41 A. Ehlers to Provide an Update on Redevelopment of Skyline Motel Site and
42 Recommend Process Moving Forward.

44 Assistant City Administrator Beeman stated the City's Financial Consultant, has been in contact
45 with Commercial Investors Group (CIG) who has proposed building a hotel on the Skyline
46 Motel site. CIG informed the team that the financial feasibility study came back indicating that a

1 hotel at that site will not be financially feasible. Therefore, Ehlers attempted to contact other
2 hotel developers without success.

4 Jason Aarsvold, Ehlers & Associates, explained CIG was no longer interested in moving forward
5 with a hotel on the Skyline Motel property. However, he noted he has learned there was interest
6 in developing the site for different kinds of uses. He encouraged the EDA to open the
7 development process back up to see what might come forward.

9 Commissioner Gunn supported this matter being opened up for further consideration. The EDA
1 o was in agreement.

12 Executive Director Zikmund requested the EDA make a motion directing staff to market the
13 Skyline Motel and that a wetland delineation be completed for this property.

15 MOTION/SECOND: Gunn/Meehlhause. To authorize staff to move forward with marketing the
16 Skyline Motel Site and for a wetland delineation to be completed on this property.

20 City Attorney Riggs arrived at the meeting at 6:05 p.m.

22 B. Update from Bauer Welding on Expansion and Vacant Lot.

24 Assistant City Administrator Beeman stated Bauer Welding has a vacant lot adjacent to the
25 Skyline Motel EDA property. Bauer has indicated that they intend to expand their facility which
26 would consume a portion of the vacant lot. He reported a representative from Bauer Welding
27 was in attendance to discuss this matter in further detail with the EDA.

29 Todd Rachel, Bauer Welding at 2159 Mustang Drive, explained he has owned the vacant land
30 for decades and the intent was to expand his building onto this land. He indicated he would like
31 to put a 20,000 to 30,000 square foot addition onto the back of Bauer Welding. He noted there
32 would still be a nice buffer between his site and the adjacent Skyline Motel property.

34 Commissioner Meehlhause questioned how much space would be between these two properties.
35 Mr. Rachel estimated there would be just over two acres between the two properties.

37 Commissioner Bergeron supported the expansion from Bauer Welding.

39 President Mueller asked how many employees Bauer Welding had at this time. Mr. Rachel
40 explained he currently had 80 employees and stated this number would double after the
41 expansion was complete.

Item Title/Subject: 19-EDA-330 A Resolution Approving Forgiveness of a Loan Issued
Under the Emergency Deferred Loan Program
Introduction:
Carol Storey received an Emergency Loan in the amount of $1770.00, with a 0% interest rate, on
July 13, 2017 to replace steps at her residence located at 5702 Cabot Drive, Mounds View in
Colonial Village. The EDA has been informed that Carol has since passed away, and that she did
not leave a will or other directive. The EDA has further discovered that the manufactured home
does not hold any value. The Note associated with the loan identified above specified that Carol
was to make monthly payments in the amount of $35. No payment was ever received by the EDA,
resulting in a remaining principal balance of $1,770.00. The cost to remove and demolish the
home is estimated at $2,500-$7,000 presenting an overall negative value.
Colonial Village has stated to Lorrie Brodle, Carol's daughter that she either can pay to remove
the trailer herself or she can transfer ownership to Colonial Village by supplying a clean title and
Colonial Village will remove the trailer at no cost. However, The EDA must first forgive the loan
and remove its security interests and lien on the title before the manufactured home can be
moved. Despite having no apparent legal or financial obligation to do so, Lorrie Brodle is trying to
resolve the matter.
Discussion:
Lorrie Brodle is asking the EDA to forgive the loan in the amount of $1770.00. Since this is the
EDA's loan program, the EDA has the authority to forgive the loan in the event of a default.
Strategic Plan Strategy/Goal:
Create and maintain a positive business climate where businesses want to locate and remain in
Mounds View. Maximize utilization of development space and current redevelopment sites. Fill
vacant space and support redevelopment & development. Continue and focus on public relations
activities.
Financial Impact:
$1770.00
Recommendation:
1) Should the EDA choose to forgive the loan, then staff will undertake all steps necessary
to remove the EDA's security interests in the collateral.
2) Should the EDA choose not to forgive the loan, and request that Lorrie give the title to the
EDA, then Colonial Village will be requiring a monthly rent charge from the EDA since the
EDA would become the title holder. The EDA would also be responsible for removing the
trailer at an additional cost of $2,500-$7,000.
Consider 19-EDA-330, a resolution forgiving Carol Storey of an EDA Emergency Loan in the
amount of $1770.00.

CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
A RESOLUTION APPROVING FORGIVENESS OF A LOAN ISSUED UNDER THE
EMERGENCY DEFERRED LOAN PROGRAM
WHEREAS, the Mounds View Economic Development Authority (the "EDA") administers
the Emergency Deferred Loan Program (the "Program") whereby it provides for no -interest
emergency repair loans available to residents of the city of Mounds View; and
WHEREAS, the EDA previously approved and authorized a loan under the Program for
Carolyn Ann Storey (the "Borrower") to be used to make certain improvements to a manufactured
home located at 5702 Cabot Drive, Mounds View, MN 55112; and
WHEREAS, the Borrower has since passed away and there remains an outstanding balance
of $1,770.00 on the loan previously provided to Borrower under the Program; and
WHEREAS, in an effort to handle the affairs of the Borrower, her daughter has requested
that the EDA consider forgiving the remaining outstanding principal balance of the loan in order to
allow the chattel property which is currently being used as securitized collateral to be released so that
it may be disposed of; and
WHEREAS, the EDA has determined, through reasonable investigation, that the
manufactured home identified herein has a negative value, and that the EDA is unlikely to recover
the remaining outstanding principal balance of the loan.
NOW, THEREFORE, BE IT RESOLVED by the Economic Development Authority of
the City of Mounds View, Minnesota:
1. That the EDA hereby approves the forgiveness of the outstanding balance of the loan issued
pursuant to the Program in an amount not to exceed $1,770.00. The EDA further authorizes
the release of its security interest attached thereto.
2. The President, EDA staff, the EDA attorney, and EDA consultants are hereby authorized and
directed to take any and all additional steps and actions necessary or convenient in order to
accomplish the intent of this Resolution.

Promissory Note
(Mounds View Economic Development Authority Emergency Deferred Loan Program)
$1,770.00 Mounds View Minnesota
July 13, 2017
FOR VALUE RECEIVED, the undersigned (the "Borrower"), promises to pay to the
order of the Mounds View Economic Development Authority, a public body corporate and
politic under the laws of Minnesota (the "Lender"), or its assigns, the sum of One Thousand
Seven Hundred Seventy Dollars and No/100 ($1,770.00), (the "Loan"), at zero percent (0%)
interest. Said sum was made available to the Boirower under that certain Mounds View
Economic Development Authority Emergency Deferred Loan Program for the Borrower to
undertake home improvements related to serious health o1 safety home repairs at the Borrower's
property located at 5702 Cabot Drive, Mounds View, Minnesota (herein called the `Residence").
The Loan shall be repaid as follows:
1. The entire, unfoigiven principal balance of the Loan shall be immediately due and
payable upon the transfer, sale or lease of the Residence or at any time the Residence is no
longer the principal place of residence of the Borrower.
2. No interest shall accrue on this Loan.
3. The Borrower has the right to pay the debt evidenced by this Note, in whole or in
part, without charge or penalty, on any date.
4. The Lender will charge the Borrower $35.00 for each check or automatic payment
withdrawal request that is returned unpaid due to insufficient funds or for any other reason.
5. This Note is secured by a Mortgage (the "Mortgage') in favor of the Lender of
even date herewith. Failure to pay a payment of the Loan as required herein or default under any
of the covenants in the Mortgage shall constitute an event of default.
6. Upon the occurrence of an event of default, the Lender shall mail notice to the
Borrower specifying• (a) the event of default (b) the action required to cure such event; (c) a
date not less than 30 days from the date the notice is mailed to the Boirower by which date such
default must be cured and (d) that failure to cure such default on or before the date specified in
the notice may result in acceleration of the Loan.
7. If suit is instituted by the Lender, its successors or assigns, to recover on this
Note, the undersigned agrees to pay all costs of such collection, including reasonable attorneys'
fees and court costs.

