HomeMy WebLinkAboutOrdinance 792ORDINANCE NO. 792 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE AMENDING TITLE 1200, CHAPTER 1202 OF THE MOUNDS VIEW CITY CODE BY ADDING LANGUAGE REGARDING SUBDIVISION REQUIREMENTS THE CITY OF MOUNDS VIEW ORDAINS: SECTION 1. The City Council of the City of Mounds View hereby amends Title 1200, Sections 1202.01, 1202.03, 1202.04, 1202.05 and 1202.07 of the Mounds View Municipal Code by deleting the ~-+" material and adding the underlined material as follows: 1202.01: PRELIMINARY SUBDIVISION PLAN APPLICATION: *** Subd. 2. Application: a. *** (8) Anv additional information reauested by the glannina department or city staff deemed necessarv to preserve neiahborhood aesthetics or protect the health. safety and welfare of neiahborina landowners and the future residents within the subdivision. 1202.03: NECESSARY DATA FOR PRELIMINARY PLAT: The preliminary plat or surveyor's certificate of the proposed subdivision shall contain or have attached thereto the following information: *** Subd. 4. Other Information: a. Such other information or reauirements as may be requested by the Planning and Zoning Commission sr-Council or city staff that are deemed to be necessarv to preserve neiahborhood aesthetics or to protect the health. safety and welfare of neiahborina landowners and the future residents within the subdivision. Ord 792 Page 2 1202.04: CONDITIONS OF PRELIMINARY PLAT APPROVAL: *** Subd. 2. Tentative Approval: The approval of a preliminary plat of a major subdivision by the Council is tentative only, involving merely the general acceptability of the layout as submitted. The Council shall not permit the installation of any public improvements in the proposed plat unless the preliminary plat is approved. Preliminary plat approval is conditioned upon compliance with all reauirements deemed necessary to areserve neiahborhood aesthetics or protect the health. safety and welfare of neiahborina landowners and the future residents within the subdivision. 1202.05: NECESSARY DATA FOR FINAL PLAT: *** Subd. 2. Information to be Shown: *** p. Any other information as may be required by the Planning and Zoning Commission, e~Council or city staff that is deemed to be in the interest of the public's health, safety or welfare. 1202.07: FINAL PLAT APPROVAL PROCEDURE: *** Subd. 2. Conformance to Preliminary Plat: *** b. The Clerk-Administrator shall examine the final plat to determine whether it conforms to the preliminary plat, as approved.-, includina, but not limited to. comaliance with all reauirements deemed necessary to oreserve neiahborhood aesthetics or to protect the health. safety and welfare of neiahborina landowners and the future residents within the subdivision. c. If the Clerk-Administrator determines that the final plat, as submitted, does not conform with the terms of the Council approval of the preliminary plat, includina. but not limited to. comaliance with all reauirements deemed necessary to preserve neiahborhood aesthetics or to protect the health, safety and welfare of neiahborina landowners and the future residents within the subdivision, the Ord 792 Page 3 Clerk-Administrator shall so report to the Planning and Zoning Commission. The Planning and Zoning Commission shall recommend to the Council approval or disapproval of the final plat within thirty (30) days of receipt of the Clerk- Administrator's report. SECTION 2. This ordinance shall take effect and be in force 30 days from and after its passage and publication, in accordance with Section 3.09 of the City Charter. The ordinance, along with the full text of the City's Wetland Zoning Code, are on file and available for public viewing at the office of the Clerk Administrator. Second Reading and Adoption of Ordinance 789, Amending Section 607.08 Related to Construction Noise MOTION/SECOND: Flaherty/Mueller. To Waive the Reading and Adopt Ordinance 789, Amending Section 607.08 Related to Construction Noise, and Approve Publication of a Summary Ordinance. Council Member Mueller asked whether there has been or will be notification of these changes to homeowners and contractors under construction. Community Development Director Ericson said that those developers under construction will be notified as would all homeowners who obtained permits this past year. Director Ericson indicated that Staff is seeking authorization to publish a summary of the Ordinance. City Administrator Ulrich indicated that this would become effective 30 days after publication. Second Reading and Adoption of Ordinance 792, Amending Chapter 1202 (Subdivision Plats and Procedures) Community Development Director Ericson reviewed Ordinance 792, Amending Chapter 1202. MOTION/SECOND: Mueller/Hull. To Waive the Reading and Adopt Ordinance 792, Amending Chapter 1202 (Subdivision Plats and Procedures) and Approve Publication of a Summary. ROLL CALL: Stigney/Hull/Flaherty/Mueller Ayes - 4 Nays - 0 Motion carried. H. Resolution 6895, Approving Contracts for SCADA Systems Upgrade #2 Public Works Director Lee provided information on the SCADA system upgrade. Council Member Flaherty indicated that this is very important to the City and then asked if there are any draw backs to a nonproprietary system.
