2 Bill Morrie, 8141 Red Oak Court, explained he has been a resident of Mounds View for the past
3 45 years. He commented on a petition that was signed on August 5th to remove Brian Amundsen
4 from the Charter Commission. He explained time did not permit him to discuss all of the
5 rationale behind the City's decision. He understood that the City believed the Charter
6 Commission was not able to work effectively operate due to Brian's actions and specifically his
7 conduct at the May 21, 2019 meeting. He reported City Attorney Riggs represented the City at
8 the court hearing and Brian defended himself. He was of the opinion that several City Council
9 meetings and other City meetings defamed and dishonored Brian's good reputation in Mounds
10 View. He commented this was a great source of anguish for both Brian and his wife. He
11 reviewed the findings from Judge Guthman noting the Judge found Brian Amundsen to be polite
12 and courteous. He reported differing opinions and outlooks are generally desirable features for
13 memberships in a public body. He explained the petition to remove Brian Amundsen was
14 dismissed and the petition was denied.

16 Kay Morrie, 8141 Red Oak Court, stated the petition to remove Brian Amundsen from the City
17 of Mounds View Charter Commission was denied and the petition was dismissed. She explained
18 Brian could retain his position with the Charter Commission. She indicated the allegations
19 brought against Brian were a source of public dishonor to his reputation and harmed him
20 personally. She hoped that by publicly reviewing the judge's findings that Brian's reputation in
21 this community be restored to the high honor it deserved. She requested an apology from the
22 City Council. She reported she has known Brian Amundsen for many years and she believed he
23 was a man of integrity.

25 Brian Amundsen, 3048 Woodale Drive, stated throughout the summer he attended meetings
26 where he was being attacked for his actions as well as on his character and service to the
27 community. He explained he received the blessings of God's wisdom, support from his wife
28 Valerie, his children and friends, along with fortitude to withstand the false allegations and court
29 hearing. He reported the request to remove him from the Charter Commission has been denied
30 by the District Court Judge because the Judge found him to be both courteous and polite. He
31 stated the court found the characterizations of his actions from May 21St were untrue and that he
32 was not the cause of the Commission's vacancies in the past or at present. He indicated the
33 Charter Commission may conduct business when a quorum is present per the Commission's
34 bylaws. He explained the effectiveness of the Charter was not based on what the work is, or
35 whether amendments were passed or not. He stated the court found the removal request did not
36 meet a legal cause standard which was set back in 1893 by the Minnesota Supreme Court. He
37 shared information with Mounds View residents stating Charter amendments require two of three
38 groups (City Council, Charter Commission and Mounds View residents) to make an amendment.
39 He reported one group could not make an amendment without the agreement of another group.
40 He discussed how the City's charter preserves government control and provides the ability to
41 referendum, petition on Ordinances and to limit annual levies. He stated he would continue to be
42 a custodian of the City's Charter, to preserve the citizen's rights contained within, and through
43 God's justice he enjoyed the love and support of his wife, family and friends.

1 Valerie Amundsen, 3048 Woodale Drive, stated she was married to Brian Amundsen. She
2 indicated she was incredibly proud of her husband and how he has conducted himself in the face
3 of horrendous personal attacks over the past summer. She explained she has also witnessed
4 amazing grace and support from the community. She commented after three months of waiting
5 she received news that the judge ruled in Brian's favor and that he had not done anything wrong.
6 She indicated Brian would not be removed from the Charter Commission as the Judge saw
7 through the incredible bias of the City. She reported Brian could have quit this position, but he
8 did not do anything wrong and there was injustice at hand. She commended her husband for
9 remaining calm through this entire ordeal and stated she was extremely proud of him. She
10 encouraged those interested in reading through the court documentation to contact City Hall. She
11 reviewed the findings from Judge Guthman and expressed the importance of having a variety of
12 opinions within public organizations. It was her hope the City Council would issue a public
13 apology for all the City has put her husband and herself through.

19 8. COUNCIL BUSINESS
20 A. Resolution 9187, Conduct a Hearing Denying a Rental Dwelling License, and
21 Authorizing an Order to Vacate the Premises of 5067 Irondale Road due to
22 Violation of Mounds View City Code Chapter 1012 (Rental Dwelling
23 License).

