RESOLUTION NO. 4663 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION DIRECTING THE CITY CLERK NOT TO FILE CHARTER AMENDMENT CONCERNING TERM LIMITS WHEREAS, at the November 8, 1994 election, a ballot proposition pertaining to limiting the number of terms that the Mayor and City Councilmembers may hold was adopted by the voters; and WHEREAS, the Minnesota Attorney General has concluded that a term limits provision such as the one adopted at the November 8, 1994 election violates the Minnesota Constitution; and WHEREAS, a case involving the City of Minneapolis is currently pending before the Minnesota Supreme Court that will address the constitutionality of term limits; and WHEREAS, Minnesota Statutes, Section 410.11 requires the City Clerk to file a copy of the charter amendment with the Secretary of State and County Recorder; and WHEREAS, the City Council must provide for the orderly administration of justice and insure that the Mounds View City Charter does not contain any unconstitutional provisions. NOW, THEREFORE, BE IT RESOLVED by the Mounds View City Council that the City Clerk is directed not to file the charter amendment that was passed on November 8, 1994 until the Supreme Court has issued a final ruling as to the constitutionality of term limits in the case that is presently pending before it involving the City of Minneapolis.
