8. COUNCIL BUSINESS
A. Resolution 9146, Authorizing the Dissolution of the North Metro I -35W
Corridor Coalition.
City Administrator Zikmund requested the Council authorize the Dissolution of the North Metro
I -35W Corridor Coalition. He explained this organization has been around for the past 10 years.
He reported this group has met its mission and could therefore be dissolved.
Council Member Gunn explained the City would receive a small distribution of assets from the I -
35W Corridor Coalition after Mr. Behnke was paid for his services.
Mayor Mueller thanked Council Member Gunn for her service with this organization.
MOTION/SECOND: Gunn/Meehlhause. To Waive the Reading and Adopt Resolution 9146,
Authorizing the Dissolution of the North Metro I -35W Corridor Coalition.
Ayes — 5 Nays — 0 Motion carried.
B. Resolution 9147, Approving a Revision to the 2019 Fee Schedule by Adding
an Engineering Plan Review Fee.
City Administrator Zikmund requested the Council approve a revision to the 2019 Fee Schedule
by adding an Engineering Plan Review Fee. He explained this fee would allow the City to
recover costs for inspections being completed for engineering plans.
MOTION/SECOND: Meehlhause/Gunn. To Waive the Reading and Adopt Resolution 9147,
Approving a Revision to the 2019 Fee Schedule by Adding an Engineering Plan Review Fee.
Mayor Mueller stated it was her hope the engineering review would assist with addressing
problems before they occur for residents constructing a shed or deck.

I C. Ordinance 962, First Reading and Introduction of an Ordinance Granting to
2 CenterPoint Energy Resources, a Natural Gas Utility, A Delaware
3 Corporation, its Successors and Assigns, a Nonexclusive Franchise to
4 Construct, Operate, Repair and Maintain Facilities and Equipment for the
5 Transportation, Distribution, Manufacture, and Sale of Gas Energy for
6 Public and Private Use and to Use the Public Ways and Public Ground of the
7 City of Mounds View, Minnesota, for Such Purposes; and Prescribing
8 Certain Terms and Conditions Thereof.

10 Finance Director Beer requested the Council grant CenterPoint Energy Resources a Nonexclusive
11 Franchise to Construct, Operate, Repair and Maintain Facilities and Equipment for the
12 Transportation, Distribution, Manufacture, and Sale of Gas Energy for Public and Private Use
13 and to Use the Public Ways and Public Ground of the City of Mounds View. He reported this
14 franchise with CenterPoint began in 1999. He noted the proposed franchise would allow
15 CenterPoint to continue operating in Mounds View and the document would include a sunset
16 provision.

28 D. Ordinance 965, First Reading and Introduction of an Ordinance Amending
29 Chapter 514 Relating to Lawful Gambling.

31 City Administrator Zikmund requested the Council introduce an Ordinance amending Chapter
32 514 relating to Lawful Gambling. He reviewed the proposed change within the Code language
33 noting the Council was proposing to charge a 10% fee to those holding a charitable gambling
34 license.

36 Council Member Meehlhause requested the Council discuss the charities that should benefit from
37 these dollars at a future worksession meeting. City Administrator Zikmund reported he would
38 bring this item back to the Council for further discussion at the October worksession meeting.

45 E. Resolution 9151, Approving the Purchase of One Police Replacement SUV.

2 Police Chief Harder requested the Council approve the purchase of one Police replacement SUV.
3 He explained the Police Department lost a squad car and was in need of a replacement. He
4 discussed how vehicle costs would increase in 2020. For this reason, he recommended a
5 replacement SW be purchased from the State bid because it was immediately available. He
6 noted much of the equipment could not be harvested out of the totaled vehicle which meant the
7 new vehicle would have to be fully outfitted. He provided further comment on the expense of
8 the SW and recommended approval of the purchase.

1 o Mayor Mueller asked if this purchase would cut into the 2020 budget. Police Chief Harder
1 1 explained this vehicle was purchased in 2019 and the Department would be receiving insurance
12 proceeds. However, he anticipated there would be slight difference between the insurance
13 proceeds and the final expense for the purchase. He noted he had originally planned to purchase
14 two SW's in 2019 but only moved forward with the purchase of one vehicle.

21 F. Resolution 9153, Approving a Construction Contract with O'Neil Electric
22 Inc. for the Bronson Lift Station Upgrades and SCADA Program
23 Engineering Services with AE2S.

25 Public Works Director Peterson requested the Council approve a Construction Contract with
26 O'Neil Electric Inc. for the Bronson Lift Station upgrades and SCADA Program Engineering
27 Services with AE2S. He explained the components at this lift station dated back to 1991. He
28 commented further on the much-needed updates and recommended approval of the construction
29 contract with AE2S. He reported the expense for this project would be covered by the Sanitary
30 Sewer budget.

32 Mayor Mueller asked how long this project would take to complete. Public Works Director
33 Peterson estimated the project would take 30 days to complete.

35 Council Member Meehlhause asked how many lift stations the City had. Public Works Director
36 Peterson reported the City had two lift stations and commented further on the areas they served.

2 Public Works Director Peterson requested the Council approve purchase and installation of
3 electronic locks at the City Hall playground and splash pad building. He explained the locks
4 would be programmable and would alert staff if doors were ajar. Staff reviewed the bids for this
5 project and recommended approval of the project. It was noted the expense for the electronic
6 locks would be covered by the Special Projects Fund.

s Mayor Mueller questioned when this project would be completed. Public Works Director
9 Peterson anticipated the work would be completed after Labor Day.

12 Approving Purchase and Installation of Electronic Locks at the City Hall Playground and Splash

17 9. REPORTS
18 A. Reports of Mayor and Council.

20 Council Member Gunn invited all residents to attend Festival in the Park this weekend. She
21 reviewed the events that had been planned for this year, which included a parade, dance, car
22 show, bike race, music, K-9 demonstrations, fireworks and festivities at Silver View Park.
23
24 Council Member Meehlhause reported he would no longer be serving on the Executive
25 Committee for NYFS but noted he would be serving on the Finance Committee.
26
27 Council Member Bergeron thanked everyone who hosted or attended a Night to Unite gathering
28 on Tuesday, August 6th. He thanked the Police Department, Fire Department, Allina and the
29 Irondale Band for their presence in the City at various events.

31 Mayor Mueller commented on a barking dog situation that was addressed at a recent worksession
32 meeting.

34 Mayor Mueller reported she was looking forward to attending the Festival in the Park Committee
35 meeting on Tuesday, August 13th where all final details would be wrapped up for this year's
36 event. She explained she was seeking volunteers to assist with setting up a tent for the car show
37 on Friday, August 16th from 2:00 to 4:00 p.m. She encouraged all residents to attend this year's
38 Festival in the Park activities which were planned for Friday, August 16th and Saturday, August
39 17th

41 B. Reports of Staff.

43 Public Works Director Peterson reported the final lift was installed on Wooddale Drive. He
44 commented the two new shelters at the splash pad would be installed later this week. He

1 explained the County continued their work on Long Lake Road and information on this project
2 was available on Ramsey County's webpage.

4 Public Works Director Peterson indicated staff has received concerns regarding the amount of
5 parking that was occurring on Edgewood Drive for people visiting the splash pad. He indicated
6 the Council could consider eliminating parking on the east side of the street. Further discussion
7 ensued regarding the parking situation surrounding the splash pad. The Council supported the
8 elimination of parking on the east side of Edgewood.

10 Public Works Director Peterson explained a portion of the playground equipment that was at City
11 Hall Park would be relocated to Random Park.

13 i. 1St and 2nd Quarter Police Report
14
15 Police Chief Harder reviewed the 1St and 2nd Quarter Police report with the Council. He
16 explained arrests and traffic stops were up given the fact the Mounds View Police Department
17 now had a full-time traffic officer. He commented on the benefits of the VCET team's
18 intelligence. He discussed the numerous community outreach events the Police Department had
19 scheduled and he thanked his officers for participating in the Special Olympics Torch Run.

21 Mayor Mueller requested the 1St and 2nd Quarter Police reports be posted on the City's website.
22 Police Chief Harder explained this would be done and the information would be made available
23 to the public.

