A. Presentation by American Legion. 41

Kennedy ________________, American Legion representative, discussed the work being doing 43
by the American Legion and noted this organization holds Police Officers and Fire Fighters in 44
high regard. He explained Officer Garland had been nominated for an award based on his 45

service to this country and to the City of Mounds View. He presented Officer Garland with the 1
Law Enforcement Certificate of Accommodation for Outstanding Public Service in the state, 2
community and nation. In addition, he indicated Officer Garland was recognized as Minnesota’s 3
American Legion Law Enforcement Officer of the Year for 2018 and 2019. He congratulated 4
Officer Garland for this recognition and commended the Mounds View Police Department for 5
their outstanding efforts in the community. 6

Mayor Mueller stated the City was extremely proud of its Police Department and especially 8
Officer Garland. She congratulated Officer Garland for his great work and asked Chief Harder to 9
come forward at this time. Police Chief Harder accepted the award from the American Legion 10
on Officer Garland’s behalf. A round of applause was offered by all in attendance. 11

B. Swearing In of Officer Mike Hanson. 13

Police Chief Harder introduced newly hired Police Officer Mike Hanson to the City Council. He 15
administered the oath of office to Officer Hanson and welcomed him to the Mounds View Police 16
Department. A round of applause was offered by all in attendance. 17

Officer Hanson introduced his family to the City Council and thanked them for the opportunity to 19
work in this community. 20

C. Presentation from Ramsey County Parks and Recreation Department – 22
Benjamin Karp. 23

Public Works Director Peterson reported Ramsey County had recently completed a North 25
Regional Trail Master Plan and was seeking Council approval. He explained Benjamin Karp 26
from Ramsey County was in attendance to provide the Council with further information on this 27
plan. 28

Benjamin Karp, Ramsey County Parks and Recreation Department, provided the Council with a 30
presentation on the North Regional Trail Master Plan. He reported the master plan would serve 31
as a guiding document to identify long-term infrastructure and recreation improvements for the 32
development of a park, trail or other resource. He discussed the project goals within the master 33
plan and described the community engagement that occurred. In addition, approaches to reduce 34
barriers had been identified within the master plan. The preferred concept plan was reviewed in 35
detail with the Council and requested Council approval of the master plan. 36

Council Member Meehlhause asked where the cross-country ski trails would be located. Mr. 38
Karp reviewed the location of the new cross-country ski trails on the preferred concept plan. 39

Mayor Mueller commented on the TCAAP portion of this project and questioned if the park 41
plans for this property would move forward even though development has stalled. Mr. Karp 42
indicated the park plans would be moving forward in a phased approach. 43

Council Member Bergeron questioned what would be done at the “enhanced road crossing”. Mr. 1
Karp stated overpasses and underpasses may be created, or signaled crosswalks in order to 2
improve safety for pedestrians and bikers. 3

City Administrator Zikmund requested the Council approve a one-day gambling permit for the 14
Mounds View Police Foundation as part of the Mounds View Festival in the Park. He explained 15
the Foundation was looking to host bingo at the Festival in order to raise funds for the Mounds 16
View Police Department. 17

Mayor Mueller thanked the Mounds View Police Foundation for their efforts on behalf of the 19
Police Department. 20

Community Development Director Sevald requested the Council adopt an Ordinance that would 31
amend the Zoning Map for the properties at 8482, 8484 and 8486 Long Lake Road. He 32
discussed the history of these properties and noted a rezoning accidently occurred. Staff 33
provided further comment on the error that occurred and requested the Council approve the 34
rezoning. 35

City Administrator Zikmund requested the Council adopt an Ordinance updating Chapter 1000 of 5
the City Code. He reviewed the minor changes that were made to this portion of the code and 6
recommended approval. 7

D. Resolution 9118, Approving Pilot Trial of City Hall Hours of Operation. 19

City Administrator Zikmund requested the Council approve a pilot trial of new City Hall hours of 21
operation. He explained the new hours would assist the City in providing better customer service 22
while also assisting the City with employee retention efforts. He stated three members of the 23
administrative staff would be working on Fridays. He reported the new hours would begin on 24
June 1st and would run through the end of August on a trial basis. 25

