COUNCIL BUSINESS 12 A. Public Hearing: Resolution 9317, Conditional Use Permit for Open and 13 Outdoor Storage as an Accessory Use at 2832 Mounds View Boulevard. 14 15 Community Development Director Sevald requested the Council consider a conditional use permit 16 for open and outdoor storage as an accessory use for the property at 2832 Mounds View 17 Boulevard. He explained Caliber Companies, owner of Caliber Drywall and Donnelly Stucco, 18 purchased 2832 Mounds View Boulevard (Tires N'More) in September, 2020. Caliber plans to 19 remodel the building's interior and enclose the east side of the backyard facing CVS, with an 8' 20 fence this fall, and will renovate the exterior in 2021. Caliber plans to move its operations from 21 south Minneapolis to Mounds View by December 1st. Staff commented on the request further 22 and explained the Planning Commission recommended approval of the Conditional Use Permit. 23 24 Mayor Mueller opened the public hearing at 6:37 p.m. 25 26 Hearing no public input, Mayor Mueller closed the public hearing at 6:38 p.m. 27 28 Mike Horsch, Caliber Drywall representative, introduced himself to the Council and described the 29 work his company completed. He noted the back of the property would be used for truck and 30 scaffolding storage. 31 32 Mayor Mueller questioned how many employees would be working from this location. Mr. 33 Horsch reported he would have seven or eight onsite employees and the remainder of his 34 employees would be working offsite. 35 36 Council Member Meehlhause questioned how high the fence would be along the tree line. 37 Community Development Director Sevald reported the fence would be 8 feet in height in order to 38 screen the outdoor storage. 39 40 Mayor Mueller requested further information regarding the proposed landscaping plan. Mr. 41 Horsch stated he did not have a formal plan in place, but noted he would be improving the 42 boulevard along CVS along with the front of the building next spring. 43 44 MOTION/SECOND: Hull/Meehlhause. Community Development Director Sevald requested the Council review and approve the submission of the 2040 Comprehensive Plan to the Metropolitan Council. He explained the Draft Plan was submitted to the Metropolitan Council in December 2019, which responded with an incomplete letter. The Plan has been revised. Staff intended to re -submit the Plan to the Metropolitan Council after the City Council's October 12th meeting. However, Met Council Staff advised that there is a backlog of plans for review. Thus, Staff chose to submit the revised Plan on September 25th, ahead of the Planning Commission and City Council meetings. Prior to September 25th , a Public Hearing notice had been published for the Commission's October 7th meeting. The intent is for the Plan to be approved by the Metropolitan Council by the end of this year, in order to continue qualifying for affordable housing grants in 2021. In 2017, Boulevard Apartments received a $500,000 Livable Communities grant. A similar grant may be pursued for the former Skyline Motel site in 2021. Staff reported the Planning Commission reviewed this matter and recommended submission of the 2040 Comprehensive Plan. Mayor Mueller requested a minor language change to the Resolution for clarity purposes. MOTION/SECOND: Meehlhause/Gunn. To Waive the Reading and Adopt Resolution 9318, Review and Submission of the 2040 Comprehensive Plan to the Metropolitan Council. A roll call vote was taken. Ayes — 5 Nays — 0 Motion carried. C. Resolution 9313, Memorandum of Understanding Travel Time Pay for Weekends and Holidays for the Public Works Collective Bargaining Unit. 36 Human Resources Coordinator Ewald requested the Council approve a Memorandum of 37 Understanding for travel time pay for weekends and holidays for the Public Works Collective 38 Bargaining Unit. She explained members of the Public Works Bargaining Unit have requested 39 one-half hour of travel time going to work on weekends and holidays for snow and ice control 40 operations, utility emergencies, weather emergencies and other hazards. She reported the HR 41 Committee reviewed this request and recommended approval of one-half hour of travel time for 42 weekends and holidays. 43 44 MOTION/SECOND: Hull/Bergeron. Resolution 9314, Authorize Recruitment Process for Public Service Worker — 11 Streets Position. 12 13 Human Resources Coordinator Ewald requested the Council authorize the recruitment process for 14 a Public Service Worker -Streets Position. She explained long-time Public Works employee Tim 15 Fredberg has submitted his retirement paperwork which will open up a position within the Public 16 Works Department. She noted Mr. Fredberg's last day with the City will be November 301h. She 17 indicated internal recruiting will begin after Mr. Fredberg leaves the City with backfilling to occur 18 accordingly. 19 20 Public Works Director Peterson reported Mr. Fredberg will be dearly missed but wished Mr. 21 Fredberg all the best in his retirement. 22 23 Council Member Meehlhause questioned why the City would not begin the hiring process until 24 after Mr. Fredberg retires. Human Resources Coordinator Ewald stated this was for budgetary 25 purposes. 