RESOLUTION AUTHORIZING ABATEMENT OF NUISANCE CODE
VIOLATIONS AT 8379 RED OAK DRIVE, MOUNDS VIEW, MINNESOTA, 55112.
WHEREAS, the Norbert Moe Estate and Ann M Moe are the owners of property located
at 8379 Red Oak Drive, zoned R-1, Single Family Residential, legally described as follows:

WHEREAS, on November 5, 2008, staff inspected the property located at 8379 Red Oak
Drive in response to information received regarding exterior accumulations of junk and debris;
and
WHEREAS, a notice of violation was issued to Ann Moe dated November 5, 2008. Staff
requested corrective actions completed to bring the property into compliance with Sections
607.06 Subd. 2c (1) and 607.03 Subd. 3c of the Nuisance Code by November 30, 2008; and
WHEREAS, on December 1, 2008 staff performed a follow up inspection of the property
at 8379 Red Oak Drive to verify corrective actions were completed and found that conditions had
not been completed; and
WHEREAS, on December 4, 2008 Administrative Citations were issued to Ann Moe for
violations of City Code remaining in existence at 8379 Red Oak Drive; and
WHEREAS, in a letter dated December 4, 2008, staff notified Ann Moe of its intent to
appear before the Mounds View City Council on December 22, 2008 to request authorization to
abate violations cited in the Notice of Violation dated date; and
WHEREAS, on December 22, 2008 the City council tabled action on this item for 30
days; and
WHEREAS, on January 20, 2009 staff performed a reinspection of the property at 8379
Red Oak Drive and observed that items had been relocated behind a temporary fence; and
WHEREAS Ann Moe is responsible for maintaining Nuisance Code violations on the
exterior of the above-said property that include, but are not limited to:
1. Accumulation of tires, automotive parts and components.
2. Accumulation of junk and debris.
3. Accumulation of rusting metal and inoperable/unusable equipment.
4. Accumulation of household furnishings and appliances.

WHEREAS, the City Council finds that the nuisance code violations at 8379 Red Oak
Drive constitute a Public Nuisance under Section 607.03 Subd. 3c and the City may abate and
assess the costs of said abatement against the property pursuant to Minn. Stat. 429.101; and
WHEREAS, the City has complied with the notification requirement for nuisance
abatement as stated in 607.09, Subd. Sb. of the Mounds View Municipal Code; and
WHEREAS, the Norbert Moe Estate and Ann M Moe, property owners of 8379 Red Oak
Drive, will be liable to the City for the costs of such abatement, including administrative costs
pursuant to Section 607.09, Subd. 7 of the Mounds View Municipal Code; and
WHEREAS, if the property owners fail to pay the cost, after being duly notified, of the
abatement of nuisance code violations at address within 30 days after the date of the invoice, the
City may certify the unpaid costs against the property pursuant to Section 607.09, Subd. 8 of the
Mounds View Municipal Code.
NOW THEREFORE, BE IT RESOLVED THAT:
The City will abate any violations of Chapter 607 of the City Code at 8379 Red Oak drive no
sooner than May 1, 2009 as follows.
The City Council authorizes City staff to complete any actions necessary to achieve
compliance with the City Code with respect to violations of Section 607.03 Subd 3c.
2. The Norbert Moe Estate and Ann M Moe shall be personally liable to the City for the
costs of abatement, including administrative costs and reasonable storage costs.
Any unpaid portion of the abatement costs after 30 days of the date on the invoice maybe
certified as special assessments against the property upon a duly called hearing and
pursuant to Section 607.09, Subd. 8 of the Mounds View Municipal Code.
