To Approve the Consent Agenda as amended removing Item 5D. Ayes — 5 Nays — 0 Motion carried. D. Resolution 9204, Approving a Cost of Living Adjustment, Insurance Contribution, and Insurance Opt -Out Payment Amounts for 2020. Council Member Gunn requested comment from staff on this item. Finance Director Beer reported staff was proposing a cost of living adjustment that was consistent to the adjustments that have been made for the past 15 years. He stated 3% was being offered to remain in alignment with the percentage that was offered to union and non-union employees. MOTION/SECOND: Gunn/Meehlhause. To Waive the Reading and Adopt Resolution 9204, Approving a Cost of Living Adjustment, Insurance Contribution, and Insurance Opt -Out Payment Amounts for 2020. Ayes — 5 Nays — 0 Motion carried. 6. PUBLIC COMMENT None. 7. SPECIAL ORDER OF BUSINESS None. 8. COUNCIL BUSINESS A. Public Hearing: Resolution 9195, Authorizing the Draft 2040 Comprehensive Plan to be submitted to the Metropolitan Council for review. Community Development Director Sevald requested the Council authorize the draft 2040 Comprehensive Plan to be submitted to the Met Council for review. He reported the City was required to update its Comprehensive Plan every 10 years. He discussed the purpose of the Comprehensive Plan and how it was used as a guiding document for the City. He requested the Council hold a public hearing and authorize staff to submit the Comprehensive Plan to the Met Council. Mayor Mueller opened the public hearing at 6:39 p.m. Hearing no public input, Mayor Mueller closed the public hearing at 6:39 p.m. Council Member Bergeron asked if the zoning designation for the Skyline Motel property had been adjusted. MOTION/SECOND: Hull/Meehlhause. To Waive the Reading and Adopt Resolution 9195, Authorizing the Draft 2040 Comprehensive Plan to be submitted to the Metropolitan Council for review. Council Member Meehlhause thanked all of the residents, staff members and Commission members that worked on the Comprehensive Plan. Ayes — 5 Nays — 0 Motion carried. B. Public Hearing — 2020 Tax Levy and Budgets for All Funds: 1. Resolution 9196, Adopting the 2020 Tax Levy 2. Resolution 9197, Approving the 2020 EDA Tax Levy 3. Resolution 9198, Adopting the 2020 Municipal Budget Finance Director Beer discussed the 2020 Tax Levy, EDA Tax Levy and municipal budget in detail with the Council. He commented on the City's four enterprise funds and requested the Council hold a Public Hearing prior to approving the three Resolutions. Mayor Mueller opened the public hearing at 6:46 p.m. Hearing no public input, Mayor Mueller closed the public hearing at 6:46 p.m. MOTION/SECOND: Gunn/Bergeron. To Waive the Reading and Adopt Resolution 9196, Adopting the 2020 Tax Levy. Ayes — 4 Nays — 1 (Hull) Motion carried. Mayor Mueller stated she had requested a reduction in the EDA levy to $50,000 versus $100,000 and because the reduction was not made, she would not be supporting the 2020 EDA Tax levy. MOTION/SECOND: Meehlhause/Bergeron. To Waive the Reading and Adopt Resolution 9197, Approving the 2020 EDA Tax Levy. Ayes — 4 Nays — 1 (Hull) Motion carried. MOTION/SECOND: Meehlhause/Gunn. Resolution 9193, Approving the 2020 City Council Meeting, Council/Staff Mounds View City Council December 9, 2019 Regular Meeting Page 4 1 Retreats, and the Town Hall Meeting Dates. 2 3 City Administrator Zikmund reviewed the 2020 City Council meeting, council/staff retreats and 4 the town hall meeting dates with the Council. He requested the Council discuss when to hold the 5 Council retreat and recommended approval of the proposed meeting schedule. 6 7 Mayor Mueller recommended the Council/staff retreats be held on Monday, March 161h (budget 8 discussion), Monday, May 181h (strategic planning), and Monday, September 21" (team building) 9 10 Council Member Meehlhause stated he supported the Council attending a team building retreat 11 but explained it may be of more value to hold this event earlier in the year. City Administrator 12 Zikmund commented the team building retreat could be held in March or May instead of 13 September. 14 15 The consensus of the Council was to meet on March 161h for a team building retreat and on May 16 181h for a budget retreat. It was noted the strategic plan would be addressed at Council 17 worksession meetings. 18 19 Mayor Mueller asked if the Council would have to hold a special meeting on January 6th. City 20 Administrator Zikmund reported this was the case. 21 22 MOTION/SECOND: Hull/Gunn. Resolution 9200, Approving Various Appointments to the City of Mounds 29 View's Boards, Commissions and Committees. 30 31 City Administrator Zikmund requested the Council approve appointments to the City's boards, 32 commissions and committees. He commented on the residents that submitted interest in serving 33 the City and recommended approval of the appointments. 