RESOLUTION AUTHORIZING .ABATEMENT OF NTISANCE CODE
VIOLATIONS AT 2070 TERRACE DRIVE, MOUNDS VIEW, MINNESOTA, 55112.
W1~EREAS, Mary G. Higgins is the owner of property located at 2070 Terrace Dave,
zoned R-l, Single >~ amity Residential, legally described as follows:

WHEREAS,. on November 21, 2008, staff inspected the property located at 2070 Ten•ace
Drive ix response to information received regarding exterior accumulations of junk and debris;
and.
WIIEI~EAS, a notice of violation was issucd to Mary G. Ilggins dated November 2l;
2fl08 and. requested corrective actions completed to bring the property into compliance with..
Section b07.03 Subd. `3c of the Nuisance Code by December 1,.200& :and
WHEREAS, on December 4, 2008 staff performed a follow up inspection of 2070
Terrace Drive. and found that corrective actians had not been completed; and
WHEREAS, iii a letter dated December 4, 200$, staff'notifi~d Mary'G. Hi~~;ins of its
intent to appear before the Mounds View City Council on December 22, 20b8 to request
authorization to abate violations cited in the Notice of Violation dated November 21, 2008; and
WHERl~AS Mary Cx. Higgins is responsible for maintaining Nuisance Gode violations on
the exterior of the above-said property that include, but are not. limited to:
l . Mattress next to garage.
2. Accumulations of rusting metal, junk and. debris..
3. Inoperahlefunusable household furnishings..
WHEREAS, the City Council finds that the nuisance code violations at 2070 Terrace
Drive constitute a Public Nuisance under Section 607.03 Subd. 3c and the City may abate and
assess the costs of said abatement against the property pursuant to Nlinn, Stat. 429,1031:; and
WHEREAS, the Gity has catnplied with the notification requirement for nuisance
abatement as stated in 607.09, Subd. Sb. of the iVlounds View Municipal Code; and
WHEREAS, Mary° G. Higgins, property ocviler of 2070 Terrace Drive, will be personally
liable to the City for the costs of such abatement, including administrative costs pursuant to
Section:607.09 Subd. 7 of the Mounds View Municipal Code; and...

WHER)1AS, ifthe property owner. fails ta'pay the cost, after being duly notified, of the
abatement of nuisance code violations at 2070 Terrace Drive within 30 days after the date of the
invoice; the City may certify'the unpaid costs against the property pursuant to Section 647.09,
Subd. S of the Mounds View Municipal Code.
NQW THEREFQRE, BE TT RESQLVED THAT:
The City will abate violations of Chapter b07 of the City Cade no sooner than 5 calendar days as
follows.
1. The City Council authorises City staff to complete any actions necessary to achieve
compliance with the City Code with respect to exterior ~~iolatians of Section 607.03 Subd
~G.
2. N1aryG. Higgins shall be personally liable to the City far the costs of abatement,.
including administrative costs and reasanablt; storage casts.
3. Any unpaid portion of the. abatement costs after 30 days of the,date on the .invoice may be
certified as special assessments against the property upon a duly called hearing and
pursuant. to Section b07.09,_Subd. 8 of the Mounds View Municipal Code.
