WHEREAS, the properties are zoned PUD Planned Unit Development, and are within the County Road 10 Corridor Overlay District; and, WHEREAS, all permitted uses, accessory uses, and conditional uses within all zoning districts are a Permitted Use within a PUD district. Multi -Family Dwellings are a Conditional Use within the R-4 High Density Residential district, and therefore are a Permitted Use within the PUD District, subject to approval of a Conditional Use Permit for a Residential Planned Unit Development; and, WHEREAS, a Development Review is required for construction activity that increases the gross square footage of the principle building by 10% or, 10,000 square feet. The Developer has proposed a new 145,000 sq ft building; and, WHEREAS, the Developer has submitted the following; Applications Geotechnical Report (Chosen Valley Testing) 3D renderings Site Plan (Cole Group) Civil plans (Schultz Engineering) Landscape Plan (Cole Group) Photometric Plan (Router Group) dated, Jan 14, 2019 dated Mar 21, 2019, received May 2, 2019) undated, received, May 30, 2019 undated, received May 30, 2019 undated, received May 30, 2019 undated, received May 30, 2019 dated May 30, 2019, received May 30, 2019 Resolution 9132 Page 3 of 5 Architectural Plans (Cole Group) Elevation plans (Cole Group) Preliminary Plat (O'Malley & Kron) Final Plat (O'Malley & Kron) undated, received May 2, 2019 undated, received May 30, 2019 undated, received May 30, 2019 undated, received May 30, 2019 WHEREAS, plans submitted by the Developer, received May 2, 2019, were distributed by Staff to applicable departments and agencies. Comments were received from the following: Tyler McLeetc, Stantec, City Engineer (May 21, 2019) Nick Henly, Mounds View, Building Official (May 17, 2019) Jacob Martin, Mounds View, Fire Inspector I (May 16, 2019) Gregg Gund, Ramsey County, Survey Technician (May 29, 2019) Erin Laberee, Ramsey County, Traffic Engineer (May 7, 2019) Nick Tomczik, Rice Creek Watershed District, Permit Coordinator (May 7, 2019) WHEREAS, the Developer submitted revised plans on May 30, 2019. Applicable plans were included in the June 24, 2019 City Council Staff Report; and, WHEREAS, the Planning Commission reviewed the request at its June 19, 2019 meeting, recommending approval (Resolution 1099-19); and, WHEREAS, the City Council conducted a dully noticed Public Hearing on June 24, 2019; and makes the following Findings (italics): 1. The use will not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. Finding: The proposed 128 -unit apartment building will not create an excessive burden on public facilities. 2. The use will be sufficiently compatible or separated by distance or screening from adjacent residentially zoned or used land so that existing homes will not be depreciated in value and there will be no deterrence to development of vacant land. Finding: The proposed 128 -unit apartment building includes sufficient setbacks and landscaped screening from adjacent single-family homes. 3: The structure and site shall have an appearance that will not have an adverse effect upon adjacent residential properties. Finding: The proposed 128 -unit apartment building includes features such as decks and patios along Edgewood Dr to better assimilate into its residential setting. 4. The use, in the opinion of the City Council, is reasonably related to the overall needs of the City and to the existing land use. Resolution 9132 Page 4 of 5 Finding: The proposed 128 -unit apartment building fits a need for additional market -rate housing, as demonstrated by a housing study submitted by the Developer, and completed by Viewpoint Consulting Group, dated April 23, 2018. The study supports a need for 130 —173 market -rate apartment units between the years 2017-2022 within the Mounds View area, to capture 15% - 20% of the unmet demand within the area. The use is consistent with the purposes of the Zoning Code and the purposes of the zoning district in which the applicant intends to locate the proposed use. Finding: The proposed 128 -unit apartment building is consistent with the purposes of a Planned Unit Development. 6. The use is not in conflict with the Comprehensive Plan of the City. Finding: The Comprehensive Plan (2008) guides these properties as Mixed Use PUD. The proposed apartment building is consistent with the residential component of the Mixed- Use designation. The use will not cause traffic hazards or congestion. Finding: The addition of a 128 -unit apartment building will significantly increase local traffic. Careful consideration was made on the appropriate location of the property's driveway access, with consultation from Ramsey County and the City Engineer. The proposed location on Edgewood Drive will have the least impact on the greatest number of residents and users. 8. Adequate utilities, access roads, drainage and necessary facilities have been or will be provided. Finding: Adequate utilities, roads, and drainage facilities exist, or will be constructed as part of the project. WHEREAS, Prior to the issuance of any building permits, the Developer shall submit a Landscape Escrow to the City, or other surety acceptable to the City Attorney, in an amount equal to 150% of the estimated cost of landscape materials and labor. The City may hold this in a non-interest bearing account. Landscaping shall be completed prior to a Certificate of Occupancy (C/O) being issued. On or about one year after the C/O is issued and landscaping is completed, landscaping shall be inspected by Staff. Any landscaping that has not survived or is in poor health, shall be replaced by the Developer. The City shall refund the escrow, but may withhold a proportionate amount until one-year after the replaced landscape materials have been inspected and determined satisfactory. Resolution 9132 Page 5 of 5 WHEREAS, in permitting a new conditional use, the City Council may impose additional conditions which the City Council considers necessary to protect the best interest of the surrounding area or community as a whole. These conditions shall be described in a PUD Narrative and consistent with plans submitted May 30, 2019, to be approved by the City Council; and, NOW, THEREFORE, BE IT FINALLY RESOLVED, that the Mounds View City Council approves of this Conditional Use Permit for a Residential Planned Unit Development, and Development Review, and directs Staff to prepare a Final PUD Narrative, to be reviewed by the City Attorney, and may be signed by the Mayor, City Administrator, and Applicant.
