Item Title/Subject: PUBLIC HEARING; Resolution 1122-20; Variance to Reduce the Front
(Side) Yard Setback for an Attached Garage, 2512 County Road H2
Introduction:
Bill and Tiffany O’Malley propose to expand their two-car garage into a four-car garage, towards the
backyard. The lot is a corner lot (e.g. two front yards). The existing garage has a non-conforming
setback. The proposed addition will be no closer to the front (side) yard than the current garage.
Discussion:
Within the R-1 district, the minimum front yard setback is 30’.1 The setback of the existing attached
garage is not known, but is believed to be 26’ – 27’, based on Ramsey County aerial photos. There is no
known survey. It is the City’s policy to require a survey for proposed buildings if within 1’ of setbacks, or
other critical boundaries (e.g. wetlands). The applicants are opposed to the expense of a survey, unless
the Variance is approved. Staff is agreeable to make a survey conditional upon approval of the Variance.
A similar Variance was approved in 2019 without a survey.2

1 Mounds View Municipal Code, Section 1104.01, Subd 3(b) (Setbacks for Principal Buildings)
2 2832 Sherwood Road, received a Variance to reduce the front (side) yard setback from 30’ to 22’ to match the
setback of the existing house for a garage, and a Variance to increase the maximum combined square footage of
accessory buildings in a rear yard, from 20% to 26% (Resolution 1102-19). In this case, the house was built in
1956 with no garage (the owner did not drive). The applicant purchased the house in 2019, and requested to build
a two-car garage and breezeway with the front (side) yard setbacks to match the house. No survey was required.
This case, along with similar projects, prompted Staff to establish a policy of requiring surveys when buildings are
within 1’ of setbacks, or visual confirmation of property pins to confirm compliance with setbacks.

Recommendation:
Staff recommends approval of the Variance. The applicant’s hardship is that the attached garage is too
close to the property line. If the addition were built at the 30’ setback, it would look awkward.
The Planning Commission is requested to conduct a Public Hearing, and consider the following options:
1. Approve Resolution 1122-20, approving a Variance to reduce the front (side) yard setback, from 30’
to a distance equal to the existing attached garage (approximately 26’ – 27’).
2. Deny Resolution 1122-20, with Findings.
3. Table the request. If additional information is needed before a decision can be made, the
Commission may Table the request until such information is provided. Because of the 60-Day Rule
(deadline: December 2, 2020), this would need to come back to the Commission at its November
18th or December 2nd meeting, or Staff may extend the City’s review past 60-Days by providing
notice and reasoning to the applicant.
A Public Hearing notice was published in the October 13, 2020 Shoreview Press, and mailed to property
owners within 350’ of the subject property.
Staff received a voicemail from an anonymous person, who did not object to the Variance, but
expressed concerns about the number of vehicles parked on the property, and concerns about the
garage being used as a business.
Home Occupations are a permitted use 7, such that (paraphrased); it is conducted within the residential
structure; is compatible with the neighborhood; does not involve employees other than persons residing
in the home; does not alter features typical of a home; does not have exterior storage; does not
generate on-street parking; does not create a nuisance; and does not involve an activity visible from the
street.

RESOLUTION APPROVING A VARIANCE TO REDUCE THE FRONT (SIDE) YARD
SETBACK, FROM 30-FEET TO A DISTANCE EQUAL TO THE SETBACK OF THE
ATTACHED GARAGE, LOCATED AT 2512 COUNTY ROAD H2
(PLANNING CASE VR2020-005)
WHEREAS, the applicants; William and Tiffany O’Malley, propose to add onto an attached
garage, and are requesting a Variance to reduce the front (side) yard setback from 30’, to a distance
equaling the existing setback from Skiba Drive, on property located at 2512 County Road H2, legally
described as:

