Dear Bob :
After our recent conversation regarding the Home Rule
Charter at Don Hodges ' Testimonial Dinner, I presented the
attached memorandum to the City Council for their considera-
tion at the January 2, 1990 Agenda Session.
The City Council has authorized me to meet with you and, if
appropriate, the entire Charter Commission to discuss my
recommendations regarding two changes to the Home Rule
Charter . As indicated in my memorandum, these changes
relate to the filing dates for Special City Council
Elections and the adoption of a Long-Term Financial Plan by
resolution rather than ordinance as currently required by
the Charter .
Please advise me as to how you would like to handle this
matter. I would be happy to meet either with you and/or the
entire Charter Commission to discuss my proposals in detail .

SUBJECT: HOME RULE CHARTER
At a recent social gathering Bob Toborg indicated a desire
to meet with me regarding changes the staff would like to
suggest be made in the Home Rule Charter . I indicated to
Bob that prior to my meeting with him I would like to
discuss the matter with the City Council and receive your
approval . For that reason, I am writing this memorandum and
requesting that we discuss this matter in detail .
Should you approve of my meeting with Mr . Toborg, I would be
suggesting to him two (2 ) changes to the Charter that I feel
are necessary for the efficient operation of the City at
this time. The first of these is an addition to Section
4. 05 of the Charter which addresses vacancies on the City
Council . Currently, the filing dates for our special
elections is identical to those for regular elections. As
you recall, with our special election in the Spring of 1989,
we were unable to hold the election for approximately 60
days due to the filing requirements contained in our Charter
and State Law. It would be my recommendation that a
shortened filing date be provided for for special elections
to fill vacancies on the City Council in order to fill such
vacancies in a more timely fashion.
The second change that I would be recommending would be to
provide for the adoption of the Long-Term Financial Plan by
resolution rather than by ordinance as currently required
under Section 7. 05. I would be recommending this because
the Long-Term Financial Plan is a policy statement and
planning documentfor the City, not a document that should
become binding law. Since the Long-Term Financial Plan
looks out five years and is frequently prepared prior to the
adoption o - - . s .u.ge , even those projects for
the next year are sometimes questionable until we become
aware of the level of revenues we might be receiving.
Should a resident of the City wish to challenge the City ' s
non-compliance with the Long-Term Financial Plan, we would
find ourselves in a very difficult position due to the fact
that it is the law of the City, not a policy document.
It would be my hope that we could discuss the aforementioned
changes I would be recommending and any other thoughts you
might have with regard to the Charter prior to any meeting
you might approve of me having with Mr . Toborg.
