HomeMy WebLinkAboutResolution 7127RESOLUTION NO. 7127 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING THE COMMON INTEREST COMMUNITY PLAT FOR THE SUBDIViS10N OF 5360 EDGEWOOD DRIVE; MOUNDS VIEW PLANNING CASE NO. MA07-003 WHEREAS, Silverview Chiropractic has applied for the approval of a common interest community plat consistent with Minnesota Statutes Chapter 5156 of 5360 Edgewood Drive; and WHEREAS, the plat date-stamped October 25, 2006, proposes a five lot subdivision to be called MOUNDS VIEW CITY CENTER SUITES (the "CIC Plat"); and WHEREAS, the subject parcel is legally described as follows: Lot 2, Block 2, MOUNDS VIEW CITY HALL ADD1TlON, Ramsey County, Minnesota WHEREAS, the parcel is zoned PUD, Planned Unit Development and the adopted Comprehensive Plan designates the parcel for Community Commercial Planned Unit Development; and WHEREAS, the City is in the process of clarifying the application of the City's subdivision regulations of Title 1200 of the Mounds View Municipal Code to a common interest community plat in general; and WHEREAS, the proposed CIC Plat generally complies with the relevant provisions of the City's subdivision regulations; and WHEREAS, pursuant to City Council Resolution 7126, the City Council must approve the division of land as contemplated herein as a CIC Plat; and NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council approves the CIC Plat entitled MOUNDS VIEW CITY CENTER SUITES located at Edgewood Drive, subject to the following conditions: 1. Pursuant to City Council Resolution 7126, this Resolution shall act as the City Council's approval of the division of land as contemplated herein as a common interest community. plat. 2. The applicant shall arrange to have an acceptable title commitment provided to the City Attorney for review prior to the final plat approval by the City Council. 314827v3 S1R MU210-144 1 3. All utilities within the development area and to the individual units shall be located underground. 4. The approval of the CIC Plat as contemplated herein is subject to the requirement that all documents necessary and relevant for creating the CIC Plat pursuant to Minnesota Statutes have been completed and properly filed. 5. The applicant shall file the CIC Plat no later than 6 months after the date of approval of this Resolution, or the CIC Plat approval will become null and void. 6. The proper City officials are authorized to execute on behalf of the City the C{C Plat and any other necessary documents and to take any and all other steps necessary or convenient in order to carry out the intent of this Resolution and City staff arid consultants are authorized to take all necessary further action in order to carry out the intent of this Resolution. 7. The recitals set forth above in this Resolution are incorporated into and made part of this Resolution. Adopted this 23~d day of July, 2007.
