Meeting Conclusion Item No: ___5A Meeting Date: Nov 7, 2018 Type of Business: Planning Case VR2018-001 City of Mounds View Staff Report To: Mounds View Planning Commission From: Jon Sevald, Community Development Director Item Title/Subject: PUBLIC HEARING: Resolution 1087-18, Approval of a Variance to Reduce the Parking Lot Setback for Edgewood Middle School Introduction The Mounds View School District has proposed additions onto Edgewood Middle School, located at 5100 Edgewood Dr, to include an indoor swimming pool, gymnasium, classrooms, and science lab. Additionally, the north parking lot is proposed to be expanded, necessitating a Variance to allow a 0’ setback from the property line along Edgewood Drive. Discussion The current indoor pool is located in the southeast corner of the school. This pool will be closed, and space re-allocated for other uses. The new indoor pool and gymnasium addition will be located on the north end of the school, currently occupied by an 86 stall parking lot. The building addition will displace 47 of those stalls. To compensate, the parking lot is proposed to be expanded to 120 stalls, consuming most of the green space in this corner of the property. A 0’ setback to the property line with Edgewood Drive is proposed. If approved, the 0’ setback would match that of the existing parking lot in front of the school. Analysis A Variance is the waiving of literal provisions of the Zoning Code in instances where their strict enforcement would cause practical difficulties because of unique circumstances related to the property.1 Within the R-1 zoning district, a 30’ setback for parking lots is required for properties exceeding 2.5 acres 2 (the property is 34.5 acres). If the parking lot were set back 30’ from the property line, it would reduce the proposed parking lot from 120 stalls to 99 stalls. Although the City Code requires 87 stalls for the swimming pool 3, it is anticipated that the pool will be used at the same time as the gymnasium, tennis courts, and practice fields. If the parking lot were set back 30’, it is likely that overflow parking would occur along Edgewood Drive resulting in a greater distance from the building entrances. 1 City Code, Section 1102.02, Subd 129 (Variance) 2 City Code, Section 1104.01, Subd 4 (c)(1)(b)(ii) (Parking Areas in R-1 District, for sites greater than 2.5 acres) 3 City Code, Section 1121.13 (public swimming pool) Item 05A Page 2 The intent of the 30’ setback is to allow for a greenspace buffer between the parking lot and the property line. However, Staff agrees that the highest and best use of this area of the property is to maximize parking near the Gymnasium and Pool entrance. As compensation for lost greenspace, Staff is recommending that trees and shrubs be installed in areas near the gym/pool entrance, east parking lot entrance, and along the south driveway. This recommendation is included in Item 5C of tonight’s agenda (Development Review). A Variance may be granted only in the event that all of the criteria 4 for granting a Variance is met (please refer to the attached Resolution). Summary The Mounds View School district has proposed building additions and improvements to Edgewood Middle School, including the expansion of the north parking lot, necessitating a Variance to reduce the parking lot setback from 30’ to 0’ along Edgewood Drive. A Public Hearing Notice was mailed to property owners within 350’ of the subject property, and published in the October 26, 2018 edition of the Mounds View/New Brighton Sun Focus. Recommendation Staff recommends approval of Resolution 1087-18, approving a Variance to reduce the parking lot setback from 30’ to 0’. The Planning Commission is requested to conduct a Public Hearing, and consider the following options: 1. Approve Resolution 1087-18, approval of the Variance. 2. Deny Resolution 1087-18, denying the Variance, with cause. If the Commission chooses this option, Findings of Facts are needed to justify the denial. 3. Table the request. If additional information is needed before a decision can be rendered or if more discussion is needed, the Commission can simply move to table the request until such information has been provided. Because of the 60-day requirements (Deadline: Dec 17, 2018) the Commission would need to act upon the request as soon as reasonably possible to avoid an inadvertent approval. MOUNDS VIEW PLANNING COMMISSION RESOLUTION 1087-18 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION APPROVING A VARIANCE TO REDUCE THE PARKING LOT SETBACK FROM 30-FEET TO 0-FEET FOR EDGEWOOD MIDDLE SCHOOL, LOCATED AT 5100 EDGEWOOD DRIVE, (PLANNING CASE VR2018-001) WHEREAS, additions and improvements to Edgewood Middle School are planned, including a gymnasium, indoor swimming pool, and expansion of a parking lot to serve these additions; and, WHEREAS, the City of Mounds View City Code, Section 1104.01, Subd 4(c)(1)(b)(ii) requires that sites having more than 2.5 acres of