COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING A CONDITIONAL USE PERMIT
FOR OPEN AND OUTDOOR STORAGE AS AN ACCESSORY USE,
2832 MOUNDS VIEW BOULEVARD
(PLANNING CASE CU2020-004
WHEREAS, the applicant, Mike Horsch (JAM Ventures MN Two LLC), has applied for a
Conditional Use Permit for Open and Outdoor Storage as an Accessory Use on property located at 2832
Mounds View Boulevard, legally described as:
Lot 1, Block 1, Velmier CVS Addition
WHEREAS, the property is zoned B-3 Highway Business; and,
WHEREAS, the Mounds View City Code, Section 1114.04, Subd 4, requires a Conditional Use
Permit for Open and outdoor storage as an accessory use within the B-3 district. Among other conditions,
outside storage abutting a residential district must be screened; and,
WHEREAS, the Mounds View City Code, Section 1103.08, Subd 6, related to required
screening, requires a green belt planting strip at least 8' in height, or a solid fence not less than 6' in
height. The subject property includes a 6' solid wooden fence along the western property line adjacent to
residential properties, and a chain link fence along the southern property line adjacent to a storm water
infiltration basin. The applicant proposes to enclose unfenced areas with an 8' solid wooden fence; and,
WHEREAS, the Mounds View City Code, Section 1125.01, Subd 3(b) includes the Criteria for
Granting Conditional Use Permits, stating; In granting a conditional use permit, the City Council shall
consider the advice and recommendations of the Planning and Zoning Commission and the effect of the
proposed use on the Comprehensive Plan and upon the health, safety and general welfare of occupants of
surrounding lands. Among other things, the City Council shall make the following findings where
applicable (Findings in Bold italics):
1. The use will not create an excessive burden on existing parks, schools, streets and other public
facilities and utilities which serve or are proposed to serve the area.
Finding: The Open and Outdoor Storage will have no impact to public facilities.
2. The use will be sufficiently compatible or separated by distance or screening from adjacent
residentially zoned or used land so that existing homes will not be depreciated in value and there
will be no deterrence to development of vacant land.
Finding: The Open and Outdoor Storage will be adequately screened by an 8' solid
wooden fence, except along the southern property line, which is adjacent to a
wooded storm water infiltration brain.

The structure and site shall have an appearance that will not have an adverse effect upon adjacent
residential properties.
Finding: The Open and Outdoor Storage area is currently screened from adjacent
residential properties by a 6' solid wooden fence. Screening will be improved by
a new 8' solid wooden fence.
4. The use, in the opinion of the City Council, is reasonably related to the overall needs of the City
and to the existing land use.
Finding: The building was built in 1965, primarily for use as a warehouse (PAK
Company). The property has been underutilized as a warehouse without retail,
for many years (Tires N'More). The proposed primary use for retail
sales/service of construction materials with warehousing, and an accessory use
of open and outdoor storage (Caliber Companies), is appropriate for this
location, considering the existing building.
The use is consistent with the purposes of the Zoning Code and the purposes of the zoning district
in which the applicant intends to locate the proposed use.
Finding: The proposed use (open and outdoor storage) is consistent with the purposes of
the Zoning Code.
6. The use is not in conflict with the Comprehensive Plan of the City.
Finding: The property is guided Mixed Use MU-PUD in the Comprehensive Plan (2010).
Open and Outdoor Storage is not specifically addressed in the Comprehensive
Plan, but relates to the following.•
General Land Use
Goal 1: Maintain a cohesive land use pattern that ensures compatibility and
functional relationships between activities and uses.
Policy h. Transitions between distinctly differing types of land uses should not
create a negative economic, social, or physical impact on adjoining
developments.
Policy k. Require and maintain buffering and visual separation between
differing land uses, when possible.
Policy L Strive for compatibility of adjacent land uses.
Commercial
Goal 2: Provide safe, convenient, attractive, and accessible commercial
development.
Policy d. Ensure that all service, institutional and commercial uses are
adequately screened and buffered from any existing or planned
residential developments.
Policy e. The City will require buffers such as screen plantings, fences, and
public and semi-public use areas to help eliminate conflicts and
disruptions between commercial land uses and activities and
adjacent or nearby residential development.
The use will not cause traffic hazards or congestion.
Finding: The proposed use (open and outdoor storage) will not significantly contribute to
traffic hazards or congestion. The property includes two easements; (1)

accessing Groveland Road, and (2) accessing Mounds View Boulevard; both
crossing thru 2840 Mounds View Boulevard (Simons property).
Adequate utilities, access roads, drainage and necessary facilities have been or will be provided.
Finding: Such facilities are adequate.
WHEREAS, On October 7, 2020, the Planning Commission recommended approval of the
Conditional Use Permit (Resolution 1122-20); and,
WHEREAS, a Public Hearing notice was published in the Shoreview Press on September 29,
2020, and mailed to property owners within 350' of the subject property. The City Council held a Public
Hearing on October 12, 2020; and,
NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council based
upon the above Findings, the Staff Report, and in consideration of public testimony, hereby
approves a Conditional Use Permit for Open and Outdoor Storage as an Accessory Use with the
following conditions:
The applicant shall install an 8' tall solid wooden fence around the west, north, and east
portions of the outside storage area. The fence shall be completed prior to June 1, 2021.
Applicable permits shall be obtained.
All work permitted, associated with the open and outdoor storage, shall be completed
within one year of the approval of this CUP, or the CUP shall laps and become void,
consistent with the Mounds View City Code, Section 1125.01, Subd 3(0 (Lapse of
Conditional Use Permit by Nonuse).