26 27 MOTION/SECOND: Gunn/Meehlhause. Resolution 9315, Approving a Contract with Ramsey County for Election 35 Services. 36 37 Human Resources Coordinator Ewald requested the Council approve a contract with Ramsey 38 County for election services. She reported Ramsey County has been handling the City's elections 39 since 2013. She noted the proposed contract was for six years. The rate increase was discussed in 40 detail with the Council noting the increase would cover the costs for early voting. 41 42 Council Member Gunn noted a spelling error within the Resolution. 43 44 MOTION/SECOND: Gunn/Hull. Resolution 9321, Discontinue contract with the YMCA and to formally approve a City Operated Park and Recreation Department. 9 City Administrator Zikmund requested the Council discontinue the contract with the YMCA and 10 to formally approve a City operated Park and Recreation Department. He stated earlier this year 11 the YMCA reached out to the City requesting a change. He explained the City has been meeting 12 with the YMCA and staff had been directed to amend the existing contract. He reviewed the 13 changes that would occur at the Community Center and how staffing would transition seamlessly. 14 He noted Andy Thomas, Darrel Fibideau, and Leah Vandicar would remain working for the City 15 of Mounds View. 16 17 Public Works Director Peterson stated he was pleased with how City Administrator Zikmund had 18 worked out the seamless transition for staff. He discussed how he would be partnering with staff 19 and neighboring communities to begin planning for winter and spring programming. He stated he 20 was excited for the programs the City would be offering to its residents. 21 22 Michael Hanson, 2401 Mounds View Boulevard, stated he was associated with the Irondale 23 Baseball Association. He explained he was pleased to see the City reassuming the parks and 24 recreation services coming back in-house. He reported the local baseball association would like 25 to see more baseball options being offered by Mounds View Parks and Recreation. 26 27 MOTION/SECOND: Gunn/Bergeron. To Waive the Reading and Adopt Resolution 9321, 28 Discontinue contract with the YMCA and to formally approve a City Operated Park and 29 Recreation Department. 30 31 Council Member Hull stated he would respect the Council moving in a new direction, but he 32 would not be supporting this motion. 33 34 Council Member Meehlhause thanked the YMCA for their 20 year partnership with the City of 35 Mounds View. 36 37 A roll call vote was taken. 38 39 Ayes — 4 Nays — 1 (Hull) Motion carried. 40 41 G. A roll call vote was taken. Ayes 5 Nays 0 Motion carried. H. Resolution 9324, Approving the Purchase of a new Caterpillar Wheel Loader 926M. Director of Public Works/Parks and Recreation Peterson requested the Council approve the purchase of a new Caterpillar Wheel Loaders 926M. He reported staff did not recommend refurbishing the existing piece of equipment due to the high expense for repairs. He discussed the cost of the new wheel loader and described how this piece of equipment would be utilized by the City. Council Member Meehlhause questioned the age of the current loader. Director of Public Works/Parks and Recreation Peterson indicated the current loader was 16 years old. MOTION/SECOND: Hull/Meehlhause. To Waive the Reading and Adopt Resolution 9324, Approving the Purchase of a new Caterpillar Wheel Loader 926M. A roll call vote was taken. Ayes 5 Nays — 0 Motion carried. 9. REPORTS A. Reports of Mayor and Council. Council Member Meehlhause stated he would be attending an NYFS Finance Committee meeting on Wednesday, October 141h Council Member Meehlhause indicated he would be attending a Mounds View Police Foundation Zoom call on Tuesday, October 131h at 4:30 p.m. Mayor Mueller reported she attended a Conservation Minnesota meeting on Wednesday, October 7th via Zoom and on Thursday, October 81h she attended a Regional League of Minnesota Cities meeting at SBM Fire Station #3. Mayor Mueller reported articles were due for the winter edition of Mounds View Matters on Thursday, October 151h Mayor Mueller explained the SBM Fire Department was offering a CPR class on Wednesday, October 281h at Fire Station No. 3. B. Reports of Staff. Finance Director Beer explained he had put information in the Council's boxes from Minnesota Compass which was a data tool available to the City. Director of Public Works/Parks and Recreation Peterson provided the Council with an update on the projects that were being completed in the City. He noted the ground reservoir roof was complete and Water Treatment Plant No. 2 would be started up in several weeks. City Administrator Zikmund reported the EDC would be meeting jointly with the City Council on Monday, October 191h City Administrator Zikmund reviewed the worksession agenda for Monday, November 2nd with the Council. The LCA program may be an option to partially finance the redevelopment of the Skyline Motel property. Discussion: The Metropolitan Council administers the Livable Communities Act program (LCA), which includes grants to incentivize the creation and preservation of living wage jobs, affordable housing, and implementation of compact