Item Title/Subject: Discussion Regarding Proposed 2002 Fee Schedule
Date of Report: November 29, 2001
Attached is the proposed Fee Schedule for 2002. Each department has reviewed fees relevant to
the department functions and has made recommendations for changes where necessary. Changes
to the fee schedule are either underlined (additions) or stricken (deletions). If you are using a hard
copy to review the proposed changes you may want to look for the vertical lines in the margin which
indicate changes to the text. If you are reviewing the document from your computer, the changes will
appear in red or blue.
The Council will notice that staff is proposing that fees be added to the schedule for Work Session
and Special meeting agendas and packets. In addition, staff is proposing that a fee faxes be added
to the schedule. These changes are being proposed to recover costs incurred by the City.
Recommendation: Please review the enclosed proposed 2002 Fee Schedule and advise staff of
any changes you would like to see made to the Fee Schedule.

I. BUILDING/COMMUNITY DEVELOPMENT RELATED FEES
A. VALUATION TABLE
The following Valuation Table shall be used to determine fees for those permits indicated below and in
all cases where the work is of such a nature that the permit fees cannot be determined from the
schedule established below for such work. The minimum fee for all permits shall be $23.50 unless
otherwise specified.

Item Title/Subject: Discussion Regarding Declaring the Housing Inspector a
Fire Fighter

As the Council is aware, the individual serving in the Building Official position will perform
fire-fighting duties and is, therefore, eligible to enroll in PERA’s police and fire fund. This
would result in lower contributions by the City to PERA on behalf of this position.
Currently, the Housing/Code Enforcement Inspector is in a similar position, as he has been
serving the City as a fire fighter since beginning employment with the City in December
1999. At this time, staff is proposing that the Council consider declaring that fire fighting is
a primary responsibility of the Housing/Code Enforcement Inspector. Upon approval by
the Council the Housing/Code Enforcement Inspector may be enrolled in PERA’s police
and fire fund.
Recommendation
Give staff direction to bring a resolution before the Council declaring fire fighting as a
primary responsibility of the Housing/Code Enforcement Inspector.

FIRE FIGHTER DECLARATION FOR THE HOUSING/CODE ENFORCEMENT
INSPECTOR
WHEREAS, the policy of the State of Minnesota as declared in Minnesota
Statutes 353.63 is to give special consideration to employees who perform hazardous
work and devote their time and skills to protecting the property and personal safety of
others; and
WHEREAS, Minnesota Statutes Section 353.64 permits governmental
subdivisions to request coverage in the Public Employees Police and Fire plan for a
non-full-time fire fighter provided the fire service position regularly engages the
employee in the hazards of fire fighting.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council
hereby declares that the position titled Housing/Code Enforcement Inspector, is, for
primary services provided, that of a firefighter engaged in the hazards of fire fighting.
NOW, THEREFORE, BE IT FURTHER RESOLVED that this governing body
hereby requests that Jeremiah Anderson, the Housing/Code Enforcement Inspector, be
accepted as a member of the Public Employees Police and Fire Plan effective the date
of this employee’s initial Police and Fire salary deduction by the governmental
subdivision.

Attached is a complete new printing of the 2002 Budget, except for the General
Fund, which was in the November 26th agenda packet. There are no changes
since the last time these budgets were distributed, but this printing is to insure
that everyone has a copy for the work session. The General Fund seems to
have been extensively discussed, but the City Council may wish to have further
discussion of the rest of the budget.
Answers to two budget questions raised earlier are as follows:
For the Northwest Youth & Family Services in the Miscellaneous Department of
the General Fund, it was asked, “How many of the participants are Mounds View
residents?”
While Northwest serves a larger constituency, all of the participants on the
activity report supplied to us gave Mounds View as their home address.
For the Lakeside Park, a computation error for the 1-ton truck on the equipment
rental list was noted. It reads 2.5 hours @ $8.00/hr = $200.00. Spring Lake
Park confirms that this should read 25.0 hours @ $8.00/hr = $200.00.

Background
This item is on the agenda for your consideration as a result of Council Member Stigney’s
request for an investigation of this contract. As the City Council will recall the Assistant to
the City Administrator brought this to the Council’s attention at the October 1, 2001 Work
Session.
To review, the City Council entered into an Agreement for Building Inspection Services in
April 1999. Article IV, Section 4.1 (c) states that:
“Except as otherwise adjusted upward from time to time in accordance with the
Consumer Price Index (CPI), the annual cost to the Municipality for the Service
Fees shall not exceed Thirty-five Thousand Dollars ($35,000) per year (a figure
based on historical numbers of plan review and inspections) unless said activity
increases by a margin of ten (10%) or more in any year, at which time the Fire
Department and Municipality shall in good faith renegotiate the compensation set
forth in this Agreement.”
Article IV, Section 4.1 (d) of the Agreement further stipulates that:
“…the Municipality will pay the Fire Department a fee of Five Thousand Dollars
($5,000) (the “Administrative Fee”) on the date of this Agreement and, thereafter, on
January 1 of each contract year…”
According to the City’s proposed 2002 Budget, the City of Mounds View has expended :
1999 $58,520
2000 $67,063
2001 $16,250 (YTD through September)
$55,000 (budgeted)
I have attached a copy of the Bureau of Labor Statistics, Consumer Price Index for your
reference. That report indicates that the CPI for the years 1999 and 2000 was 2.2 and 3.4
respectively. Given the fact the City entered into this Agreement mid-year 1999, it is
difficult to make many assumptions about the cost for that particular year; however it

appears that the City expended beyond what the Agreement for Services provided in 2001.
During discussions with the Fire Chief he stated that within months after the Agreement
was entered into, activity increased by more than 10% and the compensation terms of the
Agreement were renegotiated by City Staff and the Fire Chief. The renegotiated terms
resulted in the Fire Department billing the City at an hourly rate (currently $30.00 and hour)
for services rendered.
• A review of the City’s files failed to provide any documentation that summarized the
result of these negotiations. Apparently the City simply started receiving bills that
reflected this new arrangement.
• A review of the City’s minutes suggests that these new terms were never brought
back to the City Council for their review and hence, were never approved.
• A review of the City’s files failed to provide documentation that could be reviewed
regarding the “increased activity level.”
At the November 13, 2001 City Council Meeting, the City Council approved Resolution
5646 Creating a Full-time Building Official/Fire Marshall/Fire Fighter Position, effective
January 1, 2002.
Requested Council Consideration: The aforementioned summary raises some specific
questions:
1. Does the City Council wish to have staff continue to review this issue?
2. What were the “historical numbers of plan review and inspections” referenced in the
Agreement? And
3. How do these compare to subsequent years’ experience?
4. Should staff review the billing documents?
5. Was the City over billed?
6. What do we do with our findings?
Recommendation:
Staff recommends the City Council review the information contained in this report and
direct accordingly.
