Call to Order The meeting was called to order by Chair Stevenson at 7:00 p.m. for April 17, 2019. ______________________________________________________________________________ 2. Citizens Requests and Comments on Items Not on the Agenda None. ______________________________________________________________________________ 5. Planning Cases A. Resolution 1095-19, Recommending Approval of Ordinance 956, Amending the Zoning Map for 8482, 8484 and 8486 Long Lake Road Community Development Director Sevald stated staff is requesting an amendment to the Zoning Map to correct an error. The affected properties include a twin-home and a single-family home. The twin-home was rezoned from R-1 to R-2 in 1982. During the City’s updating of the Zoning Map, the neighboring single-family home was rezoned instead. Staff recommended the Planning Commission hold a public hearing and approve the Ordinance amending the zoning map as requested. Commissioner Farmer questioned if staff had reviewed State Statute and if this zoning could be passed when the zoning would not be consistent with the Comprehensive Plan. Community Development Director Sevald explained this area of the City was intended for single-family detached homes. He noted back in 1982 the Council made an exception and allowed a townhome. Since that time, no further exceptions have been made in that area of town. Chair Stevenson stated by granting an R-2 zoning designation in this location it does not mean that any other R-2 rezonings would be approved. He believed that this was more of a clerical correction at this time. Commissioner Monn explained she understood Commissioner Farmer’s concerns as the Comprehensive Plan and Zoning Map were not in alignment. She reported it was the Planning Commission’s job to review and address these matters. Commissioner Farmer asked when the City’s Comprehensive Plan would be adopted. Community Development Director Sevald reported this would document would be adopted in early in 2020. Commissioner Nelson commented the issue was created years ago by a former City Council and the Planning Commission was simply being asked to correct a clerical issue. Community Development Director Sevald indicated this was the case. Commissioner Farmer questioned if the affected property was being impeded at this time. Community Development Director Sevald stated staff was not aware of any concerns, noting the error occurred some 20 years ago. He noted the error was brought to the City’s attention by a real estate appraiser after reviewing the City’s zoning map. To approve Resolution 1095-19, a Resolution Recommending Approval of Ordinance No. 956, amending the Zoning Map. Ayes – 3 Nays – 2 (Farmer & Monn) Motion carried. _____________________________________________________________________________ B. Resolution 1096-19, Recommending Approval of the Revocation of a Conditional Use Permit for C & N Group, LLC (dba Tires N’More) 2832 Mounds View Boulevard Community Development Director Sevald stated the City has taken numerous enforcement action against Tires N’More located at 2832 Mounds View Boulevard. The property is in violation of City Codes pertaining to non-permitted land use (warehouse), outside storage, and Fire Code violations. At times, the property owner, C & N Group LLC, has cooperated with the City, but many times they have not. Staff has nearly exhausted its options for enforcement. Revocation of the CUP is an additional option. Sami Soussi, Tires N’More representative, explained his brother ran into a few issues after having an accident. He reported he and his brother have been working at the business to get it cleaned up. He indicated he was working to get one of the trailers impounded. He noted the parking lot was getting cleaned up and he was trying to find the right manager to run the store. Commissioner Monn asked if Mr. Soussi was aware of the numerous code violations for this property. Mr. Soussi stated he was aware of the violations. Commissioner Monn questioned why he had been uncooperative with the City. Mr. Soussi explained he doesn’t have someone onsite at all times, but rather was working to clean up the site after hours. Commissioner Farmer inquired if the store had been open for retail sales. Mr. Soussi reported the store had not been open for retail sales. He stated it was his hope that the property would be cleaned in another month or two and would be ready to operate. Commissioner Nelson commented the City has given the property owner a “couple of months” to clean this property several times. He indicated he was still not hearing a clear plan from the property representative and stated he would be more comfortable with the City providing Mr. Soussi with a drop-dead date. He expressed concern with the fact the Tires N’More in Mounds View was only open for six hours on Saturdays and questioned if this should even be considered a retail store. He explained the store in Mounds View was suffering and he didn’t believe this was fair to the community. Mr. Soussi stated he was searching for a person to manage this site and understood the Mounds View store has been a headache. He