MOUNDS VIEW CHARTER COMMISSION
MINUTES
. September 6, 1979
I. Meeting called to order by Chairman, Bill Doty, at 7:05 p.m.
The Chairman pointed out that an error in parliamentary procedure had
been made on 7.04 Subd. 2. In place of the original wording in 7.04
• Subd. 2 the following motion and amendment made by D. McCarty and
seconded by C. Ziebarth passed: "At least two weeks before the budget
is adopted for the ensuing fiscal year there shall be a notification
to the public that a summary of the budget is available at City Hall
and that hearings will be held, but failure to notify will not invalidate
the budget." (3) Ayes, (2) Nays - B. Doty, N. Loeding, (1) Abstention -
R. Lykke. (This subdivision has been renumbered to 3)
Moved by N. Loeding and seconded by D. McCarty to go through the minutes
at a later date rather than this evening. Passed.
Chairman Doty outlined the procedure. Beginning with Chapter 8 the
Commission will review the charter. At the end of each chapter the
Meeting will be open to comments from the floor.

III. Review of Chapter 8
Sec. 8.01 Power to Make Improvements and Levy Assessments.
Insert a , after changes and "shall" before not in the second sentence.
C. Ziebarth moved and D. McCarty seconded to use .language from the model
in place of the last two sentences. "The total assessments for any local
improvement may not exceed the cost of the improvement, including all costs
and expenses connected therewith, with interest. No assessment shall
exceed the benefits to the property." Vote:(5) Ayes, (1) Nay - N. Loeding.
Motion passed.
-Sec-.--8-.-04 r-e-placed-with "l_desc_riration-of each proposed public improvement
shall be given in a city newsletter, but failure to give such description
or any defect in the description shall not invalidate the improvement."
Commission concurs with changes.
IV. Review of Chapter 9
Sec. 9.01 Acquisition of Property.
Insert "real" before property in the first sentence.
Scratch the last sentence.
Commission concurs with changes.
V. review of Chapter 10
• Sec. 10.01 - in the last sentence change clerk to "city administrator".

VI. Review of Chapter 11
Sec. 11.05 Public Utility.
Insert the following sentence at the end of the section: "Before such
ordinance is submitted to a vote, the council shall hold a public hearing on
the matter in accordance with section 11.06 of, this chapter."
C. Ziebarth moved to strike 11.06. Motion failed for lack of a second.
Sec. 11.06 - Make title singular by eliminating the 's' in Hearings.
Commission concurs with changes.
VII. Review of Chapter 12
Sec. 12.01 - Official Publications.
Eliminate the word "state" in state law, add "and this charter" following
law.
Sec. 12.02 - Oath of Office. In the oath of office it should be city
administrator rather than clerk administrator.

Sec. 12.04 - Official Bonds. In the first sentence change clerk administrator
to city administrator. In the next to the last sentence change city clerk
to city administrator. •
Sec. 12.06 - Vacation of Streets. Following the words "alley or" add
"other public grounds or".
Note: There is a need to review the phraseology of the charter in reference
to areas referring to state law. In some cases it should be only the word. law.
Sec. 12.11 - Disposition of Fines and Penalties. C. Ziebarth moved with
second by H. Skiba to strike the entire Sec. 12.11. Motion passed. (7) Ayes
Renumber Sec. 12.12 to 12.11.
Under advisement insert a new Sec. 12.12 as follows: "A newsletter shall
be published by the city at regular intervals at least six times each year.
The_-postal roll for the city shall be used for the distribution."
Commission concurs with changes.
VIII.The Charter Commission will review past chapters for an hour.
Sec. 7.04 Subd. 1 In place of September 1 change to "the first regular
council meeting in September." - Commission concurs.
Make a new Subd. 2 beginning with the words "For each utility" and
ending with the word "appendices." Change "the" budget to "its" budget.
The rest of the Subd. beginning with "The total proposed operating budget"
is to be included in Subd. 1. Subd. 2 now becomes Subd. 3. Commission

concurs with these changes.
• Sec. ?.05 Subd. Scratch entire subdivision and insert "A summary of
the long term financial plan shall be given in a city newsletter.

• established consisting of D. McCarty, B. Doty, and N. Loeding.
N. Loeding amended the motion, seconded by D. ?Todges, to designate
B. Doty as the chairman of the Research Committee.
Vote on Amendment: (6) Ayes, (1) Nay - Carol Ziebarth
Vote on Main I`otion: (6) Ayes, (1) Nay - Carol Ziebarth
The Research Committee will meet Thursday Sept. 13 at 7:00 p.m.
IX. D. McCarty moved, seccided by L. Nygaard, that the meeting be adjourned.