Lot 1, Block 2, Random’s First Addition
WHEREAS, City Code, Section 1104.01, Subd (b) (Setbacks for Principal Buildings), requires
setbacks “Not less than thirty feet (30’) from the lot line if lot is on corner and the lot line abuts a
street.”… The subject property is a corner lot abutting County Road H2 and Skiba Drive. The proposed
garage addition will be attached to the principal building (e.g. attached garage); and,
WHEREAS, there is no known survey of the property. The property owner is unable to locate
property pins confirming where the property line is. Based on Ramsey County GIS (2018 aerial photos),
Staff estimate the front (side) yard setback to be 26’ – 27’ from the Skiba Drive property line, whereas a
minimum of 30’ is required in the R-1 zoning district. The reduced setback causes the home and attached
garage to be a non-conforming structure; and,
WHEREAS, Minnesota Statute §462.357, Subd 1e (Nonconformities) states; …“any
nonconformity, including the lawful use or occupation of land or premises existing at the time of the
adoption of an additional control under this chapter, may be continued, including through repair,
replacement, restoration, maintenance, or improvement, but not including expansion”… The proposed
addition is an expansion of a nonconforming building; and,
WHEREAS, a Public Hearing notice was published in the Shoreview Press on October 13, 2020,
and mailed to property owners within 350’ of the subject property; and,
WHEREAS, the Planning Commission conducted a Public Hearing on November 4, 2020; and,
WHEREAS, the Mounds View Planning Commission has reviewed the Staff Report,
submitted plans, and has compared the request to City Code, Section 1125.01, Subd 4 (Criteria
for Granting Variances), and in consideration of public testimony, makes the following Findings
of Fact (italics):

1. The variance is in harmony with the general purposes and intent of this Title.
Finding: The variance is in harmony with the general purposes and intent of this Title.
2. The variance is consistent with the comprehensive plan.
Finding: The property is guided “Single Family Detached” [Residential]. Garages are not
specifically addressed by the Comprehensive Plan (2010). The Variance relates
to the following:
Residential
Goal 1: Preserve the identity and maintain and improve the quality and
appearance of existing neighborhoods.
Goal 3: Encourage a creative approach to the use of land and related
residential development.
Policy c. The City will encourage the upgrade and expansion
of homes by providing flexible standards that
address the unique circumstances of expanding
existing single dwellings.
The proposed addition onto the attached garage will improve the quality and appearance
of the neighborhood. The addition is within the total combined size allowed for
accessory buildings within the R-1 district.
3. The applicant proposes to use the property in a reasonable manner not permitted by this Title or the
City Code.
Finding: It is reasonable for the garage addition to have a setback equal to the existing garage.
4. Unique circumstances apply to the property which do not apply to other properties in the same zone
or vicinity and result from lot size or shape, topography or other circumstances over which the owner
of the property since the enactment of this Title has had no control. The unique circumstances do not
result from the actions of the applicant.
Finding: The home was built in 1971. The Building permit (#71-281) shows a 27’ setback for the
front (side) yard on Skiba Drive. It is not known what the required minimum setback was
in 1971, but the current minimum setback is 30’ within the R-1 district. The unique
circumstance is that the home was built with a setback that is nonconforming to current
requirements. This nonconformity was not created by the applicant.
5. The variance does not alter the essential character of the neighborhood.
Finding: The reduced setback for the attached garage addition will not alter the essential
character of the neighborhood.
6. The variance requested is the minimum variance which would alleviate the practical difficulties.
Economic conditions alone do not constitute practical difficulties.
Finding: The requested variance, for the garage addition to match the setback of the existing
garage, would alleviate the practical difficulties.

7. The Board of Adjustment and Appeals may impose such conditions upon the premises benefited by a
variance as may be necessary to comply with the standards established by this Title or to reduce or
minimize the effect of such variance upon other properties in the neighborhood and to better carry out
the intent of the variance. The condition must be directly related to and must bear a rough
proportionality to the impact created by the variance
NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission, acting as
the Board of Adjustment, based upon the above Findings, the Staff Report, and in consideration of public
testimony, approves a Variance to reduce the front (side) yard setback, from 30’ to a distance equaling the
setback of the existing attached garage, located on property at 2512 County Road H2, with the following
conditions:
1. The applicant shall obtain a Building Permit, and complete a lot survey, confirming
building setbacks, easements, and building areas.
2. Permitted work shall begin within one year of the date of this Variance, or this approval
shall expire, consistent with City Code, Section 1125.02, Subd 5 (Lapse of Variance or
Appeal).

