Mayor Mueller read a Resolution in full for the record thanking Angelica Klebsch for her years 2
of dedicated service on the Mounds View Planning Commission. A round of applause was 3
offered by all in attendance. 4

Angelica Klebsch thanked the Mayor and Council for their support. She explained she 6
appreciated her time on the Planning Commission and encouraged members of the community to 7
consider serving in this way. 8

8. COUNCIL BUSINESS 10
A. Public Hearing: 2019 Tax Levy and Budgets for All Funds. 11
1. Resolution 9047, Adopting the 2019 Tax Levy. 12
2. Resolution 9049, Approving the 2019 EDA Tax Levy. 13

Finance Director Beer discussed the 2019 Tax Levy, EDA Tax Levy and municipal budget in 16
detail with the Council. He commented on the City’s four enterprise funds and requested the 17
Council hold a Public Hearing prior to approving the three Resolutions. 18

Mayor Mueller opened the public hearing at 6:56 p.m. 20
21
Brian Amundsen, 3048 Woodale Drive, stated he objected to the levy increase. He commented 22
on the City’s Charter noting the limits that were written into the document and approved by 23
Mounds View voters. He explained he was on the Charter Commission and authored much of 24
this language. He reported one section of the Charter does allow for voter approval of special 25
items, such as the additional Police Officer. He commented on the EDA budget, which was 26
$235,000. He stated the EDA does not have taxing authority and was being exercised by the 27
City. He was of the opinion the EDA levy should be added to the overall levy. He requested the 28
Council reconsider the budget and to eliminate the over levy charges that were being pushed onto 29
Mounds View citizens. 30

City Attorney Riggs advised the Council can pass an EDA levy and noted this was separate from 32
the City’s General Tax Levy. 33

Hearing no further public input, Mayor Mueller closed the public hearing at 7:02 p.m. 35

Council Member Bergeron asked if the Council had violated the spirit of the law, or acted 37
illegally. City Attorney Riggs reported the Council was acting within the City Charter. 38

Mr. Amundsen commented the spirit of the law, as stated earlier, was that the community felt 40
government growth should be limited to CPI + 2% for a maximum of 5%. He explained the 41
voters agreed with this limit and supported a Charter change. He indicated the Council was 42
responsible to follow this language. He provided further comment on the role of the EDA on 43
behalf of the City. He questioned why the EDA was assuming a levy for loan purposes that only 44
totaled $50,000. 45

Council Member Meehlhause requested further information on the proposed levy noting the limit 2
was proposed to be 4.4%. Finance Director Beer reported this was the case. He explained voter 3
approved levy items were not included in this amount, neither were debt service payments. 4

Mayor Mueller stated she was a member of the Charter Commission at the time the levy limits 6
were set. She explained the Charter Commission had opportunities for the City to raise other 7
monies for capital improvement and debt obligation. 8

Council Member Meehlhause stated the two police referendums that were approved by Mounds 10
View residents were exempt from the levy. Finance Director Beer reported this was the case. 11

Council Member Meehlhause commented further on the history of City’s levy increases. He 13
discussed the budget increases that were being proposed for the SBM Fire Department. He 14
described the investment the City has made in its streets over the past 10 years and noted how 15
this project was funded. 16

City Administrator Zikmund requested the Council approve the transfer of the on-sale 42
intoxicating liquor license, along with the restaurant and bowling licenses for The Mermaid, Inc. 43
(Michael J. Anderson) to Shift Entertainment. 44

Kate Becker, 2200 Mounds View Boulevard, explained she was an attorney representing the new 5
owner for The Mermaid. She reported the buyer would be purchasing 10 bowling centers in the 6
metro area. She did not anticipate any significant changes would occur at The Mermaid. She 7
noted all appropriate food licenses have been applied for. 8

Council Member Gunn asked if the mermaid would be coming back. Ms. Becker stated she 10
would pass this question along to the new owner. 11

Mayor Mueller indicated the community had much love for the mermaid and would love to 13
welcome her back to Mounds View. 14

City Administrator Zikmund requested the Council approve the 2019 City Council meeting, 35
Council/Staff retreats, and the Town Hall meeting dates. He reviewed the proposed schedule in 36
detail with the Council, noting the January retreat date may be postponed. He requested feedback 37
from the Council on the Town Hall meeting date. 38

