNCIL APPROVAL OF THE UPDATED
COMPREHENSIVE PLAN; PLANNING CASE NO. SP-154-07.
WHEREAS, State Statutes (Minn. Stat. 462.355, Subd. 1a and 473.175-473.871)
require the City of Mounds View to update its Comprehensive Plan and submit it to the
Metropolitan Council for review; and
WHEREAS, State Statutes (Minn. Stat. 462.355, Subd. 1) states that the planning
agency shall prepare the comprehensive plan; and
WHEREAS, Section 401.04 of the Mounds View City Code designates the Planning
Commission as the planning agency as authorized by State Statutes; and
WHEREAS, the Planning Commission has prepared an update to the
comprehensive plan; and
WHEREAS, the Planning Commission held a public hearing on November 19,
2008, with City staff publishing the required notice in the official city newspaper; and
WHEREAS, the Planning Commission held the public hearing to review the
proposed plan update and to take comments from the public about the proposed
Comprehensive Plan; and
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission recommends that the City Council adopt the comprehensive plan dated
November 12, 2008, with noted changes.
BE IT FINALLY RESOLVED that the Planning Commission directs City staff to
forward this resolution to the Mounds View City Council before approval of the minutes.

RESOLUTION ESTABLISHING THE 2009 MEETING SCHEDULE OF THE
MOUNDS VIEW PLANNING AND ZONING COMMISSION
WHEREAS, the Mounds View Planning Commission intends to hold two regular
meetings per month during the year 2009; and,
WHEREAS, the Planning Commission will meet on the first and third Wednesdays of
each month, or as amended; and,
WHEREAS, the schedule of ineeting dates shall be established and posted to
provide an orderly system for use by the Planning Commission, staff and general public.
NOW, THEREFORE, BE IT RESOLVED that Exhibit 1, attached hereto, is the
Planning Commission's official meeting schedule for the year 2009.
BE IT FINALLY RESOLVED that ifthe Planning Commission is required to ordesires
to hold special oremergency meetings, such meetingswill be held in accordancewith State
