A. Charitable Gambling — Discussion.

2 Community Development Director Sevald discussed City Code pertaining to charitable
3 gambling. He noted an individual has suggested locating a bingo hall from Arden Hills to
4 Mounds View and City Code does not address this use. He questioned if the Council viewed
5 bingo halls as a commercial recreational use. If this were the case, staff noted the bingo hall
6 would be allowed but would require a charitable gambling license.

8 Council Member Meehlhause supported the Council discussing this possibility further.

1 o Council Member Bergeron requested staff discuss this matter further with the City Attorney to
1 1 see if bingo halls were considered charitable gambling organizations.

13 Council consensus was to discuss the possibility of a bingo hall in Mounds View further at the
14 October worksession meeting.

17 A. Public Hearing: Second Reading and Adoption of Ordinance 963, an
18 Ordinance Continuing a Franchise Fee on Center Pointe Energy Natural Gas
19 Operations within the City of Mounds View and Ordering Summary
20 Publication. ROLL CALL VOTE.

22 Finance Director Beer requested the Council adopt an Ordinance that would continue a franchise
23 fee with Center Pointe Energy for natural gas operations in the City of Mounds View. He
24 reviewed the sunset provision that was approved within Xcel Energy franchise and requested the
25 Council approve the sunset provision for the Center Pointe Energy franchise.

27 Mayor Mueller opened the public hearing at 6:43 p.m.

39 B. First Reading and Introduction of Ordinance 965, Vacating Portions of
40 Greenfield Avenue Right -of -Way and Easements, as part of Crossroad
41 Pointe.

43 Community Development Director Sevald requested the Council introduce an Ordinance that
44 would vacate portions of Greenfield Avenue right-of-way and easements as part of the Crossroad
45 Pointe development. He discussed the location of this development as being the south corner of
Mounds View City Council September 9, 2019

1 Mounds View Boulevard and County Road H2. He reported a portion of Greenfield Avenue and
2 easements were being proposed to be vacated as part of this project. Staff reviewed the location
3 of the proposed hammerhead and recommended introduction of the Ordinance.

5 MOTION/SECOND: Meehlhause/Bergeron. To Waive the First Reading and Introduce
6 Ordinance 965, Vacating Portions of Greenfield Avenue Right -of -Way and Easements, as part of
7 Crossroad Pointe.

11 C. Resolution 9160, Adopting a Preliminary Levy and General Fund Budget for
12 2020.

14 Finance Director Beer requested the Council adopt a preliminary levy and general fund budget
15 for 2020. He reported by State law the Council had to approve a preliminary levy by September
16 30th. He reviewed the proposed preliminary levy with the Council stating the 2020 budget relied
17 less on LGA and the levy reduction portion of the general fund. He commented a General Fund
18 base levy increase of 4.2% with an overall levy increase of 4.63% was being proposed at this
19 time and recommended approval of the preliminary levy.

21 MOTION/SECOND: Bergeron/Gunn. To Waive the Reading and Adopt Resolution 9160,
22 Adopting a Preliminary Levy and General Fund Budget for 2020.

24 Council Member Hull stated he would like to see the levy increase reduced to 3.2% with the City
25 using $54,000 from the unassigned fund balance to assist with covering this reduction. He
26 explained he would like to see the levy reduced given the fact the County would be having a 5%
27 increase in their levy.

29 AMENDMENT MOTION/SECOND: Hull/Mueller. To Recommend the Levy Increase be
30 Reduced to 3.2% with the City using $54,000 from the Unassigned Fund Balance to cover the
31 Reduction.

33 Mayor Mueller stated she supported the proposed amendment given the increases being proposed
34 by the County and School District.

36 Council Member Gunn explained she appreciated the proposed amendment, but questioned what
37 would happen if the County levy were not approved. She suggested the levy remain at 4.2% and
38 that it be lowered to 3.2% if the levy were approved.