25 Community Development Director Sevald requested the Council hold a hearing and deny a rental
26 dwelling license for the property at 5067 Irondale Road. He explained this property has been a
27 rental since 2017. He commented on the numerous police calls that have been generated by this
28 property. He reported staff would recommend this property not be occupied as a rental. He
29 indicated notice of this meeting and the recommendation of staff was sent to the property owner.
30 It was noted property owner's intent would be to have the current tenants vacate the property and
31 to sell the property. He stated the property owner could request another rental license in one year.

33 City Administrator Zikmund explained he had a conversation with the property owner today
34 regarding the multiple violations and the property owner was remorseful and contrite. He
35 discussed the issues with the property owner and notification was sent to the tenants. He
36 reported the property owner would like to renovate the space and reapply for a rental license
37 sooner than one year. He indicated the City's current policy was described to the property owner.

39 Council Member Hull stated Mr. Sean Haller works for Coldwell Banker and was a realtor. He
40 expressed concern that the property owner had not requested a rental license when he purchased
41 the home in 2017. City Administrator Zikmund explained the property owner was very
42 apologetic and knew he was supposed to have a rental license. He reported the property owner
43 shared his intent was to sell the property originally and then his plans changed given the strong
44 housing market.

1 Council Member Bergeron asked if the property were to sell prior to one year if the new owner
2 could request a rental license. Community Development Director Sevald stated the new owner
3 could request a rental license and the property would be subject to an inspection.

5 Council Member Hull reported there were six documented crimes tied to this property which
6 included robbery, burglary, CSC, assault and shots fired. He questioned if the City of Mounds
7 View would be better off without these residents living in the community. Police Chief Harder
8 stated the data speaks for itself with respect to this property.

10 Mayor Mueller indicated this property has had 32 police calls.

12 Council Member Gunn explained these residents were not being kicked out because the property
13 did not have a rental license, but rather because the property has had 32 police incidents. This
14 was why the tenants were being evicted. City Administrator Zikmund thanked Neighborhood
15 Resource Officer Heineman for working with the Code Enforcement Department. Police Chief
16 Harder explained Officer Heineman recognized a problem and after partnering with City staff
17 was able to take action against the property.

19 Council Member Bergeron stated this was a tremendous show of appropriate action given the
20 problems that have occurred at this property. He thanked Officer Heineman and Code
21 Enforcement Official Martin for addressing this concern.

23 MOTION/SECOND: Gunn/Hull. To Waive the Reading and Adopt Resolution 9187, Conduct a
24 Hearing Denying a Rental Dwelling License, and Authorizing an Order to Vacate the Premises of
25 5067 Irondale Road due to Violation of Mounds View City Code Chapter 1012 (Rental Dwelling
26 License).

28 Council Member Meehlhause thanked Jacob Martin and Kirsten Heineman for their great work
29 on this matter.

33 B. Resolution 9185, A Resolution Approving the City of Mounds View 2020 Fee
34 Schedule.

36 City Administrator Zikmund requested the Council approve the City of Mounds View 2020 Fee
37 Schedule. He noted the proposed fee schedule was reviewed by the Council at a recent
38 worksession meeting. He explained the lateral sewer line fee was included in the fee schedule.
39 Staff commented further on the proposed fee schedule and recommended approval.

41 Council Member Gunn asked if fees were proposed for the splash pad pavilion. City
42 Administrator Zikmund reviewed these fees with the Council.

44 MOTION/SECOND: Hull/Bergeron. To Waive the Reading and Adopt Resolution 9185, A
45 Resolution Approving the City of Mounds View 2020 Fee Schedule.

C. Resolution 9188, Approving JPA with City of Spring Lake Park to provide
Building Official Services.
City Administrator Zikmund requested the Council approve a joint powers agreement with the
City of Spring Lake Park to provide building official services. He reported this JPA would be an
opportunity for the City to continue its relationship with the City of Spring Lake Park. He
described the services the City of Mounds View would provide to Spring Lake Park and
recommended approval of the JPA.
MOTION/SECOND: Gunn/Meehlhause. To Waive the Reading and Adopt Resolution 9188,
Approving JPA with City of Spring Lake Park to provide Building Official Services.
Council Member Bergeron stated he appreciated the joint efforts between Mounds View and
Spring Lake Park.