25 Mayor Mueller discussed how busy the department's K-9 officers have been this year and
26 commended each officer for their great work on behalf of the community. Police Chief Harder
27 stated he was extremely proud of both of the department's handlers and K -9's.

29 City Administrator Zikmund reported the Council would be holding a strategic planning retreat
30 on Monday, August 19th at Random Park at 6:00 p.m.
31
32 City Administrator Zikmund explained the comment period on the Tobacco 21 Ordinance would
33 expire in two weeks, on August 20th
34
35 Theresa Cermak provided the Council with an update on the events the Police Foundation would
36 be running at Festival in the Park. She explained this group would be in charge of bingo and
37 other children's games. She indicated she was still seeking volunteers to assist with Festival in
38 the Park. She noted she would be retiring from the Festival in the Park Committee after 26 years
39 of service to the community. The Council offered Ms. Cermak a round of applause and thanked
40 her for her dedicated service to the City.

Item Title/Subject: Resolution 9156, Appointing Alexis Bostrom to Police
Administrative Assistant
Introduction:
Resolution 9130 passed on June 24, 2019, which approved the hiring of a Police
Records/Evidence Technician. Staff advertised the position however due to a turnover
within the Police Department administrative staff there became an urgency to fill the
Police Records/Evidence Technician position before the closing date. The Police
Administrative Assistant received a promotion to the position of Police Evidence/Records
Technician. Police Evidence/Records Technician applicants received notification of the
job title/responsibility changes and interviews for the Police Administrative Assistant
position progressed.
Discussion:
The administrative police posting advertised for 10 working days on the City's web site,
the League of Minnesota Cities web site, and Indeed.com. Staff received 32 completed
application packets by the deadline. Police Department personnel and the Human
Resources Coordinator interviewed eight (8) candidates and selected Ms. Alexis Bostrom
for the position.
Strategic Plan Strategy/Goal:
Create a culture where employees desire to work.
Financial Impact:
This is a budgeted position.
Recommendation:
The panel is recommending the Council appoint Ms. Alexis Bostrom to the position of
Police Administrative Assistant starting September 3, 2019. Due to her previous work
experience, the panel recommends Ms. Bostrom start at Step 2 in the 2019 compensation
plan, complete a six-month probationary period and advance to Step 3 on her one-year
anniversary based on successful job performance.

The Charter Commission was established in 1980 after two years of meetings by
concerned citizens that crafted and drafted a City Charter that was presented and
approved by the majority of voters. In its original form, the Charter had 15 members but
was subsequently amended down to 9. Due to the resignation of Marissa Reyes -
Johnson shortly after conclusion of the May 21, 2019 meeting there is a vacancy.
Discussion:
As council is aware, finding residents to serve has been challenging. Additionally, as
you are aware the 10th Judicial District Court advertises for and appoints Charter
Commission members. In speaking with the Court Administrator Luke Gosselin, he has
informed me that as of August 26, 2019, Robert (Bob) King is the only resident to have
filed for service.
Recommendation:
Adopt Resolution 9158 requesting the court to appoint Robert (Bob) King to the Charter
Commission.

Introduction: At their June 3, 2019 Workshop, Council received presentation and input
from representatives advocating for increased regulation of tobacco products.
Discussion: Upon conclusion of the presentation, Council reviewed the various options;
Age 21, vaping products, menthol products, combination of two or more. Council
consensus was to move forward with Age 21 restriction only. State law requires a 30 day
notice to the code prior to holding a public hearing. Upon receipt of the updated code
from City Attorney, staff published on the web page and sent notice to the attached
tobacco retailers the week of July 15 notifying them of the proposed change and that a
public hearing would be occurring at the August 26, 2019 meeting (thereby complying
with statutory requirement. To date, staff has received no communication from any
retailer and has included in the packet a letter received from an advocate.

Mounds View recognizes that the sale of commercial tobacco, tobacco -related devices, electronic
delivery devices, and nicotine or lobelia delivery products to persons under the age of 18 violates
both state and federal laws: and because studies, which the city accepts and adopts, have shown
that youth use of any commercial tobacco product has increased to 26.4% in Minnesota: and
because nearly 90% of people who use tobacco start before they have reached the age of 18 years,
and that almost no one starts using tobacco after age 25: and because studies show that youth and

young adults are especially susceptible to commercial tobacco product availability and advertising
at tobacco retail environments: and because commercial tobacco use has been shown to be the
cause of many serious health problems which subsequently place a financial burden on all levels
of government, this ordinance is intended to regulate the sale of commercial tobacco. tobacco -
related devices, electronic delivery devices, and nicotine or lobelia delivery products for the
purpose of enforcing and furthering existing laws, to protect youth and young adults against the
serious health effects associated with use and initiation, and to further the official public policy of
the state to prevent young people from starting to smoke, as stated in Minn. Stat. & 144.391, as it
may be amended from time to time.
In making these findings, the City Council accepts the conclusions and recommendations o£ the

512.02: DEFINITIONS: Except as may otherwise be provided or clearly implied by context,
all terms shall be given their commonly accepted definitions. For the purpose of this chapter, the
following definitions shall apply unless the context clearly indicates or requires a different meaning.
Subd. 1. COMPLIANCE CHECKS. The system the City uses to investigate and ensure that
those authorized to sell , and eleetfenie
deliver -y devices licensed products are following and complying with the requirements of
this ordinance. Compliance checks shall involve the use of miner- ns under 21 as
authorized by this ordinance. Compliance checks shall also mean the use of minor -s - erg
under 21 who attempt to purchase , and
eleetrenie–delivery deviees licensed products for educational, research and training
purposes as authorized by state and federal laws. Compliance checks may also be
conducted by other units of government for the purpose of enforcing appropriate federal,
state or local laws and regulations relating to , tebaeee related

Subd. 2. INDIVIDUALLY PACKAGED. The practice of selling any tobacco or tobacco
product wrapped individually for sale. Individually wrapped tobacco and tobacco products
shall include but not be limited to single cigarette packs, single bags or cans of loose
tobacco in any form, and single cans or other packaging of snuff or chewing tobacco.
Cartons or other packaging containing more than a single pack or other container as
described in this definition shall not be considered individually packaged.
Subd. 3. INDOOR AREA. All space between a floor and a ceiling that is bounded by walls,
doorways, or windows, whether open or closed, covering more than 50 percent of the
combined surface area of the vertical planes constituting the perimeter of the area. A wall
includes any retractable divider, garage door, or other physical barrier, whether temporary
or permanent
Subd. 4. LOOSIES. The common term used to refer to a single or individually packaged
cigarette or any other tobacco product that has been removed from its packaging and sold
individually. The term "loosies" does not include individual cigars with a retail price,
before any sales taxes, of more than $2.00 per cigar.
Subd. 5. LICENSED PRODUCTS. Licensed Products shall mean the term that collectively
refers to any tobacco product, tobacco —related device, or electronic delivery device.
Subd. 6. MOVEABLE PLACE OF BUSINESS. Any form of business operated out of a
truck, van, automobile or other type of vehicle or transportable shelter and not a fixed
address store front or other permanent type of structure authorized for sales transactions.
Subd. 7. ELECTRONIC DELIVERY DEVICE. "Electronic Delivery Device" shall mean
any product containing or delivering nicotine, lobelia, or any other substance; whether
natural or synthetic intended for human consumption that can be used by a person to
simulate smoking in the delivery of nicotine or any other substance through inhalation of
vapor from the product. Electronic delivery device shall include any component part of
such a product whether or not sold separately. Electronic delivery device shall not include
any product that has been approved or otherwise certified by the United States Food and
Drug Administration for legal sales for use in tobacco cessation treatment or other medical
purposes, and is being marketed and sold solely for that approved purpose.
Subd. 8. RETAIL ESTABLISHMENT. Any place of business where tobacco, tobacco
products, tobacco -related devices, or nicotine or lobelia delivery devices are available for
sale to the general public. The phrase shall include but not be limited to grocery stores,
convenience stores, restaurants, and drug stores
Subd. 9. SALE. Any transfer of goods for money, trade, barter or other consideration.