and efficient development. To qualify for these grants, developers must partner with cities participating in the LCA program. In order for cities to participate in the LCA program, the city must have adopted a Fair Housing Policy. Although Mounds View has participated in the LCA program in the past', Staff is unable to find the City's Fair Housing Policy. Therefore, Staff is requesting that the City Council adopt a new policy. In order for the City to qualify for the 2021 LCA program, a policy must be submitted to the Metropolitan Council by Friday, November 13, 2020, to be reviewed by its Community Development Committee on November 16tn The Metropolitan Council and Housing Justice Center have provided an example policy, which has been adapted by a number of cities. The attached Mounds View policy is an adaptation of Roseville's policy, which was based on the example. Strategic Plan Strategy/Goal: Continue community engagement while being sensitive to the changing demographics & their needs and inclusive to all socioeconomic situations. Financial Impact: None directly. In 2019 there were 70 LCA grant applications requesting $32.5 million. Fifty-six projects were approved, totaling $18.7 million.Z This is a highly competitive program. Recommendation: Staff recommends approval of Resolution 9325, adoption of a Fair Housing Policy. LHIA is part of the LCA program. 2 2019 Metropolitan Livable Communities Fund Annual Report Item 05B Page 2 of 4 RESOLUTION 9325 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESTOA A RESOLUTION ADOPTING A FAIR HOUSING POLICY WHEREAS, the Metropolitan Livable Communities Act (LCA) was established by the Minnesota Legislature in 1995 (MN Statute §473.25) to incentivize the creation and preservation of living wage jobs, affordable housing, and implementation of compact and efficient development. The LCA program is administered by the Metropolitan Council using adopted policies and guidelines; and, WHEREAS, the Metropolitan Council offers four types of grants to communities participating in the Local Housing Incentives Account Program. Such grants include; Livable Communities Demonstration Account (LCDA) Local Housing Incentives Account (LHIA) Tax Base Revitalization Account (TBRA) Transit Oriented Development (TOD) WHEREAS, to participate in the LCDA program, communities must adopt a Fair Housing Policy (Exhibit A); and, NOW, THEREFORE BE IT RESOLVED, that the Mounds View City Council hereby adopts a Fair Housing Policy. The intent of Title VIII is to assure equal housing opportunities for all citizens. Furthermore, the City of Mounds View, as a recipient of federal community development funds under Title I of the Housing and Community Development Act of 1974, is obligated to certify that it will affirmatively further fair housing. The City of Mounds View is committed to meeting this obligation, and has developed this Fair Housing Policy to further that goal. 2. Fair Housing Policy Statement It is the policy and commitment of the City of Mounds View to ensure that fair and equal housing opportunities are granted to all persons in all housing opportunities and development activities funded by the city regardless of race, color, religion, gender, sexual orientation, marital status, status with regard to public assistance, familial status, national origin, or disability. This shall be done through strong external policies that provide meaningful access to all constituents and fair housing informational and referral services; and internal practices and procedures that do not discriminate and that affirmatively further fair housing. 3. External Practices A. Meaningful Access I. Online Information. The City of Mounds View will have information about fair housing prominently displayed on the City's website. The website page will provide a link to the Minnesota Department of Human Rights. The web page will also have links to various fair housing resources, including the Department of Housing and Urban Development, Southern Minnesota Regional Legal Services, and others. 11. In -Person Information. The City of Mounds View will provide fair housing information to anyone requesting such information at the city offices. Community Development Department staff will provide information of the online web page for fair housing resources. III. Languages. The City of Mounds View is committed to providing information in the native language of its residents. Therefore if the city's website translation tool does not provide translation in a native language, then the City of Mounds View will direct individuals to appropriate translation services that are available. Internal Practices The City of Mounds View commits to the following steps to promote awareness and sensitivity to fair housing issues in all of its government functions. A. Staff Training - the City will continue to train its staff and officials on fair housing considerations. B. Housing Analysis - the City will review its housing inventory periodically to examine the affordability of both rental and owner -occupied housing to inform future City actions. C. Code Analysis -the City will review its municipal code periodically, with specific focus on ordinances