40 Council Member Bergeron and Council Member Meehlhause supported this recommendation.

42 Ayes — 2 Nays — 3 (Bergeron, Gunn, Meehlhause) Amendment failed.

44 Mayor Mueller called for a vote on the original motion on the floor.

D. Resolution 9161, Approving the Preliminary EDA Property Tax Levy
Request and Budget for Fiscal Year 2020.
Finance Director Beer requested the Council approve a preliminary EDA Property Tax Levy and
general fund budget for 2020. He explained the EDA has requested a levy of $100,000 to assist
with economic development in the City of Mounds View. He reported this was the same amount
levied in the previous year.
MOTION/SECOND: Gunn/Meehlhause. To Waive the Reading and Adopt Resolution 9161,
Approving the Preliminary EDA Property Tax Levy Request and Budget for Fiscal Year 2020.
Ayes — 5 Nays — 0 Motion carried.
E. Resolution 9164, Authorizing a Refunding of Conduit Debt on Behalf of
Apple Tree Dental.
Finance Director Beer requested the Council authorize a refunding of conduit debt on behalf of
Apple Tree Dental. It was noted the expense of the refunding would be covered by Apple Tree
Dental and the City would not be liable for the debt.
MOTION/SECOND: Meehlhause/Bergeron. To Waive the Reading and Adopt Resolution
9164, Authorizing a Refunding of Conduit Debt on Behalf of Apple Tree Dental.

F. Second Reading Ordinance 961, Amending Chapter 500 Section 512 Tobacco
Products and Ordering Summary Publication. T-21. ROLL CALL VOTE.
Assistant City Administrator Beeman requested the Council adopt an Ordinance amending
Chapter 500 Section 512 regarding the legal sale age for tobacco products and ordering a
summary publication. He reported on Monday, August 26th the Council introduced this
Ordinance. He explained the City Attorney had reviewed the Ordinance and recommended
approval.
Mayor Mueller opened the meeting for public comment.
Casey Cable, 2221 County Road H2, thanked the Council for addressing this matter and for
changing the purchase age for tobacco in Mounds View to 21. She reported this was a step in the
right direction for youth in Mounds View.
Mayor Mueller commented the Council may need to revisit Subdivision 12 which addresses how
close tobacco establishments can be to each other.

8 G. Resolution 9158, Recommending Appointment to Charter Commission.

10 Assistant City Administrator Beeman requested the Council adopt a Resolution recommending
I t an appointment to the Charter Commission. He suggested the Council review the applications
12 and make a recommendation regarding the Charter Commission vacancy.

14 MOTION/SECOND: Meehlhause/Hull. To Waive the Reading and Adopt Resolution 9158,
15 Recommending the Appointment of Robert King to Charter Commission.

17 Mayor Mueller supported the appointment of Robert King given the fact he was the first
18 individual that stepped forward to submit an application.

20 Council Member Gunn encouraged the other individuals that submitted an appointment for the
21 Charter Commission to consider volunteering on another City Commission.

25 9. REPORTS
26 A. Reports of Mayor and Council.

28 Council Member Hull reviewed the 2nd quarter police report with the Council and noted traffic
29 stops were up considerably. He explained the Police Department's additional officer was making
30 a difference.

32 Council Member Bergeron stated last Thursday, September 5th he attended a North Suburban
33 Cable Commission meeting where the group discussed the 2020 budget and FCC regulations.

35 Council Member Bergeron noted he would be taking in a webinar on Open Meeting Laws later
36 this week.

38 Council Member Meehlhause reported the Mounds View Business Council would be meeting on
39 Wednesday, September 11th at 7:30 a.m. at the Mermaid.

41 Council Member Meehlhause stated on Saturday, September 14th the SBM Fire Department
42 would be having their 75 Year Anniversary Celebration at the National Sports Center in Blaine.

44 Council Member Meehlhause commented on Tuesday, September 17th he would be attending a
45 Twin Cities Gateway Board meeting where the 2020 budget would be discussed.

Council Member Meehlhause explained the Festival in the Park Committee would be meeting on
Tuesday, September 17tH
Mayor Mueller reported the next Minnesota Women in Government Presents Program would be
held on Friday, October 11th at 11:00 a.m. at the League of Minnesota Cities offices in the St.
Croix Room.
Council Member Meehlhause stated the YMCA Advisory Committee met today and he was
pleased to report revenues were up from last year. He noted the YMCA's Youth in Government
program was seeking members at this time.
Council Member Gunn reported the Community Service Fair would be held on Saturday,
September 21St from 10:00 a.m. to 1:00 p.m.
Council Member Meehlhause commented last Tuesday the Skyline Motel was burned to the
ground. He stated he looked forward to this site being redeveloped.
Council Member Bergeron indicated he was pleased by all of the training that occurred at the
Skyline Motel prior to the building being burned.

Finance Director Beer discussed the proposed $12 million school district operating levy.

