RESOLUTION NO. 9231
CITY OF MOUNDS VIEW RESOLUTION AUTHORIZING
THE CONVEYANCE OF CITY OF MOUNDS VIEW PROPERTY TO THE
MOUNDS VIEW ECONOMIC DEVELOPMENT AUTHORITY
BE IT RESOLVED by the City Council ("Council") of the City of Mounds View as follows:
Section 1. Recitals.
1.01. The City of Mounds View (the "City") has previously established the Mounds View
Economic Development Project (the "Project"), which is currently administered by the Mounds View
Economic Development Authority (the "Authority").
1.02. The City asserts that it owns certain property within the Project encompassing a 30 -foot
excess right-of-way parcel legally described as set forth in Exhibit A (the "Property").
1.03. The Property is presently vacant land.
1.04. There is no future use of the Property contemplated by the City and the Property is
deemed surplus property.
1.05. The City and Authority are considering various development proposals for two apartment
facilities and the proposed expansion of two adjacent businesses (the "Development") to be constructed on
or adjacent to the Property.
1.06. The City and Authority previously reviewed the proposals for the Development on the
Property and have concluded that the proposed Development is consistent with and promoted the goals and
objectives for which the Project was established.
1.07. In order to facilitate the Development, the City agrees to convey to the Authority, and the
Authority agrees to subsequently utilize for the Development, the Property.
1.08. The City is authorized to convey real property pursuant to Minnesota Statutes Section
465.035 to any governmental subdivision or Minnesota Statutes Section 471.64 to any other political
subdivision of the State.
1.09. The Authority is a political subdivision of the State pursuant to Minnesota Statutes Section
469.091, Subdivision 2.
1.10. The City and the Authority have followed applicable statutory provisions, including but not

limited to, Minnesota Statutes, Section 465.035, Minnesota Statutes, Section 469.101 and Minnesota
Statutes, Section 471.64, in authorizing the conveyance of the Property.
1.11. The City has determined it is most cost effective to convey the Property to the Authority in
consideration of one dollar ($1.00) and other good and valuable consideration pursuant to this Resolution
and a standard quit claim deed.
1.12. The Property shall be subsequently conveyed by the Authority pursuant to Minnesota Statutes,
Section 469.105 for development purposes.
1.13. The City finds and determines that conveyance of the Property to the Authority is for a public
purpose and is in the public interest because it will further the objectives of the Development and the Project.
1.14. The City finds and determines that the further conveyance by the Authority of the Property
for the Development is for a public purpose and is in the public interest because it will further the objectives
of the Project.
1.15. The City Council finds that the requirements of Minnesota Statutes Section 462.356,
Subdivision 2 are hereby deemed satisfied, and that the conveyances of the Property to the Authority and
by the Authority for the Development are consistent with the proposed amended comprehensive municipal
plan, or alternatively, the City dispenses with the requirements of Minnesota Statutes Section 462.356,
Subdivision 2 and finds in the City Council's judgment that the proposed conveyance of the Property to the
Authority has no relation to the proposed amended comprehensive municipal plan of the City.
Section 2. Authorization.
2.01. The recitals set forth in this Resolution are incorporated into and made a part of this
Resolution.
2.02. The City Council finds and determines that the requirements of Minnesota Statutes Section
462.356, Subdivision 2 are hereby satisfied, or alternatively, dispensed with based upon the findings of the
City Council.
2.03. The City Council finds and determines that the transaction herein referenced and
contemplated is for a public purpose and is in the public interest.
2.04. The City Council approves the conveyance of the Property to the Authority pursuant to
Minnesota Statutes Section 465.035 and Minnesota Statutes Section 471.64, and authorizes and directs the
Mayor and City Administrator to execute the deed and related documents necessary to facilitate the
transaction referenced herein and contemplated herein, with all such actions to be in accordance with the
terms and conditions set forth in this Resolution.

2.05. The Mayor and City Administrator, staff and consultants are hereby authorized and directed
to take any and all additional steps and actions necessary or convenient in order to accomplish the intent of
this Resolution.

the laws of the State of Minnesota, Grantor, hereby conveys and quitclaims to the Mounds View
Economic Development Authority, a body corporate and politic under the laws of Minnesota,
Grantee, real property in Ramsey County, Minnesota, described as follows:
That part of the South 33 feet of the North 1/2 of the Southeast 1/ of the Northeast'/
of Section 17, Township 30, Range 23, Ramsey County, Minnesota, lying East of
Lot 4, Block 1, Mounds View Industrial Park, subject to highway.

Together with all hereditaments and appurtenances, and subject to all encumbrances of record, if
any.