8. The remedies of the Lender as provided herein or in any other instrument securing
this Note shall be cumulative and concurrent and may be pursued singly, successively, or
together, and, at the sole discretion of the Lender, may be exercised as often as occasion
therefore shall occur; and the failure to exercise any such right or remedy shall in no event be
construed as a waiver or release thereof.
9. The Lender shall not be deemed, by any act or omission or commission, to have
waived any of its rights o1 remedies hereunder unless such waiver is in writing and signed by the
Lender and then only to the extent specifically set forth in the writing. A waiver with reference
to one event shall not be construed as continuing or as a bai to or waiver of any right or remedy
as to a subsequent event. This Note may not be amended, modified or changed except only by
an instrument in writing signed by the party against whom enforcement of any such amendment,
modifications or change is sought.
10. If any term of this Note, or the application thereof to any person or circumstances
shall, to any extent, be invalid or unenforceable the remainder of this Note, 01 the application of
such term to persons or circumstances other than those to which it is invalid or unenforceable
shall not be affected thereby, and each term of this Note shall be valid and enforceable to the
fullest extent permitted by law.
11. If any event of default occurs, and if the Lender engages legal counsel or others in
connection with advice to the Lender or the Lender's rights and remedies under this Note, the
Borrower shall pay all reasonable expenses incurred by the Lender for such persons, irrespective
of whether any suit or other proceeding has been filed or is filed or commenced. Any such
expenses, costs and changes shall constitute additional principal, payable upon demand, and
subject to this Note.
12. The performance or observance of any promise or condition set forth in this Note
may be waived, amended or modified only by a. writing signed by the Borrower and the Lender.
No delay in exercise of any power, light o1 remedy operates as a waiver thereof, nor shall any
single or partial exercise of any other power, right or remedy.
13. Demand, protest and notice of demand and protest are hereby waived and the
undersigned waives, to the extent authorized by law, any and all homestead and other exemption
rights which otherwise would apply to the debt evidenced by this Note.
14. This Note shall be governed by and construed in accordance with the laws of the
State of Minnesota.

RE: An Emergency Deferred Loan
In July 2017 The Mounds View Economic Development Authority wrote a loan to our Resident
Carol Storey under the Emergency Deferred Loan Program. The amount of the loan was
$1,770.00 at zero percent interest. The loan was written to "undertake home improvements
related to serious health or safety home repairs at the Borrower's property located at 5702
Cabot Drive" in Colonial Village. Full payment of the loan would be required upon the transfer,
sale or lease of the home. We believe no payments were required or have been made an the
loan. The Mounds View Economic Development Authority is listed as a lienholder on the title to
the manufactured home.
On September 15, 2019 Carol Storey passed away. Her family reports that her estate lacks any
assets to pay this obligation. The family does not have the willingness or the resources to pay
the debt. The family has asked Colonial Village to accept surrender of the home. Colonial Village
believes the home is beyond reasonable repair and has a negative value. Colonial Village has
agreed to accept the responsibility and expense of removing the home from the homesite.
Disposal costs of the home range from $2,500 minimum to $7,000 for on -site demolition.
The family of Carol Storey and Colonial Village are requesting that the Mounds View Economic
Development Authority forgive the loan and issue a lien release.