City Administrator Zikmund requested the Council approve revisions to the City’s Retirement 37
Health Savings Plan Policy. He commented on the proposed changes that were made to the plan 38
and recommended approval. 39

Mayor Mueller asked if all three groups came to a consensus on this item. City Administrator 41
Zikmund reported two groups supported the changes and one group chose not to make a change. 42

A. Reports of Mayor and Council. 5

Council Member Gunn reported the Mounds View Police Foundation would meet on Tuesday, 7
June 4th and the Festival in the Park Committee would meet on Tuesday, June 18th. She 8
explained the Festival Committee was still seeking volunteers to assist with this year’s event. 9

Council Member Meehlhause stated the Mounds View Lions Club held their annual garage sale 11
two weeks ago. He thanked all who supported this event noting over $1,000 was raised from this 12
event. 13

Council Member Meehlhause reported he attended a Twin Cities Gateway meeting last week. 15
He explained Steve Markuson’s contract had been extended to May 31, 2020. He noted hotel 16
revenues for 2019 were doing quite well. 17

Council Member Meehlhause commented he would be attending an NYFS Board meeting on 19
Thursday, May 30th. He explained Cohen Tayler had been hired to assist with an executive 20
search for Jerry Hromatka’s replacement. 21

Council Member Bergeron reported he would be attending the North Suburban Cable 23
Commission meeting on Thursday, June 6th. 24

Mayor Mueller noted school would be out in early June. She encouraged residents to be mindful 26
of children walking to and from neighborhood parks. She asked that residents consider making a 27
donation to the Ralph Reeder Food Shelf to assist with feeding children this summer. 28

Mayor Mueller stated on Saturday, May 25th she had the privilege of serving troops at the River 30
Center in St. Paul. She noted 1,200 families of servicemen and women were at this event. She 31
noted mayors from 26 different cities assisted with this event. She thanked the local businesses 32
that paid for these family members to Skype with loved ones in Kuwait. 33

Mayor Mueller reported she would be attending a Ramsey County League of Local Government 35
meeting on Thursday, May 30th at 5:30 p.m. 36

Mayor Mueller indicated she would be attending a Minnesota Women in Local Government 38
meeting on Friday, May 31st at 11:00 a.m. 39

Mayor Mueller thanked the City for setting aside training funds for the City Council and staff to 41
attend the League of Minnesota Cities Annual Conference in Duluth. 42

Public Works Director Peterson reported his staff was busy training in the seasonal workers. He 1
noted the YMCA park programs would begin in two weeks once school was out for the summer. 2
He explained the City Hall/Police remodel bids would be opened on Friday. He indicated the 3
Silver View Park parking lot was removed today. He commented further on the plans for this 4
park along with the project timeline. 5

Public Works Director Peterson reported the last 12 months have been the wettest in history. He 7
understood the groundwater level was high. He indicated the City was already 6” over normal 8
precipitation levels. He stated the City needs a long stretch of dry weather to dry things out. He 9
commented on the progress that was being made at City Hall Park. 10

City Administrator Zikmund updated the Council on the City’s compliance efforts with Tires 12
N’More. 13

City Administrator Zikmund explained he and Rayla Ewald would be traveling to Eden Prairie 15
for a mediation session with a separated officer, per the officer’s request. 16

City Administrator Zikmund reported the legislative session has completed and he was pleased to 18
report LGA would continue. 19

City Administrator Zikmund stated on Friday, June 7th the County Road I bridge would be 21
brought down. 22

City Administrator Zikmund reviewed the workshop agenda for Monday, June 3rd. The Council 24
agreed to discuss the Charter Commission at this meeting. 25

Mayor Mueller reported the City had three eagle scouts that would be recognized by the Council 27
at a future meeting. 28

Council Member Gunn reported the Scouts and the Lions would be cleaning up Mounds View 30
Boulevard on Saturday, June 1st. 31

Council Member Gunn stated on Saturday, June 8th the Mounds View Police Foundation would 33
be hosting a hot dog/bake sale fundraiser at Von Hansen’s Meats from 10:00 a.m. to 4:30 p.m. 34

Theresa Cermak commented on a drawing that was being sponsored by the Festival in the Park 36
Committee where a queen-sized quilt would be given away. 37

