Item Title/Subject: Resolution 5553 Approving a Golf Course
Seasonal Position

Background
In January the Golf Course Manager approached the City Administrator, City
Attorney and me and indicated that the individual who had held the seasonal
Apprentice PGA Professional position had filed for unemployment in past years
and would be filing for unemployment again this year. The Golf Course Manager
suggested that the City consider bringing back this individual as a regular full-
time employee in lieu of paying unemployment and due to his past relationship
with the City and the cost savings that would be realized by having this individual
on staff as a regular employee rather than a seasonal employee.
The individual in question was put on payroll as a regular full-time employee with
benefits effective February 12, 2001. Shortly thereafter staff realized that the
decision to put the individual on payroll as a regular employee was premature
and invalid without the approval of the City Council.
In past communications I indicated that at the March 26, 2001 City Council
meeting I would ask the Council to review the classification of the Apprentice
PGA Professional position. This item was on the March 26, 2001
agenda for consideration, however, at the March 26, 2001 HR Committee
meeting direction was given to table this item until the Golf Course feasibility
study had been reviewed by the Council.
Discussion
Over the last week staff has become aware that, based upon information from
the Department of Economic Security, the City had never paid unemployment for
the individual in question until January 2001. Further, it appears that it may not
be fiscally prudent over the long term to make the Apprentice Professional
position a full-time regular position.
I have conferred with the City Manager and City Attorney regarding this issue.
The consensus is that because the original recommendation to the Council to
make the Apprentice Professional position a full-time regular position was based
in part on inaccurate information, it would not be prudent to make this position a
regular position at this time.
RECOMMENDATION
I am asking the Council to continue to classify the Apprentice Professional
position as seasonal until such time as the Council may decide to amend this
classification after review of the feasibility study. Further, I am asking the Council
to stop the accrual of benefits but allow the Apprentice Professional to use the
benefits he has accrued over the last 1 1/2 months. The Apprentice Professional
seasonal position would be compensated at a rate of $11.50 per hour and work
40 hours per week from February 12, 2001 through October 12, 2001.

STATE OF MINNESOTA
RESOLUTION APPROVING A GOLF COURSE SEASONAL POSITION
WHEREAS, seasonal positions must be approved by the City
Council; and
WHEREAS, this position would be filled for the period of
February 12, 2001 through October 12, 2001 and paid an hourly wage of $11.50
per hour for up to 40 hours weekly.
NOW, THEREFORE, BE IT RESOLVED that the City Council does
approve the Apprentice PGA Professional position as a seasonal Golf Course
position.

RESOLUTION APPOINTING PLANNING COMMISSION MEMBERS
WHEREAS, there are currently two open seats on the Planning Commission; and
WHEREAS, the City of Mounds View is dependent upon and appreciative of citizen input
through membership on various boards and commissions, and
WHEREAS, the Commissions consist of members appointed by the Mayor with the
approval of the majority of the City Council.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Council do hereby
approve the following appointments to the Planning Commission:
• Herbert Zwirn (Term: 2001-2003)
• Mari Scotch (Term: 2001-2003)

Item Title/Subject: Discussion and Consideration of Resolution 5541, a
Resolution Approving a Development Review for a
16,912 Square Foot Office Building at 2720 Highway 10
Date of Report: March 29, 2001
Background:
This item was discussed at great length at the Council’s March 26, 2001 meeting. As
the Council will recall, action on Resolution 5541 was tabled to allow for additional
information gathering and scheduling of expert testimony on the behalf of Mr. George
Winiecki, the neighboring property owner to the southeast.
Discussion:
Staff would simply like to summarize some of the main points regarding this request for
the benefit of the Council.
1. The request is consistent with the requirements of the Zoning Code and the Silverview Estates PUD.
2. The applicant has already compromised by moving the building back an additional 20 feet from
the front, increasing the proposed front setback from 30 feet to 50 feet.
3. By increasing the front setback, the applicant will incur additional development costs.
4. By increasing the front setback, the amount of impervious surface area within the 100-foot
wetland buffer increased from 5% to 16%.
5. The MIPH building will impact the sightlines to Mr. Winiecki’s building regardless if the set
back 50 feet or 73 feet.
6. Mr. Winiecki has a sign that will not be impacted by the location of the MIPH building.
While staff appreciates Mr. Winiecki’s concerns, the City should not allow the former TJB
Homes building, which was intentionally built far back from the highway, to dictate the
future setbacks of the adjoining undeveloped parcels.
Recommendation:
Staff and the Planning Commission recommend approval of Resolution 5541, a
resolution approving a development review for Minnesota Institute of Public Health to
allow for a 16,912 square foot office building with a future 6,000 square foot upper-story
addition, consistent with the Silverview Estates PUD and the Zoning Code.