related to zoning, building and occupancy standards, to identify any potential for disparate impact or treatment. D. Project Planning and Analysis -the City planning functions and development review will consider housing issues, including whether potential projects may perpetuate segregation or lead to displacement of protected classes. E. Community Engagement - The City will seek input from underrepresented populations in the community utilizing engagement best practices, such as facilitating conversations regarding fair housing, development, zoning, and land use changes. F. Affirmatively Furthering Fair Housing - As a recipient of federal funds, the City agrees to participate in the Regional Analysis of Impediments, as organized by the regional Fair Housing Implementation Council. The City will integrate the recommendations and action plan into city planning documents, including the Comprehensive Plan, and other applicable documents. WHEREAS, Steve Markuson was appointed Executive Director of Twin Cities Gateway in May 2010 after its formation earlier that year; and WHEREAS, Steve previously served as Explore Minnesota's Executive Director from 1995-2000, where he led a grassroots tourism industry campaign that resulted in the first state budget increase in more than 12 years and won him two Odyssey awards from the Travel Industry Association of America; and WHEREAS, as Executive Director of Twin Cities Gateway, Steve has been responsible for strategic marketing, partnership development, public and media relations, and organizational management with the objective of increasing area visitation to stimulate tourism and community -related economic development; and WHEREAS, through Steve's efforts, the fund balance reserve that has increased Twin Cities Gateway's economic viability over other convention bureaus, especially during the recent pandemic, and positioned it to provide effective promotional efforts for all nine communities; and WHEREAS, during Steve's tenure, lodging tax receipts have nearly doubled while the room supply remains constant, thereby earning him the outstanding Individual in Minnesota Tourism award in 2017 and the coveted Roger Toussaint Award from the Minnesota Association of Convention and Visitor Bureaus in 2018; and WHEREAS, Steve is known for mentoring promising travel business associates as well as assisting Convention and Visitor Bureau leaders with launching new travel organizations within the industry; and WHEREAS, Steve is a Minnesota travel business icon and has played a major role in marketing the City of Mounds View by taking a start-up convention and visitor bureau and making it the gold standard others try to emulate in the State today; and WHEREAS, Steve has performed his duties at Twin Cities Gateway with great dedication, professionalism, and enthusiasm, thus gaining the respect of his fellow colleagues and associates; and WHEREAS, after 10 years of dedicated service and extraordinary achievements, Steve Markuson will retire from TCG on December 31, 2020; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Mounds View, on behalf of the City of Mounds View and surrounding communities, expresses its heartfelt appreciation to Steve Markuson for his dedication and devoted service to Twin Cities Gateway. Individual notices of the meeting were sent by first class mail to the affected property owners on October 8, 2020. Attached is the full roll of assessment notices that were sent out. These are accounts that were delinquent as of September 30, 2020. Some of the property owners already have paid, or will pay, the amount due by 4:30 P.M. on Monday, October 26, 2020 in order to avoid the $35.00 administrative fee. Others will pay after the roll is certified Monday night, but before the roll is forwarded to Ramsey County. In that case, they will pay the total due, including the administrative fee. Owners may prepay the assessment between October 27, 2020 and November 26, 2020 without paying additional interest. After that, interest at the rate of 5.5% will accrue from October 26, 2020 through the payment date. The interest rate and administrative fee were set by the City Council in Resolution 7135. On or about November 30, 2020, we will forward the assessment roll, minus any prepayments, to Ramsey County for collection with the 2021 property taxes. These same entities entered into a Supplemental Agreement with the Mounds View and Irondale Youth Hockey Associations to help insure that the ongoing financial obligations for the purchase of ice time were met. These approximately 25 year master agreement will be ending on December 31, 2023 and the MASC is now seeking a commitment from the cities and Ramsey County on whether we want to remain in the consortium. The city council is being asked to consider resolution 9238 indicating Mounds View intent to withdraw from the master agreement when it expires. Discussion: In 1997, the cities of Shoreview, Arden Hills, Mounds View, and New Brighton (SAMN), and Ramsey County entered into a Master Agreement with the Minnesota Amateur Sports Commission (MASC) for the construction, financing, and operation of the Super Rink at the National Sports Center in Blaine. The