Subd. 10. SELF-SERVICE MERCHANDISING. Open displays of tobacco, tobacco products,
tobacco -related devices, or electronic delivery devices in any manner where any person
shall have access to the tobacco, tobacco products, tobacco -related devices, or electronic
delivery devices, without the assistance or intervention of the licensee or the licensee's
employee. The assistance or intervention shall entail the actual physical exchange of the
tobacco, tobacco product, tobacco -related device, or electronic delivery device between the
customer and the licensee or employee. Self-service sales are interpreted as being any sale
where there is not an actual physical exchange of the product between the clerk and the
customer.
Subd. 11. SMOKING. Inhaling or exhaling smoke from any lighted or heated cigar, cigarette,
pipe, or any other lighted or heated product, whether natural or synthetic,
containing, made, or derived from nicotine, tobacco, marijuana, or other plantthat is 6f
inhaling er- exhaling vaper- ftem any eleetfenie delivery deviee. Smoking shall ineftWe
eaffying a lighted or- heated eigar-, eigar-ette, pipe, or- any other- lighAed or- hea4ed tobaeee e
plant pr-edu intended for inhalation. Smoking also includes carrying or using an activated
electronic delivery device.
Subd. 12. TOBACCO or TOBACCO PRODUCTS. Tobacco and tobacco products include
any product containing, made, or derived from tobacco that is intended for
human consumption, whether chewed, smoked, absorbed, dissolved, inhaled, snorted,
sniffed, or ingested by any other means, or any component, part, or accessory of a tobacco
product; cigarettes: cigars; cheroots; stogies; perique; granulated, plug cut, crimp cut, ready
rubbed, and other smoking tobacco; snuff, snuff flour; Cavendish; plug and twist tobacco;
fine cut and other chewing tobaccos; shorts; refuse scraps, clippings, cuttings and
sweepings of tobacco; and other kinds and forms of tobacco. Tobacco excludes any tobacco
product that has been approved by the United States Food and Drug Administration for
sale as a tobacco cessation product, as a tobacco dependence product, or for other medical
purposes, and is being marketed and sold solely for such an approved purpose.
Subd. 13. TOBACCO -RELATED DEVICES. Tobacco -related devices includes any tebaeee
pr-eduet as pipe, rolling papers, ashtray, or other device intentionally designed or
intended to be used with tobacco products. e �,>7ie enables the ,.>,o., ing sniffing
Tobacco related devices shall include
components of tobacco related devices which may be marketed or sold separately.
Subd. 14. VENDING MACHINE. Any mechanical, electric or electronic, or other type of
device which dispenses tobacco, tobacco products or tobacco -related devices upon the
insertion of money, tokens or other form of payment directly into the machine by the person
seeking to purchase the tobacco, tobacco product or tobacco -related device.
512.03: LICENSE:
Subd. 1. License required. No person shall sell or offer to sell any ,
tobacco related deviee, or- eleetreaie delivery de licensed products without first having
obtained a license to do so from the City.

Subd. 2. Application. An application for a license to sell tobacco, tobacco products, tobacco -
related devices, or electronic delivery devices shall be made on a form provided by the City.
The application shall contain the full name of the applicant, the applicant's residential and
business addresses and telephone numbers, the name of the business for which the license
is sought, and any additional information the City deems necessary. Upon receipt of a
completed application, the City Administrator shall forward the application to the City
Council for action at its next regularly scheduled City Council meeting. If the City
Administrator shall determine that an application is incomplete, he or she shall return the
application to the applicant with notice of the information necessary to make the application
complete.
Subd. 3. Action. The City Council may either approve or deny the license, or it may delay
action for a reasonable period of time as necessary to complete any investigation of the
application or the applicant it deems necessary. If the City Council shall approve the license,
the City Administrator shall issue the license to the applicant. If the City Council denies the
license, notice of the denial shall be given to the applicant along with notice of the
applicant's right to appeal the City Council's decision.
Subd. 4. Term. The license is effective from July 1 st to June 30th of each year.
Subd. 5. Revocation or suspension. Any license issued under this section may be revoked or
suspended as provided in Section 512.12.
Subd. 6. Transfers. All licenses issued under this Chapter shall be valid only on the premises
for which the license was issued and only for the person to whom the license was issued.
No transfer of any license to another location or person shall be valid without the prior
approval of the City Council.
Subd. 7. Moveable place of business. No license shall be issued to a moveable place of
business. Only fixed location businesses shall be eligible to be licensed under this section.
Subd. 8. Display. All licenses shall be posted and displayed in plain view of the general
public on the licensed premise.
Subd. 9. Renewals. The renewal of a license issued under this section shall be handled in the
same manner as the original application.
Subd. 10. Issuance as privilege and not a right. The issuance of a license issued under this
section shall be considered a privilege and not an absolute right of the applicant and shall
not entitle the holder to an automatic renewal of the license.
Subd. 11. Proximity to youth -oriented facilities. No license shall be granted pursuant to this
Chapter to any person for any retail sales of ,
devieesZand eleEtrenie delivery dev licensed products within 1,000 feet of any school,
playground, house of worship, or youth -oriented facility, as measured by the shortest line

between the space to be occupied by the proposed licensee and the occupied space of the
school, playground, house of worship, or youth -oriented facility, unless that person has been
in the business of selling such products in that location before the date this Chapter was
enacted into law for at least one year. For the purpose of this section, a youth -oriented
facility is defined to include any facility with residents, customers, visitors, or inhabitants
of which 25 percent or more are regularly under the age of 21 or which primarily sells, rents,
or offers services or products that are consumed or used primarily by persons under the age
of 21.
Subd. 12. Proximity to other tobacco retailers. No license shall be granted pursuant to this
Chapter to any person for any retail sales *„>,,,eee *„>,,,eeo pr -e uets *„>,,,eee related devices
licensed products within 2,000 feet of any other
establishment holding such a license, as measured by the shortest line between the space to
be occupied by the proposed licensee and the occupied space of the nearest existing licensee,
unless that person has been in the business of selling such products in that location before
the date this section was enacted into law for at least one year.
Subd. 13. Proximity limitation. Subdivisions 11 and 12 of Section 512.03 shall only apply to
new licenses approved after January 1, 2012. Subdivisions 11 and 12 of Section 512.03 shall
not apply to renewals and approved transfers.
Subd. 14. Smoking.
a. Smoking shall not be permitted and no person shall smoke within the indoor area
of any retail establishment with a tobacco retailer license. Smoking for the purposes of
sampling , and elee4enie delivery
deviees-licensed products is prohibited.
b. Notwithstanding paragraph (a), pursuant to Minnesota Statutes, Section 144.4167,
subdivision 4, a cigar may be lit in a retail establishment if all of the following circumstances
are met:
1. The smoking is by a customer or potential customer, who is not Winder
the age of 21, for the specific purpose of sampling cigars;
2. The retail establishment has an entrance door opening directly to the outside;
3. The retail establishment is not a tobacco department or section of any individual
business establishment with any type of liquor, food, or restaurant license; and
4. The retail establishment derives more than 90 percent of its gross revenue from
the sale of loose tobacco, plants, or herbs and cigars, cigarettes, pipes, and other
smoking devices for burning tobacco and related smoking accessories and in which
the sale of other products is merely incidental.