D. Resolution 9186, Approving the 2017 Municipal Inflow and Infiltration
Grant Request to the Metropolitan Council.
Public Works Director Peterson requested the Council approve the 2017 Municipal Inflow and
Infiltration grant request to the Met Council. He discussed the Met Council grant program and
noted the City had participated in this program since 2014. He commented further on the
proposed grant program and recommended approval of the request.
MOTION/SECOND: Meehlhause/Bergeron. To Waive the Reading and Adopt Resolution
9186, Approving the 2017 Municipal Inflow and Infiltration Grant Request to the Metropolitan
Council.
Mayor Mueller thanked staff for applying for this grant.

9. REPORTS
A. Reports of Mayor and Council.
Council Member Gunn reported on Saturday, November 16th a waffle breakfast and bake sale
would be held at the Community Center from 9:00 a.m. to 12:00 p.m. The event would help
support the Mounds View Police Foundation. She commented the event would also have a coat
drive.

Council Member Meehlhause reviewed the meetings he would be attending over the next two
weeks. He stated he would be attending a League of Minnesota Cities / Metro Cities meeting on
Thursday, November 14th and on Tuesday, November 19th he would be attending a Convention
Bureau Board meeting. He commented on Wednesday, November 20th he would be attending
two NYFS meetings.
Council Member Meehlhause reported he received a card in the mail from David Piskorski
stating he and his wife are touring Europe and were nice enough to send him a card.
Council Member Bergeron stated he was looking forward to attending the waffle breakfast on
Saturday morning.
Mayor Mueller reported on Thursday, November 21St she would be attending the Ramsey County
League of Local Government annual meeting.
Mayor Mueller commented Monday, November 11th was Veterans Day. She thanked all of the
veterans in the community for their dedicated service.
Mayor Mueller stated on Saturday, November 16' there would be a ceremony at St. John the
Baptist for two Eagle Scouts.
Mayor Mueller indicated the City sent notice to property owners that live near Crossroad Pointe
regarding the Graystone Flats development. She reported the developer would be setting footings
yet this fall and construction would begin next spring. She stated she was proud of the fact this
property would be back on the tax rolls.
B. Reports of Staff.
City Administrator Zikmund stated the Council would be holding a Closed Session meeting on
Monday, November 25th. He was pleased the City had six developers with proposals for the
Skyline property.
Finance Director Beer reported the Truth In Taxation meeting was scheduled for Monday,
December 2nd
Mayor Mueller suggested the six presentations be split between November 25" and December
2nd
City Administrator Zikmund reviewed the items the Council would be addressing at the
upcoming worksession meeting.
City Administrator Zikmund stated Deputy Chief Steve Menard has submitted his paperwork for
th
retirement and he believed his last day would be Wednesday, November 27

The Council discussed whether to hold an EDA meeting on November 25th and it was the
consensus to hold the EDA meeting at 6:00 p.m. and the Council meeting would start at 7:30
p.m. and then the "closed session" would follow the end of the Council meeting.
Mayor Mueller wished Andy Nelson all the best in his new position and thanked him for his
dedicated service to the City of Mounds View.

Background:
Timesaver Off Site Secretarial, Inc. has been providing recording secretary services for the
City of Mounds View since 1999. TimeSaver is a family-owned business and the previous
owner is retiring and has passed the business over to her daughter who has been
employed with the business for many years. The name of the business has changed to
Minute Maker Secretarial.
Discussion:
Rates will increase in 2019 (base rate is an approximate 2.5% increase). The contract
addendum rates are as follows:

APPROVING THE RECORDING SECRETARY SERVICE
AGREEMENT ADDENDUM DATED DECEMBER 31, 2019 WITH
MINUTE MAKER SECRETARIAL
WHEREAS, Minute Maker Secretarial (formerly TimeSaver Off -Site Secretarial, Inc.)
has been taking minutes for City Council, EDA and Planning Commission meetings since
1999; and
WHEREAS, the City Council and Staff are pleased with the thoroughness and
accuracy of the minutes taken by Minute Maker Secretarial (formerly TimeSaver Off -Site
Secretarial, Inc.); and
WHEREAS, rates for Minutes Maker Secretarial have increased for 2019 by
approximately 2.5%; and
WHEREAS, attached to this Resolution is the addendum to the Recording Secretary
Service Agreement;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council agrees
to and accepts the terms of the Minute Maker Secretarial recording secretary service
agreement addendum dated December 31, 2019, as attached
BE IT FURTHER RESOLVED that this agreement shall expire December 31, 2020.

