CALL TO ORDER
The Mounds View City Council was called to order by Mayor McCarty at 7:00 p.m. on March 24, 1997.

ADDITIONS TO THE AGENDA:
There were no additions to the agenda.
APPROVAL OF MINUTES:
March 10,1997 -City Council Meeting:
Mayor McCarty noted a correction to the minutes of March 10, 1997. He noted that on Page 3, Line 1,
Council member Stigney made a motion to postpone the hiring for the Recreation Program Supervisor position
until such time as the Council had an opportunity to review and discuss the personnel policy and to authorize
staff to hire a temporary person during the interim. There was no Second to that motion, and Mayor McCarty
noted that Mr. Koopmeiner's friendly amendment which occurred immediately following Mr. Stigney's motion
was inadvertently taken as a second to the motion.

Council member Koopmeiners stated he would take responsibility for seconding Mr. Stigney's motion.
Furthermore, the amendment recommended by Mr. Koopmeiners will be noted as an accepted friendly
amendment.
Page 3, Line 1 should therefore be changed to read, "MOTION/SECOND: Stigney/Koopmeiners to postpone
hiring for the Recreation Program Supervisor position until such time as the Council has had an opportunity to
review and discuss the Personnel Policy and to authorize staff to hire a temporary person for a period of three
months".
Council member Trude noted a correction to Page 4, Line 33. This should be changed to read as follows:
"Council member Trude noted that children who are tagged for smoking are akeady required to perform
community service hours. However, the Police Department has many other pressing matters to attend to".
MOTION/SECOND: Quick/Koopmeiners to Approve the Minutes of the March 10, 1997 City Council
meeting AS AMENDED.

ACCEPTANCE OF ADVISORY COMMISSION MINUTES:
• There were no Advisory Commission Minutes for consideration.
SPECIAL ORDER OF BUSINESS:
A. A Proclamation Declaring April 6 -12,1997 as International Building Safety Week for 1997.
Ms. Sheldon, Director of Community Development noted that this proclamation is to recognize the importance
of the building plan review and building permit process in maintaining safe construction for both the
community and individuals. She proceeded to read the Proclamation.
MOTION/SECOND: Quick/Stigney to Adopt the Proclamation, Declaring Apri16 - 12, 1997 as International
Building Safety Week 1997.
VOTE: 5 ayes 0 nays Motion Carried
CONSENT AGENDA:
MOTION/SECOND: Trude/Koopmeiners to approve the Consent Agenda as presented in the Agenda.
Council member Stigney noted that there were two items on the Consent Agenda for Step Adjustments for two
employees. He noted the basis the city uses for establishing the compensation policy is based on group five
cities rather than six and he would like this matter discussed at the next Council work session.

Mayor McCarty noted that this is the period of time for residents to address the Council with comments or
concerns on items that are not on the Agenda.
Naja Werner, 2765 Sherwood Road, stated it is her understanding that at the last meeting of the Park &
Recreation Committee, a member of the committee said that a flyer would be prepared and sent home with the
Pinewood Elementary children, urging the parents to vote on the Bel Rae matter. She wondered if it was legal
to use the public schools for this purpose and if it is ethical. She provided a copy of the flyer that was sent
home with the students.
Ms. Trude noted that she has two children at Pinewood Elementary and she has not received the flyer.
Mr. Floyd Olson, City Attorney, noted that Section 404 of the City Charter states that the City Council has the
discretion for holding Special Advisory Elections and to provide the means for holding it. That is all that is
referred to in the Charter, however he would assume that it would provide for consideration discretion as to
how to conduct the election.
Mr. Whiting provided a copy of the flyer that was put together by the City of Mounds View and distributed to
the residents. Anything other than the one he identified was put together by someone other than city officials.
PUBLIC HEARINGS:
Public Hearing and Consideration of Resolution No. 5098, A conditional Use Permit for an oversized
garage at 2185 Pinewood Drive.
Mayor McCarty noted that this request had been withdrawn by the applicant.
Public Hearing and Review of a Conditional Use Permit for on-site mobile home sales at 2075 Rustad
Lane.
Mayor McCarty opened the Public Hearing at 7:22 p.m. He noted that this was not an application for a new
Conditional Use Permit, but rather a review of an existing Conditional Use Permit, which was extended in
1995.
Mr. Jim Ericson, Planning Associate, explained that this Conditional Use Permit was originally granted in
February of 1995 which allowed for the onsite display and sales of model manufactured homes in the Colonial
Village Park. He noted the six stipulations which were a part of the Conditional Use Permit.
He noted that the Planning Commission and staff recommend that the CUP be reconfirmed with the same
stipulations.
Tony Zook, 5671 Quincy Street, stated he is concerned about the street condition on Quincy, between Hillview
Road and County Road 118. The residents are concerned about the heavy trucks which will be using the
street, causing further damage. They would like to see an additional surcharge for sheet maintenance for the
trucks that will be using the street.
Mayor McCarty noted that the Supreme Court of the State of Minnesota just ruled (in an Eagan case) that local
units of government could not apply use taxes for road construction and maintenance as it is an unauthorized
• tax. Therefore, this would not be an option for the Council.