C. Any cigar lighting allowed under paragraph (b) shall be prohibited in the licensee's
retail establishment if the licensee transfers title to, relinquishes management or control,
sells the retail establishment, or the licensee's tobacco license is suspended or revoked by
the City.
Subd. 15. Each license issued under this article is subject to all of the following conditions:
a. The licensee must post signs in visible locations that prohibit loitering inside or
near the front entrance of the retail establishment.
b. The licensee must fully light the interior of the retail establishment during business
hours such that every part, corner, aisle, room, and section of the retail establishment is
illuminated wholly.
C. The sales counter, store entrance, and interior of the retail establishment shall be
visually recorded with a videotape or similar device at a quality level that allows the visual
identification of patrons and employees. The recordings shall be maintained and made
available to the police for thirty calendar days before being reused.
d. The licensee must post a sign at the front entrance that prohibits selling tebaeee
relmed licensed products to minor -s - persons under the age of 21.
e. The licensee must fully cooperate with representatives from the City of Mounds
View when present at the retail establishment for City business purposes.
f. The licensee must maintain clean and clear front and rear entrances of the retail
establishment.
g. The licensee may not supply matches to non -purchasing customers.
h. Each day of business, the licensee must inspect the entrances of the retail
establishment for litter and properly dispose of such litter.
i. The licensee must promptly remove any graffiti on the exterior of the retail
establishment.
512.04: FEES: No license shall be issued under this Chapter until the appropriate license fee
shall be paid in full. The fee for a license under this Chapter shall be established in the City's Fee
Schedule, as it may be amended from time to time.
512.05: BASIS FOR DENIAL OF LICENSE:
Subd. 1. Grounds for denying the issuance or renewal of a license under this chapter include
but are not limited to the following:

a. The applicant is under the age of 4-921 years.
b. The applicant has been convicted within the past five years of any violation of a
federal, state, or local law, ordinance provision, or other regulation relating to tobacco,
tobacco products, tobacco -related devices, or electronic delivery devices.
C. The applicant has had a license to sell ,
devises-ereleetreaie delivery deviees licensed products revoked within the preceding 12
months of the date of application.
d. The applicant fails to provide any information required on the application, or provides
false or misleading information.
e. The applicant is prohibited by federal, state, or other local law, ordinance, or other
regulation from holding a license.
f. The applicant is not of good moral character.
Subd. 2. However, except as may otherwise be provided by law, the existence of any
particular ground for denial does not mean that the City must deny the license.
Subd. 3. If a license is mistakenly issued or renewed to a person, it shall be revoked upon
the discovery that the person was ineligible for the license under this chapter.
512.06: PROHIBITED SALES: It shall be a violation of this Chapter for any person to sell
or offer to sell any tebaeeo, tebaeee et, tebaeee-rested deviee,or-eleetrenie delivery de-
licensed products:
Subd 1. To any person under the age of 4-821 years.
Subd. 2. By means of any type of vending machine.
Subd. 3. By means of self-service methods whereby the customer does not need to a make a
verbal or written request to an employee of the licensed premise in order to receive the
licensed
product and whereby there is not a physical exchange of the ,
licensed product between the licensee,
or the licensee's employee, and the customer.
Subd. 4. By means of loosies as defined in Section 512.02.
Subd. 5. Containing opium, morphine, jimson weed, bella donna, strychnos, cocaine,
marijuana, or other deleterious, hallucinogenic, toxic or controlled substances except
nicotine and other substances found naturally in tobacco or added as part of an otherwise

lawful manufacturing process. It is not the intention of this provision to ban the sale of
lawfully manufactured cigarettes or other tobacco products.
Subd. 6. By any other means, to any other person, on in any other manner or form prohibited
by federal, state or other local law, ordinance provision, or other regulation.
Subd. 7. Such sales are prohibited before 10:00 A.M. and after 10:00 P.M. at any retail
establishment that derives more than 90 percent of its gross revenue from the sale of
tebaeee, tebaeeo related &ets, tebaeee-related device censed products.
512.07: SELF-SERVICE SALES: It shall be unlawful for a licensee under this chapter to
allow the sale of , or- eleetT-enie delivery d
licensed products by any means where by the customer may have access to those items without
having to request the item from the licensee or the licensee's employee and whereby there is not a
physical exchange of the tebaeee, t">,, eee prod ets tobaeeo related devicesor- eleet -once deliver,
dues licensed products between the licensee or his or her clerk and the customer. All
tobaeeo pr -educts, tebaeee r-ela4ed devieo or -elect -eerie delivet=y devi es licensed products shall
either be stored behind a counter or other area not freely accessible to customers, or in a case or
other storage unit not left open and accessible to the general public. Any retailer selling
licensed products at the
time this Chapter is adopted shall comply with this section within 90 days following the effective
date of this Chapter.
512.08: RESPONSIBILITY: All licensees under this Chapter shall be responsible for the
actions of their employees in regard to the sale of , tobaeeo related
licensed products on the licensed premises, and the sale of
an item by an employee shall be considered a sale by the license holder. Nothing in this section

512.09: COMPLIANCE CHECKS AND INSPECTIONS: All licensed premises shall be
open to inspection by the police department or other authorized City official during regular
business hours. From time to time, bu4 at least once per *The City shall conduct compliance
checks from time to time but at least twice per year. The City will conduct at least one compliance
check that involves the participation of a person between the ages of 15 and 17 and at least one
compliance check that involves the participation of a person between the ages of 18 and 20 to enter

research, or training purposes, or required for the enforcement of a particular state or federal law.
512.10: OTHER ILLEGAL ACTS: Unless otherwise provided, the following acts shall
be a violation of this Chapter:

(x)21 years shall be charged an administrative penalty of one hundred dollars ($100.00)
for a first offense and fifty dollars ($50.00) additional for every subsequent offense. This
penalty shall be in addition to the penalty charged under Section 512.11, Subd. 1. No penalty
under this Subdivision, shall take effect until the person against whom the penalty will be
charged has received notice, served personally or by mail, of the alleged violation, and has
had an opportunity for a hearing before the City Council. The notice shall provide
information on how and where a hearing may be requested. The hearing must be requested
within ten (10) business days of notice delivery. A decision by the City Council that a
violation of this Section has occurred shall be in writing. Judicial appeal shall be as provided
for by state law.
Subd. 3. Continued violation. Each violation, and every day in which a violation occurs or
continues, shall constitute a separate offense.
Subd. 45. Other individuals. Other individuals, ether- than miners as regulated by Subd. 4 of
this Section, found to be in violation of this Chapter, shall be charged an administrative fine
of $50.
Subd. 56. Defenses. It shall be an affirmative defense to a charge of
related devieos licensed products to a person under the age of eighteen ( 4`21 years in
violation of this Section that the licensee or individual making the sale relied in good faith

under this Chapter may be suspended or revoked by the City Council for a violation of any
provision of this Chapter if the licensee has been given a reasonable notice and an
opportunity to be heard. A second violation within twelve (12) months of the initial violation
shall result in a suspension of not less than three (3) consecutive days. A third violation
within twenty four (24) months of the initial violation shall result in a suspension of ten (10)
consecutive days. A fourth violation within twenty four (24) months of the initial violation
shall result in revocation of license for ninety (90) consecutive days, and shall require a
hearing before the City Council.
Subd. 2. Hearing and Notices. Suspension or revocation of a license shall be preceded by a
hearing before the City Council. A hearing notice shall be delivered to the licensee at least
ten (10) days prior to the hearing. The hearing notice shall state the time and place of the
hearing and the nature of the charges against the licensee. Judicial appeal shall be as provided
for by state law.
512.13: EXCEPTIONS: Nothing in this Chapter shall prevent the providing ef tebaeee, tebaeee
pteduets, tobaeeo-related devises;-or-eleetronie delivery devieeslicensed products to a mino
person under the age of 21 as part of a lawfully recognized religious, spiritual, or cultural
ceremony.
512.14: SEVERABILITY: If any section or provision of this ordinance is held invalid, such
invalidity shall not affect other sections or provisions which can be given force and effect without
the invalidated section or provision.
SECTION 2. This ordinance shall take effect and be in force 30 days from and after its passage and
publication, in accordance with Section 3.09 of the City Charter.

Dear Mayor Mueller and Mounds View City Council Members,
I strongly support your efforts in working on an ordinance to increase the tobacco sales age to
21. Approximately 95% of current adult smokers started before they were 21. If youth don't
smoke by the time they are 21, they likely never will.
As the Student Support Health Coordinator serving the students of Mounds View schools, I am
writing you to tell you that in my experience, tobacco products are still very appealing to our
young people. Tobacco has countless long-term negative health effects. In fact, the Minnesota
Department of Health released a health alert just this week to notify healthcare providers of
severe lung injury cases among teens who reported vaping. We also know that nicotine interferes
with brain maturation and can have long term effects on development and mental health.
The tobacco industry heavily targets young adults primarily between ages 18-21, particularly
with E -cigarettes. They come in bright colors and an array of flavors like strawberry, banana split
and cotton candy. Tobacco use among Minnesota High School students has increased for the first
time in 17 years. According to the 2017 Minnesota Youth Tobacco Survey, 26.7% of high school
students reported using a tobacco product in the past 30 days.
Increasing the tobacco sales age to 21 is a positive step towards keeping tobacco products out of
the hands of our youth. Your work will help us in creating and maintaining a healthy learning
environment for our youth and the students of Mounds View Public Schools.