Item Title/Subject: Resolution 1123-20, Recommending Approval of Ordinance 973,
Amending Chapter 1130 of the Mounds View Municipal Code Adopting
Certain Rules of the Rice Creek Watershed District Regarding
Stormwater Management
Introduction:
Storm water management is administered by the Rice Creek Watershed District (RCWD)1. Construction
projects meeting a certain threshold must obtain a permit from RCWD. In recent years, the City has
experienced some frustrations with RCWD’s administration and inspections of projects. The City is
proposing to take this responsibility over from RCWD. If approved, the City’s regulations would mirror
that of RCWD. The primary difference would be in inspections and enforcement, including streamlining
application, review, and inspections processes. Currently, there is some duplication between RCWD and
the City.
Discussion:
The Minnesota Legislature adopted the Watershed Act in 1955 to protect, control, and improve
waterways and water supplies. Watershed districts were formed according to hydrological boundaries,
as opposed to political boundaries. The Rice Creek Watershed District was formed in 1972 across
portions of Anoka, Hennepin, Ramsey, and Washington counties, including 28 cities and townships.
RCWD is governed by a five-member Board of Managers, appointed by the counties. Mounds View has
been fortunate in that it has had a resident on the Board for many years; (Barbara Haake; 1994-2019,
and Marcie Weinandt; 2020-2023).
Rice Creek Watershed District has adopted a set of rules (Rules A thru L), similar to ordinances. The City
intends to adopt Rules C, D, E, and F by reference in the City Code. The City will enter into a
Memorandum of Understanding (MOU) with RCWD, for the City to administer these Rules, including
permit review, inspections, and enforcement.
Permit review, inspections, and enforcement will be administered through the Public Works
Department, in part thru contracting with Stantec (City Engineer) for plan review.
The cities of Circle Pines and Hugo have taken similar action. Other cities have shown some interest in
the same.
RCWD Rules (summary):
Rule C: A Storm Water Management Plan is required for the subdivision of land, one-acre or
larger, or construction of 10,000 sq ft or more of impervious surface area. There are
exceptions, including smaller residential subdivisions that do not create new streets.
Rule C is applicable to the number of stormwater infiltration basins the City was
required to create as part of the street reconstruction program.

Rule D: An Erosion and Sediment Control Plan is required for projects that are on one-acre or
larger; or that disturb soils 10,000 sq ft or more in size; or is within 300’ of a lake,
stream, wetland, or public drainage system. These types of projects typically include
erosion control methods (e.g. silt fence, or bio-logs) around the boundaries of disturbed
areas, and in protection of storm drains and waterways, and clean-up of any erosion
outside of the construction area.
Rule E: A Floodplain Alteration permit is required when placing fill or structures within the 100-
year flood plain. A structures’ lowest floor must be at least 2’ above the 100-year
floodplain elevation.
Rule F: A Wetland Alteration permit is required when placing fill within a wetland, or altering its
boundaries or water flow.
The City’s overall intent is to create a more efficient program. Currently, there are duplication of
reviews and inspections by RCWD and the City. Enforcement has lacked at times, in part due to
miscommunications between the two governments, over who is responsible for what, and when.
Because the City will be the regulatory body, it is likely that there will be more enforcement, more
permits, and more costs to construction projects. It is the City’s goal that by streamlining the regulatory
process that time efficiencies will outweigh any additional costs, allowing construction to start and end
sooner.
Strategic Plan Strategy/Goal:
Maintain and plan for infrastructure improvements including waste water, water, & transportation.
Financial Impact:
The City’s intent is for fees to cover the cost of the City’s administration of the program. Fees will be on
a sliding scale depending on the size of the project.
The Rice Creek Watershed District is a taxing authority, and will continue to levy the same amount onto
the City’s property owners, whether or not Mounds View takes over permitting authority.
Recommendation:
Staff recommends approval of Resolution 1123-20, recommending approval of Ordinance 973.
A Public Hearing notice was published by the Shoreview Press on October 27, 2020. The City Council will
conduct the Public Hearing at its November 9th meeting.

ADOPTING CERTAIN RULES OF THE RICE CREEK WATERSHED DISTRICT
REGARDING STORMWATER MANAGEMENT
ORDINANCE NO. 973
THE CITY OF MOUNDS VIEW ORDAINS:
SECTION 1. The City Council of the City of Mounds View hereby amends Title 1100 of the
Mounds View Municipal Code to add a new Chapter 1130 as follows:

1130.01: RULES ADOPTED:
Subd. 1. Stormwater Management Plans: The City of Mounds View hereby adopts by
reference, and as may be amended, the Rice Creek Watershed District Rule C related to
Stormwater Management Plans. Applications related to stormwater management plans
will be reviewed by the Local Governing Unit (LGU) in accordance with the Rice Creek
Watershed District Rule C .
Subd. 2. Erosion and Sediment Control: The City of Mounds View hereby adopts by
reference, and as may be amended, the Rice Creek Watershed District Rule D related to
Erosion and Sediment Control. Applications related to the modification or alteration of
erosion sediment control will be reviewed by the Local Governing Unit (LGU) in
accordance with Rice Creek Watershed District Rule D.
Subd. 3. Floodplain Alteration: The City of Mounds View hereby adopts by reference, and as
may be amended, the Rice Creek Watershed District Rule E related to Floodplain