Introduction:
Staff is in the process of reviewing the Personnel Manual and is presenting revisions to
the Hiring Policy. Revisions include edits to the current policy plus wording recommended
by the League of Minnesota Cities.
Discussion:
The most notable change to the revised Hiring Policy grants the ability for posting
positions internally before advertising externally.

CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING HIRING POLICY REVISIONS
WHEREAS, the Hiring Policy is a part of the Personnel Manual for all City
employees; and,
WHEREAS, revisions incorporated into the Hiring Policy include edits to the
current policy plus wording recommended by the League of Minnesota Cities.
NOW, THEREFORE, BE IT RESOLVED, that the Mounds View City Council
approves revisions to Section 1.23 of the Mounds View Personnel Manual as follows:
POLICY: HIRING POLICIES SECTION 1.23
A. POSITION VACANCY ANNOUNCEMENT
The City Administrator or a designee will manage the hiring process for positions
within the City. While the hiring process may be coordinated by staff, the City
Council is responsible for the final hiring decision and must approve all hires to
City employment. All hires will be made according to merit and fitness related to
the position being filled.
The City Administrator or designee will determine if a vacancy will be filled through
an internal job posting, an open recruitment process, by promotion, transfer, or
some other method. This determination will be made on a case-by-case basis.
Position vacancies in the City are published by posting announcements at City Hall
and various media sources as determined by the City Administrator.
Announcements specify the title and salary range of the position; the nature of the
work to be performed; the qualifications required for the job; the time, place and
manner of making application; the closing date for receiving applications; and other
pertinent information. Deadline for application may be extended by the City
Administrator. (Police, temporary and seasonal hiring may vary from this
procedure.)
B. APPLICATION FORMS
Application for employment will generally be made online or by application forms
available at the City. Applicants will be required to provide information on training,
experience, references, Veterans Preference, etc. Applicants may be required to
submit certificates from examining physicians following a conditional offer,
educational and training institutions, and reasonable proof of any statements
made. Applications will be accepted when a position has been posted. Deadline
for applications may be extended by the City Administrator. Applications shall
remain on file for a period of two (2) years. The appropriate application must be
completed and signed by the person applying.

C. SELECTION OF CANDIDATES
Applicants are scored on a point system, which measures qualifications for the
position and veteran status according to the DD Form 214 and other related forms.
Based on the scoring, candidates are then chosen for interviews. Examinations
which will fairly test the capacity and fitness of the candidate to discharge efficiently
the duties of the position may be conducted. Skill testing may also be performed
for certain positions. Recommendations requesting approval to hire regular full-
time and part-time employees will be presented by the City Administrator and/or
Human Resources Coordinator to the City Council for action. All temporary and
seasonal employees are appointed by the respective Department Head with
approval from the City Administrator.
D. DISQUALIFICATION: An application may be rejected if:
• The application or supplemental application indicates the candidate does
not possess the minimum qualifications required for the position, including
a valid driver's license for positions requiring operation of a motor vehicle;
• The candidate fails to file the application and supplemental application by
the announced closing date for receiving applications (Deadline for
application may be extended by the City Administrator);
• The candidate is not a citizen of the United States and does not possess
the appropriate documentation from U.S. Citizenship and Immigration
Services;
• After a conditional offer of full-time employment has been made, the
candidate is found to be unable to perform the essential functions and duties
of the position with or without reasonable accommodation;
• After a conditional offer of full-time employment has been made, the
candidate is found to have a criminal record which disqualifies the applicant
from the position pursuant to Minnesota Statute §364.03; or
• The candidate has made false statement of any material fact, omitted
material information or attempted to practice any deception or fraud in the
application process.
E. MEDICAL EXAMINATION
After a conditional offer of employment has been made to the candidate, a hiring
assessment may be conducted by a City approved psychologist. A physical
examination may be conducted by a City approved physician. The City's Drug and
Alcohol Testing Policies are set forth in this Manual. The psychologist and/or
physician will render opinions regarding whether the candidate can perform the
essential functions of the position, with or without reasonable accommodation.
Information obtained from medical exams are treated as confidential medical
records.
F. PRE-EMPLOYMENT BACKGROUND CHECK (MN §299C.60, §363)
In accordance with federal, state and local law, the City may conduct a pre-
employment background check, including a criminal record check of candidates
who have received conditional offers of employment. Volunteers working with
children are required to undergo a criminal background check, which may include