Mayor McCarty closed the Public Hearing at 7:28 p.m.
Carol Muellner, Property Manager of Colonial Village, stated since the Conditional Use Permit was granted,
only three new homes have been put in. Therefore, she does not see this as a problem for the residents on
Quincy Street.
MOTION/SECOND: Koopmeiners/Quick to Confirm the Conditional Use Permit Issued for On-Site Mobile
Home Sales at 2075 Rustad Lane, with the same stipulations, based on the one-year review as required by the
permit.

COUNCIL BUSINESS:
A. Requesting Approval to transfer $3,490 from Cable Franchise Fund to 1997 Cable TV Fund for the
upgrade of audio system for televising City Council Work Sessions.
Mary Saarion, Director of Parks, Recreation and Forestry, explained that the set up of the Council Chambers
does not provide an adequate audio system to allow for the televising of the Council Work Sessions. Three
companies were contacted, but only one company, Blumberg Communications was able to come in. The other
two companies indicated a two to three month delay. Blumberg Communications put in the existing
microphone system in the Council Chambers and did the cabling as well. They submitted a proposal which
includes the equipment and installation. Ms. Saarion noted that the Cable TV Commission had requested
some additional equipment to further assist in televising the city meetings and programs. She proceeded to go
through the additional requests. She noted that funds are available in the Cable TV Franchise fund.
Council member Stigney wondered if the city should consider looking at an Eight Input Mixer if they are going
to update their technology. He noted that he feels some of the equipment could also be obtained at a lesser
cost. Ms. Saarion noted that Blumberg Communications was available to come out immediately and upgrade
the system, whereas the other companies indicated a 2 - 3 month delay.
Council member Trude stated she feels the P.A. system in the Council Chamber should also be evaluated at the
same time as the other upgrades. It was the general consensus of the Council that some of the options be
looked at more closely and discussed with Patrick Toth to be reviewed again at the next Council meeting.
D. Consideration of a minor subdivision (lot split) for Carol Hoopingarner at 8344 Groveland Road.
Mr. Ericson explained that this applicant was requesting approval of a minor subdivision to split her property
into two lots. He noted that the applicant has submitted the required documents (with one minor change
required) and staff is recommending approval of the subdivision.

Carol Hoopingarner, Owner of Real Property Located at 8344 Groveland Road.

E. Consideration of a development Review and wetland alteration permit for ZEP Manufacturing at
8490 Coral Sea Street.
Mr. Ericson explained that Benson-Orth Associates has applied for a development review and wetland
alteration permit to allow for the construction of a 22,300 square foot branch sales office and warehouse on
Coral Sea Street. The building would consist of 5,950 square feet of office space (2,500 square feet of
mezzanine space) and 19,320 square feet of warehouse space. The property is currently zoned I-1 which
allows for this use. The parcel is undeveloped with the western edge of the properly in wetland. There is an
additional small wetland in the northeast corner of the site. Mr. Ericson noted that this project meets all the
setback requirements. The Planning Commission and staff recommend approval of Resolution 5097,
approving the development Review for ZEP Manufacturing with stipulations. Staff also recommends approval
of Resolution No. 5103, a resolution approving the Wetland Alteration Permit for this project with stipulations.