Introduction:
Karla Freecheck has resigned from her position effective June 21, 2019. Ms.
Freecheck was employed with the City for one year and five months (hire date of
January 16, 2018). Attached is Resolution 9121 which authorizes severance to Ms.
Freecheck in accordance with the City’s Personnel Manual.
Discussion:
Section 3.47 of the personnel manual provides for payout of unused vacation and comp
time hours. Employees with less than two years of service are not eligible for payout of
sick time hours. Ms. Freecheck resigned with 35.66 hours of vacation. Ms. Freecheck
had less than two years of service so is not eligible for sick time payout. Ms. Freecheck
had a comp time balance of 1.50 hours.
The following represents severance eligible to Ms. Freecheck:

KARLA FREECHECK, POLICE ADMINISTRATIVE ASSISTANT
WHEREAS, Karla Freecheck has resigned as Police Administrative Assistant for
the City of Mounds View, her last day of employment is June 21, 2019; and
WHEREAS, in accordance with the Mounds View Personnel Manual, Ms.
Freecheck is eligible for a cash payout of her vacation hours; and
WHEREAS, in accordance with the Mounds View Personnel Manual, Ms.
Freecheck is eligible for a cash payout of her comp time; and
WHEREAS, Ms. Freecheck had less than two years of service and is not eligible
for sick time payout; and
WHEREAS, Ms. Freecheck’s balance of accrued and unused vacation is 35.66
hours; and
WHEREAS, Ms. Freecheck’s balance of accrued and unused comp time is 1.50
hours; and
WHEREAS, Ms. Freecheck’s rate of pay upon resignation was $21.68 per hour.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council
approves severance to Karla Freecheck consistent with the Mounds View Personnel

Item Title/Subject: Resolution 9122 Adopting and Reporting Performance Measures
Background:
The legislature created the Council on Local Results and Innovation in 2010. (CLRI) The CLRI
created standardized performance measures that will aid residents, taxpayers, and state and local
elected officials in determining the efficacy of cities in providing services. Participation in the
standard measures program is voluntary.
Discussion and Recommendation:
To participate, a city must adopt, implement, and publish a minimum of 10 performance measures
as provided by the CLRI. The City of Mounds View already maintains a number of the standard
performance measures and will add more in the future. The standard measures will be published
on the City’s website and in the next edition of Mounds View Matters. The City will also be eligible
for reimbursement of $.14 per capita or $1,865.78 for participation in the program. Attached is
resolution 9122 and the list of standard performance measures that the City Council will adopt.
Staff recommends approval.
Strtegic Plan Strategy/Goal:
- Enhance Revenue Sources thru minimal use of staff time.
- Community Engagement by providing performance measure metrics that we currently track.
Financial Impact:
- $1,865.78 additional revenue, minimal staff time to compile and submit the report, cost to
publish in the newspaper.

CITY OF MOUNDS VIEW

STATE OF MINNESOTA
RESOLUTION ADOPTING AND REPORTING PERFORMANCE MEASURES
WHEREAS, Benefits to the City of Mounds View for participation in the Minnesota
Council on Local Results and Innovation’s comprehensive performance measurement program
are outlined in MS 6.91 and include eligibility for a reimbursement as set by State statute; and
WHEREAS, Any city/county participating in the comprehensive performance
measurement program is also exempt from state levy limits for taxes, if levy limits are in effect;
and
WHEREAS, The Mounds View City Council has adopted and implemented at least 10
of the performance measures, as developed by the Council on Local Results and Innovation,
and a system to use this information to help plan, budget, manage and evaluate programs and
processes for optimal future outcomes.
NOW THEREFORE LET IT BE RESOLVED THAT, The Mounds View City Council will
continue to report the results of the performance measures to its citizenry by the end of the
year through publication in the quarterly Mounds View Matters news letter, posting on the
city’s website, or through a public hearing at which the budget and levy will be discussed and
public input allowed.
BE IT FURTHER RESOLVED, The Mounds View City Council directs staff to submit to the
Office of the State Auditor the actual results of the performance measures adopted by the city.