34 35 Council Member Hull stated he would like to see Ms. Mohammad serving on the Park, 36 Recreation and Forestry Commission instead of Mary Zeiger. He indicated he would like to see 37 Mary Zeiger replace Gary Rundle on the Planning Commission. 38 39 City Administrator Zikmund reported he had spoken with Ms. Mohammad in his office, along 40 with Police Chief Harder and she was very excited to be serving ono the Mounds View Police 41 Foundation and on the Civil Service Academy. 42 43 Council Member Meehlhause indicated the Planning Commission was Mary Zeiger's second 44 choice and the Park, Recreation and Forestry Commission was her first choice. City Administrator Zikmund explained he would have to confirm that Ms. Mohammad was available to work with this group and the Mounds View Police Foundation. Council Member Meehlhause commented the Council could delay action on this Resolution until January in order to allow staff to speak with Ms. Mohammad and Gary Rundle to resolve the appointment issues. MOTION/SECOND: Bergeron/Hull. To Table Action on Resolution 9200, Approving Various Appointments to the City of Mounds View's Boards, Commissions and Committees to the January 6, 2020 City Council Meeting. Ayes — 5 Nays — 0 Motion carried. E. Resolution 9201, Accept Bid and Award Contract to Shank Constructors for Water Treatment Facilities Upgrades at Water Treatment Plants #2, #3 and the Booster Station. Public Works Director Peterson requested the Council accept a bid and award a contract to Shank Constructors for water treatment facilities upgrades. Staff discussed the proposed upgrades for Plants #2, #3 and the booster station in further detail with the Council and recommended approval of the project. MOTION/SECOND: Meehlhause/Gunn. To Waive the Reading and Adopt Resolution 9201, Accept Bid and Award Contract to Shank Constructors for Water Treatment Facilities Upgrades at Water Treatment Plants #2, #3 and the Booster Station, adjusting the total project cost and stating Item 5 should read: The Public Works Director will notify the City Administrator and City Council of any adjustments in excess of $10,000. Council Member Gunn asked when work would begin on this project. Public Works Director Peterson stated work could begin after the contract was approved by the Council. Ayes — 5 Nays — 0 Motion carried. F. Resolution 9210, Approving the Final Payment for the 2019 Street Reconstruction Project. Public Works Director Peterson requested the Council approve the final payment for the 2019 Street Reconstruction Project. Staff reported this project was completed under budget. He commented on the project detailing the change orders that were approved and recommended approval of the final payment. MOTION/SECOND: Bergeron/Hull. To Waive the Reading and Adopt Resolution 9210, Approving the Final Payment for the 2019 Street Reconstruction Project. Ayes — 5 Nays — 0 Motion carried. Ordinance 969 — Second Reading and Order Summary Publication Title 900, 3 Chapters 906 and 907 relating to Water Meter Requirements and Sump 4 Pump Discharge. ROLL CALL VOTE 5 6 City Administrator Zikmund requested the Council approve Ordinance 969 related to water 7 meter requirements and sump pump discharge. He explained staff received no input from the 8 public since the First Reading. He commented further on the proposed replacement of the City's 9 water meters and recommended approval of the Ordinance. 10 11 MOTION/SECOND: Gunn/Meehlhause. To Waive the Second Reading and Adopt Ordinance 12 969 and Order Summary Publication Title 900, Chapters 906 and 907 relating to Water Meter 13 Requirements and Sump Pump Discharge. 14 15 Mayor Mueller reported the City has budgeted for the replacement of all water meters and 16 encouraged the public to work with City staff to have their water meter replaced in 2020, 2021 or 17 2022. 18 19 ROLL CALL: Bergeron/Gunn/Hull/Meehlhause/Mueller. 20 21 Ayes — 5 Nays — 0 Motion carried. 22 23 H. Ordinance 971 — Second Reading and Order Summary Publication Title 24 1000, Chapter 1012 — Rental Housing Licensing. ROLL CALL VOTE 25 26 City Administrator Zikmund requested the Council adopt an ordinance relating to rental housing 27 licensing. He explained staff received no input from the public since the First Reading. He 28 commented further on the proposed rental housing licensing program and recommended approval 29 of the Ordinance. 30 31 Mayor Mueller questioned how rental property owners could learn about the Mounds View/New 32 Brighton property coalition meetings. Finance Director Beer explained mailings are sent out to 33 rental property owners regarding these meetings. 