HomeMy WebLinkAboutResolution 9165RESOLUTION NO. 9165 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING THE FINAL PLAT OF "CROSSROAD POINTE" (Planning Case MU19-001) WHEREAS, the City of Mounds View City Code, Title 1200 provides requirements and procedures for the subdivision of plats, requiring a Major Subdivision of a parcel or parcels of property in which more than one additional parcel or lot is created or which is two (2) acres or larger in size; and, WHEREAS, INH PROPERTY MANAGEMENT, INC., a Minnesota corporation, d/b/a INH Properties, representing the property owner, Mounds View Economic Development Authority, has applied for approval of the Major Subdivision of "Crossroad Pointe" located on property legally described as; Address PID Legal Description 2400 08-30-23-31-0005 The North 363 feet of the West 330 feet of the Northeast 1/4 of the Southwest County 1/4 of Section 8, Township 30, Range 23, Ramsey County, Minnesota. Road H2 2394 08-30-23-31-0071 That part of the Northeast 1/4 of the Southwest 1/4 of Section 8, Township 30, Mounds Range 23, Ramsey County, Minnesota, described as follows: Beginning at the View Blvd intersection of the East line of the West 330 feet and the South line of the North 365.46 feet of said Northeast 1/4 of the Southwest 1/4; thence North parallel with the West line of said Northeast 1/4 of the Southwest 1/4 a distance of 255 feet; thence East parallel with the North line of said Northeast 1/4 of the Southwest 1/4 a distance of 47.07 feet; thence Southeasterly to the intersection of the East line of the West 475 feet and the South line of the North 193.01 feet of said Northeast 1/4 of the Southwest 1/4 ; thence South parallel with the West line of said Northeast 1/4 of the Southwest 1/4 and to the South line of the North 365.46 feet thereof; thence West to the point of beginning, according to the United States Government Survey thereof and situate in Ramsey County, Minnesota. Together with an easement for utility purposes over, under and across the South 10 feet of the North 314.46 feet of the East 115 feet of the West 475 feet of the NE % of the SW'/ of Section 8, Township 30, Range 23, Ramsey County, Minnesota. WHEREAS, the properties are zoned PUD Planned Unit Development (Ordinance 958), and are within the County Road 10 Corridor Overlay District, and are guided for Mixed Use PUD within the Comprehensive Plan; and, WHEREAS, the applicant has submitted the following: 1. Final Plat, received May 30, 2019 WHEREAS, Staff distributed the submitted materials to applicable departments and agencies for review as part of the May 1, 2019 Preliminary Plat review package, receiving comments specific to the Final Plat (versus the Preliminary Plat) from: Gregg Gund, Ramsey County Land Survey Division, May 29, 2019 Rice Creek Watershed District, Aug 14, 2019 Mike Winfield, Ramsey County Land Survey Division, Aug 16, 2019 WHEREAS, the Rice Creek Watershed District has issued a Conditional Approved Pending Receipt Of Changes (permit application #19-064), August 14, 2019; and, WHEREAS, the applicant has obtained approval of a Preliminary Plat for "Crossroad Pointe" (Resolution 9133); and, WHEREAS, the City of Mounds City Code, Section 1204.02, Subd 4 (Dedication Amount), allows for the dedication by the subdivider to the City, up to ten percent (10%) of the buildable land (land area minus right-of-way dedication), or cash equivalent. The City is requiring a Park Dedication Fee of $110,000 based on 10% of the land sale price ($1,350,000 minus $250,000 in Variable Costs of Developing the Development Property); and, Resolution No. 9165 Page 3 WHEREAS, the Developer agrees to construct public improvements, including streets, trails, sidewalks, and private improvements, as shown on the approved Site Plan and Development Review (Resolution 9132); and, NOW, THEREFORE, BE IT RESOLVED, the City Council finds that the request is consistent with the City of Mounds View City Code, Title 1000 (Building and Development Regulations), Title 1100 (Zoning Code), and Title 1200 (Land Subdivision), and the Comprehensive Plan; and, NOW, THEREFORE, BE IT FURTHER RESOLVED, based upon the above findings, the information and documents regarding the proposed Final Plat, the Staff Report, the Plat Opinion, testimony of the applicant, and in consideration of public testimony, the City Council does hereby approve the Final Plat of "Crossroad Pointe", with the following conditions: New utilities within the development shall be located underground (excludes existing overhead power lines along Mounds View Boulevard, and County Road 112); and, 2. The Developer shall obtain applicable permits from the Rice Creek Watershed District (RCWD), and submit a signed/recorded copy of the Maintenance Agreement for storm water management facilities to RCWD; and, 3. The Developer agrees to construct at the Developer's expense, a public sidewalk, trail, and public roadway (Greenfield Avenue turn -around) to city standards as shown on the plan set, undated (Preliminary Plat/Development Review plans, approved on June 24, 2019) or as amended and approved by City Staff. These improvements shall be constructed at the time the building is constructed; and, 4. The Developer shall submit a Landscape Escrow or Letter of Credit to the City in an amount equal to 150% of the estimated cost of materials (all vegetation) and labor (installation of all vegetation). The Escrow shall be provided to the City prior to issuance of a Building Permit. The City shall hold this escrow in a non-interest bearing account. On or about one-year after landscaping is installed, the City will inspect the property. If all landscaping has survived, the escrow will be returned to the Developer. If all, or a portion of landscaping has not survived, the City will notify the Developer, and the Developer shall replace the landscaping. The City may retain a proportionate amount of this escrow until one-year after the replacement landscaping is installed and inspected for survivability; and, The Developer agrees to pay to the City, a Park Dedication Fee of $110,000, equivalent to 10% the agreed sale price (EDA Resolution 19 -EDA -320). This fee shall be paid prior to the City signing the Final Plat mylars; and, 6. The Developer shall satisfy all requirements of the City Attorney, and Ramsey County Surveyor, prior to the City signing the Final Plat mylars; and, 7. The Developer shall comply with the Purchase and Development Agreement by and between Mounds View Economic Development Authority and INH Properties (Resolution 19 -EDA -320); and, A 1°iari =n,<; D ,til."I" le t'` mwwrt i!x Resolution No. 9165 Page 4 8. No grading or construction on the property shall take place unless permitted by applicable authorities; and, 9. The Developer shall pay all of the City's costs in reviewing the application, including those of the City Attorney and engineering or other consultants; and, NOW, THEREFORE, BE IT FINALLY RESOLVED, within six months of this approval, the Developer shall record the Final Plat with the Ramsey County Register of Deeds or Registrar of Titles. Within ten days of recording, the Developer shall furnish the City with a reproducible copy of the Final Plat showing evidence of recording.