Introduction:
Resolution 9106 passed on April 22, 2019, which approved the hiring of a Police
Administrative Assistant.
Discussion:
A posting based on the job description was published for 10 working days on the City’s
web site, the League of Minnesota Cities web site, and Indeed.com. Over 600
candidates submitted resumes. Of those, 112 candidates submitted completed
application packets by the application deadline. The applications were scored with 10
individuals being interviewed by Police Department personnel and the Human
Resources Coordinator.
Strategic Plan Strategy/Goal:
Create a culture where employees desire to work.
Financial Impact:
This is a budgeted position.
Recommendation:
The panel is recommending the Council appoint Ms. Hanna Kenow to the position of
Police Administrative Assistant starting June 25, 2019. Due to her previous work
experience, the panel recommends Ms. Kenow start at Step 1.5 in the 2019
compensation plan, complete a six-month probationary period and advance to Step 2.
Step 3 will follow one year later (1½ years after her start date) based on successful job
performance.

WHEREAS, The City of Mounds View posted for a Police Administrative

matter reached a negotiated settlement. It is recommended that the council adopt a
resolution approving the mediated settlement agreement and release of claims.

As recommended by City Attorney and in order to be in line with our strategic planning
efforts to be more efficient and in order to properly handle HR matters, this resolution is
recommended for approval.
Financial Impact:
The settlement amount will be $90,000.00.
Recommendation:
Staff and the City Attorney recommend approval of Resolution 9126, a resolution
approving a mediated settlement agreement and release of claims relating to the
dispute with Keith Demarest.

RESOLUTION APPROVING MEDIATED SETTLEMENT AGREEMENT AND
RELEASE OF CLAIMS
WHEREAS, Keith Demarest was previously employed by the City as a patrol
officer with the Police Department; and
WHEREAS, Mr. Demarest allegedly sustained injuries in the line of duty, which
the City denies; and
WHEREAS, Mr. Demarest was granted Police and Fire Plan duty disability
benefits by the Public Employees Retirement Association (PERA), pursuant to Minn.
Stat. § 353.656, Subd. 1; and
WHEREAS, Mr. Demarest claims to be entitled to continuation of health
insurance coverage under Minn. Stat. § 299A.465, as a result of his duty disability,
which the City denies;
WHEREAS, the parties participated in mediation on May 29, 2019 and reached a
settlement of Mr. Demarest’s claim under Minn. Stat. § 299A.465; and
WHEREAS, the parties wish to resolve their differences without the cost, delay
and uncertainty of litigating the matter; and
WHEREAS, the Settlement Agreement provides for the resolution of the dispute
between the parties as well as a release of all claims for the future payment of any
health insurance premiums by the City on behalf of Mr. Demarest under Minn. Stat. §
299A.465.
NOW, THEREFORE, BE IT RESOLVED THAT the above-referenced recitals are
incorporated herein to this Resolution.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the City Council hereby
approves the Settlement Agreement in substantially the form as attached hereto as
Exhibit A, the contents of which are incorporated herein by reference.
NOW, THEREFORE, BE IT FURTHER RESOLVED THAT, the Mayor, the City
Administrator and the City Attorney are hereby authorized and directed to take any and
all additional steps and actions necessary or convenient to prepare the appropriate
documents and/or agreements to facilitate the directives of the City Council as provided
herein in order to accomplish the intent of this Resolution.

Introduction: In accordance with Ordinance 951, a public hearing is no longer required for
liquor license renewals. The City of Mounds View issued liquor licenses for the subject
businesses in 2018 and their renewals are before the City Council for consideration as they will
expire June 30, 2019.
Discussion: All applicants have submitted their city liquor license application materials and the
applicable fees with the exception of Speedway #4264. We are still waiting for their liquor
liability insurance. They are aware that we have not received it and are working on getting it to
us. The following investigations and inspections have been conducted to determine whether
there is cause for the City to consider denial of any of the above referenced liquor license
applications:

been in contact with the owner, Mr. Jeff Moritko, who has requested that the City divide the total
amount due in four equal payments with the first payment being due by June 21, 2019 and the
remaining three payment due on 21st of each month thereafter. In addition, he is pledging
that Moe’s will stay current to avoid this issue in the future.