Super Rink is a four sheet ice complex (later expanded to eight rinks) at the National Sports Center in Blaine that is operated by the Minnesota Amateur Sports Commission. Since none of these four cities were in the ice arena business, Ramsey County also became a partner to the agreement and placed the initial $500,00o down payment for the construction of the large ice arena facility. The cities of Blaine and Coon Rapids were also part of the Master Agreement and contributed $500,000 toward the capital cost. The facility was then financed through a 25 year bond to be paid through annual ice rentals at the Super Rink. Each of the parties to the agreement also needs to guarantee the purchase of 208o hours of ice time annually to ensure that there is sufficient revenue to pay the debt service and operating costs for the facility. The primary reason that the SAMN group entered into the Master Agreement and became part of this consortium was the strong interest in more ice time from the two youth hockey associations (Mounds View and Irondale) that serve our geographic area. Based on this interest from the youth hockey associations, the four cities and Ramsey County also entered into a Supplemental Agreement with the two associations to establish a $300,00o escrow account that could be used to cover any ice rental shortfalls that might occur during the term of the agreement. The escrow account, which was funded entirely by the youth hockey associations, has grown to $400,000 due to interest earnings. All interest earnings above the $400,000 amount is returned annually to the youth hockey associations. The City of Shoreview maintains this escrow account on behalf of the four cities. When the Master Agreement expires the escrow money must be returned to the youth hockey associations. The Mounds View and Irondale Youth Hockey Associations have now merged into one organization. Fortunately, due to the annual ice rentals from the hockey associations, the Mounds View School District, and strong ice programming efforts by the Super Rink staff, the Super Rink has always been able to meet its financial obligations for both debt service and operating costs. The SAMN cities have never needed to use the escrow account to meet its financial obligations. The two hockey associations receive priority use on one of the rinks as a result of the SAMN group's participation in this consortium. As noted earlier, the terms Master and Supplemental agreements will expire on December 31, 2023. The Super Rink facility is nearly 25 years old and there are now significant deferred maintenance items and other improvements that are necessary for the facility to continue to operate at a high level. Some of the improvements include a completely new refrigeration system that will meet current standards, replacement of the dasher boards, scoreboards, and sound systems, and upgrades to the locker rooms and common areas in the building. These replacements and upgrades will require another major bond issue to finance the cost of the improvements. It is likely that the MASC will be seeking a contribution of somewhere between $500,000-$1,000,00o from it partners to help finance the improvements and continue as part of the consortium. The MASC is requesting that the current partners decide now whether they want to continue in the consortium so they can begin to develop plans for the future. They had originally asked that consortium members make a decision by June, 2020, however this date has been pushed back due to the COVID pandemic. The Shoreview city manager met with representatives from each of the cities in the SAMN group and Ramsey County to review the history of the agreements and discuss whether there was interest in continuing as part of the Super Rink consortium. Ramsey County operates a comprehensive ice arena system throughout the county and the cities are currently served by the Shoreview ice arena and the two sheets of ice at the County's new arenas in Vadnais Heights. Since Ramsey County already operates a significant ice arena system, they did not have an interest in participating in the Super Rink in the future. Further, since none of the cities are currently in the ice arena business, they also indicated that they did not want to continue in the Super Rink consortium after the Master Agreement expires at the end of 2023. The Shoreview city manager also talked with the Mounds View School District staff and the current President of the Mounds View Youth Hockey Association regarding our cities intent to not be part of this consortium in the future. It is important to note that either the Mounds View School District or the Mounds View Youth Hockey Association could choose to become a future partner with the MASC in the Super Rink facility. Staff believes that this would make the most sense since they are the primary beneficiaries and users of the current rink that is dedicated to our four city group. Staff is requesting that the city council approve resolution 9238 indicating the City of Mounds View intent to withdraw from the Master Agreement with MASC for the construction and financing of the Super Rink facility when it expires on December 31, 2023.
