5. Planning Cases
A. VR2008-002 Consideration of a Variance to allow for additional Wall
Signage at Totino’s at Mounds View Square, 2535 County Highway 10
Planning Associate Heller reported the applicant, Totino’s Restaurant, represented by Mark Elwell,
has requested a variance to allow for an increased amount of wall signage on their building located at
Mounds View Square, 2535 County Highway 10. She explained Totino’s is a new business in
Mounds View and under city code they are allowed 100 square feet of signage on the building. The
proposed signage for above the door is 89 square feet. The applicant is requesting an additional 40
square feet for signage on the south wall of the building. Recently, the Planning Commission
approved a variance for another business with a similar situation.
The hardship circumstance is because the building is sitting on a corner. The way the building is
orientated, it would be difficult for traffic going northbound on Highway 10 to see their main sign
above the front door. The building was built many years ago and has good visibility on all four sides.
The additional 40 feet of signage would push the total to 129 square feet of signage. Planning
Associate Heller indicated notices were mailed to all property owners within 350 feet with no
comments as of today. She stated that Mark Elwell, Totino’s is present for any questions from the
commission.
Chair Stevenson opened the public hearing at 7:04 p.m.
There being no public input, Chair Stevenson closed the public hearing at 7:05 p.m.
Commissioner Miller questioned the additional 40 square foot sign on the south wall. Planning
Associate Heller indicated that Totino’s would be 29 square feet over the allowed amount.
Commissioner Gunn suggested the resolution reading a second sign of 40 square feet.
Commissioner Walsh-Kaczmarek suggested amending the third paragraph by adding “current
amount of signage is 89 square feet.”
MOTION/SECOND: Commissioner Walsh-Kaczmarek/Commissioner Gunn. To approve
Resolution 884-08, a Resolution Recommending Approval of a Variance for an additional 29
Feet for a Total of 129 Square Feet of Exterior Wall Signage for Totino’s at Mounds View
Square, 2535 County Highway 10; Planning Case No. VR2008-002.
Ayes – 7 Nays – 0 Motion carried.

Item Title/Subject: Final Approval of an Administrative Variance for a
Reduced Driveway Setback at 5414 Jackson Drive;
Planning Case AV2008-001
The applicant, Matt Eenigenburg, is proposing to replace the bottom half of his driveway
with concrete (the top half was replaced in 2004). The entire driveway is currently the
same width and has a one foot setback from the north property line. Up until 2004, the
applicant and his neighbor to the north had a shared driveway. That year the neighbor
decided to reroute his driveway to the other side of the house and removed his half of
the old driveway. When the shared driveway was removed, Mr. Eenigenburg was given
permission by the City to allow his existing driveway to remain on the property line,
since this was a special situation. The driveway was actually cut to give the application
about a one foot setback, which the City Code allowed at the time with permission from
the adjacent property owner.
The applicant is now ready to replace the bottom half of his driveway and would prefer
the entire driveway to remain the same width, instead of the bottom half being four feet
narrower in order to meet the current setback requirement of five feet. Mr. Eenigenburg
would typically be required to bring the section of the driveway that is being replaced
into compliance with a five foot setback. The requested four foot variance would allow
the applicant to keep the whole driveway the same width.
Discussion:
Staff reviewed this request and determined that it qualified for an administrative
variance, as it is a pre-existing, non-conforming driveway. Administrative Variances
were added as an option a few years ago to make the process faster and easier for
residents when their request was not excessively beyond what the code allows. Staff
reviewed the proposed driveway replacement and spoke with the applicant about his
hardship claim.
Staff feels that the situation is sufficient to warrant a variance. Staff also considered any
negative affects that the proposed addition might have on the surrounding area and
found that the driveway replacement would not negatively impact the neighborhood as
the width would be remaining the same. The Community Development Director granted
preliminary approval. The five adjacent property owners have been notified of the
variance request. At the time this report was written, Staff had received no feedback
from the adjacent property owners.

Recommendation:
The Commission can take one of the following actions related to the request:
1. Approve the administrative variance as requested. Resolution 885-08 is
attached for the Commission’s approval if that is the chosen course of action.
2. Deny the requested variance. If the Commission chooses this option, the
applicant will have the right to apply for a formal variance.
3. Table the request. If additional information is needed before a decision can be
rendered or if more discussion is needed, the Commission can simply move to
table the request until such information has been provided. Because of 60-day
requirements, the Commission would need to act upon the request as soon as
reasonably possible to avoid an inadvertent approval.

RESOLUTION APPROVING AN ADMINISTRATIVE VARIANCE TO ALLOW A ONE
FOOT SETBACK FOR A DRIVEWAY AT 5414 JACKSON DRIVE;
MOUNDS VIEW PLANNING CASE AV2008-001
WHEREAS, the applicant, Matt Eenigenburg, has applied for a variance to allow
a one foot setback to continue for a driveway located at 5414 Jackson Drive; and,
WHEREAS, 5414 Jackson Drive is zoned R-1, Single Family Residential, and is
legally described as follows:
The South 50 feet of Lot 11, and except the south 75 feet of Lot 10, Block 3, Spring
Lake Park Highlands, , Ramsey County, Minnesota
WHEREAS, the Community Development Director has reviewed the following
documents regarding this proposal:
1. Planning Application
2. Zoning Map
3. Site Plan
WHEREAS, the purpose of the administrative variance provision in the Zoning
Code is to give relief to property owners when the strict enforcement of the zoning code
requirements imposes a hardship thereby restricting the improvement of property due to
practical difficulties brought about by unique or extraordinary features of the physical
property that are beyond the property owner’s control; and,
WHEREAS, according to Section 1125.02, Subdivision 6 of the Mounds View
Municipal Code, the Community Development Director is to review a standard set of
criteria, of which all must be satisfied, in order to grant an administrative variance to the
Zoning Code; and,
WHEREAS, the property owners adjacent to the subject property were notified of
the variance request and were allowed ten days to respond; and,

NOW, THEREFORE, BE IT FURTHER RESOLVED, the Mounds View Planning
Commission, based upon its review of the identified hardship, does hereby grant final
approval of the variance request to allow the current one (1) foot setback to remain for a
driveway at 5414 Jackson Drive.
Adopted this 21st day of May, 2008.