RECORDING SECRETARY SERVICE AGREEMENT
Dated: December 31, 2019
By and between Minute Maker Secretarial, Inc. and the City of Mounds View, 2401 Mounds
View Boulevard, Mounds View, MN 55112.
1. EXTENSION OF RECORDING SECRETARIAL SERVICE AGREEMENT: The term
of the existing Recording Secretary Service Agreement dated December 31, 2018 shall be
extended under the same terms and conditions to December 31, 2020.
2. TOSS CHARGES: TOSS shall be paid for its services as recording secretary for each
meeting with a one (1) hour minimum, the highest rate prevailing, as follows:
a. Base Rate: One Hundred Forty -Eight and 00/100 dollars ($148.00) for any
meeting up to one (1) hour (billable time) plus Thirty -Five and 50/100 dollars
($35.50) for each thirty (30) minutes following the first one (1) hour; or
b. Unit Rate: Forty -Six and 50/00 dollars ($46.50) for the first hour of meeting time

Introduction:
Chapter 900 had previously been reviewed and updated earlier this year. However,
components of the HOPP Program required a modest update to two of the chapters;
906 which addresses water meters and 907 which deals with discharges into the
sanitary sewer system.
Discussion:
As discussed at numerous workshop and council meetings, the HOPP or Water
Preservation Program scheduled to be launched January 1, 2020; addresses multiple
facets — all related to preserving and conserving water.
To that end, council discussed replacing all water meters in the city for a number of
reasons that include;
1. Currently we do not own them and property owners were able to purchase
whatever they wanted leading to inconsistency and data driven concerns on
accuracy.
2. Some are very old as defined by more than 25 years and possibly, twice that. As
they age, their accuracy does become and issue.
3. New technology enables more accurate reading and depending on the type of
reader, forensic analysis of usage by time of day and day of week.
The other change is technical and clarifies current practice and Met Council regulatins
of now allowing sump pump discharge into the sanitary sewer system.
Strategic Plan Strategy/Goal:
Maintain and plan for infrastructure improvements including waste water, water, &
transportation
Financial Impact:
Water utility fund will be used to purchase and install meters. Depending on revenue
captured via more accurate meters, the fund may or may not need an increase to the
rate. If required, per council direction at workshop — a temporary fee per quarter
sufficient to cover the cost will be implemented and upon completion of the installation
upgrade, will be eliminated from the utility bill.
Recommendation:
Staff recommends the Council conduct First Reading of Ordinance 969.

THE CITY OF MOUNDS VIEW ORDAINS:
SECTION 1. The City Council of the City of Mounds View hereby amends Title 900, Chapter
906, Municipal Water System, Section 906.04 of the Mounds View Municipal Code by adding the

Subd. 3. Testing and Repairs:
a. All applications for the maintenance and repair of water meters shall be made to
the City Administrator. (Amended, Ord. 844,5-20-10)
b. Said meters shall be tested and repaired, from time to time, as is necessary to insure
accurate measuring of the flow of water; except, that whenever a meter has been
damaged due to negligence on the part of persons other than the employees of the
City ; the owner, occupant or user of the premises or such other
persons desiring the use of the water shall reimburse the City
for the expense of repairing any such meter and for the cost of testing any meter
exeeeding five-eighths ineh (5 8"�rc�-) in si'e Upon failure to reimburse the
Municipality within a reasonable time and upon demand therefor, the water service
and supply to said premises may be shut off or discontinued as determined to be in
the best interest of the City.