Council consensus was to hold the Town Hall meeting on Monday, April 15th. 40

Views Boards, Commissions and Committees. 4

City Administrator Zikmund requested the Council approve several appointments to the City of 6
Mounds View Boards, Commissions and Committees. He reviewed the number of application’s 7
staff received for the open positions. Staff commented further on the recommended 8
appointments and recommended approval. 9

9041, Approving Various Appointments to the City of Mounds Views Boards, Commissions and 12
Committees. 13

Council Member Meehlhause read a portion of the Resolution noting the appointments aloud for 15
the record. 16

Mayor Mueller thanked everyone who applied for the open positions and for their willingness to 18
serve the community. 19

E. Resolution 9055, Promotion of Brian Beeman to Assistant City 23
Administrator. 24

City Administrator Zikmund requested the Council approve the promotion of Brian Beeman to 26
the position of Assistant City Administrator. He explained in the past year he has been working 27
on staffing and HR issues, along with reorganization matters. He stated as he worked through 28
these issues, staff recognized the need to promote Brian Beeman to the position of Assistant City 29
Administrator. He commented on the pay and step increase Mr. Beeman would be receiving and 30
recommended approval of the promotion. It was noted this promotion would be effective 31
January 1, 2019. 32

MOTION/SECOND: Hull/Meehlhause. To Waive the Reading and Adopt Resolution 9055, 34
Promotion of Brian Beeman to Assistant City Administrator. 35

Council Member Meehlhause stated he served on the HR Committee with Council Member Hull 37
and several staff members. He reported the HR Committee had discussed this promotion and 38
fully supported the recommendation. 39

Council Member Bergeron stated Brian Beeman was a tremendous asset for the City of Mounds 41
View. 42

Mayor Mueller explained it had taken the City some time to fill this position, but indicated she 44
was very pleased with the HR Committee’s recommendation. She congratulated Brian Beeman 45

F. Second Reading, Ordinance 952, Approving and Ordering Summary 5

City Administrator Zikmund requested the Council approve the Second Reading of Ordinance 8
952 and order the summary publication. He explained this Ordinance would update the Public 9
Health portion of City Code. He reviewed the proposed changes to this section and 10
recommended approval. 11

Council Member Hull excused himself from the Council Chambers. 13

Brian Amundsen, 3048 Woodale Drive, asked if in Section 602.01, Subdivision 4 the word 15
emergency should be further defined. City Attorney Riggs advised he did not believe this was 16
necessary but understood there was some discretion with the term emergency. City 17
Administrator Zikmund reminded the Council that businesses were allowed to have three false 18
alarms before receiving a strike. 19

City Administrator Zikmund requested the Council approve the Second Reading of Ordinance 31
953 and order the summary publication. He explained this Ordinance would update the Police 32
Powers portion of City Code. He reviewed the proposed changes to this section and 33
recommended approval. 34

Council Member Meehlhause asked what portion of City Code included beekeeping. City 36
Administrator Zikmund reported this was included in Chapter 500, under Business Licensing. 37

Council Member Hull returned to the Council Chambers. 39

H. Resolution 9053, Approving Loan Documents, Master Subordination 3
Agreement, and Master Disbursement Agreements Relating to the Local 4
Housing Incentives Account Program (LHIA) Loan and the Boulevard 5
Apartment Project. 6

City Attorney Riggs requested the Council approve loan documents, Master Subordination 8
Agreement and Master Disbursement Agreements relating to the Local Housing Account 9
Program (LHIA) loan for the Boulevard Apartment Project with MWF. He reported staff has 10
reviewed the documents with bond counsel and has made necessary changes. He provided 11
further comment on the documents and noted this was the final housekeeping matter to move this 12
project forward. 13

Council Member Meehlhause asked if the $500,000 from the Met Council was a grant or a loan. 15
City Attorney Riggs reported the dollars from the Met Council were a forgivable loan. He 16
explained if the conditions of the loan were met the dollars would be forgiven. 17

Mayor Mueller stated she was pleased that access to this property had been changed to Mounds 24
View Boulevard and away from Groveland Road. 25

I. Resolution 9051, Approving Repairs to Garage Door at the Public Works 29

Public Works Director Peterson requested the Council approve repairs to the garage door at the 32
Public Works building. He explained in July of this year staff damaged three panels on the door 33
and has since had the garage door out of service. He discussed the expense to repair the garage 34
door and recommended approval. It was noted the Sewer Department would be funding this 35
expense. 36

