Motion by B. Doty, second by J. Miller to approve the Agenda as presented
APPROVED
Motion by B. Thomas, second by C. Mueller. to approve minutes of May 2, 2006 as
amended with the following:

Chair J. Thomas reported he will be absent from the July 2006 meeting.
6. Reports of Members
C. Mueller reported there was a nice presence of citizens at the going away party for
• Duane McCarty and his wife. Duane was/both an original Charter Commission
member and helped draft the original charter. He also has served on the Council and in
many other civic roles.
B. Thomas reported that the Council had approved Ordinance 772. which is Charter
Commission Resolution 2006-05 for Chapter 7 updates previously approved by this
Commission.
7. Unfinished Business
a. Discussion of Chapter 7.03..nesolution 2006-06
B. Amundsen '- e__ :- .:e_t whether the proposed updates to Section 7.03
and 7.10 should be done by resolution for a Ballot or by simple Council Ordinance?
Chair J. Thomas discussed how Section 7.10 could. in his opinion, be updated by
Ordinance, but that because of the extensive added language and levy restrictions that the
citizens should vote on the 7.03 changes.
Motion by B. Thomas, second by J. Miller. that Resolution 2006-06 only include Section
7.03 language for a ballot question. APPROVED
Discussion changed to ballot language presentation. Chair J. Thomas indicated that the
entire language of 7.03 would be on the ballot in fine print, with a summary item for the
citizens to vote approval or rejection. C. Mueller requested that communication about
the ballot item include the definition from the League of Minnesota Cities Handbook
Chapter 4 of"Home Rule Charter City-. Consensus was to include that language.

Revision—Draft 20060502 is presented here in line order:
1. Line 3 deletion existing language and change to ". . ."
2. Line 4 to 5, drop language.
3. Line 18, move"12 month"to before"average", replace from "immediate past"to
"May 31" with "most recently published data."
4. Line 19, insert"the"before "Consumer".
5. Line 45, correct spelling of"Valuation" and move "Building and Zoning Permit or
Inspection and Planning fees"to line 51. . .
6. Line 46. drop "Community Center fees".
7. Line 52 move, "charges collected by direction of the State, County or other taxation
authority or by joint powers agreements"to Line 54 and start the sentence with "The
term "fee" does not include...".
8. Line 79, insert a colon at the end of the line.
9. Line 81 move "or"to a new line and add lines 84 and 85 after"increase".
10. Line 84 remove number "3" and move line up to line 83 as a continuation to the
second option.
11. Line 88 combine "in" and "to"to "into".
12. Line 102, drop the "s"on "moneys".

Discussion moved to the Resolution 2006-06 language.
Language changes as follows:
1. Drop "DRAFT".
• 2. Change Subdivision reference to "1" not "7".
3. Drop "of the" before "deletion."
4. Change the segment that reads "The Mounds View Charter Commission requests the
City Council adopt by ordinance those items it is in unanimous agreement with."
to read: "The Mounds View Charter Commission requests the City Council prepare
the following Charter language amendment for a ballot and have it placed before the
voters at the next general election."
5. Change "60"to "30".
6. Under Objectives, delete item 3) and all of its language.
7. In last paragraph, drop the word "two" and the"s" in "sections".
8. Change "are" to "is".
9. Place a period at the end of the line after "attached".
10. Drop the remaining phrase of the sentence starting with "by section and
recommended for adoption..." to the end of that paragraph.
Motion by B. Thomas, second by B. Doty to approve Resolution 2006-06 as amended
with the language of 7.03 as amended this evening. APPROVED
Discussion then moved to time line and the next steps for this language. Chair J. Tho as
indicated that the resolution and language would be corrected and forwarded to legal
review before being sent to the Council. It was discussed that the target was to get the
language to the Council for Monday July 10th, and if there were questions the Charter
Commission could review on July lit''. the next regularly scheduled meeting. _