Alteration. Applications related to the modification or alteration of floodplains will be
reviewed by the Local Governing Unit (LGU) in accordance with Rice Creek Watershed
District Rule E.
Subd. 4. Wetland Alteration: The City of Mounds View hereby adopts by reference, and as
may be amended, the Rice Creek Watershed District Rule F related to Wetland Alteration.
Applications related to the modification or alteration of wetlands will be reviewed by the
Local Governing Unit (LGU) in accordance with Rice Creek Watershed District Rule F
and the Minnesota Wetland Conservation Act .
1130.02: INCORPORATION; CONFLICTS: The Rice Creek Watershed District Rules C,
D, E, and F, as may be amended from time to time, and which are expressly adopted in Section
1130.01 above, shall be made part of this Chapter as if fully set forth herein. In the event of a
conflict between a provision of this Chapter, including any provision contained in the Rice Creek
Watershed District Rules expressly adopted herein, and any other provision in the Mounds View
Municipal Code, the more restrictive standard or provision shall prevail.
1130.03: SEVERABILITY: In the event that a court of competent jurisdiction adjudges any
part of this Chapter, including any provision contained in the Rice Creek Watershed District Rules
expressly adopted herein, to be invalid, such judgment shall not affect any other provision
contained within this Chapter, including any other provision contained in said Rice Creek
Watershed District Rules, unless specifically included within that judgment.
SECTION 2. This ordinance shall take effect and be in force 30 days from and after its passage and
publication, in accordance with Section 3.09 of the City Charter.
Introduction and First Reading by the Mounds View City Council on November 9, 2020.
Second Reading and Adoption by the Mounds View City Council on November 23, 2020.
Publication Date: December 8, 2020, 2020.
WHEREAS, the Mounds View Planning Commission concurs that an amendment to the
City Code is warranted and justified.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission recommends approval of amendments to Title 1100 of the Mounds View City Code
as defined herein.
BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs
Staff to forward this resolution to the City Council prior to approval of the minutes.

MEMORANDUM OF UNDERSTANDING
Between the Rice Creek Watershed District
and the City of Mounds View
for Local Water Planning and Regulation
This Memorandum of Understanding (“MOU”) is made by and between the Rice Creek
Watershed District, a watershed district with purposes and powers as set forth at
Minnesota Statutes Chapters 103B and 103D ("District"), and the City of Mounds View, a
Minnesota municipal corporation ("City").
Recitals and Statement of Purpose
WHEREAS, pursuant to Minnesota Statutes §103B.231, on April 8, 2020, the District
formally adopted its watershed management plan (“WMP”) detailing the existing physical
environment, land use and development in the watershed and providing for water
resource management to protect water resources, improve water quality, prevent flooding
and otherwise achieve the goals of Minnesota Statutes Chapters 103B, 103D and 103E;
and
WHEREAS, to achieve the policies and purposes of the WMP and pursuant to Minnesota
Statutes §103D.341, the District has adopted and implements rules requiring permits for
and otherwise regulating land disturbance activities; and
WHEREAS, pursuant to Minnesota Statutes §103G.2242 and associated statutes and
rules, the District serves as the local government unit (“LGU”) for implementation of the
Minnesota Wetland Conservation Act (“WCA”) except within the boundaries of a
municipality that has undertaken to fulfill the role of LGU; and
WHEREAS, the City has developed a local water management plan under Minnesota
Statutes §103B.235, entitled “Water Resource Management Plan for the City of Mounds
View, Minnesota" and dated ________________, 2020, that describes the existing and
proposed physical environment and land use within the City and sets forth an
implementation plan for bringing local water management into conformance with the
WMP ("Local Plan"); and
WHEREAS, on ________________, 2020, the District Board of Managers conditionally
approved the Local Plan by adoption of Resolution _____________, which resolution is
attached and incorporated herein; and
WHEREAS, Minnesota Statutes §103B.211 and the WMP provide that at the City's
election and on the District's approval of the Local Plan, the District shall cease to apply
its rules within the City boundaries, except as the District and City have agreed, and
further that the District and City shall agree as to which will act as the WCA LGU; and
WHEREAS, pursuant to Minnesota Statutes §103B.235 and the WMP, District approval
of the Local Plan requires a finding that the official controls of the city will protect water
resources to a degree equivalent to that of the District rules, and further is conditioned on
District approval of inspection and administrative procedures for the City's effective