property managers of residential property, health care workers, and/or public
school employer. Individuals hired for public safety provisions (law enforcement,
firefighters) are required to have a background check.
G. RESIDENCY REQUIREMENTS (MN § 415.16)
Employees are not required to become a resident of Mounds View at any time.
H. EMPLOYMENT OF RELATIVES
To maintain proper control and accountability of City functions and operations and
to reduce potential organizational conflicts of interest or perceived conflicts of
interest that may arise due to employment of an employee's relative, the policy
stated in this section was implemented.
The City permits the employment of relatives except as prohibited below. The term
"relative" when used in this policy means any two (2) or more individuals who
reside in the same dwelling unit or who are related to each other by blood, common
law marriage, or adoption, where one (1) of the individuals is the spouse, parent,
grandparent, child, brother, or sister of the other.
The City will not employ relatives under any of the following circumstances:
• Where an employee directly or indirectly supervises a relative.
• Where an employee is responsible for auditing the work of a relative.
• Where a conflict of interest or the perception of a conflict could exist.
I. PROMOTIONS
The City will fill vacancies by promotion of qualified full-time or part-time employees
whenever practicable and appropriate.
J. VETERANS PREFERENCE
A veteran's preference in employment with the City shall be in accordance with
Minnesota Statutes and federal law.
K. Employment of Former Employees — Vacation Schedule
Former employees who are rehired by the City within two (2) years or their
separation will continue on the vacation schedule at the point of their departure. If
over two (2) years, consideration will be given as part of the negotiation process.

National Pregnancy and Infant Loss Awareness Day — October 15, 2019
Recognizing National Pregnancy and Infant Loss Awareness Day
WHEREAS, Infants Remembered In Silence, Inc. (IRIS) and many other nonprofit organizations
work with thousands of parents all over Minnesota and across the United States who have experienced
the death of a child during pregnancy through early childhood; and
WHEREAS, Many of these parents live in, deliver in, have a child die in, or a bury a child in our
community; and
WHEREAS, Infants Remembered In Silence (IRIS) a 501(c)(3) nonprofit organization was
founded 1987, 32 years ago, to offer support for parents whose child/children died from miscarriage,
ectopic pregnancy, molar pregnancy, stillbirth, neo-natal death, birth defects, sudden unexplained death
of a child (SUDC), sudden infant death syndrome (SIDS), illness, accidents, and all other types of infants
and early childhood death; and
WHEREAS, bereaved parents around the world remember their children annually on October 15
with a candle lighting at 7 pm. Some will remember their child/children in their homes while others will
remember them in small gatherings around the state, across the nation and around the world; and would
unify these parents in tribute to their children; and
WHEREAS, in 1988, President Ronald Reagan proclaimed October as National Pregnancy and
Infant Loss Awareness month; and
WHEREAS, in honor of the thousands of children that die each year in Minnesota Infants
Remembered In Silence, Inc. (IRIS) respectfully request that October 15th, 2019 be recognized as
Pregnancy and Infant Loss Remembrance Day.

Introduction:
INH Properties is proposing to build a 127 -unit apartment building at the South corner of Mounds
View Boulevard and County Road H2 to be known as Crossroad Pointe. The project will require
that a portion of Greenfield Avenue (highway easement) through the site be vacated, along with
easements for utilities, storm sewer, driveways, and parking, associated with the former land use
(Roberts, Taiko, and Premium Stop).
Discussion
The project is divided by Greenfield Avenue. The approved Preliminary Plat and Development
Review includes the closure of the street, terminating as a hammerhead dead end inside the
project area. Once the street is vacated and the property sold, the street will be blocked off. This
will occur by December 31, 2019.
Strategic Plan Strategy/Goal:
Continue BR&E program, maximize utilization of development space and updated list of available
sites, encourage landowners to maintain their properties, & consider residential redevelopment.
Financial Impact:
The Development Agreement includes an allowance for infrastructure expenses. The Developer
will pay any additional costs.
Recommendation:
Staff recommends the Council conduct a Public Hearing, Second Reading and Adoption of
Ordinance 966, vacating portions of Greenfield Avenue, and private easements.
A Public Hearing was notice' was published in the September 11, 2019 edition of the New
Brighton/Mounds View Bulletin, and mailed to property owners affected by the closure of
Greenfield Avenue. Affected utilities were notified via Gopher One Call locate.

