HomeMy WebLinkAbout1087-18MOUNDS VIEW PLANNING COMMISSION RESOLUTION 1087-18 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION APPROVING A VARIANCE TO REDUCE THE PARKING LOT SETBACK FROM 30 -FEET TO 14 -FEET FOR EDGEWOOD MIDDLE SCHOOL, LOCATED AT 5100 EDGEWOOD DRIVE, (PLANNING CASE VR2018-001) WHEREAS, additions and improvements to Edgewood Middle School are planned, including a gymnasium, indoor swimming pool, and expansion of a parking lot to serve these additions; and, WHEREAS, the City of Mounds View City Code, Section 1104.01, Subd 4(c)(1)(b)(ii) requires that sites having more than 2.5 acres of land, provide a minimum 30' setback for non- residential parking areas within a residential district; and, WHEREAS, Edgewood Middle School is located on 34.5 acres, and zoned R-1 Single - Family Residential. The property is located at 5100 Edgewood Drive, legally described as: PID: 08-30-23-34-0003 Unplatted lands, Subject to Road and easements and except east 640 feet of south 190 feet of the south east''/4 of southwest 1/4 of Section 8, Township 30, Range 23 WHEREAS, Wold Architects and Engineers, representing the Mound View Independent School District 621, has requested a Variance to reduce the setback of the north parking lot from 30' to 14', along Edgewood Drive; and, WHEREAS, the City of Mounds View City Code, Section 1125.02 provides the Planning Commission, acting as the Board of Adjustment and Appeals, authority to approve Variances to the City Code in instances where their strict enforcement would cause practical difficulties because of unique circumstances related to the individual property under consideration; and, WHEREAS, the City of Mounds View City Code, Section 1125.02, Subd 2 provides the Criteria for Granting a Variance (Findings in italics); Resolution 1087-18 Page 2 a. The variance is in harmony with the general purposes and intent of this Title. Finding: The general intent of this setback is to provide a greenspace buffer between the parking lot and the property line. The smaller greenspace buffer will not substantially impact adjacent properties, and is thereby in harmony with the general purposes and intent of this Title. The school includes an existingparking lot located along Edgewood Drive, which has a 0' setback This parking lot is believed to have existed where -is since the school was built in 1958, predating many of the adjacent homes. b. The variance is consistent with the Comprehensive Plan. General Land Use Goal 1: Maintain a cohesive land use pattern that ensures compatibility and functional relationships between activities and uses. Policy k: Require and maintain buffering and visual separation between differing land uses, when possible. Finding: The north parking lot provides daytime parking for staff, and night-time parking for activities at the swimming pool, gymnasium, tennis courts, and practice fields. The reduced setback is necessary to allow the parking lot to expand, sufficiently serving these needs. Public Facilities Goal 1: Plan public facilities and services in a coordinated and economic manner on a basis that is consistent with the nature of development in the city. Policy b. The City should require adequate screening, landscaping and buffering of public facilities to limit their impact on surrounding uses and to enhance the area where they are located. Finding: The reduced parking lot setback will not significantly impact the appearance of the school property as viewed from the adjacent homes across Edgewood Drive. Resolution 1087-18 Page 3 C. The applicant proposes to use the property in a reasonable manner not permitted by this Title or the City Code. Finding: The request is a reasonable use. d. Unique circumstances apply to the property which do not apply to other properties in the same zone or vicinity and result from lot size or shape, topography or other circumstances over which the owner of the property since the enactment of this Title has had no control. The unique circumstances do not result from the actions of the applicant. Finding: Unique circumstances include the use of the property as a school. Although these circumstances are a result of the applicant (School District), if the parking lot is not expanded into the setback (landscaped buffer), additional overflow parking is likely to occur on Edgewood Drive, thereby impeding the view of the landscaped buffer from adjacent homes, and defeating the setback's purpose as a greenspace buffer. e. The variance does not alter the essential character of the neighborhood. Finding: The variance will not alter the character of the neighborhood. f. The variance requested is the minimum variance which would alleviate the practical difficulties. Economic conditions alone do not constitute practical difficulties. Finding: The variance requested, is the minimum which would alleviate the practical difficulties. g. The Board of Adjustment and Appeals may impose such conditions upon the premises benefited by a variance as may be necessary to comply with the standards established by this Title or to reduce or minimize the effect of such variance upon other properties in the neighborhood and to better carry out the intent of the variance. The condition must be directly related to and must bear a rough proportionality to the impact created by the variance. NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission, based upon the above findings, the staff report, and in consideration of public testimony, approves a Variance for a 0' setback for a parking lot for Edgewood Middle School, located at 5100 Edgewood Drive, subject to the following conditions: Resolution 1087-18 Page 4 The parking lot will be constructed in compliance with the City Code, and consistent with the Site Plan, dated October 15, 2018. 2. The work approved shall commence within one year of the date of this Variance unless an extension is granted in accordance with City Code, section 1125,02. Subd 5 (Lapse of Variance or Appeal), or approval of this Variance shall become void.