implementation and enforcement of its official controls, and on mutual establishment of a
framework for the District's periodic review of the City's regulatory program; and
WHEREAS, District approval of the Local Plan is conditioned on execution of this MOU
setting forth the respective roles and responsibilities of the District and the City in
regulating potential water resource impacts within the City.
NOW, THEREFORE, the parties enter into this MOU in order to document the
understanding of the parties as to the roles and responsibilities of each related to the
subject matter described herein.
Terms
1. The City may exercise all present and future authority it otherwise may possess to
issue permits for and regulate activities affecting water resources within the City.
2. The City in its Local Plan commits to adopting ordinances that expressly
incorporate the District’s Rule C (Stormwater Management Plans), Rule D (Erosion
and Sediment Control Plans), Rule E (Floodplain Alteration) and Rule F (Wetland
Alteration), as may be amended by the District. The District will cease to apply its
Rules C, D, E, and F within municipal boundaries when:
a. The District has confirmed that the City's ordinances are adopted and in
effect; and
b. The District and City have agreed on written protocols for: (i) City
procedures to administer and enforce its water resource ordinances,
including maintenance of those stormwater practices constructed or
installed for compliance with City ordinances pursuant to this MOU and that
the City owns or has assumed the obligation to maintain; (ii) City
transmission of information to the District regarding changes to the City's
hydrology or conveyance systems that the District finds warranted to keep
its watershed models and data systems current; and (iii) procedures for
District review of City regulatory program implementation.
3. The City shall serve as the WCA LGU within the municipal boundary of the City.
4. The District shall retain its regulatory authority in the following circumstances:
a. With respect to all District rules other than those contained in Rules C, D, E
and F;
b. As to work by any public body that the City does not have the legal authority
to regulate;
c. If the work requires a variance from City water resource ordinances;
d. If the City, in a specific case or programmatically, requests that the District
exercise its regulatory jurisdiction;

e. If, in accordance with Section 8 of the WMP, the District Board of Managers
finds that the City is not implementing its Local Plan; or
f. As required for the District to meet its legal obligations under its NPDES
municipal stormwater (MS4) permit or any other independent law.
5. The City need not issue a permit for its own work, but shall document its review
demonstrating that the work conforms to its water resource ordinances.
6. The District retains approval authority with respect to a comprehensive stormwater
management plan under Rule C.
7. In issuing a permit under its stormwater management or floodplain alteration
ordinance, the City shall require the drainage system repair easement set forth at
Rules C.10 and E.4, as amended, to be conveyed to the District, which easements
shall be subject to prior District review and approval.
8. If the District revises its Rule C, D, E or F in a manner that it considers significant
and so advises the City in writing, the City shall revise its own ordinance to maintain
equivalent water resource protection. If the District has not approved the City's
revision within six months or such other time as the parties may agree, the District
may reassume regulatory jurisdiction with respect to the affected rule.
9. The District retains all authority that it may possess under Minnesota Statutes
Chapters 103B, 103D and 103E and any other provision of law, except as explicitly
reposed in the City under this Agreement.
10. This MOU may be amended only by a writing signed by both of the parties.
Otherwise, this MOU will expire, and the District will reassume regulatory
jurisdiction under its Rules C, D, E and F, two years after the District's adoption of
its next decennial WMP revision. Notwithstanding the foregoing, this MOU will
remain in effect until the District and the City enter into a superseding MOU, and
the District will not reassume regulatory jurisdiction under the aforementioned
rules, provided: (a) the City has adopted a Local Plan that conforms to the District’s
decennial WMP revision within the time specified by Minnesota Statutes
§103B.235, subdivision 1, and Minnesota Rules 8410.0160, subpart 6; (b) the
City’s revised official controls are effective within 180 days of the City’s adoption
of its Local Plan; and (c) the City has confirmed to all conditions of the District’s
Local Plan approval.

Introduction:
The Mounds View Planning Commission consists of seven city residents who are not elected officials.
Commission members are appointed by the City Council based upon recommendations made by the
Commission, to three-year terms. The Commission currently has three members whose terms expire on
December 31, 2020 (Farmer, Klander, and Stevenson).
The City solicited applications from the public to serve on advisory commissions, including the Planning
Commission. The City received four applications for the Commission by the October 28th deadline.
These applications are included in the attachments.
Recommendation:
The Planning Commission is requested to review these applications, and approve the Resolution,
recommending appointments to the Commission. The City Council will take action at its November 23rd
meeting.