land, provide a minimum 30’ setback for non- residential parking areas within a residential district; and, WHEREAS, Edgewood Middle School is located on 34.5 acres, and zoned R-1 Single- Family Residential. The property is located at 5100 Edgewood Drive, legally described as: PID: 08-30-23-34-0003 Unplatted lands, Subject to Road and easements and except east 640 feet of south 190 feet of the south east ¼ of southwest ¼ of Section 8, Township 30, Range 23 WHEREAS, Wold Architects and Engineers, representing the Mound View Independent School District 621, has requested a Variance to reduce the setback of the north parking lot from 30’ to 0’, along Edgewood Drive; and, WHEREAS, the City of Mounds View City Code, Section 1125.02 provides the Planning Commission, acting as the Board of Adjustment and Appeals, authority to approve Variances to the City Code in instances where their strict enforcement would cause practical difficulties because of unique circumstances related to the individual property under consideration; and, WHEREAS, the City of Mounds View City Code, Section 1125.02, Subd 2 provides the Criteria for Granting a Variance (Findings in italics); Resolution 1087-18 Page 2 a. The variance is in harmony with the general purposes and intent of this Title. Finding: The school includes an existing parking lot located along Edgewood Drive, which has a 0’ setback. This parking lot is believed to have existed where- is since the school was built in 1958, predating many of the adjacent homes. The requested Variance will allow the north parking lot to expand, matching the 0’ setback of the aforementioned parking lot. The lack of a greenspace buffer between the property line and the north parking lot will not substantially impact adjacent properties, and is thereby in harmony with the general purposes and intent of this Title. b. The variance is consistent with the Comprehensive Plan. General Land Use Goal 1: Maintain a cohesive land use pattern that ensures compatibility and functional relationships between activities and uses. Policy k: Require and maintain buffering and visual separation between differing land uses, when possible. Finding: The north parking lot provides daytime parking for staff, and night-time parking for activities at the swimming pool, gymnasium, tennis courts, and practice fields. The reduced setback is necessary to allow the parking lot to expand, sufficiently serving these needs. Public Facilities Goal 1: Plan public facilities and services in a coordinated and economic manner on a basis that is consistent with the nature of development in the city. Policy b. The City should require adequate screening, landscaping and buffering of public facilities to limit their impact on surrounding uses and to enhance the area where they are located. Finding: The reduced parking lot setback will not significantly impact the appearance of the school property as viewed from the adjacent homes across Edgewood Drive. The north parking lot to be expanded will look similar to the existing parking lot in front of the school, which has a similar 0’ setback. Resolution 1087-18 Page 3 c. The applicant proposes to use the property in a reasonable manner not permitted by this Title or the City Code. Finding: The request is a reasonable use. d. Unique circumstances apply to the property which do not apply to other properties in the same zone or vicinity and result from lot size or shape, topography or other circumstances over which the owner of the property since the enactment of this Title has had no control. The unique circumstances do not result from the actions of the applicant. Finding: Unique circumstances include the use of the property as a school. Although these circumstances are a result of the applicant (School District), if the parking lot is not expanded into the setback (landscaped buffer), additional overflow parking is likely to occur on Edgewood Drive, thereby impeding the view of the landscaped buffer from adjacent homes, and defeating the setback’s purpose as a greenspace buffer. e. The variance does not alter the essential character of the neighborhood. Finding: The variance will not alter the character of the neighborhood. The proposed 0’ parking lot setback will match the 0’ setback of the parking lot located in front of the school. f. The variance requested is the minimum variance which would alleviate the practical difficulties. Economic conditions alone do not constitute practical difficulties. Finding: The variance requested, is the minimum which would alleviate the practical difficulties. g. The Board of Adjustment and Appeals may impose such conditions upon the premises benefited by a variance as may be necessary to comply with the standards established by this Title or to reduce or minimize the effect of such variance upon other properties in the neighborhood and to better carry out the intent of the variance. The condition must be directly related to and must bear a rough proportionality to the impact created by the variance. NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission, based upon the above findings, the staff report, and in consideration of public testimony, approves a Variance for a 0’ setback for a parking lot for Edgewood Middle School, located at 5100 Edgewood Drive, subject to the following conditions: Resolution 1087-18 Page 4 1. The parking lot will be constructed in compliance with the City Code, and consistent with the Site Plan, dated October 15, 2018. 