A RESOLUTION RECOMMENDING APPROVAL OF A DEVELOPMENT REVIEW
REQUEST FOR AN OFFICE BUILDING LOCATED AT 2720 HIGHWAY 10;
PLANNING CASE NO. DE01-002.
WHEREAS, Minnesota Institute of Public Health has applied for a development review to
construct a 16,912 square foot office building at 2720 Highway 10; and,
WHEREAS, the subject property is zoned PUD, Planed Unit Development, is designated
as a “Mixed Use PUD” use on the Comprehensive Plan and is legally described as follows:
Lot 2, Block 1, Silverview Estates
Ramsey County, State of Minnesota
WHEREAS, according to Section 1006.06 of the Mounds View Municipal Code, any new
construction or expansion of existing facilities requires the approval of a development review; and,
WHEREAS, according to the adopted Development Agreement pertaining to the
Silverview Estates Planned Unit Development, a maximum 25,000 square feet of commercial
office is a permitted use on this lot; and,
WHEREAS, the Mounds View City Council has reviewed the following documents
regarding this proposal:
1. Planning Application
2. Site Plans, Date-stamped March 22, 2001
3. Zoning Map
4. Architectural Rendering
5. Sightline Scenarios
6. Letter from George Winiecki, dated Feb 19, 2001
7. Letter from Gary Dahle, dated March 21, 2001

9. Silverview Estates site plan, approved Dec 8, 1997

11. Staff Report
WHEREAS, the proposed development satisfies the requirements of Zoning Code as
well as the adopted Planned Unit Development Document agreement approved on December 8,
1997; and,
WHEREAS, the site plans date-stamped 3/22/01 indicate that the proposed office
building will be set back 50 feet from the property line fronting Highway 10, will be 13,912
square feet with a 3,000 square foot first level expansion and a 6,000 square foot second story
expansion; and,
WHEREAS, the number of parking stalls required for full build out (22,912 square feet)
is 92 stalls, of which 70 will be constructed immediately, the remaining 22 marked as proof of
parking to be constructed in conjunction with the second building expansion; and,
WHEREAS, the City Forester has reviewed and approved the Landscape Plan; and,
WHEREAS, the Fire Marshal has reviewed and approved the site plans in terms of
access, drive aisle width and other Fire Department requirements and considerations; and,
WHEREAS, the photometric analysis, date stamped 2/2/01, complies with the City Code
Section 1103.09 pertaining to lighting and glare.
NOW THEREFORE BE IT RESOLVED that the Mounds View City Council, finding
that all of the requirements of the Zoning Code and PUD Document have been met, approves the
development review request for the construction of a 13,912 square foot office building with a
possible first-story expansion of 3,000 square feet and a possible 6,000 square foot second story
expansion at 2720 Highway 10, subject to the following stipulations:
1. Barrier curbing (B 6-12) shall be installed around the perimeter of the parking lot, islands
and access drive.
2. All utilities to the building shall be installed underground.
3. One monument sign shall be allowed not to exceed eight (8) feet in height or one hundred
(100) square feet in area. The base of such sign shall be constructed of masonry or stone
materials to match the building. A pole or pylon type sign is prohibited.
4. All architectural features and building treatments shall be consistent along all elevations
of the building.
5. The site plan shall be revised to show a 30-foot wide access to Highway 10 and to show
detail for the proposed garbage dumpster enclosure. The enclosure shall be solidly
constructed and shall be finished with masonry materials to match the building. The gate
to the enclosure shall have a latching or locking mechanism and shall completely shield
from view the interior contents of the enclosure.
6. The Grading, Drainage and Utility Plan shall be revised to show a swale running between
the building and the southeast property line to ensure that stormwater runoff does not
flow onto the adjoining property.
7. The applicant shall submit to the City a cash payment of $14,125 in lieu of constructing
and installing required trailway and lighting corridor improvements.
8. A development agreement which sets forth all of the terms, conditions, requirements,
guarantees and plans for the orderly development of the land shall be executed and
recorded with Ramsey County as required by Section 1006.06, Subd. 4 of the City Code.
9. The applicant shall execute and record with Ramsey County a utility easement document
which conveys to Five D Limited (the Holiday Stationstore) a non-exclusive right to
maintain and repair if necessary the water and sanitary lines servicing their property. A
copy of this recorded document shall be kept on file with the City.
10. The applicant shall execute and record with Ramsey County a parking easement
agreement in the favor of Realife Cooperative of Mounds View which conveys to Realife
the non-exclusive right to park in the MIPH lot during weekends and specified holidays.
A copy of this recorded document shall be kept on file with the City.
11. The applicant shall obtain a permit from Ramsey County for any and all work to be
performed within the Highway 10 right of way, including but not limited to the proposed
access drive onto Highway 10.