b. Review Chapter 5 Updates. f
Chair J. Thomas introduced new language from Scott Riggs!�ityvegal could. which
could be added in Section 5.01 after the MN Statute 410.20 reference. It was suggested
the language be an endnote and be included with an "*"any time we reference 410.20.
Members reviewed the letter from Mr Riggs and agreed to include the following in the
endnote. "Minnesota courts have limited the powers of initiative and referendum to
ordinances which are legislative in character. General legislative acts lay down some
permanent and uniform rule of law, administrative acts relate to daily administration of
municipal affairs, and quasi judicial acts are the product of investigation, consideration
and deliberate human judgment based upon evidentiary facts of some sort."
Discussion then moved to focus on Revision —DRAFT 20060502_2 language and
changes approved by consensus are reported here in line order sequence and not in order
discussed.
1. Line 78, add previously discussed endnote "*" after"General Voter Authority.".
2. Line 113, place a colon after"following" and move "required number of signatures"to
each of the bulleted items following.
3. Line 114 to 117, intent the language for readability.
4. Line 151, add previously discussed endnote "*" after"Initiative.".
5. Line 167, add "and 5.04"after"5.03".
6. Line 168 place a comma after "ordinance"and "charter", add "normal ordinance"
before"adoption process", place comma after"adoption process" and insert "which
does not exclude the referendum process defined in 5.07,".
7. Line 186. add"normal ordinance" before "adoption process", place comma after
"adoption process" and insert "which does not exclude the referendum process
defined in 5.07.".
Chair J. Thomas requested all members review the suggested language changes and the
flow charts planned to be in the appendix for consistent language and process flow. He
asked members to call him directly with any suggested changes.
c. Review Resolution 2006-04 Practices for Documentation Modifications.
Discussion focused on language changes.
1. At the top of the resolution, correct the date to June 13, 2006 and drop "DRAFT"
2. In paragraph 1, sentence 2, add "therefore"before "adopts" and drop second period at
end of sentence.
3. In item 8, make "deletion"plural and correct spelling of"fist"to "first."
4. In item 9, add a comma after"complete- and change"striked"to "stricken"
Motion by B. Doty, second by C. Mueller to approve the Resolution 2006-04 on
Commission Documentation Practices. APPROVED

for housekeeping and clarification updates to sections of the Mounds View Charter that
have caused confusion or seem to be semantically incorrect.

requests for housekeeping and clarification updates to sections of the Mounds View
Charter that have caused confusion or seem to be semantically incorrect. The
Charter Commission Mounds View Charter Commission adopts and recommends the following practices
for document modifications going forward. .

Jonathan J Thomas 1. The Charter Commission Secretary or Assistant Secretary will maintain and

Vice Chair 2. The beginning of the document shall maintain a numerical listing of the Charter
Bill Doty Commission Objective(s) and a one sentence explanation for each change to a

3. Until approved by the Commission resolution, all documents will have a
2nd Vice Chair "DRAFT"header label and the revision date of the last changes applied to the
Jean Miller document. The page number and total pages of the document will also be
763-786-3959 included in the header information.
Secretary 4. Language usage, syntax and definitions follow Minnesota Statue 645.

27 Section 3.05. Procedure on Ordinances. Every proposed ordinance shall be presented in
28 writing and read in full before adoption,unless the reading is dispensed with by unanimous consent of
29 the Council. No ordinance shall contain more than one subject. Such subject shall be clearly expressed
30 in its title. The enacting clause shall be "The City of Mounds View ordains". No ordinance,except an

While I wanted to discuss this matter with you prior to forwarding,here are my initial attempts at
drafting some language for the charter issues that we discussed earlier this week:
1. Minnesota Statutes Section 410.20 applicability to Charter Sections 5.01,5.05 and 5.07.
A possible footnote for Charter Sections 5.01,5.05 and 5.07 would be as follows:
Despite the language of Minnesota Statutes Section 410.20, upon which Charter
Section 5.05 and Section 5.07 are based, Minnesota courts have limited the powers of
initiative and referendum to ordinances which are legislative in character. In
determining whether an ordinance is legislative and potentially subject to the initiative
or referendum process, Minnesota courts have distinguished between legislative,
administrative and quasi-judicial acts of a city. General legislative acts lay down some
permanent and uniform rule of law, administrative acts relate to daily administration of
municipal affairs, and quasi-judicial acts are the product of investigation, consideration
and deliberate human judgment based upon evidentiary facts of some sort.
2. Standard language for the enacting clause of an ordinance that contemplates a"suspension"time
period in the event of a referendum challenge.
The following may work as standard language for the enacting clause of an ordinance:
SECTION ??. This Ordinance becomes effective thirty (30) days after its
publication in the official City newspaper, unless challenged by a petition for
referendum pursuant to Chapter 5 of the City of Mounds View Charter, wherein the
Ordinance shall take effect consistent with the requirements of Chapter 5 of the Charter.