WHY RAISE THE TOBACCO SALE AGE?
The tobacco industry heavily targets young adults ages 18-21 in order to
recruit new tobacco users and guarantee profits. Approximately 95 percent
of current adult smokers started before they were 21.' In Minnesota, no one
under 18 years old is allowed to buy tobacco. Youth get tobacco from several
sources, including social sources. A 16 -year-old has more contact with and
access to 18-year-olds who can buy tobacco. However, it is less likely a
16 -year-old would ask a 21 -year-old for tobacco. Increasing the age gap
between young people and those who can legally buy tobacco will reduce
youth access to tobacco.
A 2015 report from the Institute of Medicine (IOM) found that increasing
the legal age to purchase tobacco to 21 would decrease smoking initiation
among 15 -17-year-olds by 25 percent .2 A Minnesota -specific study looked
at the impact of raising the tobacco age and found that 25 percent fewer
15 -year-olds would start smoking by the time they turn 18 and 15 percent
fewer 18-year-olds would start smoking by the time they turn 18. This
translates into 30,000 young people not becoming smokers over the next 15
years.3 If youth don't smoke by the time they are 21, they likely never will.
WHAT IS THE IMPACT OF NICOTINE ON ADOLESCENT
BRAIN DEVELOPMENT?
Nicotine is addictive and is particularly harmful to the developing adolescent
brain. Evidence suggests that nicotine interferes with brain maturation and
can have a long-term effect on cognitive development and mental health.4
Even brief or intermittent nicotine exposure during adolescence can cause
lasting damage.5
The addictive properties of nicotine can lead adolescents to heavier daily
tobacco use and a more difficult time quitting later in life.6 Nicotine exposure
can also increase the risk of addiction to other harmful substances.5 The
long-term effects of nicotine on the adolescent brain is a significant public
health concern.'$
WHO SUPPORTS RAISING THE TOBACCO SALE AGE TO
21?
A 2014 national survey shows that 75 percent of adults favor increasing
the minimum sale age for tobacco to 21. A national consensus is growing
to protect young people from a lifetime of addiction and health problems
caused by tobacco by raising the tobacco sale age. In addition, 70 percent
of current smokers and 65 percent of those age 18-24 support raising the
minimum tobacco sale age.9
IS YOUTH TOBACCO USE STILL A PROBLEM?
The percent of students who smoke cigarettes is declining, but the 2016
Minnesota Student Survey found that 9th and 11th graders in Minnesota are
now using e -cigarettes at twice the rate of regular cigarettes.10 Increasing
the sale age to 21 would reduce youth access to all harmful tobacco
products, including e -cigarettes, cigars and hookah.
WHAT CAN STATE AND LOCAL GOVERNMENTS DO?
Twelve states have raised the age to 21 since 2016: California, Hawaii, New
Jersey, Maine, Oregon, Massachusetts, Virginia, Utah, Arkansas, Illinois,
Washington and Delaware. Needham, Mass., raised the legal tobacco
sales age to 21 in 2005. Within five years, tobacco use among high school
students decreased by nearly half." In Minnesota, 31 communities have
raised the age to 21, joining more than 450 communties nationwide.

Attached is an ordinance to receive a second reading and adoption. This ordinance continues
the franchise agreement with CenterPoint Energy. This agreement is similar to the franchise
ordinance adopted for Xcel Energy. The franchise ordinance covering Xcel Energy requires that
the City impose the same franchise amount as is imposed on Xcel.
Ordinance 625 passed on June 28, 1999 originally enacted the franchise agreement. It provides
that the City may impose a franchise fee of not more than 4% of CenterPoint's gross operating
revenues at any time during the 20 -year term of the franchise. The 20 -year term ran from 1999
through July 1, 2019. This agreement will extend the franchise for 20 more years from the date
of acceptance.
It has been the practice to include a sunset provision that is at the discretion of the City Council
and this does not change with this new franchise. Staff would request that a summary ordinance
be published with the complete ordinance available on-line and at City Hall.

SECTION 1. DEFINITIONS.
For purposes of this Ordinance, the following capitalized terms listed in alphabetical order
shall have the following meanings:
1.1 City. The City of Mounds View, County of Ramsey, State of Minnesota.
1.2 City Utility System. Facilities used for providing non -energy related public utility
service owned or operated by City or agency thereof, including sewer and water service, but excluding
facilities for providing heating, lighting or other forms of energy.
1.3 Commission. The Minnesota Public Utilities Commission, or any successor agency
or agencies, including an agency of the federal government, which preempts all, or part of the
authority to regulate Gas retail rates now vested in the Commission.
1.4 Company. CenterPoint Energy Resources Corporation, d/b/a CenterPoint Energy
Minnesota Gas, a Delaware corporation, its successors and assigns including all successors or assigns
that own or operate any part or parts of the Gas Facilities subject to this Franchise.
1.5 Gas. Natural gas, manufactured gas, any mixture thereof, or all other forms of
gaseous energy.
1.6 Gas Facilities. Pipes, mains, regulators, and other facilities owned or operated by
Company for the purpose of providing gas service for public use.
1.7 Notice. A written notice served by one party on the other party. Notice to Company
shall be mailed to the CenterPoint Energy, Minnesota Division Vice President, 505 Nicollet Mall,
Minneapolis, Minnesota 55402. Notice to the City shall be mailed to the City Administrator, City

Hall, 2401 Mounds View Blvd., Mounds View, MN 55112. Either party may change its respective
address for the purpose of this Ordinance by written notice to the other party.
1.8 Public Ground. Land owned by the City for park, open space or similar purpose,
which is held for use in common by the public.
1.9 Public Way. Any street, alley, walkway or other public right-of-way within the City.
SECTION 2. ADOPTION OF FRANCHISE.
2.1 Grant of Franchise. City hereby grants Company, for a period of 20 years from the
date passed and approved by the City, the right to transmit and furnish Gas energy for light, heat,
power and other purposes for public and private use within and through the limits of the City as its
boundaries now exist or as they may be extended in the future. For these purposes, Company may
construct, operate, repair and maintain Gas Facilities in, on, over, under and across the Public Grounds
and Public Ways of City, subj ect to the provisions of this Ordinance. Company may do all reasonable
things necessary or customary to accomplish these purposes, subject, however, to such reasonable
regulations as may be imposed by the City pursuant to a public right-of-way ordinance or permit
requirements adopted consistent with state law and to the further provisions of this franchise.
2.2 Effective Date; Written Acceptance. This Ordinance shall be in full force and effect
from and after passage of this Ordinance, its acceptance by Company, and its publication as
required by law. The City by Council resolution may revoke this franchise if Company does not
file a written acceptance with the City within 90 days after passage.
2.3 Service and Rates. The service to be provided and the rates to be charged by Company
for Gas service in City are subject to the jurisdiction of the Commission.
2.4 Publication Expense. The expense of publication of this Ordinance will be paid by
City and reimbursed to City by Company.
2.5 Dispute Resolution. If either party asserts that the other party is in default in the
performance of any obligation hereunder, the complaining party shall notify the other party of the
default and the desired remedy. The notification shall be written. Representatives of the parties must
promptly meet and attempt in good faith to negotiate a resolution of the dispute. If the dispute is not
resolved within 30 days of the written notice, the parties may jointly select a mediator to facilitate
further discussion. The parties will equally share the fees and expenses of this mediator. If a mediator
is not used or if the parties are unable to resolve the dispute within 30 days after first meeting with the
selected mediator, either party may commence an action in District Court to interpret and enforce this
franchise or for such other relief as may be permitted by law or equity for breach of contract, or either
party may take any other action permitted by law.
SECTION 3. LOCATION, OTHER REGULATIONS.
3.1 Location of Facilities. Gas Facilities shall be located, constructed and maintained so
as not to interfere with the safety and convenience of ordinary travel along and over Public Ways and
so as not to disrupt normal operation of any City Utility System previously installed therein. Gas
Facilities shall be located on Public Grounds as mututally determined by the City and the Company.

