HomeMy WebLinkAboutResolution 7263RESOLUTION 7263 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION AUTHORIZING ABATEMENT OF NUISANCE CODE VIOLATIONS AT 8425 SPRING LAKE ROAD, MOUNDS VIEW, MINNESOTA, 55112. WHEREAS, Brady S. Newman is the owner of property located at 8425 Spring Lake Road, zoned R-1, Single Family Residential, legally described as follows: AUDITOR'S SUBDIVISION NO. 89 (MV) S 115FT OF N 300 FT OF W 234.1 FT OF LOT 38 WHEREAS, on July 3, 2007, staff inspected the property located at 8425 Spring Lake Road in response to a complaint regarding outside storage of inoperable vehicles outside and observed exterior storage of vehicles and automotive parts in violation of city code; and WHEREAS, a notice of violation was issued to Mr. Newman dated July 3, 2007, regarding exterior storage and accumulation of abandoned, junk, inoperable vehicles stored outdoors and vehicles parked off an improved surface at 8425 Spring Lake Road, staff requested corrective actions completed to bring the property into compliance with the Nuisance Code by July 17, 2007; and WHEREAS, on October 11, 2007 staff performed a follow up inspection of the property located at 8425 Spring Lake Road and observed continued Nuisance Code violations; and WHEREAS, on October 11, 2007 staff issued a Ramsey County Court Citation to Brady Newman for violation of Section 607.07 Subdivision 2 of the Nuisance Code; and WHEREAS, staff performed a reinspection of the property on December 4, 2007 and observed continued Nuisance Code violations; and WHEREAS on December 4, 2007 staff issued a second Ramsey County Court Citation to Brady Newman for continued violation of Section 607.07 Subdivision 2 of the Nuisance Code; and WHEREAS, Mr. Newman failed to appear in Ramsey County District Court on March 25, 2008 to answer to the violations cited; and WHEREAS, on Apri123, 2008 staff reinspected the property located at 8425 Spring lake Road and zero evidence of completion of corrective actions, photographs of the exterior were obtained at that time; and Resolution No. 7263 Page 2 WHEREAS Brady S Newman is responsible for maintaining Nuisance Code violations on the exterior above-said property that include, but are not limited to: 1. Accumulation of approximately 12 inoperable snowmobiles parked outside in the yard 2. Inoperable vehicles parked outside in the yard. 3. Automotive engines, parts and components stored outdoors WHEREAS, in a letter to the property owner dated April 18, 2008, staff notified Mr. Newman of its intent to appear before the Mounds View City Council on Apri128, 2008 to request authorization to abate violations cited in the Notice of Violation dated July 3, 2007; and WHEREAS, the City Council finds that the Nuisance code violations at 8425 Spring lake Road constitute a Public Nuisance under Section 607.06 Subdivision 2c (1) and Section 607.07 Subdivision 2 and the City may abate and assess the costs of said abatement against the property pursuant to Minn. Stat. 429.101; and WHEREAS, the City has complied with the notification requirement for nuisance abatement as stated in Section 607.09, Subdivision Sb of the Mounds View Municipal Code; and WHEREAS, Brady S. Newman, property owners of 8425 Spring Lake Road, will be personally liable to the City for the costs of such abatement, including administrative costs pursuant to Section 607.09, Subdivision 7 of the Mounds View Municipal Code; and WHEREAS, if the property owners fail to pay the cost, after being duly notified, of the abatement of nuisance code violations at 8425 Spring Lake Road within 30 days after the date of the invoice, the City may certify the unpaid costs against the property pursuant to Section 607.09, Subdivision 8 of the Mounds View Municipal Code. NOW THEREFORE, BE TT RESOLVED THAT: The City will abate violations of Section 607.06 Subdivisions 2 and 2c (1) of the City Code within 5 days. The City Council authorizes City staff to complete any actions necessary to achieve compliance with the City Code with respect to exterior violations of Section 607.06 Subdivision 2 and 2c(1). 2. City staff will complete an inventory of any items removed from the exterior premises, ascertaining with reasonable certainty which items may be of relative value and placing said items into storage at a secure location, which will be available to Mr. Newmanupon payment of costs associated with their removal and storage. Brady S. Newman shall be personally liable to the City for the costs of abatement, including administrative costs and reasonable storage costs. Resolution No. 7263 Page 3 4. Any unpaid portion of the abatement costs after 30 days of the date on the invoice may be certified as special assessments against the property pursuant to Section 607.08, Subdivision. 4 of the Mounds View Municipal Code.