Public Works Director Peterson requested the Council approve the proposal from Beutow 2 1
Architects for the City Hall remodel project. He reported City Hall had a little more room now 2
that the Public Works Facility was complete. He discussed the remodeling needs at City Hall in 3
further detail with the Council and recommended approval of the architectural proposal from 4
Beutow 2 Architects. 5

K. Resolution 9050, Approving a Market Adjustment for 2019. 12

Finance Director Beer requested the Council approve a market adjustment for 2019. He 14
explained in 2017 a market study was commissioned for non-union employees as an effort to 15
assist in retaining staff. He noted there were two employees at City hall that had not received a 16
market adjustment. He commented further on the proposed changes and recommended approval. 17

Approving a Market Adjustment for 2019. 20

Council Member Bergeron stated he had one resident commend the City for being so close to the 22
proper pay grades, and for meeting all gender equity requirements. 23

Council Member Gunn reported the I35W Coalition met and were going to begin holding 32
community meetings in early 2019. She noted the I35W improvements would begin in 2019 and 33
would take three years to complete. She explained the sound walls would be completed in 34
conjunction with this project and not at the end. 35

Council Member Gunn indicated the Police Foundation would be meeting next on Tuesday, 37
December 11th. 38

Mayor Mueller stated the Festival in the Park Committee would meet next on Tuesday, January 40
15th at 7:00 p.m. at the Community Center. 41

Council Member Bergeron reported he attended a Cable Commission meeting last Wednesday. 43
He noted the group discussed CTV’s new mission statement and how to move forward in 2019. 44

Council Member Meehlhause stated this past weekend he was in Bemidji where he attended the 1
Bemidji staff Christmas party. He said hello from former Mayor Jerry Linke, who was in 2
attendance at this event. 3

Council Member Meehlhause wished everyone a Merry Christmas, Happy Holidays and Happy 5
New Year. 6

Mayor Mueller reported December 14th was the deadline for matching contributions at the Ralph 8
Reeder Food Shelf. She encouraged the public to consider making a donation to the food shelf 9
on or before December 14th. 10

Mayor Mueller indicated she would be visiting MedTronics on Tuesday, December 11th with the 12
City’s Building Official. 13

Mayor Mueller stated the Minnesota Women in Government would be meeting next on Friday, 15
December 14th. 16

Mayor Mueller reported the Comprehensive Plan Committee will meet next on Tuesday, 18
December 18th. 19

Mayor Mueller explained the Mounds View Business Council will meet on Wednesday, 21
December 12th at The Mermaid. She thanked Council Member Meehlhause and staff members 22
for representing the City at these meetings. 23

Mayor Mueller stated the North Metro Mayors would meet next on Wednesday, January 16th. 25

Mayor Mueller thanked Ray Ravard with the Sun Focus for his excellent work reporting 27
activities occurring within the City of Mounds View. 28

Council Member Gunn stated the Mounds View 15 Theater would be holding a free showing of 30
the Polar Express on Saturday, December 22nd and Sunday, December 23rd at 10:00 a.m. 31
Attendees are asked to bring a food donation and noted all donations would be given to the Ralph 32
Reeder Food Shelf. 33

1. Discuss the Need for Second Meeting in December. 35

Mayor Mueller reported typically the second meeting in December has been canceled. However, 37
there may be some Council business that needs to be addressed prior to the end of the year. She 38
explained a tentative meeting has been scheduled for Thursday, December 27th at 6:30 p.m. She 39
noted an EDA meeting would be held prior to the Council meeting, if needed. 40

B. Reports of Staff. 42

Police Chief Harder stated Shop with a Cop would be held on Sunday, December 16th at the 44
Community Center. He reported it was his intention to have three or four volunteer reserve 45

officers identified in January 2019. He indicated SBM got new radios and the old radios would 1
be made available to the reserve unit. 2

Public Works Director Peterson stated he was pleased to report the ice rinks would be open prior 4
to Christmas Break. 5

City Administrator Zikmund commented on the League of Minnesota workshop and conference 7
schedule. 8

Item Title/Subject: Resolution 9058 Accepting Miscellaneous Cash Donations
for 2018
Introduction:
Pursuant to MN Statute § 465.03, the City is required to accept donations by resolution.
The attached resolution provides for this acceptance for several miscellaneous donations
that were received in 2018.
Discussion:
Total miscellaneous donations received by the City in 2018 were $9,349, $8,037 was
from Twin Cities Gateway to advertise the Festival in the Park and an Event Center
business mailing, $52 was designated for Park Trees, $290 was designated for the City
festival, and $970 was designated for supporting K9 activities by the various donors.
Recommendation:
Attached for your consideration is Resolution 9058, a resolution which accepts the
miscellaneous donations received in 2018.

