Call to order—Chair Thomas called The meeting to order at 7:07 p.m. 2.Roll Call—Present- B. Amundsen, B. Doty, D. Freimuth, D. Mandoza, J. Miller, W. Mori, M. Sandback, J. Thomas, W. Werner, Sr. Absent—M. Amirahmadi, B. Jahnke, S. Linke, D. McCarty, D. Sach Le, R. Stigney 3. Approval of Agenda and Minutes Motion by B. Mori, second by B. Doty to approve Minutes November 14, 2002 as written. UNANIMOUS APPROVAL Motion by B. Mori, second by J. Miller to approve Minutes November 24, 2002 as amended, with correction of item 4, first full sentence, delete the word "of'. UNANIMOUS APPROVAL Motion by J. Miller, second by M. Sandback to approve Minutes December 12, 2002 as written. UNANIMOUS APPROVAL Chair Thomas confirmed each member had corrected agenda, with revised jjt • notation. Motion by B. Doty, second by B. Mori to approve the presented revised agenda. UNANIMOUS APPROVAL 4. Citizens comments from the floor—none 5. Reports of the Chair—none 6. Reports of the members—All members congratulated D. Freimuth on the happy event of birth of twins to he and his wife. 7. Unfinished Business— Motion by B. Doty, second by D. Freimuth to approve Resolution 2003-1 setting this commissions' regular meeting schedule for February thru July of 2003 as amended with a spelling correction of"it's"to "its". UNANIMOUS APPROVAL Motion by B. Mori to postpone sending letter to City Council in regard to Section 2.02 of the Charter relevant to the Police Civil Service Commission pending new draft from Chair Thomas. Chair Thomas agreed to draft a new letter. 8. New Business— Commission reviewed language of Charter determined in previous meetings as being simple language updates. B. Mori presented research documentation on Charter, Chapter 4, Section 4.05, • Subdivision 5. Mr. Mori also noted his thanks to the League of Cities for their help on the basic information gathering research. No motions were offered. Motion by B. Mori, second by D. Mandoza directing Chair Thomas to draft language recommending a correction of the Charter, Chapter 2, Section 2.06, Subdivision 1 adding "except as a member of the City Council as a whole". 8 Ayes, 1 Nay, APPROVED Discussion continued to review language of Chapter 4, Section 4.02; Chapter 5; and Chapter 9, Section 9.01. No motions were offered. 9:14 PM D. Freimuth left the meeting. 9. Vice Chair At the Nov 14, 2002, meeting of the Mounds View Charter Commission, a member of the Michele Sandback Commission that is also a member of the Police Civil Service Commission presented an issue 763-783-1770 ' relating to the interpretation of the Mounds View Charter, Section 2.02. The Charter 2"VVice Chair Commission has determined at its Jan 9, 2003, meeting that there is sufficient cause to render Daniel Freimuth its opinion to you on the matter of the validity of the Police Civil Service Commission 763-780-3371 providing an administrative function for the city under the current wording of the Charter. Secretary „ We would like to note that although the Commission provides its opinion on such matters, Brian Amundsen the City Council and its legal counsel have the responsibility to interpret the Charter on 763-786-5699 behalf of the City. This was affirmed by Mr. Duke Addicks, an attorney for the League of Mary Amirahmadi b Minnesota Cities, in his presentation before this Commission on June 14, 2001. 763-786-3477 Bill Doty It is the Charter Commission's opinion that Section 2.02 does appear to be in conflict with the 763-786-3421 existence of any appointed commission that would serve in an administrative role. It was also noted that the Police Civil Service Commission was formed and has served continuously Jahnke - since prior to the Charter and that in over twenty years it has not been challenged. 7 0-4900 Daniel Sach Le The Charter Commission reviewed this issue on Thursday, January 9, 2003, and requests that 763-783-5943 the City Council provide direction to the Charter Commission for our future consideration to pursue one of the following options or other options the City Council may find appropriate. Sharon L Linke 763-786-4696 • The City Council could request that the Charter Commission review Section 2.02 of the Dana Mandoza Charter specifically excluding the Police Civil Service Commission and such other 763-784-8942 commissions as it may deem necessary, from the restriction of not allowing any commissions that would serve in an administrative function. Duane McCarty 763-784-6074 • The City Council could abolish the Police Civil Service Commission defined by ki Jean Miller Section 404 of the City Code and Minnesota Statute 419.16 which according to 763-786-3959 1 Minnesota Statute 419.16 would require a unanimous vote of the City Council.