WHEREAS, INH Property Management Inc (Developer), representing the property
owner; Mounds View Economic Development Authority (EDA), is requesting approval of the
Final Plat of Crossroad Pointe. The project is divided by Greenfield Avenue as described on
Exhibit A, and includes easements for utilities, driveways and parking, and is no longer needed for
a public purpose;
WHEREAS, any person, corporation or City owning or controlling utility easements
contained upon the property vacated, reserves the right to continue maintaining the same or to
enter upon such way or portion thereof vacated to maintain, repair, replace, remove or otherwise
attend thereto; and,

roadway of the traveled portion of Greenfield Avenue as described below is no longer needed for
a public purpose, and as such, it is in the public interest to vacate such portion of the previously
traveled Greenfield Avenue described as follows:

Subdivision 2. The public utilities or facilities located in the portion of the Greenfield
Avenue roadway easement area to be vacated described in Exhibit A of this ordinance are intended
to be relocated to the right of way or easements to be dedicated to the public pursuant to the plat
of Crossroad Pointe. The proposed vacation of the portion of the Greenfield Avenue roadway
therefore will not adversely affect the ability of the City or other utility to maintain, repair, or
replace public utilities.
Subdivision 3. The City Council finds that there is no longer a public need for that portion
of the Greenfield Avenue roadway to be vacated, as describe in Exhibit A of this ordinance.
Subdivision 4. The portion of the roadway, as described in Exhibit A of this ordinance is
hereby vacated.
SECTION 2. In accordance with Section 3.07 of the City Charter, City staff shall have the

Introduction:
INH Properties is requesting Final Plat approval of Crossroad Pointe, located on four acres at
the south intersection of Mounds View Boulevard and County Road H2.
Discussion:
The Final Plat is consistent with the Preliminary Plat, approved on June 24, 2019 (Resolution
9133). Greenfield Avenue through the project will be closed, terminating in a hammerhead turn-
around at the south end of the project.
INH plans to build a 127 unit apartment building. The City Council approved the Development
Review on June 24, 2019 (Resolution 9132). Building plans have been submitted for
review/approval. Site work is planned to start in November/December.
Strategic Plan Strategy/Goal:
Continue BR&E program, maximize utilization of development space and updated list of
available sites, encourage land owners to maintain their properties, & consider residential
development.
Financial Impact:
The $18.2 million project will generate an estimated $327,500 in property taxes, based on 2019
rates.'
Recommendation:
Staff recommends approval of the Final Plat. A Public Hearing is not required for Final Plats.
Planning Commission review is not required when a Final Plat is consistent with the approved
Preliminary Plat.

WHEREAS, the Rice Creek Watershed District has issued a Conditional Approved
Pending Receipt Of Changes (permit application #19-064), August 14, 2019; and,
WHEREAS, the applicant has obtained approval of a Preliminary Plat for "Crossroad
Pointe" (Resolution 9133); and,

WHEREAS, the City of Mounds City Code, Section 1204.02, Subd 4 (Dedication
Amount), allows for the dedication by the subdivider to the City, up to ten percent (10%) of the
buildable land (land area minus right-of-way dedication), or cash equivalent. The City is
requiring a Park Dedication Fee of $110,000 based on 10% of the land sale price ($1,350,000
minus $250,000 in Variable Costs of Developing the Development Property); and,
WHEREAS, the Developer agrees to construct public improvements, including streets,
trails, sidewalks, and private improvements, as shown on the approved Site Plan and
Development Review (Resolution 9132); and,
NOW, THEREFORE, BE IT RESOLVED, the City Council finds that the request is
consistent with the City of Mounds View City Code, Title 1000 (Building and Development
Regulations), Title 1100 (Zoning Code), and Title 1200 (Land Subdivision), and the
Comprehensive Plan; and,
NOW, THEREFORE, BE IT FURTHER RESOLVED, based upon the above
findings, the information and documents regarding the proposed Final Plat, the Staff Report, the
Plat Opinion, testimony of the applicant, and in consideration of public testimony, the City
Council does hereby approve the Final Plat of "Crossroad Pointe", with the following conditions:
1. New utilities within the development shall be located underground (excludes existing
overhead power lines along Mounds View Boulevard, and County Road 1-12); and,
2. The Developer shall obtain applicable permits from the Rice Creek Watershed District
(RCWD), and submit a signed/recorded copy of the Maintenance Agreement for storm
water management facilities to RCWD; and,
3. The Developer agrees to construct at the Developer's expense, a public sidewalk, trail,
and public roadway (Greenfield Avenue turn -around) to city standards as shown on the
plan set, undated (Preliminary Plat/Development Review plans, approved on June 24,
2019) or as amended and approved by City Staff. These improvements shall be
constructed at the time the building is constructed; and,
4. The Developer shall submit a Landscape Escrow to the City in an amount equal to 150%
of the estimated cost of materials (all vegetation) and labor (installation of all vegetation).
The Escrow shall be provided to the City prior to issuance of a Building Permit. The City
shall hold this escrow in a non-interest bearing account. On or about one-year after
landscaping is installed, the City will inspect the property. If all landscaping has
survived, the escrow will be returned to the Developer. If all, or a portion of landscaping
has not survived, the City will notify the Developer, and the Developer shall replace the
landscaping. The City may retain a proportionate amount of this escrow until one-year
after the replacement landscaping is installed and inspected for survivability; and,
5. The Developer agrees to pay to the City, a Park Dedication Fee of $110,000, equivalent
to 10% the agreed sale price (EDA Resolution 19 -EDA -320). This fee shall be paid prior
to the City signing the Final Plat mylars; and,
6. The Developer shall satisfy all requirements of the City Attorney, and Ramsey County

