Meeting called to order by Chairman, Bill Doty, at 7:35 p.m. Chairman Doty outlined the format for the evening's meeting; i.e., the Commission will begin by reviewing Chapter 6 and making any necessary changes. Comments would then be solicited from the public in attendance. Howard Neisen has resigned from the- Commission as of Aug. 23, 1979 . II. ABSENT ISTT S: -Ruth White ,.;`i.lan Illig Lowell Nygaard Wm. Werner Dave Notaro Jim Wills Walter Skiba Curt Schmidt III. Reviewal of Chapter 6 of the proposed City Charter. Carol Ziebarth made a: motion to review the entire chapter 6 and then go back to it at a later date. Notion failed for lack of a second. Duane McCarty made .a motion seconded by Don Hodges to change the title Clerk-Administrator to City Administrator. VOTE: (4) Ayes (2) Nays - I3. Doty, N. Loeding. Notion passed. III Neil Loeding made a motion seconded by Richard Lykke to accept the changes that he proposed in Chapter 6 sections 6.01, 6.02, 6.03. N. Loeding then withdrew his motion and R. Lykke withdrew his second. Carol Ziebarth made a motion not to accept the changes proposed by N. Loeding. The motion failed for lack of a second. The Commission concurs with the following proposed changes except for Carol Ziebarth. Sec. 6.01 Administrative Responsibility. Delete- "is the head of the administration" and insert ",as a body shall be responsible for theadministration of the city." -Sec. 6.02 Subd. 6 substitute supervise for coordinate and delete "in conjunction with heads of departments .a.s a group" Subd. 7 - delete "participate with affected municipal department heads, and other appointed officials, in" and substitute "be responsible for". Subd. 8 - eliminate "coordinate" and substitute "be responsible for". Subd. 9 - eliminate "cause to" and "prepared" and substitute "responsible for the preparation of". Subd. 11 - substitute "supervise" for "coordinate". Subd. 12 - eliminate "participate with the financial officer, if such there be, in" and sub-titute "be responsible for". Subd. 14 - eliminate "shall coordinate the activities of all municipal department heads and other appointed officials in the administration of municipal policy. ?He" • Subd. 19 - substitute "may advise" for "in advising". *Subd. 8 - eliminate the first part of the first sentence - "In conjunction with municipal department heads and other appointed officials," III. Reviewal of Chapter 6 of the proposed City Charter (cont'd.) Page (2) After additional discussion the Commission concurred with the following • additional changes: 6.02 Subd. 7 change "be responsible for the preparation of" to "prepare". Subd. 8 - change "be responsible for the preparation of" to "prepare". Subd. 9 - change "be responsible for the preparation of" to "prepare". Subd. 12 - change "be responsible for the submission of" to "submit". He/she, him/her, his/her to be used consistently. Change Sec. 6.04 to 6.02 Administrative Organization, with two subdivisions. Subdivision 1 is from 6.03 in the model. "The council may by ordinance establish city departments, offices, and agencies and prescribe their functions. No power or ditty conferred by this charter upon a particular office or agency shall be transferred to any other." Subdivision 2 would be the present Subdivision 1. Delete 6.04 subdivisions 2 & 3, and 6.05. Renumber 6.02 to 6.03 and 6.03 to 6.04. Although the commission concurred it should be noted that Carol Ziebarth does not concur withall the changes made in Chapter 6. IV. Reviewal of Chapter 7 of the proposed City Charter. C. Ziebarth made a motion seconded by D. Hodges to remove 7.04 Subd. 2. D. Hodges withdrew his second. VOTE: (4) Ayes (2) Nays - D. rcCarty, C. Ziebarth Notion made by D. YcCarty seconded by C. Ziebarth to amend 7.04 Subd. 2 to read "At least two weeks before the budget is adopted for the ensuing fiscal year there shall be a notification to the public that a summary of the budget is available at City Hall and that hearings will be held, but failure to notify will not invalidate the budget." D. Hodges called for the question, seconded by D. McCarty., Passed. Vote on amendment: (3) Ayes, (2) Nays - B. Doty, N. Loeding, (1) Abstention- R. Lykke. Amendment failed. - - --Vote on 7.04 Subd. 2: (3) Ares; (2)-Nays -B —Doty, N Loeding; - _- —- (i) Abstention - R. Lykke. Lotion failed. Sec. 7.04 Subd. 1 - Submission of Budget. In the first sentence change "staff" to "administrator" and "its" to "the". Subd. 2 - eliminate "and not later than September l5.'; Sec. 7.05 Long-term Financial Plan. Subd. 1 - Change the first sentence to read "The Council shall have prepared a long-term financial plan commencing with the calendar year 1980." In the second sentence eliminate the words "no later than August 15." Subd. 5. The Capital Budrnet. Eliminate "or six". Subd. 6. Eliminate "No later than September. 15 of each year, the council • s' all cause to be mailed to" and substitute "7'"he Council shall have mailed to tile" Sec. 7.10 Subd. 2 delete and substitute these words - "A description of each such proposed issue shall be given in a city newsletter, but failure to 'give such description or any defect in the description shall not invalidate the issue. IV. Reviewal of Chapter 7 (cont'd.) Page (3) Sec. 7.12 subd. 2 delete entire subdivision and substitute these words- "A description of each such proposed certificate shall be given in a city newsletter, but failure to give such description or any defect in the description shall not invalidate the certificate." Commission concurslith the changes in Chapter 7. Sec. 7.04 Subd. 2 in the second sentence strike the words "in addition to the information listed in subdivision 1." V. Next meeting scheduled for Thursday Sept. 6 at 7:00 p.m. R. Lykke made a motion seconded by D. McCarty to adjourn the meeting. Motion passed. Ieeting adjourned at 12:00 midnight.