Company's construction, reconstruction, operation, repair, maintenance and location of Gas Facilities
shall be subject to permits if required by separate ordinance and to other reasonable regulations of the
City to the extent not inconsistent with the terms of this Ordinance. Company may abandon
underground gas facilities in place, provided, at City's request, Company will remove abandoned
metal pipe interfering with a City improvement project, but only to the extent such metal pipe is
uncovered by excavation as part of the City's improvement project.
3.2 Field Locations. Company shall provide field locations for its underground Gas
Facilities within City consistent with the requirements of Minnesota Statutes, Chapter 216D. In
addition, subject to the Homeland Security act or other applicable laws, the Company must
promptly provide mapping information for any of its underground Gas Facilities in accordance
with City Code, Chapter 910, and Minnesota Rules Parts 7819.4000 and 7819.4100.
3.3 Street Openings. Company shall not open or disturb any Public Ground or Public
Way for any purpose without first having obtained a permit from the City, if required by a separate
ordinance, for which the City may impose a reasonable fee. Permit conditions imposed on Company
shall not be more burdensome than those imposed on other utilities for similar facilities or work.
Company may, however, open and disturb any Public Ground or Public Way without permission
from the City where an emergency exists requiring the immediate repair of Gas Facilities. In such
event Company shall notify the City by telephone to the office designated by the City as soon as
practicable. Not later than the second working day thereafter, Company shall obtain any required
permits and pay any required fees.
3.4 Restoration. After undertaking any work requiring the opening of any Public Ground
or Public Way, Company shall restore the same, including paving and its foundation, to as good a
condition as formerly existed, and shall maintain any paved surface in good condition for two years
thereafter. The work shall be completed as promptly as weather permits, and if Company shall not
promptly perform and complete the work, remove all dirt, rubbish, equipment and material, and put
the Public Ground or Public Way in the said condition, the City shall have, after demand to Company
to cure and the passage of a reasonable period of time following the demand, but not to exceed five
days, the right to make the restoration at the expense of Company. Company shall, upon demand,
pay to the City the cost of such work done for or performed by the City.
3.5 Avoid Damage to Gas Facilities. Nothing in this Ordinance relieves any person,
including Company, from liability arising out of the failure to exercise reasonable care to avoid
damaging the Gas Facilities, or any other persons or property, while performing any activity.
3.6 Notice of Improvements. The City must give Company reasonable notice of plans for
improvements to Public Grounds or Public Ways where the City has reason to believe that Gas
Facilities may affect or be affected by the improvement. The notice must contain: (i) the nature and
character of the improvements, (ii) the Public Grounds and Public Ways upon which the
improvements are to be made, (iii) the extent of the improvements, (iv) the time when the City will
start the work, and (v) if more than one Public Ground or Public Way is involved, the order in which
the work is to proceed. The notice must be given to Company a sufficient length of time in advance
of the actual commencement of the work to permit Company to make any necessary additions,
alterations or repairs to its Gas Facilities.

SECTION 4. RELOCATIONS.
4.1 Relocation of Gas Facilities in Public Ways. Company shall relocate its Gas
Facilities at its own expense in accordance with the requirements of Minnesota Rules, Chapter
7819. The City shall endeavor to give Company reasonable Notice of plans for a City project
requiring relocation of Gas Facilities. Company relocation of Gas Facilities shall not be construed
as a waiver of Company's right to seek reimbursement of relocation cost consistent with Minnesota
Rules, Chapter 7819. Nothing in this Ordinance requires Company to relocate, remove, replace or
reconstruct at its own expense its Gas Facilities where such relocation, removal, replacement or
reconstruction is solely for the convenience of the City.
4.2 Relocation of Gas Facilities in Public Ground. City may require Company at
Company's expense to relocate or remove its Gas Facilities from Public Ground upon a finding by
City that the Gas Facilities have become or will become a substantial impairment to the existing or
proposed public use of the Public Ground.
4.3 Projects with Federal Funding. City shall not order Company to remove or relocate
its Gas Facilities when a Public Way is vacated, improved or realigned because of a renewal or a
redevelopment plan, or for a right-of-way project or any other project which is financially
subsidized in whole or in part by the Federal Government or any agency thereof, unless the
reasonable non -betterment costs of such relocation are first paid to Company. The City is obligated
to pay Company only for those portions of its relocation costs for which City has received federal
funding specifically allocated for relocation costs in the amount requested by the Company.
Relocation, removal or rearrangement of any Company Gas Facilities made necessary because of
a federally -aided highway project shall be governed by the provisions of Minnesota Statutes,
Section 161.46, as supplemented or amended. It is understood that the rights herein granted to
Company are valuable rights.
4.4 No Waiver. The provisions of this franchise apply only to facilities constructed in
reliance on a franchise from the City and shall not be construed to waive or modify any rights obtained
by Company for installations within a Company right-of-way acquired by easement or prescriptive
right before the applicable Public Ground or Public Way was established, or Company's rights under
state or county permit.
SECTION 5. TREE TRIMMING.
Company is also granted the permission and authority to trim all shrubs and trees, including
roots, in the Public Ways of City to the extent Company finds necessary to avoid interference with
the proper construction, operation, repair and maintenance of Gas Facilities, provided that Company
shall save City harmless from any liability in the premises.

SECTION 6. INDEMNIFICATION.
6.1 Indemni . of CitX. Company shall indemnify, keep and hold the City free and
harmless from any and all liability on account of injury to persons or damage to property occasioned
by the construction, maintenance, repair, inspection, the issuance of permits, or the operation of the
Gas Facilities located in the Public Grounds and Public Ways. The City shall not be indemnified for
losses or claims occasioned through its own negligence except for losses or claims arising out of or
alleging the City's negligence as to the issuance of permits for, or inspection of, Company's plans or
work. The City shall not be indemnified if the injury or damage results from the performance in a
proper manner of acts reasonably deemed hazardous by Company, and such performance is
nevertheless ordered or directed by City after notice of Company's determination.
6.2 Defense of City. In the event a suit is brought against the City under circumstances
where this agreement to indemnify applies, Company at its sole cost and expense shall defend the
City in such suit if written notice thereof is promptly given to Company within a period wherein
Company is not prejudiced by lack of such notice. If Company is required to indemnify and defend,
it will thereafter have control of such litigation, but Company may not settle such litigation without
the consent of the City, which consent shall not be unreasonably withheld. This section is not, as to
third parties, a waiver of any defense or immunity otherwise available to the City and Company, in
defending any action on behalf of the City shall be entitled to assert in any action every defense or
immunity that the City could assert in its own behalf.
SECTION 7. VACATION OF PUBLIC WAYS.
The City shall give Company at least two weeks prior written notice of a proposed vacation
of a Public Way. Except where required for a City improvement project, the vacation of any Public
Way, after the installation of Gas Facilities, shall not operate to deprive Company of its rights to
operate and maintain such Gas Facilities, until the reasonable cost of relocating the same and the loss
and expense resulting from such relocation are first paid to Company. In no case, however, shall City
be liable to Company for failure to specifically preserve a right-of-way under Minnesota Statutes,
Section 160.29.
SECTION 8. CHANGE IN FORM OF GOVERNMENT.
Any change in the form of government of the City shall not affect the validity of this
Ordinance. Any governmental unit succeeding the City shall, without the consent of Company,
succeed to all of the rights and obligations of the City provided in this Ordinance.
SECTION 9. FRANCHISE FEE.
During the term of this Ordinance, the City may at any time impose on Company a
franchise fee not to exceed four percent (4%) of the Company's gross revenues, as hereinafter
defined. Such fee shall be payable quarterly, or as may be directed pursuant to an ordinance
establishing such fee by the city council and shall be based on the gross revenues of the Company
during the preceding quarter. The payment is due on the last business day of the month following
the month for which payment is to be made. Such fee shall be imposed by ordinance duly adopted
in accordance with the City Charter and City Code, and shall not become effective until at least