Introduction:
The businesses shown in attached Exhibit A have a current license with the City of Mounds
View that will expire June 30, 2019. These businesses are required to renew their license
with the City on an annual basis. Each of the businesses listed have applied to the City to
renew their license.
Discussion:
The City has received the appropriate fees, completed and signed renewal applications and
proof of adequate insurance where necessary, with the exception of Little Caesar’s.
Paperwork has been submitted but we are waiting for payment from the corporate office. We
have received satisfactory reports and inspections from the appropriate departments and
agencies, including any delinquent water/sewer bills, invoices, and satisfactory fire
inspections with the exception of those listed below:
Utility Billing - As discussed in the staff report for liquor license renewals, Moe’s
American Grill has an outstanding water/sewer bill in the amount of $8,680.64 and Mr.
Moritko has requested that the City divide the total amount due in four equal payments

Item Title/Subject: Resolution 9123, Approving the Bid and Awarding a Contract to
Dering Pearson Group for the City Hall / Police Remodel Project
Background/ Discussion:
The City Council has been discussing the possibility of remodeling City Hall and the Police
Department. Discussion was brought forward by Staff with the move of Public Works
Administration Staff and the Police Department requiring more space and accommodations due
to their current limited space and recent additional officers approved by referendum. (The current
space in the Police Department is lacking showers in both the men’s and women’s locker rooms,
also needed is a soft interview room, and a secure holding room.)
A rough concept was presented to the City Council on April 2nd, 2018 and Council was supportive
of moving forward in hiring an architectural firm to review the concept plans and investigate if a
remodel project at City Hall was feasible.
The following actions have been completed to date:
• May 13th - City Council to Approve Plans and Authorize bidding
• May 14th - Buetow 2 Architects send to General Contractors and advertise for bids.
• May 23rd - Walk through of project area with bidders
• May 31st - Public Bid – Bid opening City Council Chambers
The following tables is a breakdown of the bids received:
The apparent low bidder based off of the base bid was Cal-Tex. Buetow 2 Architects has reviewed
all the bids. By adding alternate #3 the low bidder for the project is Dering Pearson Group of
Rogers MN. Dering Pearson submitted a total project cost bid of $169,324, this is under the
Architects estimated construction costs of $240,000. Dering Pearson has provided a list of
projects and references as both Staff and Buetow 2 have not work with Dering Pearson in the
past.
Staff called several of the references and was only able to connect with one at the time of this
report. The reference gave high marks and praise for Dearing Pearson, indicating that for the last
project they did not go out for bid, but hired Dearing Pearson based on past performance in
workmanship and bringing projects in on budget and on time.

The total project cost for the City Hall/Police Remodel is $259,691. The 2019 adopted budget has
$257,000 in the Special Projects, fund 480-4180-7050. The estimated project is $2,692 over the
budget. Staff is expecting some cost savings in City Staff performing some of the rough
demolishing, painting, moving and SAC charges.
The following time line will be used for this project:
• June 10th - City Council approves bid and awards contract for the remodel project.
• June 11- City Attorney Contract Development
• June 17-28th - Contracts reviewed and signed.
• July 1-3 - Pre Construction Meting
• July 8-19 - City Staff starts moving items prepping for construction
• July 22 – Construction starts
Strategic Plan Strategy/Goal: Maintain and Plan for Infrastructure Improvements. Goal Focus
efforts on recruiting good employees and providing an environment to keep them.
Financial Impact: No Financial Impact to the 2019 Budget, as funding is in the Special Project
Fund, account 480-4180-7050-110 for this project.
Recommendation:
Staff as well as Buetow 2 Architects recommends the City Council accept the bid from Dering
Pearson Group of Rogers MN for the City Hall/Police Remodel for a total base bid of $155,435,
in addition to alternate #3 for $13,889. Staff also recommends the Council approve a 7%
contingency of $11,852, for any unforeseen problems that may arise with this project. Staff
further recommends the council approve the soft costs totaling $78,515. For total estimated
project cost of $259,691
Staff also recommends the City Council approves the City Attorney create a contract for this
project.