2. The work approved shall commence within one year of the date of this Variance unless an extension is granted in accordance with City Code, section 1125.02. Subd 5 (Lapse of Variance or Appeal), or approval of this Variance shall become void. Additionally, the east parking lot and driveway (bus entrance) will be replaced. The applicant is requesting an Administrative Variance to exceed the maximum driveway width permitted. Discussion Currently, the school bus loading area is in the west parking lot in front of the school. The parent pick-up & drop-off area is in front of the school on Edgewood Drive, contributing to traffic congestion. The school district proposes to move the bus loading area to the east side (rear) of the school, and reconstructing the east parking lot and driveway accessing onto Co Rd H. The school is requesting a 38’ wide driveway curb-cut on Co Rd H, whereas the maximum permitted is 32’.1 The wider driveway is to accommodate three lanes of traffic (one in and two out). Analysis An Administrative Variance may be preliminarily approved by the Community Development Director, if the request meets the criteria for granting a variance; is within an R-1 or R-2 zoning district; and either; (1) concerns a setback that is within 25% of code requirements and does not result in a setback of less than 5’; or, is related to a pre-existing, non-conforming driveway or curb cut.2 The existing driveway is pre-existing, and non-conforming due to its lack of curbing, in addition to not meeting design standards for its planned intensive use by busses. The process of affirming approval of an Administrative Variance is very similar to the process of approving a normal Variance, with the exception that a Public Hearing is not required. It is required to notify the adjacent property owners. That said, all property owners within 350’ of the subject property were notified, in conjunction with the mailing of a Public Hearing notice for the Variance request (parking lot setback) 1 City Code, Section 1121.09, Subd 5(b) (Public Parks & Preservation Areas) 2 City Code, Section 1125.02, Subd 6 (Administrative Variance Procedures) Item 05B Page 2 A Variance may be granted only in the event that all of the criteria 3 for granting a Variance is met (please refer to the attached Resolution). Recommendation Staff recommends approval of Resolution 1088-18, affirming the Administrative Variance approval. The Planning Commission is requested to consider the following options: 1. Approving Resolution 1088-18, affirming approval of the Administrative Variance. 2. Deny Resolution 1088-18, and redirect the applicant to apply for a Variance. 3. Table the request. If additional information is needed before a decision can be rendered or if more discussion is needed, the Commission can simply move to table the request until such information has been provided. MOUNDS VIEW PLANNING COMMISSION RESOLUTION 1088-18 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION AFFIRMING APPROVAL OF AN ADMINISTRATIVE VARIANCE FOR A 38-FOOT WIDE DRIVEWAY FOR EDGEWOOD MIDDLE SCHOOL, LOCATED AT 5100 EDGEWOOD DRIVE (PLANNING CASE AV2018-001) WHEREAS, additions and improvements to Edgewood Middle School are planned, including the reconstruction of the east parking lot and driveway, serving buses and passenger vehicles; and, WHEREAS, the City of Mounds View City Code, Section 1121.09, Subd 5(b) (Public Parks & Preservation Areas) permits a maximum curb cut width of 32’ for public parks and preservation areas within the R-1 Single-Family Residential zoning district; and WHEREAS, Wold Architects and Engineers, representing the Mound View Independent School District 621, has requested an Administrative Variance to allow a 38’ wide curb cut for a driveway at Edgewood Middle School. The driveway is to be located along County Road H. Finding: The request is not specifically addressed by the Comprehensive Plan, but is consistent with the following Goal and Policy; Transportation Goals and Policies Goal 1: Identify the improvements necessary to ensure the continued safety and convenience of the transportation system for movement by all modes. Policy a. Maintain transportation facilities to function in a manner compatible with adjacent land uses. When the function of a transportation facility has changed over time to become incompatible with adjacent land uses, the City should establish a program to address this