ninety (90) days after written notice thereof has been served upon the Company by registered mail.
The percent fee may be changed by the Council by ordinance from time to time, however, the
percentage must remain unchanged for at least one year. Such fee ordinance shall not prevent the
Company from adjusting its charges in such manner as it deems appropriate for the purpose of
reimbursing the Company for the payments to be made to the City, nor prevent the Company from
indicating on its bills the customer's portion of said fees. The term "gross revenues" means all
sums, excluding said surcharge, received by the Company from the sale of Gas within the corporate
limits of the City, subject to subsequent reconciliation for uncollectibles, refunds and correction of
erroneous billings. The City shall impose equivalent franchise fees on other energy suppliers to the
extent the City has such authority.
SECTION 10. PROVISIONS OF ORDINANCE.
10.1 Severability. Every section, provision, or part of this Ordinance is declared separate
from every other section, provision, or part and if any section, provision, or part shall be held
invalid, it shall not affect any other section, provision, or part. Where a provision of any other
City ordinance conflicts with the provisions of this Ordinance, the provisions of this Ordinance
shall prevail.
10.2 Limitation on Applicability. This Ordinance constitutes a franchise agreement
between the City and Company as the only parties and no provision of this franchise shall in any
way inure to the benefit of any third person (including the public at large) so as to constitute any
such person as a third party beneficiary of the agreement or of any one or more of the terms hereof,
or otherwise give rise to any cause of action in any person not a party hereto.
SECTION 11. AMENDMENT PROCEDURE.
Either party to this franchise agreement may at any time propose that the agreement be
amended to address a subject of concern and the other party will consider whether it agrees that the
amendment is mutually appropriate. If an amendment is agreed upon, this Ordinance may be
amended at any time by the City passing a subsequent ordinance declaring the provisions of the
amendment, which amendatory ordinance shall become effective upon the filing of Company's
written consent thereto with the City Administrator within 90 days after the date of final passage
by the City of the amendatory ordinance.
SECTION 12. PREVIOUS FRANCHISES SUPERSEDED; PREVIOUS FEE ORDINANCE
CONTINUED.
This franchise replaces and supersedes Ordinance No. 625 and any other previous Gas
franchise granted to Company or its predecessor, and continues in full force and effect Ordinance No.
950 establishing a franchise fee for year 2019.

Attached is an ordinance to receive an introduction and first reading. The public hearing,
second reading, and adoption will be on Monday, September 9, 2019. Notice of the public
hearing was published in the August 21, 2019 Bulletin.
This ordinance continues the agreement with CenterPoint Energy under which Center
Point Energy will collect a franchise fee in the amount of 4% of Center Point's natural gas
gross operating revenues for services within the City of Mounds View during the year
2020 and 2021.
Ordinance 962 was considered on August 12 and 26 and passed on August 26, 2019. It
provides that the City may impose a franchise fee of not more than 4% of CenterPoint's
gross operating revenues at any time through July 1, 2039. The franchise fee was first
adopted in 1999 and collected in 2001.
It has been the practice to include a sunset provision in the ordinance requiring it to be
re-enacted each year. Franchise fees collected under this agreement are minimal due to
Center Point Energy's small customer base within the City of Mounds View.
The ordinance will be brought back to the City Council for a public hearing, second
reading and adoption at the September 9, 2019 meeting. It will be published in the Sun
Focus and take effect as provided in the ordinance after publication. Staff would request
that a summary ordinance be published with the complete ordinance available on-line
and at City Hall.

THE CITY OF MOUNDS VIEW ORDAINS:
SECTION 1. The City of Mounds View Municipal Code Appendix D is hereby amended
to include reference to the following Special Ordinance.
Subdivision 1. Purpose. The Mounds View City Council has determined that it is
in the best interest of the City to impose a franchise fee on those public utility companies
that provide natural gas and electric services within the City of Mounds View.
a. Pursuant to City Ordinance No. 962, which is the Franchise Agreement
("Franchise Agreement") between the City of Mounds View (the "City") and
CenterPoint Energy (formerly Reliant, formerly Minnegasco), its successors and
assigns, a franchise fee of not more than four (4.0) percent of CenterPoint Energy's
gross operating revenues may be imposed by the City at any time during the 20
year term of the Franchise in amount and fee designs as set forth in Section 2.1 of
the CenterPoint Energy Franchise.
Subd. 2. Franchise Fee Statement. A franchise fee is hereby imposed on Center
Point Energy under its natural gas Franchise Agreement in the amount of four percent
(4%) of Center Point Energy's gross revenues, as defined in Section 9 of the Franchise
Agreements commencing with Center Point Energy's January 2020 billing month.
Subd. 3. Payment. The said franchise fee shall be payable to the City in
accordance with the terms set forth in Section 9 of the Franchise.
Subd. 4. Surcharge. The City recognizes that the Minnesota Public Utilities
Commission may allow each said utility company to add to its effective rates for the utility
service on which the public utility gross earnings fee is imposed, a surcharge to reimburse
such utility company for the cost of the fee.
Subd. 5. Proof of Company Gross Revenues. Center Point Energy shall make
each payment when due and shall quarterly furnish a complete and correct statement of
gross revenues for said quarter. Center Point Energy shall permit the City and its
designated representative free access to the company's records for the purpose of
verifying such statements.
Subd. 6. Enforcement. Any dispute, including enforcement of a default regarding
this ordinance will be resolved in accordance with the Franchise Agreement.
Subd. 7. Effective Date of Franchise Fee. Notwithstanding the effective date of
this ordinance and notwithstanding any contrary provisions in Section 9 of the Franchise,
the effective date of the fee collected under Subdivision 9 of this ordinance is the later of
ten (10) days after the publication and after the sending of written notice enclosing a copy
of this adopted ordinance upon Center Point Energy by certified mail.
Subd. 8. Sunset Clause. This ordinance shall automatically sunset on December
31, 2021.
SECTION 2. This ordinance takes effect as provided herein.

Background:
The City owns thirteen separate facilities with heating, ventilation and air conditioning
(HVAC) equipment, which require more complex contractor assistance with preventative
maintenance to allow reliable, efficient and safe operation while providing comfortable
indoor air climates. While the Public Works Staff can perform limited and basic
maintenance, City Staff is not trained and does not have the necessary credentials to
perform the needed annual inspections and testing on the majority of the HVAC
systems, especially those at City Hall and the Community Center. The City has
traditionally contracted with qualified HVAC contractors to perform this needed service,
most recently with Trane Building Services. The Park Buildings and Water Facilities
have not had a maintenance contracts over the past few years. In addition to performing
preventative maintenance, the contractors are asked to make repairs to the equipment.
Discussion:
Service agreements with Trane have expired and the Public Works recently evaluated
the best approach to perform preventative maintenance to the HVAC equipment needs
for reliable efficient and cost-effective operations. After careful consideration, Public
Works is recommending that Trane Building Services perform BAS and HVAC equipment
maintenance to City Hall and Community Center Facilities and that Architect Mechanical,
Inc. perform HVAC equipment maintenance at the Public Works Facility and the
remainder of the municipal buildings. The following is a break down for the prices:

Year 1: $4,550.75/quarter ($18,203 annually)
Year 2: $4,687.00/quarter ($18,748 annually)
Year 3: $4,827.75/quarter ($19,892 annually)

At the August 5, 2019 Work Session, the City Council discussed some possible changes
to Chapter 518, Lawful Gambling; specifically adding language requiring permitted
organizations who conduct lawful gambling in the City to contribute 10 percent of their net
profits to the City. First reading occurred at the August 12, 2019 Council meeting
Discussion:
Upon final enactment of the ordinance the Gaming License Holder will be required to
continue distribution of the net proceeds to the service area but of the total net proceeds,
10% will be directed by the Council.