APPROVING THE PLANS AND SPECIFICATIONS FOR THE CITY HALL / POLICE
REMODEL AND AUTHORIZE BIDDING
WHEREAS, the City Council has discussed the option of remodeling City Hall in order to
provide more space for the Police Department; and
WHEREAS, the City Council approved adverting for bids for the City Hall / Police
Department Remodel Project, City Project 2018-C03; and
WHEREAS, Bids were received and read aloud on Friday May 31, 2019, as noted on
the table below; and
WHEREAS, Buetow 2 Architects, Inc. reviewed the bids, and reported that low bid was
made by Dering Pearson Group for a project cost of $169,324; and
WHEREAS, Staff has contacted Dering Pearson references and reports are positive;
and
WHEREAS, The City Council acknowledges that with this project there are other soft
costs such as electronic door locks, design fees attorney fees, SAC charges ets… for an
estimated cost of $78,515; and
WHEREAS, the City Council desires to have this project completed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View,
Ramsey County, Minnesota as follows:
1. Approves the Bid submitted by Dering Pearson Group of Rogers MN for cost of $169,324
for the City Hall/Police Remodel Project, City Project 2018-C03.
2. Approves the City Attorney write a contract between Dering Pearson Group and the City for
City Project 2018-C03
3. Approves the addition of a 7% contingency of $11,852 for any unforeseen problems or
issues that may arise with this project.
4. Approves the other Soft Cost for the project as listed by Buetow 2 Architects, such as
electronic door locks, design fees, attorney fees SAC charges etc. for a total of $78,515

5. For a total project cost of $259,691, funding exists in the Special Project Fund, account
480-4180-7050-110 for this project.
6. The Mayor and City Administrator are hereby authorized and directed to execute all
appropriate documents to effectuate the actions contemplated by this resolution.
7. The Mayor and City Administrator, Staff and consultants are hereby authorized and directed
to take any and all additional steps and actions necessary or convenient in order to
accomplish the intent of this Resolution.

Item Title/Subject: Resolution 9124 Approving the Replacement of Roof Top Unit #4
at City Hall
Background:
The compressor and fan failed for the City Hall Roof Top Unit #4, (RTU #4) on June 6, 2019.
RTU #4 provides cooling to the Police Administration and Office Area.
This unit is 21 years old and past the year for recommended replacement.
Staff has received a quote from Trane Building Services to replace the unit and program into the
BAS system.
The Quote includes new curb adapter, lifting the new unit onto the roof and disposing of the old
unit along with programing into the BAS system,
The total quote from Trane is $13,000. This expense is not in the 2019 budget. Staff met with the
Finance Director to determine a funding source for the replacement.
A budget adjustment of $13,000 to the Special Project Fund account 480-4180-7030 is required
in order to make the necessary replacement of RTU #4.
Strategic Plan Strategy/Goal: Maintain and Plan for Infrastructure Improvements.
Financial Impact: Budget Adjustment is needed for $13,000, is required to the 2019 Budget, in
the Special Project Fund, account 480-4180-7030 for this needed repair.
Recommendation:
Staff recommends approving the quotes from Trane Building Services to replace and install RTU
#4 at City Hall for a total of $13,000, Staff also recommends the City Council approve a 2019
Budget adjustment of $13,000 to the Special Project Funds account 480-4180-7030 in order to
make the needed repairs and replacement of RTU #4.

WHEREAS, Public Works Department is responsible for the building maintenance at all
City facilities, this includes the heating ventilation and air conditioning (HVAC) of the buildings;
and
WHEREAS, City Hall RTU #4 after 21 years or service had the compressor and fan failed;
and
WHEREAS, Staff has received a quote from Trane Building Services to install a new RTU
at City Hall for a total of $13,000; and
WHEREAS, this repair is not budget and requires a 2019 Budget adjustment of $13,000
to the Special Project Funds account 480-4180-7030.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View,
Ramsey County, Minnesota as follows:
1. Approves the proposal from Trane Building Services to install a new RTU at City Hall
for a total of $13,000.
2. Approves a 2019 Budget adjustment to the Special Project Fund account 480-4180-
7030 of $13,000 for the necessary replacement of RTU #4 at City Hall.
3. The Mayor and City Administrator are hereby authorized and directed to execute all
appropriate documents to effectuate the actions contemplated by this resolution.
4. The Mayor and City Administrator, Staff and consultants are hereby authorized and
directed to take any and all additional steps and actions necessary or convenient in