Subd. 4. Liability for Repairs: After the initial connection has been made to the water main,
the applicant,-ef--ke-occupant or other user of such premises shall be liable for,
but the City may per-fefm, in its sole diser-efien and s*eet to the r-eeeipt e
the piAlie health, saf�ty and , all leak- associated repairs between the water
main and the structure located on the premises. It shall be in the sole discretion of
the City to repair or replace the leaking water service line. The City may, in its sole
discretion and subject to the receipt of permission and a right of entry agreement,
except in cases of emergency affecting the public health, safety and welfare, also
repair or replaceme 4 -any broken, leaking or malfunctioning curb stop boxes.
This policy permitting City to repair between the water main and structure located
on the premises shall be funded by an additional utility fee. The City Council shall
establish and adopt this utility fee by resolution annually and shall set forth any
eligibility requirements and opt -out provisions therein. This service shall be
provided to all single family, duplexes, fourplexes and townhouses. Large
apartment complexes and commercial properties are not included in this policy.
For any repairs performed by the City, the City shall not be responsible for the
restoration of the excavation site, including, but not limited to seeding or placement
of sod, trees, shrubs, flowers, underground irrigation or any other improvements
not specifically mentioned herein which may be disturbed, destroyed or removed
during the repair or replacement of the water service. The Municipality shall
provide, in its sole discretion, only the initial repair or replacement of any
impervious surface, should it be necessary in the performance of the repair of a
leak or break of the property's service. Responsibility for maintenance and
protection of the curb stop box shall be that of the applicant, owner or occupant or
other user of the premises, and it shall be the responsibility of said party to maintain
the curb stop box at such height as will ensure that it will remain above the finished
grade of the land or property. Nothing herein will prevent the Municipality from
recovering the cost of repairs from the applicant, owner or other occupant or other
user of such premises or any other party in the event it can be established that said
parties were the cause of the damages requiring the repairs. (1988 Code §70.03;
Ord. 565, 9-11-95; Ord. 673, 12-11-00)
Subd. 5. Tampering with Meter Prohibited: It shall be unlawful for any person to tamper
with, by-pass or in any manner whatsoever interfere with the proper use and
functioning of any water meter within the Municipality. (1988 Code §70.04)
Subd. 6. Meter Testing on Request of Owner; Fees: Whenever a water user questions the
accuracy of a meter and desires
that the meter be tested, they shall pay a fee of twenty five dollars ($25.00) to the
City if the meter tests accurately within a range of minus three percent to plus one
and one-half percent (-3% - +1-1/2%). The testing of water- ter -s o eeding five
eighths ineh " . If it is
not aeeufate within this range, no charge will be made for testing, and an
adjustment on the water bill will be made for testing and an adjustment on the water
bill will be made for the period of time that the meter is assumed to be inaccurate
as determined by the Municipality. (1988 Code §70.17)
SECTION 2. The City Council of the City of Mounds View hereby amends Title 900, Chapter
907, Municipal Sanitary Sewer System, Section 907.06 of the Mounds View Municipal Code
by adding the double -underlined material and deleting the seri material as follows:
907.06: STORM WATER: It shall be unlawful to discharge or cause to be discharged
into
the City sewer system, either directly or indirectly, any roof, surface, ground, sump pump, footing
tile, or other natural precipitation, or water discharged from any air conditioning unit or
system. (1988 Code §71.07; Amended, Ord. 740,6-28-04)
Subd. 1. Definition and Method: Dwellings and other buildings and structures which
require, because of the infiltration of water into basements, crawl spaces and the
like, a sump pump system to discharge excess water, shall have a permanently
installed discharge line which shall not at any time discharge water into the
sanitary sewer system. A permanent installation shall be one which provides for
year-round discharge capability to either the outside of the dwelling, building or
structure, or is connected to the City storm sewer or discharges on the surface
within the property or drainage easement. It shall consist of a rigid discharge line,
without valving or quick connections for altering the path of discharge. Discharge
directly into the street or street guttering system is prohibited. (Added, Ord. 740,
6-28-04)
Subd. 2. Disconnection: Any person, firm or corporation having a roof, surface, ground,
sump pump, footing, or air conditioning unit or system now connected and/or
discharging into the sanitary sewer system shall disconnect and/or remove same
by November 1, 2004. Any disconnects or openings in the sanitary sewer shall
require a plumbing permit and must be closed or repaired in an effective manner
as approved by the City Building Inspector. (Added, Ord. 740, 6-28-04;
Amended, Ord. 803,4-14-08)
Subd. 3. Inspection: Every person owning improved real estate that discharges into the
City's sanitary sewer system shall allow for inspections of the building(s) located
on said property to confirm that there is no sump pump or other prohibited
discharge into the sanitary sewer system. Said inspections may be conducted by
employees or designated representatives of the City of Mounds View, or, if the
property owner so chooses, by a licensed plumber hired by the property owner.
Any person refusing to allow their property to be inspected within fourteen (14)
days of the date City employee(s) or their designated representative(s) are denied
admittance to the property must either hire a licensed plumber to inspect the
property and submit the licensed plumber's report within thirty (30) days of the
date the City employee's or their designated representative(s) were denied
admittance to the property, or, shall become subject to the surcharge hereinafter
provided for. The City may also obtain an administrative search warrant in order
to enter the property to inspect any discharge into the sanitary sewer system and
to determine compliance with this Code. Any owner of a property found to be
discharging storm water into the City sewer system, either directly or indirectly
shall make the necessary changes and furnish proof of the changes to the City
within sixty (60) days of the finding of noncompliance, unless such other time is
agreed to by the City, in order to comply with this Code. (Added, Ord. 740, 6-28-

