RESOLUTION AUfiHORIZING ABATEMENT OF NliISANCE CODE
VIaLATIONS AT St)55-57 SUNYSIDE ROAD, IVIQUNDS VIEW, MINNESOTA, 55112.
WHEREAS, Steve Francis Oberstar Jr. is the ownex of property located at 5055-57
Sunnyside Road, zoned R-2, Single & Two Family Residential,, legally described as follows:

FIN # 07-30-23-433-0075:
'WHEREAS, or, November 1~, 20418 staff inspected the property located at x055-5T
Sunnyside Rd in response to information received regarding exterior accutzlulations of garbage,..
junk az-~d debris; and
WHEREAS, on November 19, 2008 a Summary Abatement Order was issued to Steve
Oberstar Jr. requiring corrective actions completed to bring 5055-57 Sunnyside Road into
compliance with Garbage and Rubbish Storage. and Removal requirements of the City Code by
November 27,..2008,; and
~,'VHEREAS, on December 1, 2008 staff performed a ft~llow up inspzction ;of 503.5-57
Sunnyside Rd and found that the property was not in compliance, and
WHEREAS, on I?ecerrtber 1, 2008 an ,4drninistrative Citation.. was issued to Steve
Oberstar Jr. for violation of Section 607.03 Subd. lh of the City Code; anti
WIII?,REAS, in a letter dated-December 4, 2008, staff notified. Steve Oberstar Jr. of its
ntentto-appear before the Mounds View City Council. an December 22, 2008 to request
authorization to abate violations cited in the Summary Abatement Order; and.
1r`~I-IEREAS Steve Oberstar Jr, is responsible for maintaining Nuisance Code v%olations
orr the exterior of the above-said property that include, but are not limited tQ:
1. $ags of trash.
2. 2 automotive batteries,
3. Brokenlunusable basketball hoop.
4. Household furnishings and appliances
WHEREAS,: the City Council finds that the nuisance. code violations at 5055-57
Sunnyside 'Road constitute a Public Nuisance under Section 607.03 Subd. "1 h and .507.03 Subd.
3c and the City may abate and assess the costs.. of said abatement against the property pursuant: to
Minn, Stat. 429.101; and
WHEREAS, the City has complied with the notification requirement for nuisance
abatement as stated in 607.09, Subd. Sb. of the Mounds View: Municipal Code; and

WHEREAS, Steve Francis Oberstar Jr., property ov~rner of 5055-57 Sunnysde Raad, will
be personally liable to the City far the costs of such. abatement, including administrative costs
pursuant. to Section 607.09,. Subd. 7 of the Mounds View Municipal Code; and
WHI/REAS, if the property owner fails to pay the cost, after being. duly notified, of file
:abatement of nuisance. code violations at address within >0 days after the date of the invoice, the
City may ee~rtify the unpaid costs against. the prapel~ ° pursuaant to Section 607,09, S~ubd'.:8 of tk~e
Mounds View Municipal Code.
NOW THEREFQRE, BE IT RESOLVED 'I'Fix~T
The City«~ll abate violations of Chapter 607 of file City Code no sooner than 5 calendar days as
follows.
1. The City Council authorizes City staff fo complete any actions necessary to achieve
compliance with the City Code with respect to exterior violations of Section 607.03 Subd.
lh and b07.03 Subd.;3e.
2. Steve Francis C3berstar Jr. shall be personally liable to the City for the costs of abatement,.
including administrative costs and reasonable storage costs.
~. Any unpaid portion of file abatement casts after. ~0 days of the date on the invoice may be
certified as special ~ssessinezzts against the property upon a duly called hearing and
pursuant to Section 6Q7.09, Subd. 8 of the Mounds View Municipal Code..