Surveyor, prior to the City signing the Final Plat mylars; and,
7. The Developer shall comply with the Purchase and Development Agreement by and
between Mounds View Economic Development Authority and INH Properties
(Resolution 19 -EDA -320); and,
8. No grading or construction on the property shall take place unless permitted by
applicable authorities; and,
9. The Developer shall pay all of the City's costs in reviewing the application, including
those of the City Attorney and engineering or other consultants; and,
NOW, THEREFORE, BE IT FINALLY RESOLVED, within six months of this
approval, the Developer shall record the Final Plat with the Ramsey County Register of Deeds or
Registrar of Titles. Within ten days of recording, the Developer shall furnish the City with a
reproducible copy of the Final Plat showing evidence of recording. If not recorded, approval of
the Final Plat shall become void.

Regulations
Introduction:
The City has received an inquiry from a business owner who would like to apply for an
off -sale liquor license to sell 3.2% beer, but the business is located less than 500' from
a church. City Code requires that off -sale liquor establishments be more than 500' from
any public school or church.'
Discussion:
The City Attorney has researched this topic, and found no legal reason for the 500'
setback to be applicable to Mounds View. The proposed amendment would not reduce
the 500' setback for intoxicating liquor (e.g. wine and hard alcohol).

AND SUBDIVISION 2 OF THE MOUNDS VIEW CITY CODE RELATING
TO 3.2 PERCENTMALT LIQUOR LICENSE REGULATIONS

SECTION 1. The City Council of the City of Mounds View hereby amends Title 500, Chapter 503, Section
503.04, Subdivision 2, of the Mounds View Municipal Code by deleting the stfieken material as follows:
503.04: ELIGIBILITY FOR LICENSE:
Subd. 2. Places Ineligible for License; Exceptions:
a. No on -sale or off -sale 3.2 Percent (3.2%) malt liquor license shall be granted for sale on
any premises where any license hereunder has been revoked for cause until one (1) year has elapsed
after such conviction or revocation. (Amended, Ord. 843, 5-20-10)
b. No off -sale license 3.2 Percent (3.2%) malt liquor license shall be granted to any premises
where an on -sale intoxicating liquor license has been issued by the City pursuant to the provisions
of Chapter 502 of this Title. (Amended, Ord. 843, 5-20-10)
C. No on -sale 3.2 Percent (3.2%) malt liquor license shall be issued to any place within fifty
(50) feet of any public school or church with the exception of any place wherein a license was in
continuous operation and established prior to the building of such public school or church.

SECTION 2. In accordance with Section 3.07 of the City Charter, City staff shall have the
following summary printed in the official City newspaper in lieu of the complete ordinance:
On October 14, 2019, the City Council adopted Ordinance 964 that amends Title 500,
Chapter 503, of the Mounds View City Code. The purpose of the amendment was to modify
certain city regulations related to off -sale 3.2% liquor establishments.
A printed copy of the ordinance is available for inspection during regular business hours at
Mounds View City Hall and is available on line at the City's web site located at
www.moundsviewmn.org.
SECTION 3. This ordinance shall take effect and be in force 30 days from and after its passage and
publication, in accordance with Section 3.09 of the City Charter.
