RESOLUTION RECOMMENDING APROVAL OF A MINOR SUBDIVISION,
LOCATED AT 8456 RED OAK DRIVE, PLANNING CASE M12018-001
WHEREAS, Patrick Schmeichel of Elin Marco Group (applicant), and John Kulle
of OEM Engineering (property owner), are requesting approval of a Minor Subdivision of
the property located at 8456 Red Oak Drive, legally described as;
PID: 06-30-23-12-0002
That part of the Northeast Quarter of Section 6, Township 30, Range 23,
described as follows: Beginning at a point in the North line of said .
Northeast Quarter 528 feet East of the Northwest corner of said Northeast
Quarter; thence South parallel with the West line of said Northeast
Quarter, a distance of 564. 7 4 feet; thence West parallel with the South
line of said Northeast Quarter, a distance of 264 feet; thence North parallel
with the West line of said Northeast Quarter, a distance of 573.67 feet;
thence East to the point of beginning, a distance of 264 feet, Ramsey
County, Minnesota.
WHEREAS, a Minor Subdivision is the division of a parcel less than two acres,
and in which no more than one additional parcel is created; and,
WHEREAS, the proposed Minor Subdivision will divide the 0.82 acre parcel into
two lots; Parcel A, and Parcel B; and,
WHEREAS, the property is zoned R-1 Single -Family Residential, and guided
Single -Family Detached in the Comprehensive Plan; and,
WHEREAS, the Certificate of Survey, dated December 3, 2018, and
Commitment of Title Insurance, dated December 28, 2018, have been reviewed by Staff
and applicable departments and agencies, and determined to be consistent with City
Code Title 1100 (Zoning Code) and Title 1200 (Land Subdivision), and is consistent with
the Comprehensive Plan; and,

WHEREAS, the Planning and Zoning Commission has reviewed the application,
and the Staff Report, determining that the proposed Minor Subdivision is in
conformance with the City Code, and Comprehensive Plan; and,
WHEREAS, in accordance with City Code, Section 1204.02 (Dedication of
Lands), a park dedication fee will be required in the amount of $4,972 (10% of
Estimated Market Value of Parcel B), to be paid to the City prior to recording of the
Resolution; and,
NOW, THEREFORE, BE IT RESOLVED, that the applicant shall have six
months from final approval to file proper documentation with Ramsey County, including
new deeds and easement documents, and furnish proof of such recording to the City. If
such action is not accomplished by the date so indicated, this Minor Subdivision
approval shall be considered null and void; and,.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Mounds View
Planning and Zoning Commission recommends approval of a Minor Subdivision of 8456
Red Oak Drive subject to the following stipulations:
1. The Applicant shall grant the following easements to the City:
A. An easement for drainage and utility purposes around the perimeter of the
new lots, measuring 5 feet in width along rear and side lot lines, and 10
feet in width along frontage lot lines; and,
B. An easement for right-of-way purposes over the eastern 33.00 feet of both
parcels, all as depicted in the Property Split Exhibit.
2. The Applicant shall amend the Certificate of Survey if any changes are
required by Ramsey County.
The Applicant shall pay to the City, a Park Dedication Fee of $4,972, and all
costs associated with the City's review of the application, including City
Engineer, and City Attorney fees.
NOW THEREFORE, BE IF FINALLY RESOLVED, that the Mounds View
Planning Commission directs Staff to forward this resolution to the City Council prior to
approval of the minutes.