explained he appreciated the City working with him. Mounds View Planning Commission April 17, 2019 Regular Meeting APPROVED Page 4 ________________________________________________________________________ Commissioner Nelson questioned how many tires were in the long semi-trailer behind the store. Mr. Soussi estimated the trailer was housing 800 used tires. He noted he has been in contact with the semi-trailer owner and noted this trailer would be impounded this weekend and the other semi-trailer would be removed by Monday. He explained the U-Haul truck would be getting tabs in order to be used by the business to bring tires to and from the site. Commissioner Nelson stated again that he would like a more clear direction for this property than a “couple of months”. Mr. Soussi explained it was his goal to have a site manager in place and the property cleaned by June 1st. Commissioner Monn asked if the Commission could table action on this item. She feared that another accident could happen and the site would remain vacant. She stated she wanted the property owners to have a more clear plan in place for the property. Community Development Director Sevald commented the Planning Commission could table action on this item but noted the City would continue to address the code enforcement issues with the property owners. He explained it was not Mr. Soussi’s intent to install tires at this location, but rather would be running a retail store from this location. Therefore, he recommended the Conditional Use Permit revocation proceed. Commissioner Farmer asked if the trailers were allowed on the site. Community Development Director Sevald reported the trailers were not allowed and were being used for outdoor storage purposes. Commissioner Farmer supported the revocation of a Conditional Use Permit for the minor auto repair due to the fact there was no reason for it. Commissioner Nelson agreed. Chair Stevenson stated it was not the Planning Commission’s place to set timelines for code compliance issues. Community Development Director Sevald reported this was the case and explained Mr. Soussi has made progress on the site. MOTION/SECOND: Commissioner Nelson/Commissioner Monn. To approve Resolution 1096-19, a Resolution Recommending Revocation of a Conditional Use Permit for a Tire and Minor Auto Repair Store. Ayes – 5 Nays – 0 Motion carried. _____________________________________________________________________________ 6. Other Planning Activity A. Discussion – 2040 Comprehensive Plan Community Development Director Sevald introduced the 2040 Comprehensive Plan to the Commission. He explained this document was a planning or guiding document for the City to Mounds View Planning Commission April 17, 2019 Regular Meeting APPROVED Page 5 ________________________________________________________________________ use for the next 10 to 20 years. He noted a joint Commission, City Council and Comprehensive Plan Task Force meeting would be held on Tuesday, April 23rd at 6:30 p.m. He reported the Comprehensive Plan would be available on the City’s website for the Commission and general public to review. Commissioner Monn recommended the City’s mission and vision be included in this document. She thanked staff and the task force for all their efforts on this document. ______________________________________________________________________________ 7. Reports A. Upcoming Planning Cases & Activity Community Development Director Sevald discussed upcoming planning cases. He commented on the progress that was being made at the Boulevard apartments. He noted the development agreements for the Crossroad Pointe development was still being worked on. He estimated the City would be closing on this property by August 1st. He reported the City has entered into a purchase agreement for the Skyline Motel and requested RFP’s to redevelop the site into a new hotel. B. Staff Updates Community Development Director Sevald provided the Commission with an update from staff. He discussed the recent Town Hall meeting and stated he was pleased by the attendance at this event. C. Council Updates Council Member Meehlhause provided the Planning Commission with an update from the City Council. He thanked the Commissioners that were able to attend the Town Hall meeting. He commended the individuals that were selected for Citizen of the Year (Penny Howard) and Coach of the Year (Aaron Bahn). He explained the Hospital Board recently dissolved and the assets have been disbursed to the member cities. He noted the City of Mounds View received a check in the amount of $827,280. He commented on the upgrades that would be occurring to the City’s water treatment plants and noted the engineering work for this project had been approved by the Council. He indicated the Council was considering creating two new task forces, the first to address the creation of veteran’s memorial park and the second would be for GreenStep Task Force. D. Approval of Minutes March 6, 2019. MOTION/SECOND: Commissioner French/Commissioner Monn. To approve the Minutes of the March 6, 2019 regular Planning Commission meetings as slightly amended.
