As the 1987 State Legislature again amended State Statutes relating to the filing
dates for local elections, amending Minnesota Statues 1986, section 205.13, sub-
division 1, the Mounds View Charter Commission met on November 19, 1987, to address
this issue.
The commission noted that, on February 10, 1986, the City Council of the City of
Mounds View, by Ordinance, amended Chapter 4, Section 4.02 of the Home Rule Charter
of the City of Mounds View, per the request of the Mounds View Charter Commission
after a motion was duly passed unanimously to this affect. This Ordinance amended
the Original Charter changing the filing dates for city elective office from "no
earlier than forty-two days, to fifty-six days," and, "nor later than twenty-eight
days, to forty-two days" before any municipal election. This Ordinance, therefore,
becomes Amendment Number (1) to the Home Rule Charter of the City of Mounds View.
A motion was duly passed unanimously by the Mounds View Charter Commission on November
19, 1987, to amend Chapter 4, Section 4.02, of the Home Rule Charter, to read as
follows:
"Sec. 4.02. Filing for Office. No earlier than seventy days nor later than
fifty-six days before any municipal election, any resident of the city qualified
under state law for elective office may, by filing an affidavit and by paying a
filing fee to the clerk-administrator in an amount as set by ordinance, have
his/her name placed on the municipal election ballot."
Further, the Mounds View Charter Commission recommends to the City Council that
they amend Chapter 4, Section 4.02, of the city charter by Ordinance with a unanimous
vote of the council. Further, that should this action take place, an acceptable copy
of such Ordinance be mailed to the Secretary of the Charter Commission to be attached
to -the original Home Rule City Charter, and that amended copies of the-Charter be
mailed to each charter commission member, which was not done upon the occasion of
the First Amendment of February 10, 1986.
At this time I request that an acceptable copy of Ordinance No. 404, amending the
Home Rule Charter of the City of Mounds View, dated February 10, 1986, be mailed
to the Secretary of the Charter Commission, to be attached to the original Home Rule
City Charter.
