HomeMy WebLinkAbout1088-18la"1 KIJRyJ_M1AVA4W.XQ1Q0q RESOLUTION 1088-18 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION AFFIRMING APPROVAL OF AN ADMINISTRATIVE VARIANCE FOR A 38 -FOOT WIDE DRIVEWAY FOR EDGEWOOD MIDDLE SCHOOL, LOCATED AT 5100 EDGEWOOD DRIVE (PLANNING CASE AV2018-001) WHEREAS, additions and improvements to Edgewood Middle School are planned, including the reconstruction of the east parking lot and driveway, serving buses and passenger vehicles; and, WHEREAS, the City of Mounds View City Code, Section 1121.09, Subd 5(b) (Public Parks & Preservation Areas) permits a maximum curb cut width of 32' for public parks and preservation areas within the R-1 Single -Family Residential zoning district; and WHEREAS, Wold Architects and Engineers, representing the Mound View Independent School District 621, has requested an Administrative Variance to allow a 38' wide curb cut for a driveway at Edgewood Middle School. The driveway is to be located along County Road H. The property is located at 5100 Edgewood Drive, legally described as: PID: 08-30-23-34-0003 Unplatted lands, Subject to Road and easements and except east 640 feet of south 190 feet of the south east 11/4 of southwest 1/4 of Section 8, Township 30, Range 23 WHEREAS, the City of Mounds View City Code, Section 1125.02, Subd 6 (Administrative Variance Process) allows an Administrative Variance to be preliminarily approved by the Community Development Director provided that the property is zoned R-1 or R- 2; and if the request is related to a pre-existing, non -conforming driveway or curb cut, and provided that it meets the criteria of Section 1125.02, Subd 2, and is absent of any opposition from adjacent property owners, or the Planning Commission; and, WHEREAS, an Administrative Variance has been preliminarily approved by the Community Development Director, subject to affirmation by the Planning Commission; and, WHEREAS, notice of the Planning Commission's November 7, 2018 review of the Preliminary Approval of this Administrative Variance was mailed to property owners within 350' of the subject property; and, Resolution 1088-18 Page 2 WHEREAS, the City of Mounds View City Code, Section 1125.02, Subd 2 provides the Criteria for Granting a Variance (Findings in italics); a. The variance is in harmony with the general purposes and intent of this Title. Finding: The variance to allow a 38' wide driveway is in harmony with the City Code. The widen driveway will accommodate three lanes of traffic (one in, two out) intended to reduce the wait time of exiting school buses. b. The variance is consistent with the comprehensive plan. Finding: The request is not specifically addressed by the Comprehensive Plan, but is consistent with the following Goal and Policy; Transportation Goals and Policies Goal 1: Identify the improvements necessary to ensure the continued safety and convenience of the transportation system for movement by all modes. Policy a. Maintain transportation facilities to function in a manner compatible with adjacent land uses. When the function of a transportation facility has changed over time to become incompatible with adjacent land uses, the City should establish a program to address this incompatibility. The widen driveway improves the safe and convenient ingress/egress ofschool buses, thereby improving the functionality of the intersection of the driveway and County Road K C. The applicant proposes to use the property in a reasonable manner not permitted by this Title or the City Code. Finding: The request is a reasonable use. d. Unique circumstances apply to the property which do not apply to other properties in the same zone or vicinity and result from lot size or shape, topography or other circumstances over which the owner of the property since the enactment of this Title has had no control. The unique circumstances do not result from the actions of the applicant. Resolution 1088-18 Page 3 Finding: Unique circumstances include the use of the property as a school. The school experiences times of heavy traffic congestion. The applicant intends to separate the bus pick-up/drop-off area from the parent pick-up/drop-off area by moving the bus access from Edgewood Drive onto County Road H. County Road H is a busier road. The wider driveway will accommodate right and left turn lanes onto the road, allowing buses to exit the property more efficiently. e. The variance does not alter the essential character of the neighborhood. Finding: The variance will not alter the character of the neighborhood, as there is currently a driveway in the same location. The variance requested is the minimum variance which would alleviate the practical difficulties. Economic conditions alone do not constitute practical difficulties. Finding: The variance requested to exceed the maximum driveway width from 32' to 38, is the minimum needed to alleviate the practical difficulty of accommodating three lanes of traffic. g. The Board of Adjustment and Appeals may impose such conditions upon the premises benefited by a variance as may be necessary to comply with the standards established by this Title or to reduce or minimize the effect of such variance upon other properties in the neighborhood and to better carry out the intent of the variance. The condition must be directly related to and must bear a rough proportionality to the impact created by the variance. NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission, based upon the above findings, the staff report, and in consideration of public testimony, affirms the approval of an Administrative Variance for a 38' wide driveway for Edgewood Middle School, located at 5100 Edgewood Drive, subject to the following conditions: The driveway will be constructed in compliance with the City Code and Ramsey County requirements, and consistent with the Site Plan, dated October 15, 2018. 2. The applicant shall obtain a Right -of -Way permit from Ramsey County. The work approved shall commence within one year of the date of this Administrative Variance unless an extension is granted in accordance with City Code, section 1125.02. Subd 5 (Lapse of Variance or Appeal), or approval of this Variance shall become void.