incompatibility. The widen driveway improves the safe and convenient ingress/egress of school buses, thereby improving the functionality of the intersection of the driveway and County Road H. c. The applicant proposes to use the property in a reasonable manner not permitted by this Title or the City Code. Finding: The request is a reasonable use. d. Unique circumstances apply to the property which do not apply to other properties in the same zone or vicinity and result from lot size or shape, topography or other circumstances over which the owner of the property since the enactment of this Title has had no control. The unique circumstances do not result from the actions of the applicant. Resolution 1088-18 Page 3 Finding: Unique circumstances include the use of the property as a school. The school experiences times of heavy traffic congestion. The applicant intends to separate the bus pick-up/drop-off area from the parent pick-up/drop-off area by moving the bus access from Edgewood Drive onto County Road H. County Road H is a busier road. The wider driveway will accommodate right and left turn lanes onto the road, allowing buses to exit the property more efficiently. e. The variance does not alter the essential character of the neighborhood. Finding: The variance will not alter the character of the neighborhood, as there is currently a driveway in the same location. f. The variance requested is the minimum variance which would alleviate the practical difficulties. Economic conditions alone do not constitute practical difficulties. Finding: The variance requested to exceed the maximum driveway width from 32’ to 38’, is the minimum needed to alleviate the practical difficulty of accommodating three lanes of traffic. g. The Board of Adjustment and Appeals may impose such conditions upon the premises benefited by a variance as may be necessary to comply with the standards established by this Title or to reduce or minimize the effect of such variance upon other properties in the neighborhood and to better carry out the intent of the variance. Discussion A Development Review by the Planning Commission and City Council is required for building additions of 10,000 sq ft or 10% (excludes single-family, and two-family dwellings). The proposed additions consist of 39,735 sq ft, or 36%. A Development Review is a review for compliance with applicable sections of the City Code.1 The Planning Commission has reviewed a number of Development Reviews in recent years for properties within the County Road 10 Corridor Overlay District. However, since this project is within the R-1 district, and not within the overlay district, there are few zoning requirements. Analysis Zoning The property is zoned R-1, Single-Family Residential. “Public educational institutions” are a conditional use. The school was built in 1958, and swimming pool in 1966. A CUP was approved in 1982 for a “community resource center” (Resolution 1493). In 1982, the school had closed, and the community resource center relocated from New Brighton Elementary School (closed) to Edgewood. 1 City Code, Section 1006.06, Subd 3(a) (Development Plan) Item 05C Page 2 A CUP and Development Review were approved in 2002 for a 12,000 sq ft addition (administration, media center, computer lab, classrooms, loading dock), (Resolution 5688, revised by Resolution 5890). Comprehensive Plan The property is guided as “Institutional”. Utility Service Utilities are existing. Surface Water Drainage A storm water infiltration basin will be located near the east parking lot, currently occupied by a practice field. Underground storage units will be located under the north and east parking lots. This will elevate the east parking lot so that the grade more closely matches the building entrance. Erosion & Sediment Control Included in the plan set. Streets: The City plans to reconstruct Woodale Dr in 2019. The project has not been designed yet. Consideration is needed for parking, bike lane, etc. This will have an impact on the school use, and construction access. Driveways Woodale Dr: New driveway at Greenfield Ave to service the north parking lot. Co Rd H: Driveway will be reconstructed (1 lane in, 2 lanes out). An Administrative Variance has been requested to allow an increased width from 32’ to 38’. Trails Edgewood Dr Existing. Co Rd H No sidewalk exists, or is proposed. There is an existing trail along the south side of Co Rd H (Long Lake Regional Park) Along the south driveway will be a sidewalk connecting Co Rd H and the school building. Ramsey County is reviewing the feasibility of a crosswalk across Co Rd H. Item 05C Page 3 Woodale Dr New sidewalk between Edgewood Drive and parking lot driveway. Parking Required Proposed School 58 2 226 Pool 87 3 TOTAL 145 4 A Variance has been requested for the north parking lot, to reduce the setback from 30’ to 0’ along Edgewood Drive, such that this parking lot would be set back the same as the existing parking lot in front of the school. Landscaping Within the R-1 district, there are no landscaping requirements, other than establishing a lawn. Disturbed areas are proposed to be sodded. Staff is recommending that trees and shrubs be installed in high traffic pedestrian areas (yellow highlighted at left): 1. Shrubs between north parking lot and gym. 2. Shrubs between bus loading area (east parking lot) and building. 