Subd. 4. Future Inspections: At any future time, if the City has reason to suspect that an
illegal connection may exist in a premises, the owner, by written notice shall
comply with the provisions of Chapter 907.06, Subdivision 3. (Added, Ord. 740,
6-28-04)
Subd. 5. Surcharge: A surcharge of seventy five dollars ($75.00) pe at4e shall be
imposed and added to every sewer billing to
property owners that are not in compliance with this Section. The surcharge fee
shall be set by City Council resolution. The surcharge shall be added for the entire
quarter until the property is in compliance. (Added, Ord. 740, 6-28-04; Amended,

Subd. 6. Penalties: Any violation of this Section is a misdemeanor and is subject to
penalties provided for such violations under provision of Chapter 702 of

SECTION 3. The City Council of the City of Mounds View hereby amends Title 900, Chapter
912, Illicit Discharge and Connections to Storm Drainage System, Section 912.06, Subd. 2, of
the Mounds View Municipal Code by adding the double -underlined material and deleting the
st ieken material as follows:
912.06: DISCHARGE AND CONNECTION PROHIBITIONS:
Subd. 2. Exemptions to Discharge Prohibitions: The commencement, conduct, or
continuance of any illegal discharge to the storm drainage system is prohibited
except as described as follows:
a. Discharges resulting from the following activities: water line flushing, sumo numn
discharge landscape irrigation, diverted stream flows, rising ground waters,
uncontaminated ground water infiltration, uncontaminated pumped ground water,
discharges from potable water sources, foundation drains, air conditioning
condensation, irrigation water, springs, water from crawl space pumps, footing
drains, lawn watering, individual residential car washing, flows from riparian
habitats and wetlands, dechlorinated swimming pool discharges, and street wash
water.
SECTION 4. In accordance with Section 3.07 of the City Charter, City staff shall have the
following summary printed in the official City newspaper in lieu of the complete ordinance:
On December 9, 2019, the City Council adopted Ordinance xx that amends Title 900,
Chapters 906, 907, and 912 of the Mounds View City Code. The purpose of the amendment
was to modify certain city regulations related water meters and sump pump discharge.
A printed copy of the ordinance is available for inspection during regular business hours at
Mounds View City Hall and is available on line at the City's web site located at
www.moundsviewnm.org.
SECTION 24. This ordinance shall take effect and be in force 30 days from and after its passage
and publication, in accordance with Section 3.09 of the City Charter.

Item Title/Subject: First Reading Ordinance 970 Title 1100, various Chapters,
Zoning Code
Introduction:
This is a continuation of the systematic update of all codes with Chapters 100 through
1000 completed and upon final adoption of 1100, 1200 — 1500 will remain.
The Ordinance has been published on our web page since November 19, 2019. This
ordinance requires review by the Planning and Zoning Commission and is scheduled for
their December meeting. A public hearing is also required prior to final adoption with 10
days prior notice. The public hearing and second reading will occur on January 10,
2020.
Discussion:
Detailed below are the substantive changes.
1. Clarification regarding the front lot and/or lot width definitions in Chapters 1102
and 1103. We changed the party who decides front lot in the case of equal street
frontage on corner lots from the owner to the Zoning Administrator.
2. Section 1104.02 provides that the minimum lot size for two-family lots in R-2 was
6,250 square feet. We fixed that by removing some of the language in the chart.
In the case of a zero lot line twin home, the two homes will technically be on their
own lot.
3. No changes were made to Chapter 1124 (regarding Wireless
Telecommunications Facilities), but it appears those are necessary due to the
recent legislative changes for small cell wireless facilities. The city amended its
ROW ordinance to reflect these changes, but it appears there are revisions
necessary in the zoning code. The City Attorney and I suggest that be reviewed
separately because it will require additional policy -related input and a more
thorough examination of Chapter 1124's interplay with the recent small cell/ROW
changes. If for some reason there are applications or requests made regarding
wireless facilities in the interim, we will collectively determine how best to
proceed with them on a case-by-case basis.
4. Nonconforming uses are governed by state law and revisions to Chapter 1123
were made to make things consistent with statutory requirements. Cities are
generally preempted from coming up with different regulations than those
provided in Minn. Stat. Ch. 462.