B. Introduction for First Reading of Ordinance No. 594, An Ordinance Amending Chapter 606-607
and 1005 of the Mounds View Municipal Code related to the requirement to mow tall grasses and
creating an exemption for wetland and native vegetation.
Ms. Sheldon explained that this ordinance would make some modifications to the city's requirement that tall
grasses over eight inches be mowed (Nuisance Code). She noted that at the February 24, 1997 Council
meeting, some concern was raised over one of the exemptions to the requirements to mow (#3).
It was felt at that time that native vegetation on individual lots may spread to neighboring lots and cause
problems. At that time, the Council asked staff to back to the Planning Commission to discuss it fiuther and
determine if some type of modification should be made. The Planning Commission recommended a modified
version of exemption #3, which Ms. Sheldon proceeded to read to the Council. The other option (#2) would
be to drop Item #3 altogether.
MOTION/SECOND: Quick/Trude to approve the introduction of Ordinance No. 594, An Ordinance
Amending Chapters 606, 607 and 1005 of the Mounds View Municipal Code Related to the Requirements to
Mow Tall Grasses and Creating an Exemption for Wetland and Native Vegetation, Option #1, and to waive
the reading.

C. Introduction for first reading of Ordinance No. 595, An Ordinance adding day care centers and
group nurseries as a Conditional Use in the B-1, B-2, B-3, B-4 and I-1 Zoning Districts.
MOTION/SECOND: Trade/Quick to remove this item from the Table for discussion.
VOTE: 5 ayes 0 nays Motion Carried
Ms. Sheldon noted this ordinance would add day care centers and group nurseries as a Conditional Use in the
B-1, B-2, B-3, B-4 and I-1 Zoning Districts. At the present time, the City Ordinance allows for day care
centers and group nurseries in the residential district. This would add them to the business and industrial
district. She noted that two issues of concern addressed at the February 24th Public Hearing were the higher
level of exhaust fumes for children of day care centers located in areas of higher traffic volumes, and whether or
not a distance requirement should be established between day care centers/group nurseries and businesses
serving liquor, liquor stores and adult establishments.
• With respect to vehicle fumes, Ms. Sheldon noted that the City's ordinance does require that day Gaze
centers/group nurseries be located on arterial or collector streets rather than local streets (she believes this was
to try to keep heavier traffic out of the residential neighborhoods). In talking with the Air Pollution Control
District, it was their estimate that with a 200 foot distance between the play area and the traffic/intersection,
sufficient disbursal of the fumes would eliminate the hazard. Therefore, it would be Ms. Sheldon's
recommendation that a criteria be added to require that the play area be at least 200 feet from the right of way
of Highway 10.
In regard to distance requirements, criteria could be added to state that a 500 foot distance is needed between
any day Gaze center/group nursery from establishments have either a liquor license or licenses for adult
businesses. Ms. Sheldon noted that the distance requirements could be adopted for just the business and
industrial district, or could also be added to the residential districts, with a provision that existing day care
centers will not be made non-conforming. She noted that the criteria proposed would not apply to home day
care.

REPORTS•
Report of Council members:
Trude: Ms. Trude reported that she had met with State Representative last week to stay posted on
proposals for property tax reform and noting a reduction in property tax rates on renters and also on
commercial properties. She is concerned that this could mean a reduction in covering the costs of city services
and wondered if the financial consultant should assess Mounds View's situation should this occur.
She noted that this would shift a burden onto the homeowners to produce the same tax dollars

Report of Mayor McCarty: No report.
Report of Clerk Administrator: Mr. Whiting noted that the Council retreat went well. He provided a
copy of the information which was distributed door-to-door in regard to the Bel Rae Advisory Election to be
held on Apri15, 1997. He noted that ballots will be mailed out to all registered voters in the community which
will be the election form. These can be mailed back in. He noted that a meeting is being held at the Bel Rae on
Wednesday, March 26th at 7:00 p.m. to review the proposed concept for the election. He noted that he will
need to prepare a summary of the expenses and revenues produced if the city should build the gymnasium
which will be available on Wednesday evening.
Mayor McCarty noted that he has been asked many questions within the past few days about what should be
done with the Bel Rae. He took this opportunity to provide information as well as share a story which was
shared with him by a young lady who turned her life around after people who were using the Bel Rae
Community Center very actively reached out to her.
MOTION/SECOND: McCarty/Trude to collectively join in supporting the acquisition, remodeling and
operation of the Bel Rae Balkoom as our new Community Center.

Council member Stigney stated he still questions whether the type of community center with a full gym will be
used and if so, will it be adequately used in that the city has school gyms that are not being fully used right now.
Also he feels there are hidden costs which are not being identified as to how much staffing will be required, etc.
Rather than supporting it, he would rather leave it up to the voters.
