October 4, 1979
I. Meeting called to order by Chairman, Bill Doty, at 7:15 P.M.
II. ABSENT MEMBERS: Dave Notaro Walter Skiba

III. Commission members reviewed, personally, the Minutes of September 19, 1979
and Septebmer 26, 1979.
Thereupon, a motion was made by C. Ziebarth, seconded by D. McCarty, that
the Minutes of 9/19/79 be approved. Carried unanimously.
Motion made by D. McCarty, seconded by L. Nygaard, that the Minutes of 9/26/79
be approved. Carried unanimously.
• IV. The chairman stated that the Charter Draft of October 4, 1979 would be
reviewed, and additional changes or corrections would be made, if necessary.
The attending public asked if they would be allowed to make any comments
on the proposed Charter. Such permission was granted by the chairman.
V. The Commission proceeded to review the Charter Draft of 10/4/79, chapter by
chapter.
Based on suggestions from the attending public, the wording, "continuous
absence from the city for more than three months, or", Sec. 2.05, and the
wording, "from the city", Sec. 2.06 Subd. 3, page 3, were deleted.
VI. Because the meeting of the Commission was being delayed, due to intensive
input by the attending public, a motion was made by Neil Loeding that the
• Commission go through the charter first and make any necessary changes or
corrections, and then invite questions and or recommendations from the attending
public. Seconded by L. Nygaard.

• VII. Commission proceeded to review the charter, chapter by chapter.
On page 6, in sections 3.06 and 3.07, the word "passed" wherever written was
changed to the word "adopted".
Sec. 5.02, page 11, line 7, sentence altered to read: "that each signature
appended thereto was made in his/her presence and that the circulator believes
them to be the genuine signature of the person whose name it purports to be".
Sec. 5.04, Page 12, lines 4 and 5 altered to read: "Within five days of receipt
of the corrected petition, the clerk-administrator shall again report to the
council". "If the council finds that the petition is still insufficient"
C. Ziebarth does not concur with change.
Sec. 8.03, page 25, delete the word "passage" and replace with the word
"adoption", line 6.
Sec. 8.04, Subd. 1, second line, the word "petition" to replace the words,
• "written request", and in third line, the words "at least" to replace the
words "not less than". (Page 25)
With reference to Sec. 8.04, Subd. 1, page 26, C. Ziebarth made a motion to
delete the word "remonstrance", wherever it appeared, and substitute the word,
"petition". Seconded by D. McCarty.
Following discussion, a motion was made by N. Loeding, seconded by B. Werner,
to amend the motion of C. Ziebarth to also delete the word "request", wherever
it appeared, and substitute the word "petition", in order to be consistent.
Vie on amendment: Unanimous. Passed.
Vote on original motion: Unanimous. Passed.
The word "remonstrance" was changed to "petition" end of line 3 in Subd. 2,
Sec. 8.04.
Sec. 8.04, Subd. 1, on page 26, beginning on top of page, entire new sentence
added before the sentence beginning with "At such hearing "
Sentence added: "Failure to give mailed notice, or any defects in the notice,
shall not invalidate the proceedings".

• VII. Sec. 8.04, Subd. 1, page 26, reworded. Refer to. new Draft of Charter
dated 10/6/79 for rewording due to various word deletions and substitutions.
There was a great deal of discussion and input by the attending public on
Sec. 8.04, subdivisions, 1 and. 2.
Because of this, a motion was made by C. Ziebarth that Chapter 8, "Public
Improvements and Special Assessments", be referred to a bonding attorney for
review, and that the Chairman, Bill Doty, be responsible for submitting
Chapter 8 to the proper attorney. Seconded by D. McCarty.
Following discussion, D. McCarty requested permission to withdraw his second.
VOTE: (6) Ayes (1) Nay - C. Ziebarth. (Not voting - D. McCarty)
The chairman called for another second to the motion presented by C. Ziebarth.
There not being a second, motion failed.
Sec. 10.03, page 28, 4th line in paragraph, add the words, "city newsletter
and in the", thus reading: "in the city newsletter and in the official news-
paper not less than ten days prior to"
• Sec. 12.14. , page 33, delete the word "passage"passage and substitute the word
"adoption".
The chairman called a meeting of the Commission for next Thursday, October 11,
1979, at 7:00 P.M.
Motion made by B. Werner, seconded by D. McCarty, to adjourn the meeting.
Vote: Unanimous. Meeting adjourned at 12:30 A.M.