A RESOLUTION RECOMMENDING APPOINTMENTS
TO THE MOUNDS VIEW PLANNING COMMISSION
WHEREAS, the Mounds View City Code, Chapter 401 establishes a Planning and
Zoning Commission consisting of seven members of the resident population, other than elected
officials, to be appointed by the City Council based upon the recommendation of the Planning
and Zoning Commission. Such Commission members may be appointed to three year terms;
and,
WHEREAS, three Commission member’s terms expires on December 31, 2020. The
City solicited applications for city advisory commissions, to be submitted to the City no later
than October 28, 2020. The City received four applications to serve on the Planning and Zoning
Commission; and,
THEREFORE, BE IT RESOLVED, based upon the review of applications for
Planning and Zoning Commission members, the Commission hereby recommends to the City
Council that the following residents be appointed to the Mounds View Planning and Zoning
Commission for terms expiring December 31, 2023:
BE IT FINALLY RESOLVED, that the Mounds View Planning Commission directs

5. Planning Cases
A. Resolution 1122-20; Conditional Use Permit for Open and Outdoor Storage
as an Accessory Use at 2832 Mounds View Boulevard.
Community Development Director Sevald stated Caliber Companies, owner of Caliber Drywall
and Donnelly Stucco, purchased 2832 Mounds View Boulevard (Tires N’More) in September,
2020. Caliber plans to remodel the building’s interior and enclose the east side of the backyard
facing CVS, with an 8’ fence this fall, and renovate the exterior in 2021. Caliber plans to move
its operations from south Minneapolis to Mounds View by December 1st. Staff commented on
the request further and recommended the Planning Commission recommend approval of the
Conditional Use Permit as requested.
Community Development Director Sevald reported the property is zoned B-3 Highway Business.
Permitted Uses include Limited Retail uses which have as the principal use, sales with
warehousing or display secondary to that use. The expectation is that the general public can enter
the business during normal hours, and purchase a product (e.g. drywall or stucco supplies) or
service (installation). Caliber Companies will have a product showroom and sales staff. Within
the B-3 district, conditional uses include Open and Outdoor Storage as an Accessory Use.
Exterior storage must be screened from adjacent residential uses with either a sold fence, 6’ to 8’
in height; or a row of evergreen trees, a minimum of 8’ in height. Exterior storage will consist of
light-duty trucks, trailers (9’ or less in height), and scaffolding. West of the property are single-
family homes, screened by an existing 6’ solid wooden fence on the subject property. On the
adjacent residential properties, backyards are heavily wooded, providing additional screening.
Staff recommends that the 6’ fence be replaced by an 8’ fence, because the outside storage will
exceed 6’ in height. The two (2) conditions for approval were read in full for the record.
Chair Stevenson thanked staff for providing detailed photographs of the site. He recommended
the City require the 8’ cedar fence to be properly maintained. Mike Horsch, the applicant, stated
he had a wood fence at his last property. He explained he would take pride in the exterior of his
building and fence.
Chair Stevenson questioned how the scaffolding pieces would be stored. Mr. Horsch described
how the pieces would be stored on “U” shaped racks behind the building.
Chair Stevenson stated he did not want kids getting into the back of the property and climbing on
these scaffolding pieces. He asked how the safety and security of the property would be
maintained. Mr. Horsch explained this has not been a problem for him at his current property.
He reported he would work with the City to ensure the rear of the property was safe. He

