The Mounds View Charter Commission acting under Minnesota Statutes 410.12 Subdivision 7, hereby recommends amending the Charter of the City of Mounds View under Section 2.07, Subsection 1 and Subsection 2 and is amended by the addition of the bold and underlined language and by the deletion of the language to read as follows; Section 2.07. Salaries Compensation. The Mayor and councilmembers shall receive such compensation as is fixed by the Council '• ; . • • • • • , • • ordinance. The ordinance shall state the dollar amount of all compensation and shall be passed at least 60 days prior to the next regularly scheduled municipal election. Any increases in such compensation shall not become affective until after the next-municipal election following January r`. Other officers and employees of the City shall receive such salaries or wages as may be fixed by the Council. Subsection 1. Compensation thus fixed by ordinance shall remain in effect until changed by similar action. Subsection 2. Public hearing. Before the compensation ordinance is adopted the Council shall hold a public hearing on the matter. Notice of such hearing shall be published at least once in the official City newspaper not less than ten days prior to the date of the public hearing. Ord 661 re: Amendments to the Charter relating to City Manager form of government, and; Ord 662 re; Amendment to the Charter relating to Council Composition. These proposed Charter amendments were passed June 5, 2000, and published June 15, 2000. They were mailed to Julie Olsen for consideration by the Charter June 20, 2000. These ords need to be on the ballot in November. Dan believes that the Charter Commission has 60 days to review the ords and may request additional time for review. Dan would like to know what the dates are that we should expect to hear back from the Charter. (Givonna Reed] MN Stat. 410.12 subd. 5 says the Charter Commission gets 60 days after the proposed amendments are submitted to review the amendments. Because they are allowed days of mail time we would start counting from June 23rd, 2000. The Charter Commission can request an additional 90 within the 60 day timeframe. If the Charter Commisison sends its comments to the Council within that 90 days, the Council can move. If the Charter Commission does nothing within the first 60 days the Council can move to put the questions on the ballot. Just a reminder: we must have all ballot questions approved by the City Attorney and submitted to the County by Sept. 19th. 2. Also, the Charter Commission should be reviewing a proposed Charter Amendment to Section 3.01 (Meetings of the City Council). This was mailed to them June 2, 2000. Is there a"trigger date"when the Council could take action if it does not hear back from the Charter Commission on this issue? ('Givonna Reed] (Dan, this may have been my question to Scott.) (Givonna Reed] MN Stat. 410.12 subd 7 does not indicate that the City could take action after a"trigger date". The process simply falls apart if the Council and Charter Commission do not agree on something. 3. When can we expect the updated Code? (Givonna Reed] Probably not next week, but possibly the week after. This is a priority for K&G. 4. When can we expect the letter to the Charter Commission explaining why they were (and could be in the future) denied space in the Mounds View Matters? I'm attaching a letter I've prepared for Scott Riggs regarding our pending code update. Revisions to the code were just started today so I was preparing to send hard copies of ordinances (and affidavits of publication)that have been passed in the last couple months. There were no affidavits of publication in the records room for ordinances 655-657 and 660. If you have the affidavits of publication please send them, along with hard and electronic copies of each of the ordinances to Scott. In addition, the ord log book indicates that ords 649, 650, 650, 661 and 662 are or will become effective in the near future. To my understanding these are all proposed Charter Amendments and must be approved by the Charter Commission and/or voters in order to become effective. For record keeping purposes it may be in our best interest to remove the effective dates for these ordinances from the log book to avoid confusion. Also, find out whether the language associated with "ordinance" 648 (I don't think it ever made it to becoming an official ordinance) is "dead". If so, reference to that language should be taken out of the log book. Regarding ords 634 and 643 (Franchise Fee ordinances)...if I remember correctly both were passed but replaced (because of technical errors) by ord 660. Check with Scott to find out whether the Council should be taking some"official action"to void ords 634 and 643 and, if so, find out what that process entails. In any case, for the log and the official ordinance book you should in some way indicate that the ordinances are "null and void"and have been replaced by ord 660. The Charter and Franchise Fee issues are a little complex so make sure you work closely with Scott on them. Subdivision 2. The City Council of the City of Mounds View, its Economic Development Authority,or any housing or redevelopment authority, or any other agency or instrumentality of the city,may not approve the geographic expansion of an existing Tax Increment Financing District,the addition of any new projects to an existing Tax Increment Financing District, or the granting of any economic subsidy or the granting of an new tax abatements if such a• •royal would cause the a• •re•ate amount of ca•tured net tax capacity for all Tax Increment Financing Districts located in the City of Mounds View to exceed 10 percent of the total tax capacity of the city.