34 35 MOTION/SECOND: Bergeron/Meehlhause. He reported the department was hurting for vehicles at this time given the fact Ford canceled vehicle purchases last year and the department totaled another vehicle. He commented further on the proposed cost for the new vehicles and recommended approval. Council Member Bergeron asked if the Police Department was satisfied with the Ford vehicles. Police Chief Harder stated he was happy with the Ford products at this time. MOTION/SECOND: Meehlhause/Hull. To Waive the Reading and Adopt Resolution 9207, Approving the Purchase of Two Ford Police Utility Vehicles along with additional equipment and setup costs, noting the State bid would be out of St. Cloud and not Hibbing, Minnesota. Ayes — 5 Nays — 0 Motion carried. J. Resolution 9208, Approving Contract with League of Minnesota Cities/American Legal Services for Codification. City Administrator Zikmund requested the Council approve the contract with the League of Minnesota Cities/American Legal Services for codification. He explained the City has not codified its code in the past 10 years and over 50 ordinance amendments had to be codified. He reported American Legal Services specializes in this service and staff recommended approval of the contract. Mayor Mueller asked if the code would be in a single or dual column. She indicates she supported the dual column format. Council Member Hull supported the dual column format. Council Member Meehlhause and Council Member Gunn supported staff pursuing whatever format works best for staff. MOTION/SECOND: Hull/Bergeron. To Waive the Reading and Adopt Resolution 9208, Approving Contract with League of Minnesota Cities/American Legal Services for Codification. Ayes — 5 Nays — 0 Motion carried. 9. REPORTS A. Reports of Mayor and Council. Council Member Gunn reported a 35W Coalition Meeting would be held on December 12th where the I -35W Coalition will be dissolved. Council Member Gunn stated the SBM Santa Parade would be held on Thursday, December 12th Mounds View City Council December 9, 2019 Regular Meeting Page 8 1 Council Member Gunn thanked all who attended the Lions Waffle Breakfast on Sunday, 2 December 8th at the Edgewood Middle School. She noted all funds raised at this event would go 3 back directly to the local schools. 4 5 Council Member Meehlhause stated the Lions Club accepts used eye glasses at the Mounds View 6 Community Center. 7 8 Council Member Meehlhause reported he attended a YMCA Advisory Committee meeting on 9 Monday, December 2nd with Council Member Gunn. He discussed the attendance highlights for 10 2019 programming at the Mounds View Community Center. 11 12 Council Member Meehlhause explained he would be attending several NYFS meetings over the 13 coming weeks. 14 15 Council Member Meehlhause wished everyone Happy Holidays and a Happy New Year. 16 17 Council Member Bergeron reported he attended a Cable Commission meeting on Thursday, 18 December 5th. He noted CTV would be holding a garage sale on used equipment in mid to late 19 January. 20 21 Mayor Mueller wished everyone a safe and blessed holiday season and joyous New Year. She 22 stated she was very disappointed to see the temperatures were plummeting and thanked the 23 Public Works Department for their tremendous efforts to keep the City's streets free and clear of 24 snow. She encouraged residents to consider making a donation to a local organization that helps 25 those in need or to the Ralph Reeder Food Shelf. 26 27 Mayor Mueller reported she would be attending a Ramsey County Dispatch Policy meeting on 28 Tuesday, December 10th in Arden Hills. 29 30 Mayor Mueller indicated the Minnesota Women in Government would be meeting next on 31 Friday, December 13th where the group will be updating its membership brochure. 32 33 Mayor Mueller read a statement in full for the record from City Attorney Riggs regarding 34 Council action to request the Court to remove Brian Amundsen from the Mounds View Charter 35 Commission. She commented on October 28, 2019 Ramsey County District Court Judge John 36 Guthman denied the City's request. She reported the City Council request to remove Mr. 37 Amundsen was based on the fact the Chair of the Charter Commission resigned and four other 38 members had conversations with staff or Council stating they would resign or had significant 39 concerns. In fact, shortly after the ruling, a second member has now resigned. She explained the 40 City Council had met in Closed Session with the City Attorney on November 25, 2019 per 41 Minnesota Statute 13D.05, subd.3(b) to discuss this decision and the options for the City. At this 42 point, the City considers this issue to be closed. City Administrator Zikmund updated the Council on the status of Rayla Ewald and noted she would be returning to the City on January 17th at the earliest. City Administrator Zikmund reviewed the items the Council would be discussing at the January 6th worksession meeting. C. Reports of City Attorney. City Attorney Riggs provided the Council with an update on the Crossroad Pointe project and commended City staff for their efforts to complete the City Code codification. 