indicated the rear yard would have two gates and the main gate would be on the east side. He
stated these gates would be locked when the business was closed.
Commissioner Nelson commented the applicant was being wise by having the property fenced in
order to keep his equipment safe and secure. He asked if the water and drainage issues on this
property had been addressed. Community Development Director Sevald indicated it was his
understanding a drainage trench was built on the western part of the CVS property to address this
concern.
Commissioner Nelson questioned if the trucks and equipment would be hosed off on this
property. Mr. Horsch stated the equipment would be cleaned in the field and not at the shop.
Commissioner Nelson indicated he was pleased to see there would be a new use on this property.
Commissioner Monn explained she was concerned with the fire hazard the outdoor storage
would cause. Mr. Horsch stated no hazardous materials would be stored outside. He indicated the
only items that would be stored outside would be trucks, trailers and scaffolding pieces. He
provided further comment on where the scaffolding materials would be stored.
Commissioner Monn asked if the City was concerned about accessibility and parking on the site.
Community Development Director Sevald reported staff understood visitors would be parking in
the front of the building and employees would be parking in the back.
Commissioner Farmer questioned how many customer parking spaces would be located at the
front of the building. Mr. Horsch stated the site would have one handicap stall and five other
visitor parking spaces at the front of the building.
Chair Stevenson asked when the applicant would like to occupy the building. Mr. Horsch
explained he hoped to move into the building in early December.
City Administrator Zikmund inquired what would be done to the exterior of the building. Mr.
Horsch commented his intention would be to paint the stripe on the north and east side to match
the base of the building. He explained next spring he would stucco the entire building with
larger façade improvements.
Commissioner Monn questioned if the applicant would be installing any landscaping or lighting.
Mr. Horsch stated he had not considered a landscaping plan, but noted lights could be installed
on the east side of the building.
City Administrator Zikmund reported he would have Police Chief Harder meet up with Mr.
Horsch to do a site assessment for security purposes.
Commissioner Monn asked what the hours of operation would be. Mr. Horsch stated public
hours would be from 8:00 a.m. to 4:30 p.m. He noted the service trucks would be back in the
yard by 6:00 p.m.

Mr. Horsch requested the six foot existing fence remain on the west side of the property. He
explained this property line was 90% trees.
Community Development Director Sevald stated he was not aware of any complaints from the
neighbors in the past regarding outside storage. He recommended the Commission discuss this
matter further and make a recommendation within the motion for approval.
Commissioner Monn stated she supported staff’s recommendation requiring the applicant to
install an 8’ fence.
Further discussion ensued regarding the required 8’ fence.
Commissioner Nelson recommended a continuous line of fence be put in place especially
between the two gates. He understood this would be an expense to the business, but noted this
would also provide greater security to the property. He did not support a fence being installed
along the south property line where the stormwater pond was located.
MOTION/SECOND: Commissioner Rundle/Commissioner Nelson. To approve Resolution
1122-20, a Resolution Recommending Approval of a Conditional Use Permit for Open and
Outdoor Storage as an Accessory Use at 2832 Mounds View Boulevard.
A roll call vote was taken.
Ayes – 6 Nays – 0 Motion carried.
B. Public Hearing; Resolution 1123-2020; Recommending submission of the
2040 Comprehensive Plan to the Metropolitan Council
Community Development Director Sevald stated the Mounds View Comprehensive Plan (Plan)
is a 20-year guide for land use and development. The Plan includes chapters on Land Use;
Housing; Parks, Trails, and Community Facilities; Transportation; Water Resources; and
Implementation. The Plan is updated every ten years, and reviewed by the Metropolitan Council
for conformance with regional systems plans (Thrive MSP 2040). The Planning Commission is
requested to conduct a Public Hearing, and provide a recommendation to the City Council to
submit the revised Draft Plan to the Metropolitan Council, and authorize Staff to make any
additional changes necessary to the Plan.
Community Development Director Sevald explained the Draft Plan was submitted to the
Metropolitan Council in December 2019, which responded with an incomplete letter. The Plan
has been revised. Staff intended to re-submit the Plan to the Metropolitan Council after the City
Council’s October 12th meeting. However, Met Council Staff advised that there is a backlog of
plans for review. Thus, Staff chose to submit the revised Plan on September 25th, ahead of the
Planning Commission and City Council meetings. Prior to September 25th, a Public Hearing

notice had been published for the Commission’s October 7th meeting. The intent is for the Plan
to be approved by the Metropolitan Council by the end of this year, in order to continue
qualifying for affordable housing grants in 2021. In 2017, Boulevard Apartments received a
$500,000 Livable Communities grant. A similar grant may be pursued for the former Skyline
Motel site in 2021. Staff recommended the Planning Commission hold a public hearing and
recommend submission of the 2040 Comprehensive Plan.
Chair Stevenson thanked staff for all of their hard work on this document.
Commissioner Monn thanked staff and the City’s consultants for their efforts.
Beth Elliott, Stantec, stated this was a collaborative effort between herself and Community
Development Director Sevald. She explained the City was very lucky to have Community
Development Director Sevald on staff.
Commissioner Monn asked if TCAAP was discussed within the document. Community
Development Director Sevald reported TCAAP was addressed in Chapter 1.
Commissioner Monn questioned when the City would have updated census information.
Community Development Director Sevald reported it would take two years for the City to
receive 2020 census information. Ms. Elliott discussed how census information and population
projections were tied into the Comprehensive Planning process and future planning for the
region. She explained the City would not be allowed to change its numbers at this time.
Commissioner Farmer commented the City had the ability to amend the Comprehensive Plan.
Chair Stevenson opened the public hearing at 7:49 p.m.