STATE OF MINNESOTA
RESOLUTION ACCEPTING MISCELLANOUS CASH DONATIONS FOR 2018
WHEREAS, MN Statute 465.03 requires cities to accept donations by resolution;
and
WHEREAS, the City received a cash donation during 2018 in support of
advertising for the Festival in the Park and a Community Center business mailing of
$8,037; and
WHEREAS, the City received several K9 donations during 2018 totaling $970; and
WHEREAS, the City received a miscellaneous donation for park trees during 2018
totaling $52 and $290 for the City Festival.
NOW, THEREFORE BE IT RESOLVED, that the Mounds View City Council
gratefully acknowledges and accepts the miscellaneous donations of $9,349 from several
donors for 2018.

At the January 2, 2019 Planning Commission meeting, the Commission recommended
that Gary Stevenson be appointed by the City Council as Chair of the Planning
Commission. Gary has served on the Commission since 1991, and has ample
experience as Chair.
The Planning Commission also appointed Gary Rundle as Vice-Chair.
Recommendation:
The City Council is requested to appoint Gary Stevenson as Chair of the Planning
Commission for 2019.

A RESOLUTION APPOINTING GARY STEVENSON AS CHAIRPERSON OF THE

WHEREAS , the City of Mounds View Municipal Code, Section 401 establishes a
Planning and Zoning Commission, which shall be the City planning agency as
authorized by Minnesota Statute §462.354, Subd 1; and,
WHEREAS, the City of Mounds View Municipal Code, Section 402.01
establishes a Board of Adjustment and Appeals, of which its membership shall consist
of members of the Planning and Zoning Commission; and,
WHEREAS, the City of Mounds View Municipal Code, Section 401.02, Subd 1
states that based upon the recommendation of the Planning and Zoning Commission,
the City Council, shall appoint a Chairperson; and,
WHEREAS, the Planning and Zoning Commission has recommended that Gary
Stevenson serve as Chairperson of the Commission (Resolution 1092-19); and,
NOW, THEREFORE, BE IT RESOLVED, that the Mounds View City Council
appoints Gary Stevenson as Chairperson of the Mounds View Planning and Zoning
Commission for 2019.

Background:
In accordance with Minnesota state law, it requires the City Council to annually select an Acting
Mayor from among City Council Members. In addition, state law also requires the City Council to
annually select an official depository for City funds. In 2018, the Acting Mayor was Council
Member Gunn.
In addition. Minnesota state law requires the City Council to annually designate a legal
newspaper of general circulation in the City as its official newspaper
In accordance with Section 6.04, of the Mounds View City Charter, it requires the City Council to
appoint a City Treasurer.
Discussion:
The Sun Focus, the Bulletin and the Shoreview Press have each submitted proposals to be the
City’s official newspaper for 2019 (proposal letters attached). The Council selected the Sun
Focus as the City’s primary newspaper last year. The City Council expressed interest in
selecting the Sun Focus as the City’s official newspaper in previous years due to the better news
coverage that the Sun Focus provides on City matters.
In regard to circulation in Mounds View, both the Sun Focus and The Bulletin delivers their
newspapers to approximately the same number of households at 3,500. However, The
Shoreview Press has indicated that circulation in Mounds View is minimal.

Last year and in years previous, the Council selected the St. Paul Pioneer Press as the City’s
secondary newspaper. Since the Pioneer Press is a daily newspaper, it would certainly be
acceptable for the Council to select the Pioneer Press as the City’s secondary newspaper. The
Shoreview Press, however, has indicated that they would like to be considered as the City’s
secondary newspaper.
The attached resolution appoints the treasurer consistent with Section 6.04 of the City Charter,
and also lists the city job positions that are authorized to conduct banking and investment
business on behalf of the City.
Recommendation:
Designate the City’s Acting Mayor, Official Newspaper, Official Depositories, Treasurer and
Deputy Treasurer by adopting Resolution 9056.
