Item Title/Subject: Final Approval of an Administrative Variance for a
Reduced Rear Yard Setback at 7717 Long Lake Road;
Planning Case AV2004-002
Introduction:
The applicant, The Phoenix Residence, is proposing to construct a single-family home that
would serve six adults with developmental and physical disabilities. The home would be
located at 7717 Long Lake Road. Mounds View Zoning Code requires a thirty (30) foot rear
setback. The requested variance is for a twenty-five (25) foot rear setback. This property
was granted a front setback variance by the Planning Commission on April 21, 2004.
Discussion:
Staff reviewed this request and determined that it qualified for an administrative variance, as
it is within 25% of setback requirements. Staff reviewed the proposed site plan and spoke
with the applicant about the hardship claim. The hardship for the rear setback request is that
the lot is of substandard size and that the buildable area of the lot is very limited. The lot is
located on the corner of County Road I and Long Lake Road and has only ninety-four feet of
frontage on County Road I. The Mounds View Zoning Code requires that corner lots have a
minimum of one hundred feet of frontage on both street fronts.
Due to the fact that it is a corner lot, the property is required to have two front setbacks,
which in this case are thirty feet from County Road I and thirty-two feet from Long Lake
Road. In addition, the home must maintain a ten-foot side yard setback (from the east
property line) and a thirty-foot rear setback (from the north property line). The applicant is
requesting a twenty-five foot rear (north) setback in order to fit the one level, handicapped
accessible home that they are proposing to construct on the lot. There is a twenty-five foot
drainage and utility easement on the north side of the property, which the proposed home
would not encroach into.
Staff feels that there is sufficient hardship to warrant a variance. Staff also considered any
negative affects that the proposed setback might have on the surrounding area and found
that the house would not negatively impact the neighborhood. The Community Development
Director granted preliminary approval. The adjacent neighbors have been notified of the
variance request. One of the adjacent neighbors spoke with Staff about this request. The
neighbor simply wanted to see a copy of the proposed site plan and did not oppose the
administrative variance.
Recommendation:
The Commission can take one of the following actions related to the request:
1. Approve the administrative variance as requested. Resolution 772-04 is attached for the
Commission’s approval if that is the chosen course of action.
2. Deny the requested variance. If the Commission chooses this option, the applicant will
have the right to apply for a formal variance.
3. Table the request. If additional information is needed before a decision can be rendered
or if more discussion is needed, the Commission can simply move to table the request
until such information has been provided. Because of 60-day requirements, the
Commission would need to act upon the request as soon as reasonably possible to avoid
an inadvertent approval.

RESOLUTION APPROVING AN ADMINISTRATIVE VARIANCE TO ALLOW FOR A
TWENTY-FIVE FOOT REAR YARD SETBACK FOR A NEW HOUSE AT 7717 LONG
LAKE ROAD; MOUNDS VIEW PLANNING CASE AV2004-002
WHEREAS, the applicant, The Phoenix Residence, has applied for a variance to allow
for a twenty-five foot rear yard setback for a proposed new house located at 7717 Long Lake
Road; and,
WHEREAS, 7717 Long Lake Road is zoned R-1, Single Family Residential, and is
legally described as follows:
Lot 3, Block 1, Gustafsons Fifth Addition
Ramsey County, Minnesota
WHEREAS, the Community Development Director has reviewed the following
documents regarding this proposal:
1. Planning Application
2. Site Plan
3. Proposed Elevations
WHEREAS, the purpose of the administrative variance provision in the Zoning Code is
to give relief to property owners when the strict enforcement of the zoning code requirements
imposes a hardship thereby restricting the improvement of property due to practical difficulties
brought about by unique or extraordinary features of the physical property that are beyond the
property owner’s control; and,
WHEREAS, according to Section 1125.02, Subdivision 6 of the Mounds View
Municipal Code, the Community Development Director is to review a standard set of criteria, of
which all must be satisfied, in order to grant an administrative variance to the Zoning Code; and,
WHEREAS, the property owners adjacent to the subject property were notified of the
variance request and were allowed ten days to respond.
NOW, THEREFORE, BE IT FURTHER RESOLVED, the Mounds View Planning
Commission, based upon its review of the identified hardship, does hereby grant final approval
of the variance request for a twenty-five (25) foot rear yard setback for a proposed new house
constructed at 7717 Long Lake Road, contingent upon the following:
1. The construction of the proposed house shall commence within one year of the adoption
of this resolution or the variance approval shall become null and void.

Item Title/Subject: Review Parking Situation at Mounds View Gables
(National Handicapped Housing Institute)
Introduction:
In 2002, the Planning Commission reviewed a development proposal requested by National
Handicapped Housing Institute for Mounds View Gables. At the time of the review, the
applicant requested that the number of required parking spaces be reduced due to the fact
that many of the residents are not vehicle owners. At that time, the Planning Commission
approved the reduction of parking requirements, but noted that the parking situation would
be reviewed a year after the housing facility was constructed. The project was completed in
2003 and it is now an appropriate time to review the current parking situation.
Discussion:
Staff inspected the lot numerous times over the past few months and has never observed
the lot more than 50% full. Staff feels that the housing facility has adequate parking for the
use. Staff has not received any complaints or negative feedback regarding the parking
situation at Mounds View Gables. The Management of Mounds View Gables was invited to
attend the Planning Commission meeting, so that they would have the opportunity to
comment on the current parking situation.