MOTION/SECOND: Commissioner Rundle/Commissioner Monn. To approve Resolution
1123-20, a Resolution Recommending Submission of the 2040 Comprehensive Plan to the
Metropolitan Council, and Authorizing Staff to make any changes needed to the Plan.
A roll call vote was taken.
Ayes – 6 Nays – 0 Motion carried.
6. Other Planning Activity
A. Discussion: Residential Driveway Setbacks
Community Development Director Sevald stated between 1993 and 2004, driveways could have
a side yard setback of 1’ if the neighbor agreed (Ordinance 524). In 2004, the City Code was

amended back to 5’ (Ordinance 752). At that time, the Council felt that neighbors could be
coerced to allow a 1’ setback. Based on a quick scan of planning cases since 2004, the
Commission has approved 27 variances for driveway setbacks. This suggests that the ordinance
is inadequate. Staff commented further on the driveway setback standards and recommended the
setback remain at 5’.
Chair Stevenson reported the majority of the cities surrounding Mounds View had a 5’ driveway
setback.
Commissioner Monn stated she supported the setback remaining at 5’.
Commissioner French agreed the standard should remain as is. He appreciated the fact the City
had oversight on this matter.
Commissioner Nelson commented the City has had only two driveway variances requests per
year since 2004. He did not see this as a large number of requests. He supported the City
keeping the 5’ driveway setback in place.
Commissioner Rundle questioned if the Planning Commission has denied any variance requests
since 2004.
Chair Stevenson stated the Planning Commission has denied variance requests and these are then
moved along to the City Council for further consideration.
Council Member Meehlhause appreciated the fact the Planning Commission supported the
driveway setback remaining at 5’.
Commissioner Monn discussed how some residents in the City were conducting work without
properly surveying their lot.

7. Reports
A. Upcoming Planning Cases & Activity
Community Development Director Sevald discussed upcoming planning cases with the
Commission. He noted the Commission would be reviewing a variance request on Wednesday,
November 4th.
B. Staff Updates
Community Development Director Sevald provided the Commission with an update from staff.
He reported staff had a conversation with MWF regarding the Skyline Motel property. He stated

construction continues on Grey Stone Flats and this project would be completed in the spring of
2021. He explained the Mounds View Theater closed when COVID happened and the theater
operator has filed for bankruptcy. He noted AMC has assumed the lease from the former
operator. He indicated Popeye’s purchased the Arepa Bite property and would be renovating the
property. He commented Snap Market has been vacant since 2017. He stated this site would
reopen at the end of this month as the Filipino Village, a small grocery store. He explained a
small four lot single family development off of County Road I and Pleasant View will be
submitted to the City. He anticipated this project would be coming before the Planning
Commission in December or January.
City Administrator Zikmund updated the Commission on the Long Lake Woods development.
He noted this would be the largest infill project in the City since Hidden Hollow.
C. Council Updates
Council Member Meehlhause provided the Planning Commission with an update from the City
Council. He reported the Council recently approved the hiring of a new Police Officer that
previously served in the Mounds View Reserve Unit. He explained the Council approved the
EDA property tax levy in the amount of $100,000. He indicated the Council approved the 2021
general fund budget and preliminary tax levy at 3.3%. He stated the Council also approved a
$400,000 investment in the City’s HVAC units at City Hall, the Community Center and the
Public Works facility. He noted this expense would be covered by CARES Act dollars. He
explained the City Council has been discussing the Community Center and recreation
programming at its recent worksession meetings. He commented the City would be moving in a
new direction away from the YMCA for its programming. Further discussion ensued regarding
the space that was being leased at the Community Center.
D. Planning Commissioner Reports
Chair Stevenson asked if the Commission would be holding a joint meeting with the City
Council. City Administrator Zikmund explained staff had planned a joint meeting with the EDC
and would plan future joint meetings after seeing how this meeting goes.
8. Approval of Minutes
August 19, 2020.
MOTION/SECOND: Commissioner Farmer/Commissioner French. To approve the Minutes of
the August 19, 2020 regular Planning Commission meetings as presented.