5. Revisions to Chapter 1125 were made to make the voting requirements
consistent with state law. Generally speaking, and except for comprehensive
plan amendments, the only type of matter that requires more than a simple
majority vote is a rezoning of residential property to commercial property. Again,
cities are generally preempted from coming up with different regulations than
those provided in Minn. Stat. Ch. 462.

SECTION 1. The City Council of the City of Mounds View hereby amends Title 1100, Chapter
1102, Section 1102.02 of the Mounds View Municipal Code by adding the double -underlined

Subd. 73. LOT LINE, FRONT: That boundary of a lot which abuts a street, and in the case of
a corner lot, it shall be the shortest dimension on a public street; should the said dimensions
be equal, the owner- shall sign -at the f enl for- the r-ecer-d the front lot line shall be
determined by the Zoning Administrator.
Subd. 77. LOT WIDTH: The mean horizontal distance between the side lot lines of a lot,
measured within the lot boundaries. In the case of irregularly shaped lots located on a cul-
de-sac or curved street, lot width shall be measured at the required front and rear setback
lines.
SECTION 2. The City Council of the City of Mounds View hereby amends Title 1100, Chapter
1103, Section 1103.03, Subdivision 5 of the Mounds View Municipal Code by adding the double -

separated by a minimum of thirty (30) days.

from the public right-of-way or from neighboring residences and shall be in
compliance with Sections 1103.08 and 1103.09 of this Title.

1112, Section 1112.03, Subdivision 8 of the Mounds View Municipal Code by deleting the s4ieken

Subd. 8. Temporary outdoor food sales as an accessory use and including sales in or from
motorized vehicles, trailers, or wagons, subject to the following:
a. The activity shall not continue on the same property for a period greater than
twenty-one (21) consecutive days.

b. Notwithstanding t cle 13, Seetten 7 of Minnesota Gonstittxtien,-aA_ license
issued by the City shall be obtained prior to commencing the activity if otherwise
required by Title 500.
C. A permit will not be issued without the written consent of the property owner.
d. The sales area shall be grassed or surfaced to control dust.
e. The activity shall not take up parking space as required for conformity of this Title.
f. All lighting shall be hooded and so directed that the light source shall not be visible
from the public right-of-way or from neighboring residences and shall be in
compliance with Sections 1103.08 and 1103.09 of this Title.
g. The provisions of Chapter 1112.03 Subd. 5 are not applicable to temporary outdoor
food sales as an accessory use.
SECTION 7. The City Council of the City of Mounds View hereby amends Title 1100, Chapter
1113, Section 1113.04, Subdivisions 4 and 5 of the Mounds View Municipal Code by deleting the
s4ieken material and adding the double -underlined material as follows:
Subd. 4. Veterinary clinics, animal clinics, and animal boarding facilities; provided, that:
a. Noise and odor are effectively confined to the premises in accordance with Chapter 6
of this Municipal Code, Nuisances.
b. A mechanical ventilation or exhaust system shall be installed to control, capture and
remove emissions or odors generated by such use. Such systems shall be separate from
other ventilation systems in the building. Such system shall be designed to prevent the
migration of emissions or odors to other parts of the building. Installation must comply
with Minnesota Building Code Mechanical Systems, Chapter 4-34-51346-2.
C. All animal boarding activities shall be conducted indoors, except for necessary
outdoor exercise. At no time shall any animal be left unsupervised while outdoors.
d. Outdoor exercise shall be conducted so as not to unreasonably annoy, injure or
endanger the health, safety, comfort, or welfare of the public.
e. All animal boarding facilities shall comply with the Nuisance Codes established for
the City of Mounds View.
f. All animal boarding facilities shall comply with the Minnesota Pet and Companion
Animal Welfare Act (Minnesota Statutes, 346.35 — 346.44).