3. Trees & shrubs in parking lot islands (north & east parking lots) 4. Ornamental trees along east side of south driveway (east parking lot). 30 trees will be removed, sporadically located throughout the construction area. A tree inventory and replacement plan is not required for projects that are one acre or more in size, and in which ten or more high value trees, or ten trees over 8” in diameter will remain. 2 City Code, Section 1121.13 (School, elementary and junior high); “At least (1) parking space for each classroom [44] plus (1) additional space for each 50 student capacity” [691 student enrollment / 50 = 14] 3 City Code, Section 1121.13 (public swimming pool) 4 In 1982, a CUP was approved to convert Edgewood Jr. High School (closed at the time) into a Community Center (Resolution 1493), and a Variance to reduce the required number of parking stalls, from 843 to 161, provided proof of parking for an additional 82 stalls was provided (Resolution 57-82). 1 2 3 4 Item 05C Page 4 About 40% of the 34.5 acre property is wooded, and is enough to compensate for lost trees. Screening & Buffering Within the R-1 district, no screening or buffering is required. Lighting Glare from exterior light cannot exceed 1.0 foot candle (fc) measured at the centerline of a street, and 0.4 fc measured at an adjacent residential property line. The lighting plan includes measurements taken within the school property, but not beyond. The plan indicates 0.5 fc measured at the school property line. It is likely that glare is well within limits, if measured at homes across the street. Excluding the pool, the building is set back 91.5’ from the Edgewood Dr ROW. The building is set back about 300’ from Woodale Dr ROW, and about 315’ from the Co Rd H ROW. Exterior Const. Resolution 1086-18, Recommending Approval of a Development Review for Central Sandblasting located at 2299 County Road H City Planner/Supervisor Sevald stated Central Sandblasting is requesting approval of a Development Review for a building addition, located at 2299 County Road H. The property currently consists of two buildings. The east building will be removed, and the west building will be added onto, expanding from 9,450 square feet to 29,500 square feet. Central Sandblasting does sandblasting and applies protective coatings onto structural metals. The business has operated at this location since 1973, employs 38 persons on two shifts at this property, with plans of growing to 45 employees after the building addition. This application excludes the adjacent property to the east, 2297 County Road H, Metal Finishers Inc. (MFI). Both businesses are owned and operated by the Herbst family. Staff reviewed the landscaping and parking plan. He recommended the Planning Commission approve the Development Review for Central Sandblasting. It was noted that Rice Creek Watershed District had granted conditional approval for the request. Commissioner Farmer questioned if the shifts were concurrent and if this would become a concern for parking. City Planner/Supervisor Sevald stated it was his understanding there was some overlap. Dennis Chartrand, Steel Structures and contractor for Central Sandblasting, reported parking was available on the MFI site for Central Sandblasting employees. Vice Chair Stevenson asked why this type of curbing was being proposed. City Planner/Supervisor Sevald reported the newer portion of the building was built in 2007 and the remainder was built in the 1970’s. He explained the B6-12 curbing was required in the last 20 years. Vice Chair Stevenson inquired if this type of curbing was common for this type of industry and parking. City Planner/Supervisor Sevald stated he does not see these too often in industrial developments. Vice Chair Stevenson questioned why B6-12 curbs were not being installed. Mr. Chartrand stated this was a matter of providing proper drainage for the site. Vice Chair Stevenson indicated he supported the proposed landscaping for the site. Commissioner Farmer asked how the City has determined the proposed curbing would not set a precedent. City Planner/Supervisor Sevald reported the ultimate decision would be made by the Planning Commission and City Council. He stated it was staff’s interpretation that only a small area of curbing would had been installed, and therefore could be supported as requested, without curbing. Commissioner Klander questioned what the surface area would be for the portion of the building that was being removed. City Planner/Supervisor Sevald explained this area would be asphalt parking and gravel.