This supports the Strategic Goal of being a progressive City that is welcoming, and a
desirable destination to all ages & cultures, who seek progress through partnerships,
and a place where residents can work, live, and play safely and show pride in the

SECTION 1. The City Council of the City of Mounds View hereby amends Title 500, Chapter 518.06,
of the Mounds View Municipal Code by adding the double -underlined material and deleting the

Subd. 1. Any organization seeking to obtain a premises permit

of any state statute, state rule, or city ordinance relating to the operation of the establishment,
including, but not limited to, laws relating to alcoholic beverages, gambling, controlled
substances, suppression of vice and protection of public safety within the last three (3) years.
C. Lawful gambling would be conducted at premises other than those for which an on- sale
liquor license has been issued.
d. Lawful gambling would be conducted at more than two (2) premises within the City.
e. Failure of the applicant to pay the investigation fee required by this Section within the
prescribed time limit.
f. Operation of gambling at the site would be detrimental to health, safety, and welfare of
the community.
g. The applicant's registered place of business is not within the Trade Area. This
requirement may be waived by the Council for good or just cause, at the Council's sole
discretion, if it is in the interest of the Community to do so.
SECTION 2. The City Council of the City of Mounds View hereby amends Title 500, Chapter 518.08,
of the Mounds View Municipal Code by adding the double -underlined material and deleting the
semen material as follows:
518.08: REVOCATION AND SUSPENSION OF LOCAL PERMIT:
Subd. 1. A local permit may be revoked, or temporarily suspended for a violation by the
gambling organization of any state statute, state rule, or city ordinance relating to gambling.
Subd. 2. A lieenseen rmit shall not be revoked or suspended until written notice and an
opportunity for a hearing have first been given to the permitted person. The notice shall be
personally served or sent by certified or registered mail. If the person refuses to accept notice,
notice of the violation shall be served by posting it on the premises. Notice shall state the
provision reasonably believed to be violated and shall also state that the permitted person may
demand a hearing on the matter, in which case the permit will not be suspended until after the

hearing is held. If the permitted person requests a hearing, the Council shall hold a hearing on
the matter at least one (1) week after the date on which the request is made. If, as a result of the
hearing, the Council finds that an ordinance violation exists, then the Council may suspend or
revoke the permit.
SECTION 3. The City Council of the City of Mounds View hereby amends Title 500, Chapter 518.09,
of the Mounds View Municipal Code by adding the double -underlined material and deleting the

SECTION 4. The City Council of the City of Mounds View hereby amends Title 500, Chapter 518.12,

518.12 CONTRIBUTION OF NET PROFITS TO FUND ADMINISTERED BY CITY:
Subd. 1. Each organization licensed to conduct lawful gambling within the City
pursuant to Minnesota Statutes, Section 349.16, as it may be amended from time to
time, shall contribute ten (10) percent of its net profits derived from lawful gambling
in the City to a fund administered and regulated by the City without cost to the fund.
Subd. 2. Payment under this section shall be made annually on or before March 1
for the prior calendar year, and shall be submitted together with verifiable
supporting documentation.
Subd. 3. The City shall disburse the funds for charitable contributions as defined by
Minnesota Statutes Section 349.12. Subdivision 7a, as it may be amended from to
time.
Subd. 4. The Citv must. by March 15 of each year, file a report with the board that
lists all such revenues collected. interest received on fund balances, and
expenditures for the previous calendar year and must acknowledge financial
contributions of organizations conducting lawful gambling to the community and
to the recipients of the funds.

518.12 518.13 RECORDS AND REPORTING
Subd. 1. Organizations conducting lawful gambling shall file with the City Administrator one
(1) copy of all records and reports required to be filed with the Board, pursuant to Minnesota
Statutes, Chapter 349, as it may be amended from time to time, and rules adopted pursuant
thereto, as they may be amended from time to time. The records and reports shall be filed on
or before the day they are required to be filed with the Board. (Amended, Ord. 844, 5-20-10)
Subd. 2. Organizations licensed by the Board shall file a report with the acceptable to the City
proving compliance with the trade area spending requirements imposed by Section 518.12
(Designated Trade Area). Such report shall be made on a fet: pr-eser-ibed by the City and shat

SECTION 5. The City Council of the City of Mounds View hereby amends Title 500, Chapter 518.13,

o'clock (1:00) a.m. (or two o'clock (2:00 A.M. if the premises has been approved for the extended bar
closing time) and eight o'clock (8:00) A.M. on any day of the week.
SECTION 6. The City Council of the City of Mounds View hereby amends Title 500, Chapter 518.14,
of the Mounds View Municipal Code by adding the double -underlined material and deleting the

518.14 518.15 PENALTY: Any person who violates:
(a) Any provision of this Section;
(b) Minnesota Statutes, Sections 609.75-609.763, inclusive, as they maybe amended from
time to time; or
(c) Minnesota Statutes, Sections 349.11-349.21, as they maybe amended from time to time
or any rules promulgated under those sections, as they may be amended from time to time shall
be guilty of a misdemeanor and shall be subject to a fine of not more than one thousand dollars
($1,000.00) or imprisonment for a term not to exceed ninety (90) days, or both, plus in either
case the costs of prosecution. In addition, violations shall be reported to the Board and
recommendation shall be made for suspension, revocation, or cancellation of an organization's
license.

SECTION 7. The City Council of the City of Mounds View hereby amends Title 500, Chapter 518.15,
of the Mounds View Municipal Code by adding the double -underlined material and deleting the

5U5 518.16 SEVERABILITY: If any provision of this Section is found to be invalid for
any reason by a court of competent jurisdiction, the validity of the remaining provisions shall not be
affected.
SECTION 8. In accordance with Section 3.07 of the City Charter, City staff shall have the following
summary printed in the official City newspaper in lieu of the complete ordinance:
On August 26, 2019, the City Council adopted Ordinance 965 that amends Title 500, Chapter
518, of the Mounds View City Code. The purpose of the amendment was to modify certain city
regulations related to lawful gambling in the City of Mounds View.
A printed copy of the ordinance is available for inspection during regular business hours at
Mounds View City Hall and is available on line at the City's web site located at

Introduction:
Mounds View licenses 1,748 rental units, including single-family homes, townhomes, and
apartments. According to the Census, about 30% of Mounds View households are renter
occupied. As part of 2020 budget discussions, Staff is requesting to increase Rental Dwelling
License Fees to cover Staff's time. By increasing user fees, there is less reliance on the
General Fund to supplement the Rental program.
Discussion:
The City's Rental program is staffed by the Housing/Code/Fire Inspector, and Permit
Technician. The estimated City's cost is about $72,000 per year (1/2 of the inspector's time, and
'/a of the Permit Technician's time). The City's five year average annual revenue is about
$33,000. Staff's goal is to close the $39,000 gap. In comparing our fees to neighboring cities,
Mounds View charges less than half.

The intent of increasing license fees is for rental property owners to pay for the service provided
to them by the City. Currently, the program is subsidized by the General Fund. By increasing
Fees, it will encourage owners to participate in the Crime Free Multi -Family Housing program,
thereby discounting their license fee, and theoretically reducing Staff time spent on investigating
and enforcing rental complaints and violations.
SUMMARY
The Rental program (inspections & administration) is heavily subsidized by the General Fund.
By increasing rental license fees, the goal is for the fees to cover the expenses, thereby
allowing more of the General Fund to be used for expenses that benefit all residents.
An erroneous notice was published in the August 22, 2019 edition of the New Brighton -Mounds
View Bulletin as Ordinance 966. Publication is not required. An amendment to the Fee
Ordinance is by Resolution (not by Ordinance).
Recommendation:
Staff recommends approval of Resolution 9159, Amending the 2019 Fee Ordinance, regarding
Rental License Fees. The fee will be applied to the 2020 license year.

Background:
The City owns 3 emergency stand-by power generators, located at City Hall, the
Booster Station and Public Works. These units provide emergency power during local
power outages and in case of natural disasters. City Hall is designated as the
Emergency Operation Center (EOC). The generator at the booster station provides
power to the main water treatment plant, well #3 and the booster station. The Generator
at Public Works provides back up power to the building and the SCADA system, a
critical system for operating the entire City water and sanitary sewer system.
While the Public Works Staff can perform basic and some limited maintenance, City
Staff is not trained and does not have the necessary credentials to perform the needed
annual inspections and testing on these generators. The City has not contracted with
qualified contractors to perform this needed service in the past. Public Works Staff has
performed minor preventative maintenance and has contacted a service contractor
when problems occur or a unit fails in operation. This is not the proper preventive
maintenance required for stand- by/ back up power. The Generators are tested and run
the 1St Wednesday of each month, (weather depending).
Discussion:
Public Works recently evaluated the best approach to perform preventative maintenance
to the stand-by/back-up generators for the City. Public Works is recommending that
Pioneer Critical Power Inc. preform the annual testing and maintenance to all City
generators. The following is break down for the prices from Pioneer Critical Power Inc.