Subd. 5. Pet stores; provided, that:
a. Noise and odor are effectively confined to the premises in accordance with
Chapter 604 of this Municipal Code, Nuisances.
b. The boarding of animals is prohibited, except for the purposes of retail sales.

1123.03: DISCONTINUANCE OF NONCONFORMING USE: Whenever a lawful
nonconforming use of a structure or land is discontinued for a period of six «` "'^" more than
one year, any future use of said structure or lands shall be made to conform with the provisions of
this Title.
SECTION 9. The City Council of the City of Mounds View hereby amends Title 1100, Chapter
1123, Section 1123.07 of the Mounds View Municipal Code by deleting the s4iekematerial and

1123.07: DAMAGE AND DESTRUCTION: If, at any time, a nonconforming building,
structure or use shall be destroyed to the extent of more than fifty percent (50%) of its fair market

Introduction:
Chapter 1000 was recently updated this past summer. However, based on recent
changes, specifically the new rental fees and crime free program targeting problem
properties and incentivizing landlords to participate, modest changes to the code are
needed. The ordinance has been published on our web page since November 19,
2019. Second Reading and Adoption is scheduled for the December 9, 2019 meeting.
Discussion:
Section 1 — Technical conformance with current law and practice.
Section 2 — Provisions/changes to reflect recent changes to the rental licensing fee and
crime fee multi -family housing initiative.
Strategic Plan Strategy/Goal:
Maintain and plan for infrastructure improvements including waste water, water, &
transportation
Continue BR&E program, maximize utilization of development space and current list of
available sites, encourage land owners to maintain their properties, & consider
residential redevelopment

THE CITY OF MOUNDS VIEW ORDAINS:
SECTION 1. The City Council of the City of Mounds View hereby amends Title 1000, Chapter
1012, Section 1012.03 of the Mounds View Municipal Code by deleting Subdivision 2(f) thereof,
as shown stfieken below, in its entirety:

SECTION 2. The City Council of the City of Mounds View hereby amends Title 1000, Chapter
1012, Section 1012.08 of the Mounds View Municipal Code by adding the double -underlined
material and deleting the stem material as follows:
1012.08: Crime Free Rental Housing Program Voluntary Certification: The City has established a
voluntary program providing property owners and managers an opportunity to learn, train and
work hand in hand with law enforcement as well as the Community Development Department to
ensure that the City of Mounds View rental housing stock maintains a crime and drug free
environment. Based on the desired level of certification requested by the property and the
completion of the requirements for each level, the license fee can be reduced as follows.
Subd. 1. Level "C" Certification (20% reduction in license fees):
a. Property owner or a designated representative shall attend Ihfee two or more
meetings of the New Brighton/Mounds View Property Managers' Coalition
meetings per year.
b. Licensee or applicant shall have paid the required license fee in a timely manner,
as defined in the Mounds View City Code.
cd. The owner shall not allow weeds, vegetation, junk, debris, or rubbish to
accumulate repeatedly on the exterior of the premises so as to create a nuisance
condition under Chapter 607 of the City Code. Issuance of three or more Notices
of Violation during the previous licensing period regarding violations of Chapter

607 of the City Code is to be used as bias for determination of compliance with
this requirement.
de. The Crime-Free/Drug-Free Addendum shall be issued with every lease/tenant.
e. The property owner or designated representative shall attend and complete a one -
day (8 hour) training course as prescribed by the International Crime Free
Association: Crime Free Multi Housing Program. The information contained in
the seminar is a compilation of experience and proven methods from professional
rental property managers, lawyers, and police officers. Evidence of completion of
this course shall be provided in the form of a certificate of completion. Certificate
shall be dated within the past five years.
Propertv owner shall complete criminal background investigations which cover
the seven -county metro area going back at least three years on all rental applicants
who will be occupying the premises. Rental applicants must apply in person and
show valid ID. Criminal background investigations shall be conducted by an
agency that is approved by the City.
Subd. 2. Level `B" Certification shall include all of the requirements of Level "C" certification
plus following (33% reduction in license fees):
a. The property owner or designated representative shall attend €eawthree or more
meetings of the New Brighton/Mounds View Property Managers' Coalition
meetings per year.
b. Crime Free Security Assessment: The property must be Certified as "Crime Free
Multi Housing" as defined by the International Crime Free Association: Crime