10. Resolution 9214, Approving a Recommendation for the Appointment to the Charter Commission. Mayor Mueller reported the Court has requested the City Council make a recommendation on the Charter Commission appointment by the end of business on December 30th. She explained the City Council has received six applications for the open Charter Commission seat. City Administrator Zikmund stated the vacancy was triggered by the resignation of Brooks Staples from the Charter Commission. He reported the Court posted the vacancy with a deadline of December 25th to receive applications. He noted the Court Administrator emailed staff on December 26th and noted the Court had received five applications and wanted a recommendation by close of business on December 30th. He explained a sixth application was received from Rebecca Scholl. He commented further on the conversation he had with Ms. Scholl and requested the Council make a recommendation to the Court regarding the vacancy on the Charter Commission. Council Member Meehlhause reported Council Member Bergeron sent an email with his thoughts on the Charter Commission appointment. He indicated he supported Council Member Bergeron's recommendation of Miranda Munson. Mayor Mueller read the names of the residents that had applied to serve on the Mounds View Charter Commission. She understood Ms. Munson would like to become more involved in the community and believed she would be a great asset to the Charter Commission. Mayor Mueller stated she was quite pleased that five women had applied to serve on the Charter Commission. She was of the opinion Rebecca Scholl would also serve the group well. MOTION/SECOND: Meehlhause/Hull. To Waive the Reading and Adopt Resolution 9214, Approving a Recommendation for the Appointment of Miranda Munson to the Charter Commission. Mayor Mueller asked if the Court could retain the remaining five candidates for 60 to 90 days in the event the Charter Commission has another vacancy. City Administrator Zikmund stated he believed statute required the Court to post for each vacancy but noted he would follow up with the Court regarding this matter. Discussion: The State Court Administration requires a council resolution priorto providing access to any attorney. Resolution 9215 states that Katrina E. Joseph of HIJ Law, or her successor, is hereby designated the Authorized Representative and given Master Subscriber Signing Authority for the purposes of entering into a Master Subscriber Agreement between HIJ Law and the State of Minnesota Office of State Court Administration to access Minnesota court data services for governmental agencies. The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain HIJ Law's access to court data services. Recommendation: Adopt Resolution No. 9215 providing HJ Law/Katrina Joseph is our Authorized Representative. Respectfully submitted, Nyle Zikmund City Administrator RESOLUTION NO. 9215 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AUTHORIZING HIJ LAW TO SIGN A MASTER SUBSCRIBER AGREEMENT BETWEEN HIJ LAW AND THE STATE OF MINNESOTA OFFICE OF STATE COURT ADMINISTRATION TO ACCESS MINNESOTA COURT DATA SERVICES FOR GOVERMENTAL AGENCIES WHEREAS, HIJ Law serves as the City Prosecutors for the City of Mounds View; and WHEREAS, HIJ Law requires access to court data services to perform their responsibilities as City Prosecutors; and WHEREAS, the State Court Administration requires that the City of Mounds View provide HIJ Law with Signing Authority to enter into an agreement for access to court data services. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View, Ramsey County, Minnesota as follows: That Katrina E. Discussion: In December 2019, Deputy Chief Steve Menard retired from the Mounds View Police Department leaving the position of Deputy Chief vacant. A promotional process was conducted with Sgt. Ben Zender promoted to Deputy Chief leaving the Sgt. position open. The Mounds View Police Department conducted a Sgt. promotional process with Brian Schultes being recommended for promotion. Brian Schultes has been the acting Sgt. for several months, after Zender was injured during a pursuit. At this time, staff would like to promote Brian Schultes to Sergeant. Mr. Schultes successfully passed the required testing procedures, which included an oral board, and an assessment and interview with Dr. Laura Pendergrass at Martin McAlister. As officer Schultes has been the acting Sgt. since August 12, 2019, we are requesting the promotion be immediate upon council approval (January 6, 2020). Recommendation: Staff recommends City Council approval of Resolution 9218 a resolution authorizing the promotion of Brian Schultes to Police Sergeant.
