ABSENT MEMBERS: Milan Illig -Howard Neisen Dave Notaro Bill Werner Curt Schmidt Don Hodges TARDY: Nygaard (8: 45 PM) III. Reviewal of Commission Minutes of August 23, 1979 McCarty made the motion, seconded by Wills, to dispense with the reading of the minutes until the next meeting . The motion carried unanimously . IV. Reviewal of Chapters 3, 4, and 5 of the proposed City Charter: 3.07 becomes 3. 08 Procedure on Resolutions 3.08 becomes 3 . 07 Title should be: " Signing and Publication of Ordinances" ( strike "and Resolutions) . • Strike "or resolution" in the second sentence. Third sentence should read : "Every ordinance shall be published at least once in the official newspaper as soon as practicable . " 3.10 Subd. 2 should read: "An ordinance or resolution passed under the initiative .or refereddum power shall not be repealed or amended by the council except by approval of the voters . " 3.11 Title should read: "Review and Revision of Ordinances and Indexing of Resolutions ." The first sentence shou..d read : "The city shall review, revise and- rearrange (strike ---' and c odi-f-y--L)---its ordinance code and index its resolutions with such additions and deletions as may be deemed necessary by the council at least once every two years ." Second sentence: add "the" before resolution index. 4.01 The Regular Municipal Election Strike: "and of the officers to be elected" at the end of the second sentence . Last sentence should read: "Elected and qualified officers provided for by this Charter shall assume the duties of office to which they were elected on the first business day in January following such election. Charter Commission - Minutes (Continued) Page 2 4 .02 Filing for Office . • Changed to read : "No earlier than forty-two days or later than twenty-eight days before any municipal election, any resident of the city qualified under site law for elective office may, by filing an affadavit and/ aying a filing fee to the city clerk in an amount as set by ordinance, have his/her name placed on the municipal election ballot." 4.03. Judges and Clerks of Election. Change "ten days" to "twenty-five days" 4.05 Canvass of Elections . Delete . 4.06 (Becomes 4.05 because of above deletion) Special Elections except for Elected Office . Delete last sentence and insert: "Fifteen days prior notice shall be given by the city clerk by posting a notice thereof in at least one public place in each election precinct, and by publishing a notice thereof at least once in the official newspaper of the city stating the time and the places of holding such election. Failure. to give such notice shall not invalidate such election." • 4.07 (Becomes 4.06) Vacancy of Municipal Elected Office . Subd. 1 . Change "forty-five days" to "ninety days" Subd . 2. begins with the second sentence "The city clerk Change "thirty-seven days" to"sixty .days" . Subd. 3. begins with the fourth sentence "The procedure at such. . . " Subd . 4. begins with the third sentence "In the case of a vacancy. ." Change ^Sub. 2 to read: "Sub. 5 . Notwithstanding the ninety day requirement in subdivision 1 of this section, when a vacancy in an elected municipal office occurs within ninety days prior to a regular municipal election date, the special election to fill the vacancy shall coincide with the regular election. " Strike the last sentence (page 3) . 5 . 02 . General Provisions for Petitions . Add the following to the end: "Any person whose name appears on a petition may withdraw his name by a statement in writing filed with the city clerk before the clerk advises the council of the sufficiency of the petition." M.V. Charter Commission - Minutes (Continued) Page 3 5 .03. Determination of Sufficiency. • Strike the second sentence. Third sentence should read: "The required number of signers shall be at least ten percent for initiative and referendum, and for recall , at least twenty percent of the total number of electors who cast their votes at the last regular city election." Add: "Immediately upon receipt of the petition, the city clerk shall examine the petition as' to its sufficiency and report to the council within twenty days . Upon receiving the report, the council shall determine by resolution the sufficiency of the petition. " 5.05 . Initiative. Wills made the motion, seconded by Ziebarth, to insert the language from the model charter, except those specific parts mentioned, and rely on the conscience of the council to be responsive to the people. Vote: 6 ayes, 2 nays (Loeding & Nygaard) Ziebarth made the motion to remove the words "or other measure" from 5 .05 and 5 .07 . Motion failed for lack of a second. • Add after the first sentence: "Any ordinance except an ordinance relating to the budget of a capital program, the appropriation of money, the levy of taxes, or the salary of city officers or employees, may be proposed by a petition. " Change the third sentence to read: "The council shall enact the proposed measure within thirty days after the final deter- mination of the sufficiency of the petition with amendments and a majority of the sponsoring committee do not disapprove the amended form by a statement filed with the administrator within ten days of its passage by the council , or place the measure on the ballot at the next election occurring in the city." • Wills was excused from the meeting at 10: 20 PM•. 5 .08. Recall . Change the fourth sentence (Page 4) to read: "The council shall at its next meeting, by resolution, provide for the holding of a special recall election within ninety days aftersuch meeting , except if any other election is to occur within/ ninety day period after such meeting, the council may in its discretion provide • for the holding of the recall vote at that time ." • M.V. Charter Commission - Minutes (Continued) Page 4 McCarty made the motion, seconded by Ziebarth to table Chap. 6 and send back to the Commission as there is so much to be redone . McCarty withdrew his motion, Ziebarth withdrew her • second . Ziebarth made the motion, seconded by McCarty, to adjourn the meeting at 11 : 35 PM. Vote: 8 ayes, 0 nays . •
