HomeMy WebLinkAboutResolution 7136RESOLUTION NO. 7136 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION APPROVING A WETLAND BUFFER PERMIT FOR A BILLBOARD LOCATED ON SYSCO OUTLOT A, REQUESTED BY CLEAR CHANNEL OUTDOOR; PLANNING CASE NO. WB07-001. WHEREAS, Glear Channel Outdoor, the Applicant, has requested a Wetland Buffer Permit to allow for the construction of a billboard on SYSCO Outlot A, , as shown on the attached survey labeled Exhibit A; and, WHEREAS, the proposed billboard location is consistent with the amended and restated acquisition and relocation agreement between the City of Mounds View and the Applicant; and, WHEREAS, Section 1010.08 of the Municipal Code states that a Wetland Buffer Permit is required when any development activity occurs within 100 feet of a wetland; and, WHEREAS, the City Council has found that wetlands within the City, as part of the ecosystem, are critics! to the present and future health, safety and general welfare of the land, animals and people within the City, as well as within the Rice Creek Watershed District; and, WHEREAS, the proposed billboard satisfies the requirements of the Zoning Code and Building Code; and, WHEREAS, the proposal satisfies all of the wetland requirements of Chapter 1010; and, WHEREAS, on April 23, 2007, the Mounds View City Council approved Resolution 7059, a resolution approving an Interim Use Permit to constructthe proposed billboard, with stipulations. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council approves the Wetland Buffer Permit requested by Clear Channel Outdoor to construct the proposed billboard to be located on SYSCO Outlot A alongside Trunk Highway 10 in the City of Mounds View, and the pervious access road to service said billboard. a. Only clean fill, if any is needed, shall be brought onto the site. b. No waste, construction or otherwise, shall be allowed to enter into the wetland or any adjoining areas. c. The construction of the billboard shall not impede or otherwise restrict the natural flow of surface water and stormwater runoff. Resolution 7136 Page 2 d. No grading or disturbance of any kind shall be allowed within any delineated wetlands and adjacent ditch. e. The applicant shall install adequate erosion control devices during construction and shall revegetate all disturbed areas, maintaining said erosion prevention measures until the new vegetation has stabilized, Adopted this 13th day of August, 2007.
